Don't DONT call Marc Ellis. I fell for than when I was doing my K1 4 years ago. My husband was in morocco and he told me to file for my husband out of some island in the Mediterranean off of Turkey so we could do our interview there bc he thought he would have a better chance there. At that time my husband could not even leaveee Morocco. He also told me our chances were slim. Ended up doing the paper my self we we didn't have a problem at all. Marc Ellis doesn't know what he's talking about. Dont even think about him. Just finish what you started and see where it goes and plan on being there at the interview.

The same thing happened to me TODAY! I sent my papers off and was rejected with the same message. Check was made out for $590 to Department of Homeland Security. On the bottom of the Notice of Action page it does state that the checks and/or money orders may be payable to "Department of Homeland Security" or "U.S. Citizenship and Immigration Services". lol However, above that its says" Since the reorganization of the INS into three new agencies under the Department of Homeland Security, there had been confusion regarding who remittances should be made payable to. Unless specified above, your application is not being rejected for incorrect payee information.
So why they check incorrect or imcomplete gaurantee amuont is beyond me especially if thats WHAT THEY TELL YOU TO MAIL IN!
I have been on the phone with them all morning and no one can tell me whats wrong with my application. They are soo frustrating.

Two years ago when we initially filed to remove conditions for a K-1 Visa we had our first biometrics. Now, two years later, here we go again, filing to remove conditions. However, it states to add an additional biometiric fee of $85 to the regular filing fee of $505.00. I know the directions to this form is generic to first time users, however, since I already did the biometrics, do I pay it again? Anyone know? Thanks!

While it may seem realistic to just plop down and fill it now.... I work full time, and go to college full time.. and we have also just moved, so all my papers now are put away and are not immediately accessable. I do applogize for any inconvenience my lack on timeline has caused anyone but I do appreciate all the help I have received. Thanks everyone!!

Green Card trumps all, on all documents printed stating 'USA Something'
Visa Expired? no big deal - green card replaces it, and replaced it on issuance.
Mostly (sorry, in fact, IN TOTO)
IF he came into USA on a K-1 visa - it was invalidated the day he entered the USA.

What matters, to get back to Morocco,
is
a valid Moroccan passport..
then, what matters, to get back to USA, into the USA, past any POE,
is
a valid greencard.
what does he have, really?
make a list, post back in yer topic, list dates of each thing and expiration dates on each thing.

Question is... What will he need to the back home to United States? Initially he had to have a visa to travel here to the United States when he came in the first place. But its expired now. So won't he have to have it again to come back? I'm sorry, but this is the issue I'm confused About. Thanks again for your help!!

We are going to be traveling to Morocco soon and my husband has an expired visa but a conditional green card. How would you obtain a visa for a non citizen to travel back to his home country? Would he have to go through a Moroccan embassy here in the united states or could he go through any common place to get a visa?

Current green card no problems, just don't let it lapse. Remember in the 90 day window. 3 weeks easy.
Ok, so your saying with current Greencard, he can just walk in and out and no problems. I just worry because his visa is of course is now expired. So I have been wondering if he needed to apply for a visa. With all the trouble it was getting him here, as with any of us getting our spouses here, that when we try to come back with will be a big drama.

Pre information: My husband came here on a k1 visa. Now we are married. He now has his greencard for almost two years. We will soon file to removie conditions. His greencard is due to expire in late November I believe so we will file around September. Now getting to my question, we are planning a trip home to his country in may for three weeks. Will he have any problems leaving or coming back in on his current visa/greencard. I wouldnt think so. But do we need to file anything for him or do anything for him prior to going and basically, can he just walk back out and come back in as easily as I can? Going to Morocco if that means anything.

Next summer me and husband are making a trip back to Morocco. We were checking the prices on line and noticed that plane tickets to Morocco for one person were averaging about $2,000. However, if we flew into Sevilla, Spain and took to ferry south to Morocco the plane ticket would cost only $1,000. He came here on a fiance visa. He just received his 2 year permanent resident card.
Would they allow him to fly into Spain and exit the airport go through customs where the ferry is at and enter Morocco? Im sure they will bc he is a citizen of Morocco. The flip side is, when its time to go home. Will they let him enter get on the ferry to enter Spain so we can travel to the airport to Sevilla to fly home to United Stated? Thats where the tricky part is. Entering into Spain from Morocoo.
I am not sure where Mouad can or can not go with hs visa. Anyone?

You do not send originals, only copies with the AOS unless specifically specified (and in this case birth certificate is not) so a copy is MORE than fine (but remember to make a copy for your records).
It would be beneficial to still apply for those documents so if you have an interview you can take the originals because they WILL want to see them.

Hey there Kathryn! Its so nice to hear from you again!! How are you? I really hope things are great with you... things are great here for us!! He came here Feb 1st, and we married on March 15th. His I-94 states that it expires April 30th. So I imagine now he is 'out of status". What we are waiting on, which we thought we had, was his birth certificate, translation and immunization records. They have been mailed to us twice but were just not getting them. I guess I will send them a preaddressed envelope and have them send it to us dhl. I DO however have a birth certificate and translation of it for him, but they are just copies, and I dont know if they will accept a copy of a translation and birth certificate.

