I agree with soapface. You committed a good faith error that happens, I am sure all the time. The only way to avoid this errors, is to double and triple check the package before mailing, and if you can have somebody else that knows about the process, to go over it for you.

I agree with NikLR insofar as his answers. I would definitely include a cover letter. You can see examples of different cover letters as noted by NikLR. Make sure you look under the instructions on how to assemble your petition and they detail all kind of suggestions on how to assemble the package including what clips to use, cover letter, what to include in personal check or money order, etc.

I would send a new I-751, and just include the notice from USCIS. Insofar as the money order, you can still send the same one. The old "good faith marriage affidavits" are also valid. I am sure that you will not be penalized since it was a good faith error that happens all the time.

I also feel that this space should be only dedicated to questions around filing date and not to discuss how to apply for removal of conditions when there is another site for this.

This is for Yourika and Jim,
I believe I mailed the application on March 29th, 2014 and it was received in Vermont on March the 3rd. (stated on return receipt). Shortly thereafter, I received the NOA1 one year extension dated the 3rd. also and received around the 7th. I hope it is clear now. I am waiting for the Biometrics appointment which I expect soon according to the timelines of the other fellows filing around my date.

You dont need passport photos. As soon as they approve your package they will schedule her for a biometrics appointment like they did before when she appplied for AOS. The important thing is mailing the package before the expiration date of her GC

Make sure you mail the I-751 before the expiration date. If you cannot collect all the evidence just send what you can and if they need something more they will contact you with an RFE

We filed our joint petition I-751 on 2-09-14 which arrived in the Vermont Ctr on the 3rd of March. I received the I 797 (NOA-1) on 3-07-14 dated the 3rd.

I believe the visa is valid for six months.

The only problem is that my stepdaughter is not studying at this point although she plans in the future. I guess I will include her Federal Tax return for this year with her W-2 forms, copy of her green card and application and fee and resubmit the evidence I submitted for her mother. Thanks

In the past I had seen in this forum a link to a site where you could actually take passport photos yourself a lot cheaper than at the drugstore. If anybody recalls please let me know.

My wife is planning to visit her family in the Philippines this summer. We will be filing for removal of conditions shortly since her conditional GC expires in April. Since by the time she travels her GC will have expired will she need to have her passport stamped or just take her old GC and the 797 suffice.

The term biometrics refers to the photo and fingerprints they take at the actual field office. It is a much more
sophisticated photo that they actually take with precise measurements of your face that make it a lot more difficult
to for the GC to be falsified.

As long as your son acquired his conditional residency within 90 days of yours, which appears to be your case, you can include your son in your I-751 and pay only one fee.

My stepdaughter who is a K-2 Visa recepient will be applying for Removal Of Conditions very soon. She arrived 4 months after my wife therefore she will be applying on her own and not in conjunction with my wife. I would like to know what kind of evidence I have to submit for her. I understand the the comingling of funds evidence that I had to submit for my wife would not be pertinent for her application and I just don't know what other evidence other than the application and copy of her GC and drivers license and income tax return and fee should I include. Please help.

Insofar as the traffic violations, I would not worry since it is not a criminal charge. Everything shows up in a background check but again your mutual restraining orders are again not a criminal case but a family court matter. The fact that they were dropped in two weeks helps also but be prepared to answer all questions. Finally,the background check is for the applicant and not the USC.

I do not quite follow? If you are asking about ROC, you do not have to prove income requirements. You should have already satisfy that requirement when you file for AOS.

That is pretty much it. You are the one who has to satisfy criteria for removing conditions. As long as you include her in the your I-751 section 5 and include a copy of her GC, front and back that is pretty much it. It will help if she also can prove that she has resided with you since she arrived in the USA, such as bank accounts or school transcripts.

Any child of the primary beneficiary who was under 21 years of age at the time of entry to the United States.
Maybe time to ask my Senator or Congressman for help?
