  1. I need to know if I may file single even though I am married.

    Here are the factors:

    (1) My husband is a non-resident alien; we are awaiting approval of his IV (immigrant visa), while he is living abroad. He has not earned a wage in this country and holds a valid tourist visa to date.

    (2) I am a USC

    (3) I have no other dependents which I might claim for HOH

    (4) In order to file joint we must have a ITIN, which will take a min. of 8-10 weeks to obtain, after the 1-2 weeks we must wait for appropriate documentation to arrive in the mail, plus the time we must wait for IRS to process our federal with the ITIN. This is problematic because: (a) I must submit tax information for funding purposes to my university; and (b) because we must submit additional immigration information ASAP that requires our tax info.

    Related question:

    What is the average processing, wait time, for IRS transcripts? I will request for completed year 2007, and be requesting for year 2008 which I will be submitting to amend this week. How long after I submit amendment for 2008 should I wait before requesting 2008 IRS transcript? Should I request both 2007 and 2008 at the same time?

    I requested my tax transcripts for 2006, 2007 and 2008 on feb. 27 midnight (suprised because they were working sat night so late!) and I got it last week on mar. 4. It don't take that long. You should request the last 3 years, its free.

    I married in dec 2009, and I'm going to file joint marriage because of the tax refund benefit. My husband is mailing me his passport. I am not in any rush to complete my paperwork. I think for the AOS, I can just give them the tax transcripts. They will have my check stubs for the last 6 months of work (dec 2009-may 2010) to prove my 2009 income.

    If I were in your position and needed the tax documents immediately, I would file online as single. But in your case, maybe its safe to file separate and send in any 'current' tax transcripts.

  2. I'm Native American but have been called anything from Asian to Egyptian to Philippine. My husband is Egyptian, but has also been called anything from Italian to Spanish to Greek. I don't think in this day and age we can stereotype people based on their looks. People are curious and will always be curious (including myself). You just have to be patient and understanding as to why they might be looking or "staring" at you.

    When I was in Paris and in Egypt, I had my shares of stares and I probably stared at a couple of people too. It can be a complementary stare, a weird stare, a shocking stare, stare out of admiration..etc. The only thing you can control is your perception of why it is they are staring at you. Keep a positive attitude and focus on your spouse.

    I think that interracial marriages are awesome because we went through the hurdles of paperwork, wait time, fees and electronic communication to test our love.

  3. We haven't filed my husband's Income Tax (2009) so basically what we have now is his 2006-2008 tax transcripts. The reason why we haven't filed his 2009 is because we are STILL waiting on my ITIN from IRS which I filed almost a month ago. My K3 visa will expire this Aug. 2010 so right now we are kinda hurry in filing my AOS. My question is, can we file AOS even though we haven't file his 2009 Income Tax?

    I'm also going to file a joint marriage for 2009. I thought if you are filing a W-7 (to get an ITIN) for your alien spouse, your suppose to mail in all the papers together.

    How did you apply for the ITIN alone?

  4. I will be departing for Egypt on May 25. I was wondering from anyone one's experience, how I will be able to manage the paperwork from Egypt? I will have my Affidavit of Support packet ready to go, should I just take everything with me and mail it from Egypt? Should I have my husband not designate me on the DS3032 as the Agent of Choice? (or would they send both of us copies? would I need to be choice of agent to be able to pay his fees?)

    My mother would be here in the states and she would be able to open any mail I have coming home. Is there any papers that I would have to use specifically from the NVC? I've printed forms off the internet and filled them out, is that suffice?

  5. hey guys, it seems all of us are just waiting. how about we start chipping in what we've prepared so far in this "waiting game" (if the OP doesn't mind)

    for me, i've prepared the following:

    1. DS forms-made drafts. not finalizing anything yet, but will soon enough

    2. requested tax transcripts from the IRS (automated voice service is great!)

    3. got a copy of my employment agreement from my employer, notarized and included job position held, date of hire, salary per hour and annum, contact details on a formal piece of paper (don't know the exact name, but the paper has a different texture and slightly bigger then the usual 8 1/2 x 5) with the company letterhead

    4. started compiling pictures with captions (i'm up to 30 pictures, but still searching for more for 2008 because all of the files-soft and hard copies were destroyed in a flood)

    5. started filling out I-864 for my husband and I-864W for our daughter

    6. had my husband do his part in getting his NBI clearance, passports for him and our daughter, obtaining 5 copies each of their birth certs and our marriage contract (i know it's a little over the top, but it beats having to go back and forth for copies) and getting medical certs (he was diagnosed with a tumor and had treatment, but it's still there; and our daughter had primary complex way back and had treatment for that---i know any form of tuberculosis may raise a red flag)

    7. and of course started saving like crazy for plane tickets, IV fees, AOS fees, medical fees and those irritating little expenses that are non-avoidable

    i know all of us are excited and waiting eagerly for that NOA2 approval. hope we all zoom through NVC!!!

    I have a couple of questions for you, since you know what your doing...I'm still trying to plan for what I have to do.

    1. Isn't the medical checkup suppose to happen when they come to the US? Or do they see a civil surgeon abroad?

    2. Also wondering if you or anyone knows anything about the W-7 form from the IRS, since it it tax season. I think most of us got married in 2009...who else is considering claiming a joint return with your spouse??

    3. After we get the NOA2 approval, are we suppose to be applying for the Form I-485, Application to Register Permanent Residence or to Adjust Status, at the same time?

    Last question...if your spouse abroad puts you down as the "agent" do you get all the mail (specifically the IV package)? In addition, do our spouse abroad have to mail us the IV papers that need their signature??
