Denial says…last entry in US was in a nonimmigrant category B2 in 2011 and expired 2012..violation of non immigrant status by overstaying ( but she was 9 yrs old)… one or more INA 245 bars apply and she doesn’t qualify to adjust status

Hi I’m a US citizen, hubby is a green card holder. My step daughter is from Bahamas she just turned 21 this week. I applied for her I-130 a couple years ago it was approved, then applied for her green card it got denied a yr ago. My husband was the petitioner for her 485, is that the real reason for denial? Should I have filed as her petitioner?Reason said she became out of status in 2012, she has been here since we obtained custody of her at age 6 but why would they approve her I130? And got as far as setting up her finger print’s appt for 485 then we received denial letter

Hi Jim, thanks for the info, so I have checked the top box of the I-485 (a). I also printed the info with the link that you gave me. Also is there any form that I can complete to show distress. Or do I just have to wait until I can get the fees.

Forget the I-912. You don't qualify. It can only be used for adjustment of status cases where INA 213A doesn't apply, meaning no financial sponsor is required. Since a financial sponsor is definitely required in this case, you don't qualify for a fee waiver.

Note that this is primarily for a spouse to adjust status, but it generally also applies to a step-child.
Check box "a" in part 2 of the I-485. The immigrant petition that will make a visa number immediately available is the I-130 that you're concurrently submitting.

Hello, my husband has his temporary green card (CR-1 visa) he has a 9 year old daughter whom lives with us now, cause we recently was awarded custody of her from the Bahamas. I completed a I-130 and I-485, but it was returned to me saying the app wasnt complete. Are these the correct forms? I also am doing a I-912 form, and USCIS told me I need to send one with both apps. So I now know that I need to do that. The only area that wasnt complete on the I-485 was the application type, I am not sure which one to check cause they all dont sound like they apply. Can you help?

Yes I did and I also called USCIS before i even submitted my husbands I-130 to ask them if i needed a separate one and they told me no. I have copies of everything I've ever sent in from the beginning of this whole process

Hi I have a question for anyone who knows the answer. I am in the nvc process just sent in the final packet (ds-230) I received a letter from them saying you can't add anyone one this application. I didnt think I was, my husband daughter has been on this from the beginning with the I-130. Now we are almost to the end of this process and they send me a letter saying I cant add anyone. Have you heard of this before. I asked this question way before I ever filled out the I-130 and was told by USCIS to make sure I put her on the app. and I did. Any suggestions??

I think you can go with which one you want if you want thr CR1 then just dont send anything for the other one. And yes you can get everything ready now so that when NVC ask you for them you can send them fast. Good luck You should use the Short cuts that are on wiki they help alot.

Hi everyone, Happy New Year, I've been reading everyone's comment and looks like I fit well. I was approved last week for both the I130 and I129f. Although I originally wanted the CR-1 visa. Is it possible to go with that one or now that I'm approved for the K-3 that I have to go with that one? Also looks like everyone is on the ball with NVC, can you actually start working on the requirements before NVC receives your case? Please help me out cause I'm in need of that interview. Our anniversary is Feb 28th and I'm really praying he is here for that.

Good afternoon my fellow VJ'erz! Is there any way to cancel our K-3 approval and stay with the CR-1? I only applied for it because I was advised by USCIS, saying go with the K-3 to get my husband in the U.S. quicker!

Actually what I thought was an RFE was only a touch, I'm so disappointed with them, just wouldn't have thought they would drag it out to the five months!

Hi fellow VJ'erzzzzz, I have a question last week I started getting excited because on Nov 25th when I checked the status online with USCIS the last updated date had finally changed. I have checked it everyday since then including weekends (lol) and so far its been touched Nov 25th, 26th, and now the 30th. My exciteness has turned into nervousness. Could this be a good sign or a bad sign?

According to USCIS (Vj'ers will tell you different) K-3 and I-130 run parallel although evidence has obviously not proved that to be true...
Don't look at other peoples NOA 2's... It'll just make you want to scream more... (trust me) You won't be able to talk to CSC, just that stupid call center. And yes, I too feel like screaming at times, the transparency in this process is obviously not present.
Yes, K-3 is obsolete... so you may ask why did I do it? Cause I was foolish and stupid, wish I did'nt but oh well... past is past...
Also, it is not necessarily obsolete... depends on the embassy your dealing with... CR-1 will take you through dealing with NVC (NVC will process) vs. K-3 (embassy processes)
Anyway, you've just filed in August.. so check your status on line if it says "Initial Review" your probably in the background check, as i was told that's the longest portion of the "initial review" portion by my senator.
Anyway, stay up & happy, we will all get through this extremely long & tiring process.

Hey guys you might be wondering why is she starting a NVC October and
1. she has not gotten NOA2
2. she has not gotten NOA2
3. its still September... anyways i started this thread because i am claming my approval you might know these sayings "ask and it shall be given" "seek and you shall find" "claim your victory" "stand strong in faith"...with that being said..i honestly think that if anyone gets approved the last week of september (including myself) NVC will not assign a case number until early October with the current delay at NVC.

actually, mine and many others were approved within a week of the "based on your timeline your petition....." date. It jumps around alot depending on the processing trends but its a pretty good tool actually

One question though if my I-130 comes through 1st cause it was put in 1st, does that mean the K-3/K-4 is a lost case?
Because you filed an I-129f, your I-130 lost its place in line. It was pulled out when they received the I-129f and both of them went to the back of the case load. That being said, if the two petitions are not approved at the same time and you get an I-130 approval first, your I-129f cannot be approved.

Hi VJers! Is it just me or do you just feel the need to scream right now! I mean I have my good days and my bad days and I guess this is a bad day for me! I would give anything to speak to a representative working directly in the CSC, I believe we all would feel better if we only knew the process step by step. I have been reading all the different questions everyone has and the answers being given. I have yet to read any post explaining the steps. How accurate is the estimated timelines, on this journey cause I check that everyday more than once. I spend all day starring at my cell phone for a text message only God only knows how often I check my email daily. I know patience, patience, patience, is the key and that's the second thing on my prayer list nightly.. well ok at least I vented a little and I feel somewhat better. One question though if my I-130 comes through 1st cause it was put in 1st, does that mean the K-3/K-4 is a lost case?

I suggest you WAIT on the medical exam, at LEAST until a Consulate CaseNumber has been issued. The Consulate CaseNumber is USUALLY required for the medical forms - but I've no idea how things work in da Bahamas.
