    I've become the "ask" person for Immigration since I'm going through the process now for my fiance. I was asked this question and I want to make sure the answer I gave was correct.

    The wife (now) had been coming to the US from London back and forth for about a year or so. On her last visit they decided to just go to the Justice of the Peace and get married. They've been married now since April last year and they haven't filed AOS yet for financial reasons. The husband is saying that he thinks they need a lawyer to file now because it's been so long.

    Would they need a lawyer or could they just file AOS and EAD without penalty?

  2. She will not be able to fly back with him unless she intends to remain indefinitely and wait out the AP with him.

    When my husband (then fiance) had his K1 interview, he was put on AP that lasted 8 months (there is a 13 year age diff between us - I'm older). One just doesn't know how long the AP will be.

    Ahh I see I thought AP is over at the time of the 2nd interview. Got it now!

  3. Definitely an inconvenience!! I figured it had something to do with the scams. UGGH but what happens when it's someone visiting there? Oh and the bank was CBN (Central Bank of Nigeria). I called Western Union and requested that a full refund (including the processing charge) be sent to my future brother in law of the original money he sent to FH because no where on their site does it state this. I can't imagine what would have happened if the other brother wasn't there :(. But at least we are aware of this now.

    Cinnamon, I'm wondering if that is a way they are trying to reduce the number of scams. But I also wonder if that is in violation of the Western Union terms. What would happen if someone is merely visiting and needs money wired? Or is that something only for Nigerians? That can't be right to do.

  5. FH has made the looooooongggg trip to Lagos from The Gambia by land. So happy he arrived safely despite the bumps he encountered along the way. I tell you it was quite the adventure. Anyway when he arrived to Lagos he needed money Western Unioned to him to continue his trip to his hometown. Well when he went to pick up the money his brother sent to him, he was told that since he doesn't have a bank account he can't get the money. I have never heard of that. Is that something new being done? Thank God he has a brother who lives in Lagos (who he was staying with) and his other brother was able to send another transfer to that brother. I couldn't believe it!

  6. One of the biggest problems I'm having with this wait is the longer it is, the less I'm able to communicate with my honey because of the expense. It's somewhat of a catch 22 because come interview time they will see that your communication has waned and dwindled down to almost nothing and could possibly think that's indicative of the way your relationship has gone. I have said now it's even MORE important for me to be at the interview with him because of this which is even more money. I know USCIS isn't requiring that I do these things/make these changes but I'm not willing to gamble on what could happen if they aren't done. I'm trying not to be down regarding this but I am not happy that I have seen my fiancé in person since May. I have not felt the comfort of his arms since May. I feel like a big piece of me is missing and it's horrible to have that piece identified but you can't grab hold of it. This is something I really wouldn't wish on my worst enemy. But at the end of the day I know God has a plan for us so I will continue to hold on knowing that He is in control. *SIGH*

    I was JUST thinking about you so thanks for posting this! It's funny that you mention snow. My honey can't wait to get here and see snow in real life. He might miss this season but there's always next year. :)

  8. I would wait until visa is in hand. You could stall the process a little more (to avoid the extreme temperature months) by letting there be a little bit of a lag before returning your paperwork and again when scheduling your interview. Also just a thought as I don't know how things work there but here if you had to give 3 months notice that means ATLEAST 3 months prior rather than having to be out in 3 months. For instance I have to give my landlord 30 days notice but I could actually tell her TODAY that I'm moving out April 30 and not incur a penalty or have to move out next month.

  9. NO you aren't crazy. I'm not the religious type, but I was praying with Marcel this morning. We had a call into every pastor he knew in Nigeria to pray for us......

    "where two or three are gathered..." I'm so happy it worked out for you. Now back to praying we get our NOA2 soon and that FH has a quick and uneventful trip back to Naija JUST for a new passport. I am still sore that he has to make the trip JUST for that. But I'll stop complaining. :lol:
