  1. Just a few days for my file to reach GUZ and a couple of days for my wife to receive P3 after that.

    I didn't frontload my petition with a whole bunch of stuff, just essential evidence like boarding passes, itinerary, some emails and chat log, some photos, phone records etc. Nothing excessive.

    It was a speedy transition to GUZ for us. Got P3 very quickly after NOA2.

    How long have you known your wife and how long have you been married? You mention you have a 20 year old daughter (in a different topic). :huh: Is she really your daughter or stepdaughter? I'm guessing stepdaughter, i can't imagine having this much problems proving a relationship if you really had a 20 year old biological daughter with your wife.

    In any case, this is really a horrible experience for you. GUZ can be a real nightmare for some people who have a real relationship but just happen to get a nasty VO.

    There must be some help you can get like others have mentioned, getting a congressman involved and getting a professional experienced attorney that is very familiar with GUZ cases.

    I am so thankful for my wife having had a pleasant VO to work with. I could have just as easily been living this nightmare.

    Hang in there, get people involved quickly, there must be something awfully wrong here for your wife to have been treated so poorly. Don't give up, and don't sit idly by waiting for DOS or USCIS to do anything about it. Get an attorney's advice and help on this, and get your senator's office involved in figuring this mess out!

  3. Your permanent resident status gets extended for a year when you file i-751. Your NOA is proof of this. So, yes you can travel be sure to have with you the green card and the i-751 NOA extending your residency status.

    Not sure exactly what this means, i would call again, but it could well be they are backlogged with applications.

    edit: Just be sure you're not traveling for an extended time (more than 6 months, you may need a travel permit document for this)

    Send a few of your most recent paystubs, maybe the last 3 or 4 paystubs. That's what I did. This and the tax returns and the employment verification letter is enough to show you meet the income requirement. I didn't give any bank information. Not necessary if your income qualifies as you don't need to provide proof of any assets.

  5. Yes, that's correct. They've changed the process so that you go on the date on the letter for fingerprinting, document submission, etc. Then you return the next morning for the interview. :thumbs: Fun.

    As of Monday, December 6, 2010, Immigrant Visa (IV) applicants processing at Guangzhou will be required to go to the Consular Office at 12:30pm on the date specified on the appointment letter for fingerprint and document intake. The applicant(s) will then be required to return the following morning at 7:30am for their interview.

    My finance is coming over soon(in a couple of days excited!!) but this AOS process is confusing me.

    As a K-1 we're going to send in all the stuff required in the guide for K-1 people. However I heard there is an interview process and I can't see what documents you need for that? I want to start doing all the stuff required so the process goes smoothly (but some of the stuff mentioned in some of the threads seem require a SSI? Can I just add him to my credit cards, maybe add him to my cell phone bill? I don't have life or health insurance, so should I get them?) What else should I do in advance of him coming and what should we do after we send in the package to the lock box? I'm just confused in general because I don't know how to prove a bonefide relationship when he probably would only been here a week... I mean there'll be pictures?

    There is no relationship evidence to send with the AOS paperwork, other than the marriage certificate showing you've married. There may or may not be an interview. Many K1's end up not having an interview at all, just get the greencard in the mail and that's that (we're hoping that's how it will go for us!)

    If your fiance does have an AOS interview later, that is the time you bring with you any joint bank account statements, utility bills, any sort of insurance or other benefit, service, account etc that you both share, sure, even a few pictures of you doing things together. Anything that shows you two live together as a married couple. No need to go overboard, just enough to eliminate any possible doubt about your marriage being real.

    You won't be able to do much until he gets here. He can obtain a social security number about 10 days after he arrives. You can use that to open an account at the bank, add him to your credit card if you wanted. Add to utility bills, etc. If you want to get busy early on, start getting the forms filled out. :guides: Don't worry too much about relationship evidence right now.

