  1. Hi everyone

    I was married in the Philippines on Dec. 11th 2009, and lived there with my wife and her 3 young children. Now I want to patition them to the USA. I see a few options of visa types. I am hopeing to find someone that has already been down this road for advice and guidence. The 3 kids have bith records as illagetimate so not fathers to deal with. My wife has never been married tilll now to me. I only receive disability income from the TSA and so I will also need a co-sponsor. I want to use the IR1 and IR2 for my wife and kids is this the best? i would like her to be able to work as soon as she arrives.

    So the first step would be to find co-sponsor right? after that fill out the forms (not sure of what is needed) for both me and the co-sponsor. I know i need to fill out the I-130 and maybe the I-129f? then submit all to the uscis office for my state along with all fees, right? like I said I really need to chat with someone that has been there before.

    The type of Visa would be considered a CR-1 because you have been married less then 2 years. If you don't meet the income guidelines then yes you would need to find a co-sponsor. The way I did this was combine my income with a family members income. That form would be the i-864a but that type of co-sponsor would need to reside in the same house as you.   2. Hello everyone!!! I'm feeling bored here in California.. "All work and no text makes me a dull person" in the Philippines I have so many textmates and I miss them so much. But I can't text all of them everyday cause a single text to the Philippines is very expensive. Plus the fact that their reply will also be deducted from my load. Please help me...What’s the cheapest/best way to send a text message to the Philippines?

  3. I'm still waiting for my NOA2 since July 30th of my NOA1, but my Fiance needs to move because her sister leaving on Nov 30th 2010. If she can not find a trustworthy roomate to replace her she would have to find a smaller place for herself. So, my question is if she does move to a smaller place, will this effect the processing of the Visa when I update her address?

    not at all, as long as the embassy, uscis, and nvc have the right address. just call them and make them aware of the change.

  4. It's the same number but it's 1-888 so on my cell bill, that's the number you'd see. It's not a card card that I could save, I just always reload it when I need to call. Our main communication 24/7 is yahoo messenger though. So should I still submit all my income stuff along with my parents or just theirs? Ugh this stuff is so straight forward and simple, but I still get confused. Haha. Thanks for replying!

    You know what I use for calling there. I use Pennytalk. its reloadable, and a good price per minute. Ontop of all that it logs the numbers you call.. :) Skype works well as well. I would use a co sponsor in case its brought up. As long as your income now is sufficient you should be ok.

  5. hi everyone...ok im just anxious if anyone here got nvc's notification for october interview? i was reviewing fellow filipinos updates and it seems like the last one who got nvc's email was last august 31st...does anyone else here got it after that date or someone who got it this second week of september? i was told the cut off date is until friday of this week....is that true? thank you so much...

    You know, we are near the point of an interview date. I have to clear up an EASY RFE before our case goes to Manila. I had asked them how soon do interviews go out after they receive the case at the Embassy. The polite lady told me that at the end the month the Embassy tells NVC how many interviews they can schedule. This may not tie into your question but a little helpfulness :) I hope you get one soon!   6. Can Anyone tell me the average processing time for a visa review? My petition for a fiance visa was sent back here to the USCIS in the United States for review. My fiance had her 3rd interview at the U.S Embassy in Hong Kong just an hour ago and they (3 women 1 man)all but acussed her of wanting to come here for the sole purpose of a better job and life. Our petition is to expire on March 5, 2011. Any help would be greatly appreciated. Thanks

    So, you say it was sent back to the USCIS for a review? I would think it would go back to the NVC, wouldnt it? My application is waiting upon an initial review and its a 6-8week review process. It may be the same for a K-1 but im not a 100% sure because I filed for a K-3. I would say keep pushing at it. Maybe there is not enough evidence to show a "real" relationship. I wish you guys luck!!

    Well.....what a mess (but hopefully not!)

    My wife flies into Manila tomorrow (arrives at 2:10PM)

    Will be at the CFO Office by 3pm (they close at 5pm)

    Flight bound for Germany leaves at 8pm

    The big question...

    Will 2 hours (3-5pm) be sufficient time to get the CFO Guidance and Counseling Certificate and sticker (if they give her the sticker.....because she is traveling on SOFA card, not a Visa).

    She already has attended the seminar. She just needs to register and get the next certificate and also the sticker....

    Please tell me we'll be ok??????

