A 24 week old is being allowed to leave the hospital. Umm, no, not remotely possible. Either someone has their facts wrong or someone just plain lied to you. Premies are now allowed to leave the hospital anywhere before 35 weeks, anywhere.

I'm just going to lay this down here and then back away....He got busted cheating, and now says he's sorry, he won't talk to her, whatever. He is about to give you a car so you can work(be away from the house more) and you are going on a week+ long trip soon and he is not going.
What makes you believe he is telling you the truth and not just being a little better about sneaking around? He knows you have been in his Facebook, and you said yourself he deletes his text messages.
I really, TRULY hope he is sincere, and that you guys can work things out and be happy. I'm curious though what he has done to prove he has no intention of contacting her again? Has he removed her from his FB friends? Blocked her on WoW?

No, because hopefully by then your husband will wise up and file back taxes like he should have already done since you became aware this was an issue. I truly don't understand what the problem is here, if he truly made no income, he just files for those years with no income. I wouldn't think anyone would be thick enough to let their family be torn apart because they didn't want to fill out a few forms.

At least he asks questions. My husband has been a lazy one about it all, was quite happy to sit back and let me figure it all out. "I trust you to handle it" he says.

If the OP were asking for your opinion on their life choices I could see why you feel the need to interject, but they didn't, they only asked how this would affect the AOS, and the fact is it shouldn't too much since they both seem to have been in school when they met. Lots of married couples are apart for periods of time due to jobs(especially in this economy) and this is really no different. Your opinion on whether or not they *should* get married is useless in this situation.

Honestly, I WOULD be worried, both with the IRS and with the interview. Legally he cannot file joint taxes with her if they were not married as of Dec 31st. If anything he should have done it married filing jointly with YOU. She was not his spouse at the end of the tax year, he is committing fraud by filing taxes with her when he has another spouse. It will probably not come up with him ordering his tax transcript, but most likely it WILL come up at the interview.
Personally I think you have a little more to worry about than the immigration interview. Your spouse is by the sound of it knowingly committing fraud, and with his ex wife no less. I'd be more concerned for my marriage than anything else.
*Editing to add, further research is saying he only could file with him as head of household and her as a dependent IF they were still married, AND she had no income, in which case there would be no W-2's for him to get from her.

There are a lot of reasons someone would push to adjust their status, it doesn't mean there is fraud involved. Being out of status means always having the risk of being picked up by ICE, not being able to drive, not being able to work legally. My husband has been out of status for nearly 2 years, and it's been a nightmare of stress. I honestly cannot believe you refused to get him legalized because you were 'suspicious' but still stayed with him. What kind of life is that for him? He's a husband, not a house pet. I'm sorry you got cheated on, but living that way with someone who clearly does not trust him, I'm not surprised he did it. No one should have to live like that.

We went and got the passport pics done last night, and will be sitting down tonight to work on it all. Took the day off work tomorrow to finish the package, get it mailed, and then go to dinner to celebrate! Him being out of status for so long has been VERY stressful, so we are really excited to get this moving finally