I have also heard we have 6 months from April 30th to file, and I heard there is NO time limit to file aos. Danged if I aint confused. I waiting on some important documents that we need to included with out AOS papers that cant seem to make it here by mail no matter HOW MANY TIMES its mailed to us. This is our primary frustration. So thats why there is a question on our time limit to file. Once we get those documents we will file... but until then... wait wait wait! I cant seem to find a reliable answer anywhere. And I have read through AOS proceedures but they seem vague. Can anyone help with answering this? Is there a time limit? And if there is, how long do we have and from what date does it begin?

Well.. you don't say what visa/status you're talking about (nor have a profile/timeline to indicate anything) - but regardless - in most cases, The Sooner You File, the Better. You mention 90-days so perhaps you're referring to a Fiance visa? Same answer - The Sooner You File, The Better.
Is there some particular reason you'd want to wait? (or have waited?)
We are filing a k1... and yes the sooner the better. But unfortunately we have to have time to gather lost proof. Birth certificate and tranlation of that including having him immunizations being sent from morocco due to misplacement. Thanks.

I was reading the direction on filing out the I-485 form for AOS, and came across this:
"WARNING: Travel outside of the United States may trigger the three and ten year bar to admission under section 212(a)(9)(B)(i) of the Act for adjustment applicants, but not registry applicants. This ground of inadmissibility is triggered if you were unlawfully present in the United States (i.e you remained in the United States beyond the period of authroized stay) for more than 180 days before you applied for adjustment of status and you traveled outside of the United States while your Form I-485 is pending."
After reading "(i.e you remained in the United States beyond the period of authroized stay) for more than 180 days before you applied for adjustment of status" I am assuming that after his 90 days has expired and we are married, we have 180 days to submit our paperwork for Adjustment of Status.
Does anyone else read that and get the same thought? Basically I trying to figure out what is my timeline for filing AOS. Does it have to be filed before his 90 days? Or do I have a certain amount of days following his 90 days to apply and submit his papers.
If anyone can help, thanks a bunch!

I am starting to think I started this aos paperwork process a tad too late. His visa expired April 30th. I just printed the directions for filng the I-485 for AOS. One of this things it has on there is that we need to provide a birth certificate. All I have is a copy. Just a copy of birth certificate and translation that was done there in Morocco. On top of that, I see that all documents that are in a foreign language have to be translated. So we now have to have his family send him an original birth certificate and have it translated here I guess right? It says nothing about it having to be an original... so I wonder if they will take a copy of his birth certificate and translation that was done in Morocco.
Second problem. "submit a vacination supplement, not the entire medical report". He can not locate his vacination record that he had done in Casablanca prior to the interview at the embassy. I guess we will have to have him vacinated again, and not sure how much that will cost.
It also states "If you are between the ages of 14 and 79 you must be fingerprinted as part of the USCIS biometrics services requirement. After you have filed this application USCIS will notify you in writing of the time and location where you must go to be fingerprinted. Failure to appear to be fingerprinted or for other biometric services may result in a denial of your application." I dont understand this. Is this something I should have done a long time ago? I dont know what this is.
Also... as if it never ends... I dont have proof to provide for AOS paperwork. States to documents to provide are:
1. Home contract copy, rental copy, lease copy, affidavit from a person you are living with which explains the living arrangement.
All I can provide is affidavit of living arrangement.. nothing else.
2. Copy of utility bills, gas, light, electric, cable, satellite.
I can not provide any of these. They will not put him on the account with me because he does not have a social security number. And he can not get one because DHS #### up. We went to the soc sec office today to get his ssn, and it was rejected because DHS has his name mispelled in there system and ss office can not issue him a ss number until his name is corrected.
3. Joint Bank Accounts.
I once again cant do that for the ss and dhs reason.
4. Credit/Debit Cards.
Ditto
5. Insurance. Auto, Life, Medical
Ditto
6. Major Purchases.
We have none
7. Drivers License.
Cant due to no ssn and other reasons
So. His visa expires April 30th, and I have nothing to show. No ssn, no vacinations, no birth cerificate, or actually can get birth cirtificate but not sure how long it will take, and same for vacinations I guess. I really DONT know what to do at this point. CAN the AOS be filed after April 30th? To have time to gather proof required. The important point was that we married before them correct? I reallllly need advice. Thanks!

2 - To have all documents translated to Arabic.
I cant remember the fees off hand... but you have to get the documents translated by someone who is approved by the consulate.
I do recall however, that the medical was 1300dh and visa was $130 which I had heard it has gone up to about $350 I believe. Hope that was of some help...

Well guys.. The end of our Fiance petition journey is at an end tomorrow.. I will pick up my fiance tomorrow night at 11 pm central time!! I can not believe its finally here.. 2 years and 8 months ago I met him and now we will finally finallyyyy be together!! Im sooo excited

The best deal was surprisingly the US Post Office by using their "Global Express Guaranteed" service. It cost me $132.30 (discounted 10% because I paid online instead of at the post office, which would have been $147.00), it was guaranteed in 1-3 business days, and they provided tracking, something that UPS told me USPS doesn't provide on overseas delivery. I mailed it on a Tuesday, and Salim had it on Friday.
I did the same thing... I researched delivery methods, and used them also... and he also had his in 3 days! Wow couldnt beat that with a stick! I sent I think almost 10 lbs of proof and it cost me $212.00. Broke the bank but it was worth it getting to him gauranteed and within 3 days! I was really pleased!