    Well, its cutting it pretty short on getting there, and getting back to the plane in time for the flight. I am not saying its impossible but me and my wife would be there all day due to heavy lines of people waiting for the same thing or other business.. I do wish you luck on that :/

    all i have right now are the:

    1.) birth certificate of my daughter

    2.) my pre-natal book when i was pregnant

    3.) an ultra-sound during my 6th month

    4.) quantitative technique during my operation cause i was cs.

    5.) pictures after my operations (after i gave birth)

    6.) marriage certificate

    7.) picture of my daughter in day 1 til now

    8.) notarized copy of my husbands passport

    9.) notarized copy of his certificate of naturalization

    10.)plane ticket during his visits

    11.)his employment records

    are these documents ok.. or do i need some more documents? hope you can give me some more ideas ... thanks so much....

    Looking over what you have, it looks like everything that is needed plus more. According to the DS-2029 instructions page, you would need the following:

    Passport, employment records to show residency, plane tickets to show he was there when your child was conceived, NSO copy of birth certificate, marriage certificate, his certificate of naturalization.

    Couple questions... has your husband been married before? if so he will have to show proof the marriage was terminated. and also, has he resided in the US 5 years prior to the child's birth?

    Me and my wife have been married almost a year.. She resides currently in Philippines. We have a son together. I am the Biological father. We are working on her Visa and almost completed with it. Question is : Am I going to have to file a separate i-130 for him? Considering he will be a USC after we file the required forms with the Embassy. He is eligible for USC due to my status as a USC.

    I sent over my AOS and DS230 over around the same time you did, and when I called them the "nice" NVC Customer service rep told me it could take 6-8 weeks to review the papers, and hung up on me. So in my opinion they are required to tell you the time frame BUT i believe its better stated "upto 6-8 weeks"

  11. Your SF would need to make enough income for himself, wife, son (younger), and your wife. (4 people).

    So with the info you posted - he makes enough.

    Between the two of you, no issues.

    Remember - you fill out an 864 and he will fill out the 864A. Be sure to obey the instructions for evidence (USC/LPR/Income/Household)

  12. Remember, the USC petitioner will file a I-864 regardless of income. If your joint sponsor lives in the same household as the petitioner, then they will use I-864A. If they live in a separate residence, then they will fill in another I-864.

    For your joint sponsor you will need proof of their citizenship/residency. For household member, you will need proof of relationship and same household/residence. And their proof of citizenship as well.

    Thanks! the info is great. what im looking for is a little more complex it seems. Because the forms are in order. BUT what im trying to determine is if me and my co sponsor in our household sizes and income combined if its enough to meet that 125% above poverty guidelines and what is used to determine qualification... like this example.. if im 5 k short from making it to the 125% mark, does my co sponsors income help with that insufficient amount or is our income combined to say ok you make 58k together and you need 50k to meet the need to sponsor.

  13. Hello- Question I have is in regards to filing my Affdvt of Supprt for my wife.

    The reason for the question is because like most I worry that her visa might get denied based on the financial aspect of things. When looking at the I-864p(Poverty Guidelines based off of 2009) Im looking at the dollar signs and thinking wow. My income from my job is at 23.5k a year and I recieve 3k a year for child support I would be adding in as part of my income to become eligible. So overall 26.5k a year. My household size is currently Me,my 7yr old daughter, 5 yr old daughter, my wife, and soon to be son in June. So 1+1+1+1+1=5. So according to the 2009 Poverty guidelines that requires income of 25,790 x 125% = 32,237.5. So I am $5,737.5 short.

    I currently reside with my parents, since Jan 2010. My step father has agreed to co-sponsor with me with the I-864a. His individual income is 32,948.55(Based of agi of 2009 taxes.) Now his household consist of himself, my mother, and my younger brother(under 21) So household of 3. My understanding is that he would have to meet the poverty guidelines for his own household..?

    Overall our income combined is at $59,428.55. Would this be enough to financially support my wife's visa?

  14. Yeah, I think that maybe txladykat didn't understand that your step father LIVES IN THE SAME HOUSEHOLD as you.

    For example, joint sponsors need to fill out an I-864 as well. However, if they are CURRENTLY living in the same household as you then they fill out the I-864a. Your mom DOES NOT keep to fill out the I-864a as well, as long as your step-father makes the required amount of money on his own. But here's the confusion:

    You're filing DCF right? That means you don't live in the US, so how do you live in the same house as your father??