    Kinda funny how glued we get to these case updates. Before the technology was able to check the case online, we would just be sitting pretty waiting for something in the mail. Instead we get paranoid about these "touches" which probably don't mean anything other than our files being moved around or something. Granted, could be someone's getting an RFE but i've been "touched" a few times already and nothing in the mail yet. Just sitting pretty now waiting for the biometrics appt, and if something happens to come in the mail then i'll jump on that then.

  8. they asked for it in the instructions that came with packet 4 it is not on the form itself just like they want certain areas filled out in chinese and english, seems everytime we jump through their hoop they add one or teo more. i guess the only ones getting in here illegally are the mexicans sneaking across our borders and being given their green cards and citzenship and everyone else has to fill out every form known to mankind and 2 or 3 more that are kept secret till the interview then you are supposed to pull it out of your #### at that time. how well our governemt works :rofl::rofl::rofl::rofl::rofl:

  9. While I was expecting my texts & emails this week, but what do I get instead??? My AOS package sent back stating "rejected" Like I have not been through enough already with the over the top slowness of Montreal. Now I'm being rejected????

    So, they don't specify exactly what was wrong, but only a form is outdated. We downloaded all the forms from their own site, filled them that day & mailed them the next. After a phone call to find out exactly what it was, it was apparently the I-485. They stated on the phone that they only go by the revised date on the bottom right hand corner of the forms. They wrote my rejection letter on Nov. 19th saying it was outdated. It didn't become outdated until Nov. 23rd! That is the date now in the corner. UGH!!!!!

    How are we supposed to know that???? They had it in their hands on Nov. 17th????????? I feel like they did that on purpose so they could get their new fee. Now we have to send in the new fee as the last one was still under the old fee.

    ...they should have accepted the form. This doesn't make any sense. My form was 7/15/10 edition, all was fine. I wouldn't be satisfied with that answer. I would call again and get some clarification. :protest:

    It seems very unfair. You're positive that was the issue? Well in all honesty, sometimes it's less headache and stress to just play their game.

  10. Long time since packet #3 was received. She's been working and hasn't been able to get away until after moon festival. Went back to get the houku, then started to return after documents were completed. Midway back found out her mother was in the hospital for some sugrey and has returned to be with her. Sent the Packet #3 response back on 11/18/10.

    Maybe I'm geting ahead of myself, but I'd like her POE to be Chicago. Looks like a lot of flights have changes in Seattle, San Fransico and Los Angeles. Where would the POE be, Chicago, ult6imate destination or first location in the US where all other flights would be domestic?

    The POE will be the first city she lands in, her packet will be opened and processed at that time. Be sure to allow plenty of time between this and the next connecting flight. Depending on the airport and the number of international flights arriving at around the same time you may want to give her at least 3 hours to allow for processing and transferring to the domestic flight terminal, etc.

    Show the interview letter to the bank clerk and they'll take it from there. They're familiar with the visa fee process

    It seems to be a way to make sure the "spelling is correct" when translating from the Chinese characters.

    There are some very knowledgeable VJ members that have gone through Guangzhou that can confirm.

    This is the website we used to get my wife's telegraph code. Very ridiculous but we did need it on our version of the form. You would feed in the chinese characters for your fiancee and obtain the telegraph code, put that on the form.

    I have noticed however that they seem to have done away with this question on updated forms.

  13. Ok thanks ldg does that mean u get the ss and work permit quicker am hoping

    Some members who did a walk-in early have reported getting their EAD quicker, while i've seen others have waited the normal timeframe. So whether it speeds things up or not, i still don't have a concrete answer. We'll just wait our turn. But i'd like to see what comes out of those that go early and are successful and if they get their EAD quicker.

    Sometimes if you walk-in at an earlier date to the local USCIS office where your biometrics appointment is scheduled, you can get away with getting it done sooner. That is if you walk in on a non-busy day and they are nice enough to let you in. Some have reported success doing this, others have been turned away even though the office inside was mostly empty.

