    Hi Steve,

    Your wife has to be naturalized to become a US citizen to petition her mother, NOT a Lawful Permanent Resident[LPR] or green card holder.

    She will be eligible to apply for citizenship in 3 years time as long as she continues to be married and lives with you. I'm sure that won't be a problem. Until that happens, she can come here on a tourist visa. From relative's experiences no amount of letter of support really can convince the consuls. The mother as the applicant should be able to convince the consul that she is not an intending immigrant, but that's going to be hard to prove especially because her daughter's living here or will be living here. Anyway, Time flies before you know it your mom-in-law will be here. :)

  2. Please read instructions before suggesting!

    I read instructions before filling out the forms and I just did what it asked me to do. I have not read anything that says that if I'm adjusting status I don't need to submit an I-864 together with my I-130, there is nothing wrong if I want all areas covered than be sorry.

    How we go about our application packets depend on how we interpret the instructions. I don't think that there is anyone here that has not read the instructions of each form over and over and so I feel that the comment above is unfair and unnecessary. A constructive comment would have been more appropriate..i.e Besangel's post as quoted below..

    Im not so sure what pixie is trying to say here but for clarification, the I-864 is to be submitted with and included under the I-485 for AOS...
  3. Hi, I have my husbands I-130, I-485,I693,I-864m -131 & I-765 done and ready to go with a cover letter listing everything included. It is three pages long. I plan on submitting it all together in one envelope with the cover letter and then having each package clipped together. The I-485 is huge because it includes the I-693&I-864. Our I-864 is very large because I am using my assets and had to prove them.

    I mentioned that she include I-864 because of what she mentioned above.

    My I-130 included an I-864 form & supporting documents as instructed on the I-864 form. We attached another I-864 form & supporting documents with the I485 as it was also needed with this form. Please refer to paragraph below.

    A sponsor completes and signs Form I-864. A sponsor isrequired to be at least 18 years old and domiciled in theUnited States, or its territories or possessions (see Step-by-step Instructions for more information on domicile). Thepetitioning sponsor must sign and complete Form I-864, evenif a joint sponsor also submits an I-864 to meet the incomerequirement. The list below identifies who must becomesponsors by completing and signing a Form I-864.

    Who Completes and Signs Form I-864?

    The U.S. citizen or lawful permanent resident who filed aForm I-130 for a family member, Form I-129F for afiance(e), or Form I-600 or I-600A for an orphan.

  4. All in all we submitted 5 forms 2-I-130[for me & my daughter] & I-485 together with I-765 & I-824. My husband is the USC. My daughter's I-130 was rejected for the simple reason that I tried to squish the address on the address field on Part C which barely fit. Their notice was rather confusing to me because it just said, "The application/petition has not been fully completed. One or more of the following fields were not completed: -Part C Address" I was looking over the form and there were quite a few address fields on Part C, but when I looked closely it was the address on Part C #2 that they were pointing out. In my case I actually sent an additional sheet for this reason but they didn't read it because I didn't write on the field "please see additional sheet". I called USCIS customer service today to no avail, they will just read back what the notice said. :no:

    Ours was rejected for having the signature in the incorrect place as well. Since we also were filing for the work authorization at the same time, that was rejected as well. It had to do with the fact that the main AOS was rejected, therefore all other applications with it are rejected as well. I think if you do those minor adjustments all will be well.

    The above comment is right being that the I-485 is the main form and anything else concurrently filed relies on that. Go over your paper works meticulously, most of the time they think we're clairvoyants to figure out exactly what they want.. :wacko: We're re-submitting my daughter's I-130 tomorrow.

I don't know where you're from but in my case and as I was informed TB tests come out positive in people from third world countries because usually we are vaccinated against certain type of diseases at a very young age. The bcg vaccine which I had when I was a baby was a factor in my positive tb skin test but my x-ray was clear. The doctor informed me that there was nothing to worry.

    If you're test is positive, they will ask you to get an x-ray and when it's clear you dont have to worry. :)

  6. It also depends on the interviewing consul. They can be subjective in the way they answer the questions. Yes, they might show they have a lot of properties, lots of money but that doesnt tell the consul anything, because they may opt to stay here and someone else can take care of their properties, something like that. It's the overall package that the applicants present to them that will convince them and how they manage the interview.

    If they're a married couple, they should have joint bank accounts or income tax filing, if your aunt is employed maybe she can ask her HR department to give her a letter indicating that she's working with the company for so and so years and that she was granted 3 weeks leave, something like that. If your uncle is self employed, submit evidences that his company is in good standing and have been operating in the country for awhile, tax filings,etc...submit family pictures with their kids, if they have. Sometimes little things like that helps especially if they're young kids because it shows relationship to their children. But like I said its subjective, nothing is a guarantee, and however way you vouch that you'd be able to support them, it doesnt hold any bearing because the consul should see that they can support themselves more than you can support them. Also, like JUST BOB said, it depends on which country they're coming from.

I'm sure that you can use the green passport as long as its valid, but when I went to the Philippine embassy, they were encouraging Filipinos with the green passport to change it to the machine readable ones because there were complaints that there were incidents where during TSA inspection international airports, some where subjected to extra security checks because the green passport's information were handwritten.

    I thought USC spouse has to fill it out and that way, the alien spouse would be "an alien relative", isn't that right?

    Because that's what it says in step-by-step guide thing here... and in the same guide it says that I-485 is filled out by USC spouse...

    please, somebody confirm this???

    I-130 is filled by by the USC spouse. Section B is information about the petitioner [uSC spouse] & Section C & D is information about the beneficiary.[Non-USC spouse]This form is signed by the petitioner [uSC spouse]

    I-485 - is filled out and signed by the person adjusting status [non-usc spouse], not the petitioner [uSC spouse].

  9. I am Filipina, and my family in the Philippines is not part of our budget except my daughter.

    The money that you are sending right now is far better than if she was in the Philippines, so why is she complaining. I'm sure that until she met you, they were probably living on a regular daily income, but now they're getting extra, shouldnt she be happy with that.

    I'd rather be called stingy than be in financial ruins. Tell her you'll send her home, that will probably make her think.

  10. from the NY list of the Civil Surgeons I contacted I didn't find anyone cheap..they charged the same rate...spent $225 with tetanus vaccine and the TB skin test +75 for X-ray if needed. They asked if I had chicken pox and I said yes..they asked if it was recent or not..and it wasn't because I had it in grade school...I think they will know which vaccines you got from the blood test..the doctor's assistant told me that if necessary they will give me the vaccines that needed to be given...otherwise, I'll be fine..I had no problem
