    Hi,
     
         My mother has passed away back in MAY 11,2021 due to covid19. But now last week i got email from Islamabad embassy(Pakistan) that her interview is rescheduled on 14 September 2021. Can you let me know how can i  inform the embassy for her death.? Can you give me any link where i can send her death certificate so they can close her case. also can they refund the application fees.?
     
    NOTE: My mother interview was cancelled due to covid19 in 17 march 2020 last year.

    First of all, I am so sorry for your loss! However, don't let this immigration paperwork stress you. The thing is you can file as a "widow" of a US citizen.
    You will need the same form, I-751, which I am attaching a link to. Secondly, try and include as much as evidence you can!
    You will have to request a waiver in I-751, saying that my "Spouse is Deceased". Please attached a copy of the death certificate so your waiver would be approved. This is PART 2 of I-751, you will see it there.

    I had a 10 year B1/B2 visa but we applied for a K-1 visa in order for me to come to the US and marry. When they printed the K-1 in passport, they chalked off my B1/B2 and they wrote "Cancelled without Prejudice".
    The reason we waited about 6-8 months for a K-1 was because entering the US on a B1/B2 for the purpose of marriage is considered visa fraud, and if convicted, may lead to a permanent ban.
    It seems like you have applied for a K-1 and believe you me, it is the right things to do!

    There is too much confusion going on in this thread! Some people have asked people not to travel or the advises have been utterly misrepresented!
    Regardless of everything, let me just say that I had a 10 year B1/B2 visa and while my K-1 was being processed, I visited the US about 3 times in a span of one year. Also, we sent our I-129F application to USCIS while I was in the US, on a B2. And when my K-1 was issued, my B1/B2 was "Cancelled without Prejudice". However, I am a Permanent Resident now!
    The OP, Channah, is pretty smart and is well aware of the travelling requirements, the documents she needs to carry and how to answer the questions asked by the CBP. She even knows that if the CBP find her inadmissible, she might be turned back. However, scaring people and advising them not to travel to be with the SO's in uncalled for. Please refrain from these kind of personal opinions.

    Bottomline: You can visit the US as long as you have significant ties to your home country and YOU PROVE that your intentions are not to stay forever in the US, on that trip!

    RICARDO4EVA2, I understand that this has already been addressed but on VJ, we all have a right to express ourselves! I understand you have copied and pasted the expedition criteria from the USCIS page and the OP must have taken a look at it!
    So, all the work has been done by you! I usually refrain myself from posting on "heated" topics but this one needed it.
    I am glad you helped the OP out!
    Also, to the OP, I would like to add that you could try writing to your Congressman, it might help!

    The K-1 visa has a lot of pre-requisites, just like any other visa. These are:
    a) A US citizen can file a K-1 visa for his/her foreign fiance.
    b) Upon receiving the visa, the foreign fiance has to enter the US within 6 months.
    c) Upon entering the US on a K-1 visa, the marriage should take place IN THE UNITED STATES, within 90 days.
    These are just some of the important requirements of K-1. So to answer your question, once you receive the K-1, you have to get married in the US. You can not get married in Canada.
    If you do get married in Canada, the K-1 visa will be void and then you will have to file an immigrant visa for your spouse (CR-1/IR-1).