    Oops...just looked at your profile, you aren't filing DCF! Just a hint in the right direction, you'd get a lot more replies quicker under the IR-1/CR-1 board as there are more of them and they tend to respond faster then us DCF-ers, just in general!

    Anyway, what I said above is true. If you are CURRENTLY RIGHT NOW living in the same house as your step father then he should fill in the I-864a and your mom doesn't need to fill out anything.

    As far as you BOTH including your wife on the forms, I don't know the answer to that. It seems like you shouldn't include her twice as the forms specifically say not to include any 1 person more than once....

  15. Actually, the step father has to file an I-864. the I864a would be for the step-father's spouse, if they have income as well. Each person sponsoring has to fill out their own I-864, and the USC spouse has to fill one out, regardless of whether they have income or not.

    i-864a for the step father's spouse? my mom? your kidding with me right.. i-864a indicates its a co-sponsorship for sponsoring my wife's visa that requires me and the co-sponsor to live under the same household. to use their income as a basis of qualifying for the Visa. my spouse hasnt worked in a few years.

  16. you'll be fine, but your stepfather has to cover 4, his own household (3) + your wife, that's why he's being your co-sponsor for your wife, right?

    so for 4 it's $27,562, he's good.

    great info, and i completely understand that some may not know the right answer.. So, question to this, is if my step father is adding my wife to his household size, does that mean i dont include her on my own..... So COMPLICATED

  17. Does anyone have experience with this... NVC as "HELPFUL" as they are, they don't try and help out. its more less an answer like. "those are just guidelines, its upto the embassy in the country it pertains to, to decide" THAT statement is pretty broad.. its like saying hey mr./mrs. you make only 110% above the poverty guidelines, BUT since its a sunny day.. you pass..... any info would help on my previous post would help soothe some nerves..

I am a firm believer to "things happen for a reason" for her to get denied, there is a purpose. sounds like you are to pushy and dont allow her to think for herself. you seem to want it your way and to convince her to come to America isnt a way to show her you care or love her. To try and come onto the forums with the mentality of "I BET THESE GUYS KNOW THE TRICKS OF THE TRADE" its not that people on here dont want to be helpful. but your pushing a BIG decision onto someone who isnt ready. Slow down, relax, breathe and either 1. work on yours and hers relationship and take it one step at a time, or 2. move on from her. If she isnt wanting the same thing you are.. then your spinning your wheels, plenty of people out there with similar interest as you..Sounds like her interest is her own independant life without needing someone to be there to take care of her.

    Goodluck -K-1 isnt a way i would approach the problem.. focus on her feelings before yours at times.

  20. The 2010 guidelines haven't been published yet, so you just need to go by the 2009. Even if they did release them before your interview, the general consensus seems to be that they won't change much anyway, due to the poor economy.

    Even when the economy was not as bad, the change is never very significant, at least in recent history. For instance in 2007 for 2 people it was $17,212.00, in 2008 it was $17,500.00, currently it is $18,212.00 - that's only a change of $1000 in the last 2 years.

    As to your question, current income is most important, they look at past years to see the overall earning/financial picture of the sponsor.

    According to whats been written or documented is the poverty guidelines for 2010 will for the first time go down, because of the economy. I would hope for this due to the fact that im 1k shy of meeting the requirements w/o a co sponsor.

  21. The quoted statement would be accurate if instead of "owe", it read "have an IRS lien". It's not an IRS limitation but something the Consular officer might (and has done) do. The OP said nothing about an IRS lien, so I doubt there is one. If not, then simply disregard.

    Thanks for clearin' that up man, because my co-spon owes but has a payment plan, and does not have a lie with irs

  22. You will need to bring your tax filings current to get a visa. If you owe money you must also make a payment plan and expect the money owed to be subtracted from the amount you make in calculating your income. If you have your taxed filed by interview time then your should be OK. If not your inability to follow US tax could land you in trouble as you are dealing with a government agency that it known for a lack of humor and not filing taxes may be a criminal action that would exclude you from being eligible to petition for a visa.

    Question regarding the statement made in this quote. "If you owe money you must also make a payment plan and expect the money owed to be subtracted from the amount you make in calculating your income." IF you owe the IRS why would you deduct what you owe from what you make annually. Is there a publication from the IRS that says this? I only ask because my co sponsor (step father) has a pymnt plan w/the irs
