Coming to US on a tourist visa with Immigration intent is fraud.

    just getting ready for the paperworks...they had came here previously(two years ago) on visitor visa...at that time they got ten years visitor visa...now since I am citizen I put in PR/I130 with my mom's name....currently just submitted PCC for here...so it's at last stage...therefore, I want to be prepared when my father comes here...since I only placed I130 for mom...

  3. she has visitor visa but she will have permanent visa from me...I am her daughter inviting her...mother/daughter...I just didn't put my fathers file at same time...b/c someone told me that he is considered as dependent...but I am notified by NVC that this visa is only for my mother/relative (it's not derivative...)...so, my plan is once they are here I will apply my father's adjustment of status visa...I would think they will let my mother enter on permanent visa...thx

  4. i dont know what #3-17 is, but when you fill the i864, you use the household income of your wife, which is your wifes income and your income combined (assuming u filed joint tax returns) as the basis for income so as long as your income exceeds the minimum for all people in your household + mother in law, you are fine.

    the i864 still needs to be her affidavit and not yours because she is sponsoring them. you just count your income in her household income.

    Thanks aayitrum, so for the following question as far as Employment goes, what should I put? "unemployed"?

    I am still little confuse because since the application is for her and it's asking your current employer and all that I don't know what to put there....Also, same thing with "My current individual income is:".....should I put there mine or what...? Thanks

  5. Hey all VJMembers, we are in the process of collecting/filling out Financial Documents for my Mother in Law's immigration visa.

    I understand that one of the thing I have to submit is Affidavit of Support (AOS) form I864. However, since my wife does not work I will be supporting my in-laws. So, that means I will need to fill out I864A for myself.

    I have couple of questions regarding this:

    I am filling out I864 for my wife. In that, Part-6. Sponsor's Employment and Income section - my wife is house wife (and taking care of two child, actually lot more work than what I do:-)), so should I check as "Unemployed" in this section?

    Also, do I need to fill out #3-17? My wife and I have filed joint tax return each year. I understand that #18a is yes for me because I have filed a federal income tax return for last three years. And I can provide all the information (and transcripts) but just not sure what to enter and what not to. Since I will be filling out separate I864A with my information. Since, I am the only one who works in our household. Any help would be greatly appreciated it.

  6. I 485 is for someone in the country, they are not, you said they are in India, think of it this way what do you think will happen when they seek entry on their tourist visas and are asked the purpose of their visit and they say immigrating?

    Thank you. (1st) I was not aware of it that when you enter in country (with tourist visa stamped) you still get asked what you are entering for. It's tourist visa so, you are touring/visiting. (2nd) what's the purpose of i485, unless one has pre-planned all the event. Anyhow thanks.

    The quickest solution for her brother is the one you know about, if he marries then he would have to wait until his Parents become Citizens before they could file, as LPR's they can file for him as long as he stays unmarried.

    Yes, understood both options. I am interested in What is the timelite for US LPR parents to bring his/her adult child to US.

    Should mention that your wife can also file for him now as a sibling, good insurance.

    Yes, I belive time line on that I believe is around 8 years.

  7. You do not file anything, it is up to her. Tourist visas are for visiting, she files an i130, expect it to take a year.

    Say 8 years for brother, faster well find him an american wife?

    I know that I don't file anything. I am speaking in behalf of her, so I is she here.

    I think you missed the point regarding tourist visa, it was in refernce to filing i130 in conjuction with i485. I mentioned the toursit visa because it allows you to be here in country and for i485 you have to be here.

    Indeed, that is my rough estimate as well for brother. No thank you, I wasn't asking for any any quick rich (fast in this case) solutions. I was just asking for what option had the least amount of time (process duration).

  8. Hi All, I just want to start out by saying thank you to all the VJ members. I have gotten much needed help when I needed from here.

    So, my wife recently became (last Monday)US citizen. :dancing: My next step is to get my in-laws and her younger brother (older than 21) a Legal Permanent Resident (LPR). My in-laws have visitor visa for ten years. They have visited us once in past couple of years.

    I understand that I have to file Form i130 for this process. However, before I file 130, I want to understand if i485 (status of adjustment...) process made any difference. Again, I understand that the person have to be here in States for this, but since they have visitor visa they can be here, if this was going to benefit us to bring their son (wife's bro) here in shorter time. Since, her brother is older than 21 I believe it will take 6-10 years before he can come to US.

    Do we have to wait till they (wife's parent) become US citizen to invite their son here or I should say is it better to wait till they become US citizen to bring there son here or file now (once they have green card)....?

    So, does filing i485 help anything at all in our case?

    What is the best possible option to bring him here in shortest amount of time? :-)

  9. I had a similar situation. I took an additional piece of paper with additional trips I took out of the country after filing. I used the same format that was used in the application and included departure and arrival dates. Though I never gave it to them. Just disclosed my travel out of the USA. It was only for a few days and they didn't seem all that concerned about it.

    Thanks, dioxide45. When you said "disclosed", do you mean you verbally mentioned to your inteveing agent? I understand you also kept copy of printed dates in same format as form. Again thanks for sharing your exp!

  10. Yes you can apply for a tourist visa. However, you must show strong ties to India (reasons for you to return).

    No one can give you the percentage of your chances.

    Thanks, Yes, I am aware of it that for visitor visa, you do have to show well supporting documents that you will return to your home country and have no intention of staying in States. Thanks again for the respond.

  11. I have went out of country after I filed my N400(Citizenship by naturalization form). I already had my biometrics/fingerprinting done before I left. Now I have intervieweing appointment next month. Is there anything I need to do for the three weeks that I went out of country on personal trip? I read somewerhe that as long as it's not more than six months than I am ok. Any help would be greatly appreciated it.

  12. Sorry, I thought you applied for immigrant visa. But it's non immigrant. Is the problem resolved?

    Yes, Thanks. I didn't realize this but it's based on the whick language you pick for the interview. So, once you change the language (or don't change) the locations appear according to the choice of language you selected for your "non immigrant" visa. Thanks again for your help.

    so, for the first interview choice:

    As you can see Mumbai and that's it, there is no other choice.

    I went ahead and selected the data anyways, so for second appointment for OFC I get full list as seen below:

    This totally does not make sense or I am missing something here. My DS-160 application that I started has Chennai, so why it's giving me only Mumbai in the Consular Appointment.

  14. Thank you, RhettVoe. Understood. Ok, so I will tell him to get a letter from his employer stating his job title, current salary and so on. I will also ask him to get letter from his employer showing that his leave of absence for three months has been approved and so on. Do you think this is sufficient enough? Can you think of anything else (other than finacial statements, bank statements, properties, etc.) that he should bring with him during the interview. He is in his late twenties so, I am not confident that CO may not grant him visitor visa. However, he has no interntion of residing in US, he comes from wealthy family and has well paid job. Any help would be greatly appreciated it.