  15. I received a Rejection Notice today cos they returned our check for EAD $340. :wacko:

    "Recently, you submitted an application for immigration benefits. That form was submitted with an extra remittance that is not required to process your application, or the incorrect fee was submitted. Your check is being returned to you with this notice. No additional action by you is required at this time. Please comply with any other reject notice you may receive."

    So I wait for some more Rejection notice or NOA1? but does it mean that my EAD is also rejected? :blink::bonk:

    Was the other check for $1010? If so, you're good and the check should be getting cashed today or pretty soon. Did you mail both applications together? your EAD would still be processed along with the AOS. You may want to use the EAD receipt # from the e-notification and check the case status.

    We received the biometrics appointment letter on Friday for a December 13, 2010 Milwaukee, WI appointment. From what I have seen on here, it sounds like walk-ins at Milwaukee haven't been successful in the last few years. So, I think we will be waiting for his appointment - it's only 3 weeks away :)

    I didn't know it was possible to do walk-ins, interesting. We'll wait too though, no big deal.

  17. My another 2 questions are:

    1. If my fiance owe about USD7,000 tax though the past 3 yrs tax return reached 125% of the federal poverty line, will that still be a problem in ecoomically?

    2. Some people said if my fiance keeps on staying in China with me that will be an disadvantage for receiving my P2. They asked me to persuade him go back to US after the application. Is that true? But both of us don't want to leave each other. We hope get the visa then go to US together. The purpose of K1 is to let those separated lovers meet each other but now we already together so will that be a problem?

    They don't take into account his debts, just ensure you meet the income requirements and use any assets as well if needed to get above that poverty guideline. Maybe someone else can shed any other light regarding having a tax debt.

    Regarding staying in China during the petition, shouldn't be an issue. This question does come up on the affidavit of support I-864 regarding his country of domicile. This is during the AOS process once you're in the US with visa.

    For details on that look up form i864 and read Part 4 Number 15 in the instructions.

    Technically he should be residing in the US with you once you file for AOS. If he's not then he needs to explain it per those instructions.

    You can mail it from China or have his sister mail it, I don't think it matters. Whatever is best. I would mail it directly from China to save money.

    You do not file 129f petition with regional offices anymore, there is one location to file at, use the above address for EMS delivery.

    As far as living in Seattle, just make sure you notify USCIS of the new address every time you move.

    Your fiance will need to provide an address on the 129f where you intend to live. Later you will complete DS156 application for visa and again put the address you intend to live. Once you have visa and in the US, you will file an application for green card in which you will again provide your address and will file this application with the Chicago office.

    Best advise - be sure to follow all instructins carefully and the guides here on VJ, great tool.

    2.

    Include several photos of you together at different times and places. Include anything that can link the two of you together and provide proof of a relationship. Some emails and chat logs from when you two met online, phone call logs etc. His plane boarding pass and itinerary to prove when he came to see you. No need to go overboard, just include enough evidence to show you two really have something going on and are serious about committing to marriage.

    USCIS in the US just needs proof that you two have met at least once to approve the petition, but i would send more than just that. This is called "front loading" the petition with evidence. So that once it goes to Guangzhou they will have strong evidence already, when your interview date comes you will want to bring more evidence of the ongoing relationship. The real challenge is proving your relationship to the Guangzhou consulate.

    As my luck would have it, fee increases have followed me throughout our immigration process, so have fee decreases eluded me. I filed the 129f in March for $455, now it's less. My fiancee had to pay $350 for her visa because the fees went up over $200 just 2 weeks before (was $130 before June 4) she received her interview date.

    Now we filed AOS, thankfully we were able to get everything together and out this time before the AOS fee increase took effect in a few days. We'll have to pay more for Removal of conditional residence too but that's at least 2 years out. I'm crossing my fingers they won't decide to increase fee for naturalization just before we're ready to file for that. But i won't hold my breath :lol:
