Looking ahead, does anyone see any problem with my fiancee keeping her family name and not using mine? I am so not into posession that it matters not to me if she doesn't want to change her name.
Has anyone had to deal with this and were there any unexpected consequences?
My wife had two last names. She decided to take my last name and drop her father's last name. We decided to make her mother's last name as her middle name as she did not have a middle name. I thought this was best because most applications and documents in the US want a middle name. Also, she will have a unique name so mistaken identity should not be a problem. If you have a common last name, it is good to have a unique middle name.

Hello all.
I have a strange one here. I'll try to make is short and to the point.
I sent the I-485, I-765 and the I-131 in with a check for $1610. The fee was for my wife and son.
I got 3 rejection notices back. Yes 3.
The first one on the 485 said my check was wrong. It stated the filing fee is 930 plus 80 for fingerprints. A total of 1010.
The second one was with the I-765 and said the fee is 340 but is free if filed with the I-485. Ok. Total still should be $1010 at this point.
The third was on the I-131 and said the fee was 305 but would be free if filed with the I-485. Total still $1010.
But on their website it says that if her son (who is 4) files with her it is an additional 600 for a total of $1610. And I sent them $1610.
Should I just send them the $1010 now and wait for them to tell me it is wrong again? I included everything for the son to also adjust status. Copy of BC, copy of Visa in mothers passport, and a I-485 filled out for him.
Any ideas? Did I just get a newbie who looked at my paperwork. Any ideas as to what I did wrong?

I suggest that you send 2 separate checks, 1 for $1010 and the other for $600. Also, include a letter explaining why you sent them 2 separate checks. Remember, we're dealing with the US Gov't. so we have to spell everything out for them.

its about time to PJ as if they don't have us waiting enough for all this visa stuff, glad you finally got your bio letter. I have arrived safely in Florida now and have started working on the AOS, EAD and travel docs so we can post them off as soon as wee get back from Vegas at the end of the month.
Hope married life is going well for everyone and that you all get the happiness you so richly deserve
Will be popping in and out with any questions i have as the AOS seems more complicated then the K1 lol.

Welcome to the US!! You arrived in Florida at a good time. The temperature and humidity has dropped, so it is comfortable during the day. You will love the winters in Florida...75 during the day and 50's at night.
Married life is good and we're still waiting for our marriage certificate from the state. I'm calling tomorrow to see what the hold up is. I have all the documents ready, just waiting for the certificate.
Remember, the AOS process is all about you. Your future husband only has to fill out the I-864. It was confusing to me at first also. I hope your wedding goes well.

I hope you remember us... We are the December filers that were "left behind" due to problems with my Puerto Rico birth certificate. It took 7 months for us to receive our NOA2, and my fiancee's interview at the US consulate in Rio de Janeiro is set for October 19.
I know that you guys have all moved on to AOSs and Green Cards, but I have a question about the interview, and I wanted to ask y'all because I trust your opinion. I hope you don't mind... Here it goes...
Does it give us a better chance to get approved if I travel to Brazil for my fiancee's interview, or does it really not matter? If it makes a difference, I will definitely go through the expense... Nothing is more important than getting that visa approved... But otherwise, we would like to save our money for the other big expenses coming in the near future (moving, marriage, other immigration expenses, etc.)...
By the way... I should clear this up... As far as being there for emotional support for Missuzu on the day of her interview... My original plan was to be there, no questions asked. It was Missuzu who questioned whether it would be better to save the money.
What do you guys think? What are the pros and cons to me being there for Missuzu's interview?

Each Consulate is different, but in Colombia it is very important to attend the interview. I attended Carol's and I'm glad I did, plus I got to spend more time with her. When my friend went to his fiancee's interivew, a woman was denied because her fiance did not attend. I say, go to the interview...you have spent too much time and effort in this process. It would be a tremendous setback, emotionally, if she was denied.

Ditto Capt. My friend taught his wife to drive and she was always mad because he critiqued her driving. It's amazing that a perfect stanger can critique a woman's driving, but we can't.

How about taking photos in actual interview?
It's a good idea to bring plenty of evidence to the interview. I brought extra evidence (i.e. boarding passes, hotel reservations, photos) to our interview, but the CO did not ask for any of it. Although each consolute is different, it is better to be safe than sorry. It really depends if you or your fiancee have any red flags in your past.

Any idea about working without EAD but with SSN? Do employers check for that?
After May receives her SSN, she could start looking for work and write 'pending receipt of EAD' for start date on the application. Hopefully by the time the position is ready to be filled, she will have her EAD. Only other option is to work under the table.

Nice to see a thread for the dec filers!
Just to chip in, I didnot visit a civil surgeon in the US at all to file for my AOS. I just sent a copy of the medical records that were obtained as a part of the K1 process. There has been some discussion on this on visajourney. I just figured if i needed to do anything more i'd get an RFE and since I would get my AP and EAD independent of it, an RFE wouldn't affect me all that much. I guess there is nothing wrong in getting it out of the way, I was just lazy
i also read that ppl have been approved with just the k1 meds.
Well, my AP and EAD are approved and I will let you guys know about the green card.

You are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. Only if your DS-3025 is marked "incomplete" is a I-693 required to be completed. If it is marked as such (incomplete) you are required to complete certain portions of the I-693 and have a Civil Surgeon certify the form (and seal it in an evelope).
On another note: If you are required to attend an interview, one of the most critical items requested will be "evidence of the relationship" which proves that your marriage is true and faithful (i.e. photos, joint checking account, joint lease, joint mortgage, and birth certificates of children if any, etc.).

You don't need to include any evidence with your AOS packet. They don't really expect K-1 holders to provide any, given the short time window between POE-AOS.

Update:
Got a second biometrics appointment letter. First time we went in - the fingerprints weren't good enough for the FBI, apparently.
At least Daria's A# is correct on this notice... but now it's missing a receipt number.... just can't catch a break with these guys.
We are going to try a walk-in tomorrow morning. I am 50/50 on them rejecting the fingerprints again.
Also, for some reason, both EAD and AOS were touched 8/30, 10 days after biometrics... wonder ####### they are doing.
In any case, keep this thread going.

Thanks for the info. I was under the impression that for the AOS, you needed to show that both of you lived in the same household. Providing bank accounts, utility bills, credit cards with both names on the account with your home address. After researching the AOS info on VJ, I can't find any mention requiring this evidence...that makes it alot easier to file.

I feel like taking a big breath after all of the plans from the wedding, but I guess we need to get the AOS done soon. I am assuming a few things so let me ask. Allie's entry date was at the end of June. We need to file AOS before the 90 days is up for the K-1. Correct?
And the fee is $1010 and $600 for our son who is 5, correct? Total of $1610.
Good to see the Rumrunner is still afloat. It has been an amazing trip and I look forward to the day when Allie and I no longer have to worry about the next government form that we have to fill out.... I'm sure everyone feels the same.

You don't have to file before 90 days, but your fiance's legal status as a K1 expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS before the K1 visa expires. Many people have filed after 90 days without any problems, but try to file beforehand if possible. I don't know how the USCIS expects us to plan for the wedding so family members can attend, obtain enough physical evidence as proof of relationship living in the same household, and file for AOS within 90 days. I'm going to do my best to file within the 90 days, but I'm not sure if I'll make it.

I'm always surprised to hear people in Colombia say that Bogotá is pretty cold, even from people who were born and raised there. The average temperature is around 65ºF and at times it can get pretty warm since it's so high up. Last time I was there 3 years ago I was walking around with nothing but jeans and a t-shirt with my sweater wrapped around my waist just in case I needed it. I never used the damned thing.

When we were in Bogota in June, it was in the 60's during the day and I wasn't cold, but Carol was. Funny because being from Florida and used to 95F everyday I wasn't cold and Carol from Cali which is 85F everyday was cold. The difference is the fluctuation in temperature in the US versus in Colombia. The temperature in Colombia fluctuates by 10-15F and 25F in the US. I did need a light jacket in the evening.

A quick update from the December couple "left behind"...
On August 23, Missuzu received the letter from the US embassy in Rio... Her interview appointment is set for October 19!

Another question: Can a USC go to the embassy (in a general sense) w/o an appointment? I only ask because I will be there in a couple weeks for a visit and will have quite a bit of free time on my hands during the day while she's at work. I was thinking of heading over that way just to check it out ahead of time to familiarize myself with the neighborhood, i.e. what's close by, hotels, restaurants, etc. If I could pay a visit, just to check it out, I would. If not, no big deal.
Also, does anyone happen to know why the ability to edit your own post sometimes disappears?

Guess my name is no longer applicable to my status.. We just got married last Aug 4
Anyway, we are sending my AOS application tomorrow. I sure do hope this process will go faster. It has been more than a month since I arrived here and I am loving every moment I am with my husband but I'm starting to get bored at home when my husband is at work. I want to take this opportunity to thank all of you for the help with the K1 process. Goodluck to all of us.

Congrats on your marriage!
We bought a puppy to keep Carol company while I am at work. Also, she chats online with family and friends to occupy her time.
Try to find a chat room either here on Visa Journey or some where else that has the same interests as you.

Send the DS-230 and DS-2100 to schedule your interview. The I-134 and DS-156K is needed for the interview. Have your fiancee call the DAS office first to find out what she needs to bring (i.e documents, passport photos, etc.)

On a different note: got paper copies of all 3 NOA-1(s) (which makes me think initially the package is OK at least) now just gotta wait a couple of months.

I called a couple of times (didn't talk to a real person), and entered my USCIS Receipt Number... The automated system told me that they had no record of that receipt number, so I figured they still had not received the petition from the USCIS...
Then today, in my mail, I received a letter from the NVC telling me that they received my approved petition on July 31, and that they would send it on to the embassy in Brazil within one week! Awesome!
How can I find out when the NVC sends the approved petition to the embassy? And when the embassy receives it?
You can track the progress via DHL, but I don't know the process. There are previous posts in this thread that explains the process. Also, you can wait a week and contact either the DOS or the embassy itself. Research Embassy Info at the top of this page...there is very helpful info on this page.

We got our paper copy of the NOA2 in the mail on Monday (August 2)!!
I know... I know... No big deal... But it is for ME!!! We have been waiting 7 months for this!
