Have we done something wrong? I am wondering how long we should expect next steps to take to see I-485 approval or see an interview scheduled. Yes, parent is in US. Thank you for the help!

I feel like there must be a really obvious place to get this information and I'm just missing it. Could anyone please help me? We are trying to do AOS for a parent of a USC. After 17 months, the I-130 was finally approved, but I-485 is still under review at NVC. What should we expect next? Another long period of waiting?

I have searched the forums for clarification on this, so I apologize if it's been asked and answered plenty already:
I have a I-864 for the sponsor, who files taxes MFJ. Alone, the sponsor earns enough, but we got RFE to include spouse's income info. So I'm re-sending the packet and also filling out I-864a with the spouse who files taxes with the spouse on the I-864.
Here's my question: in the section on both I-864 and I-864a that requests "Federal Income Tax Return Information", so I split up our incomes (according to each individual's W-2s/1099s/Schedule Cs)? So that way the year-by-year adjusted gross income reporting would add up to the total listed as adjusted gross on the tax filing if we added the answers in I-864 to the answers in I-864a? Or do I report the whole joint adjusted gross income on both the I-864 and I-864a, even though each form is just for one of the spouses on that tax return?
Is this making sense? Thanks for your help!

Thank you. I'm wondering about the in between time when you don't yet have a receipt.
I'm not as worried about the nonresident walking around in the US, but moreso about what happens if the NOA is dated after the expiration of the authorized 6-month stay as a tourist. Or does the NOA indicate the date USCIS received the package at the processing center? It was received a week ago but the I-94 is only for two more weeks.

We sent in an AOS package (including I-130) for a parent of a USC who is here on a B-2 visa and had not originally planned to stay. If we don't receive an NOA before the expiration of their authorized 6-month stay, do we have a problem? I am worried that the I-94 indicates they need to leave by mid-September but we might not have any official recognition of our documents being submitted by then. Thanks for any help you can offer!

My USC naturalized spouse is filing an I-130 that asks for his certificate of naturalization number. When he filed for his first US passport, they never sent back the certificate of naturalization, or perhaps it was lost in the mail. The I-130 asks if he ever had a certificate (he did) and what the number is. We have no copy of the number, unfortunately. What should we do with regard to the I-130? File without the number? File for replacement certificate of naturalization and wait? It would be financially painful to spend the $555 to file the N-565. I'm grateful for any insight anyone can offer

Thanks! This is helpful. Can you or anyone else confirm that filing I-485 and I-130 at same time for parent of USC means paying both filiing fees? Or the I-485 fee includes I-130 fee. I am seeing conflicting information.

I am hoping to get some insight. I have a parent of a USC who is visiting on a tourist visa in the US currently. This was planned as a short visit only but we are now considering whether we may want to apply for a GC for the parent of the USC. I understand the 6 months allowed for a visit would likely run out before the I-130 is approved, even if we applied tomorrow, but is there any point in even entertaining the idea of: staying until end of allowable tourist visit, applying for extension, attempting to complete all steps toward IR-1 while in US? Family circumstances have changed such that it would be best for the parent to not return to home country for long or at all. Thank you for any help you can offer! I used to frequent this site a decade ago and now find I'm in need of help and lost all over again.

Some of the older threads also mention that you can request to pick up the visa (once approved) at the Lima DHL office (Callao) rather than having it sent to your Peruvian fiance(e)'s home address, which can save a few days. Good luck!
I believe that it will only go to DHL offices. I don't think they will do home delivery, no matter what province you're in.

You should definitely take a look at the Embassy info for Lima here: http://www.visajourney.com/consulates/index.php?ctry=Peru&cty=Lima
Whether it's K-1 or IR/CR-1, yes, you can attend the interview as the USC. It is not required nor even highly recommended at Peru. However, it won't hurt to come along. They can ask you questions if they have any. And, as stated above, it can make you seem more serious. Plus it's good moral support for your S.O.
Assuming no hiccups, the visa should be sent to the nearest DHL office within one week of the interview.

A conservative suggestion would be to bring paperwork for a joint sponsor to the interview just in case the VO thinks it's needed.

I agree. This shouldn't be an issue. I was in a similar position when we applied and didn't have any problems.

So will DHL deliver it to the applicant? My Fiancee lives in Uganda but will have to go to Kenya for her interview. If it were possible it would be nice for her not to have to stay in Kenya for a week waiting. Perhaps she could pick it up at some DHL office in Uganda. Any ideas?

Also, where did you get copies of police records/court documents? And where in Lima can they be certified translated into English?? Did you send original paystubs? Or copies? And the same for the taxes? Ugh so many questionss..thanks again! Te debo un ceviche!
You'll get an appointment letter with all the details on this. No need for translations from Spanish.
Police records can be obtained at the nearest police station where your fiancee lives. Penal records are found at the Poder Judicial on Avenida Abancay in Lima. Judicial records can be gotten at the Poder Judicial on Av. Abancay as well. If memory serves me right, the penal records are no longer needed. You'll want to confirm this, though.
For the I-134 documentation you can send copies of the supporting documents.

Okay. Thanks so much for your reply! So ill send the i-134 and all that jazz to my fiancee. She should have her birth certificate, police record, and court documents translated into english right? Is that necessary? Also, you BOTH attended the interview? Is that necessary? Or can she go alone? (Im in Peru at the moment, and another trip down might not be feasible) thanks so much!
If it's in Spanish, it doesn't need to be translated for the consulate in Lima. The fiancee can go to the interview alone, though you are also allowed to accompany her. Sometimes, if you have some red flags, it's advisable to accompany the fiancee. If you think it's a straightforward case, it may not be necessary for you to get there. In rare circumstances, they will make a request that the US citizen show up to a second interview before visa issuance.

In response to your answer, no need to be scare or careful, nothing could happen, a green card holder , can apply for a naturalization if he or she is married with a citizen in 2 years and 9 month begining from the date the person got the permanent residence with condition or not.
if the permanent resident is in process of removing the condition , he or she have the notice of action and already have 2 years and 9 month , the person can apply for naturalization while the condition process in pending.

Affidavits are not a requirement, just a suggestion in a long list of possible types of evidence. Better evidence shows co-mingling the finances, household property, and legal responsibilities.

Same happened to us. When I posted about it in 2011, the response was that this happens from time to time.

Proof is in this quote from the N-400 instructions:
If you are applying based on five years as a lawful permanent resident or based on three years as a lawful permanent resident married to a U.S. citizen, you may apply for naturalization up to 90 days before you meet the "continuous residence" requirement. You must meet all other requirements at the time that you file your application with USCIS.
You may apply up to 90 days before, but you are not required to (unlike ROC).

RFE for medical exam - receipt not confirmed

In early February, we received notice of an I-130 approval around the same time we received an Initial RFE tied to the I-485 that was asking for the medical exam. We sent the medical exam overnight mail the same day we got the RFE (tracking through USPS showed it arrived at intended destination). This was two months ago. When looking at the status of the I-485, there is no indication that they received the medical exam. It just says that they sent that same February RFE and we have until a specific date in April to reply.
What should we do, if anything, at this point? Does it seem like perhaps they lost it? I am not sure who to call to check on it or if just waiting is all that's required of us at this point. Thank you for any insight you might have!
