Hello all back from Australia
Had a wonderful time with my wife and step kids, took them on a good family vacation around Victoria.
Departing was torture though and we have a bit of a quandary, she will be essentially homeless in December. I was thinking on having her come over then on a tourist visa which is good for 90 days and when she needs to fly back to Australia for the interview and stay with relatives till last packet arrives then move over here permanently. Id like to get some thoughts on this.

My NOA1 date is June 22nd and my case is with VSC. I wouldn't make a blanket statement saying that Vermont is up to July. I think this is an isolated approval. I know many others that have I-130's pending at the VSC that have May and June NOA1's that are still waiting...
Sorry wasnt trying to make a blanket statement...i was under the impression that things were basiacly taken care of on a first come first serve basis unless you get an request for more info or some other hick up.

omg omg..... I was touched yesterday and this morning I got an email from USCIS said they mailed me a notice of approval!!!

Oh, thank you! Yes, we had a blast! His whole family traveled from all corners of Nigeria just to meet his American wife! It was very a very traditional Nigerian wedding and party...when he gets here, we will have a traditional Jewish ceremony with all my people...should be very interesting!
Thanks, Loto...yes, I'm a software developer for a technology company in Long Island....am admittedly a computer geek...lol
I get to join the Geek club also.....Sr Network Engineer here and admitted geek

welcome to all the new people...ive been a bit busy lately and havent been able to post. Im thinking that we should start seeing some NOA2's by end of Oct. Sure hope so...missing my wife lots. But good news is im flying down to Australia to spend 9 days with her. Thank god for web cam though its a life saver...ill never know how people before internet managed to cope with the seperation.
-
LoTo id like to say ill miss you, and dont think you should quit.
I read the other thread and unless im missing something from the removed comments, i read it as a miscommunication. Itnd to me like didnt sound to me like you were telling that person to do something wrong as much as just asking what they were doing in there visa process.
I for one sure hope that the discussions here dont become these fighting matches, i look at VJ as a group of people going through the same thing together and we can all help each other get through this long and tedious process.

Whats the point of marrying US Citizen if we can't get half their assets in event of divorce? I mean we leave our family and homeland behind to be with them, and they ditch us after 2-3 years for newer model. In class we receive about marrying US Citizen, they tell us that we get 1/2 of co-mingled assets.
And everyone wonders why a spouce visa takes so long, gives each side plenty time to think if this is realy what they want to do. No you dont marry a US Citizen to get half their assets, and i know someone whe got burned this way by a mail order bride, one month after becoming able to stay in country with out being married had him throwen out and took everything. If assets are created during the marrage then you are due your fair share of that, but not what someone has worked for before hand. Though I do understand the leaving everything behind, i think and this is what we did, make a prenup and have it all spelled out as what happens in the case of a divorce that way the person moving has security and the person that is the citizen has peace of mind and doesnt have to worry that they are after them for what thay can take.

Here are the Nevada Laws:
Property Distribution: Nevada is a "Community Property" state. Community property is all property that was acquired during the marriage This property will be divided equally (50-50) by the court if the parties are not able to come to an agreement.
In granting a divorce, the court shall dispose of any property held in joint tenancy (community property). If a party has made a contribution of separate property to the acquisition or improvement of property held in joint tenancy, the court may provide for the reimbursement of that party for his or her contribution. The amount of reimbursement must not exceed the amount of the contribution of separate property that can be traced to the acquisition or improvement of property held in joint tenancy, without interest or any adjustment because of an increase in the value of the property held in joint tenancy. The amount of reimbursement must not exceed the value, at the time of the disposition, of the property held in joint tenancy for which the contribution of separate property was made.
In determining whether to provide for the reimbursement, in whole or in part, of a party who has contributed separate property, the court shall consider: (a) The intention of the parties in placing the property in joint tenancy; (b) The length of the marriage; and © Any other factor which the court deems relevant in making a just and equitable disposition of that property. (Nevada Statutes - Chapter 125 - Sections: 150)
Essentially since its paid in full and all moneys came from his savings ( and he can prove it) she is owed nothing unless she can prove that she has somehow contributed to the house in a monetary fashion. I'm no lawyer but having just completed my own divorce with out a lawyer, because they want an ungodly amount of money, it may be cheaper to pay her off insted of using a lawyer you have to weigh which costs less, paying the bribe or paying the lawyer and having the thrill of victory.....

I was just reading the March Filers Topic and it looks like the USCIS is up to the begining of April. So if they keep the pace up looks like we have about 90 days or so.
-
yes the new update to the uscis site now shows only the steps that are relevant to your particular application.
-
congrats LOTO....hope they move fast on your case.

the K3 takes as long as the CR1/IR1 now and the Govt will close the K3 in favor of the CR1/IR1. also after the CR1 is complete you have ssn green card and right to work while with a K3 you then have to do an AOS at an extra cost between 1000 and 1500 if i remember right. so as has been stated many times and I have come to believe the standard IR/CR visa route is best and most economical way to go.

another July filer. NOA1 for wife and step-son recieved on 7/5. Hope all of our cases get approved quickly and with little hassles.
-
since he hasnt applied to bring others into the country you wont have an issue. $54 a year should be more than enough as right now the rock bottom seems to be aroung 20 thousand a year and he is way above that.
Good luck on your visa. I am also from maryland, my wife is from australia.

Ok so anyone that has gotten a I797C, Noa for interview knows that the list of stuff they want you to bring is pretty extensive. But I just have a question about this part......
If your eligibility is based on your marriage, in addition to your spouse coming to the interview with you,
bring:
Birth certificates for all children of this marriage, and custody papers for your children and for your
spouse's children not living with you.
This might be a silly question, and it might be easily understood by someone that doesn't have a thousand things jumbled in their head at the moment, but yeah that's not me hehe.
Now my question is since I was previously divorced, and I have three children from my former marriage, that do live with me, do i need to bring their birth certificates? What about the custody papers? Me and my ex-husband share custody of the kids, does he need to write a letter for me? Or just bring the parenting plan that we devised for our divorce that happened 3 years ago?
thanks for any help, I hope this makes sense to someone, because my brain has ceased to work for the moment.
do i have to be in australia for the interview with my wife, i hadent planned on that......

loto tried your theory for the receipt numbers, mine is 632 ( last 3 ) i went back to 350 and that was approved though the page has to be reopened to check a different number as it seems to remember what you put in and not update completely....but good news is that csc has approved up to 350 at least which is less than 300 from my numbers
