Hello fellow September filers, here is my question... my window will open on 09/18 and I want my application at CSC as early as possible (I know, the earliest is the 18th). I will be traveling for work between 17 - 22 and I wanted to get your opinion. Should I mail it express on the 16th even though it will arrive one day earlier then the start of my window, or should I send it tomorrow (09/15) priority (not express) certified with the return receipt, etc? Priority will probably take 3 days (I live in California, so I think it won't take more than 3 days).
I don't want to wait until I get back because as early I get the NOA and do the biometrics as better. I have an international travel in early December.

Basically it lists line by line what was on the Tax Return. I believe it's preferred because it's shorter (4-6 pages) and it's a official document from IRS.
Thanks for the clarification. I will leave as it is for two reasons: 1) I visited IRS website and it seems it takes 10 to 30 business days to receive the transcripts (and I am submitting my I-751 on Wednesday); 2) I re-read the instructions for I-751 and they don't request specifically the transcripts, but they say " joint tax returns". I understand the transcript is official since it is coming from IRS, but hopefully it won't be a problem to send just the return. As I said, I am including a partial copy which will contains the most important sections of the Transcripts.
But I appreciate you explaining the difference between both. It is always good to know :-)

Will sound like a dumb question, but what is the difference between your Tax Transcript and copy of your Tax Return? I thought they were about the same thing.
My husband and I filed online using TurboTax and for 2008, the final Tax document is 146 pages! I am sending a partial copy of this document, including the most important parts (federal and state). I didn't include, for example, the "worksheets" that are in that file, and some of the parts that were not pertaining to us.
Anyway, I didn't want to send them 300 pages for Tax only (2007 and 2008) so I am sending a partial copy (about 20 pages each). If they want to see the whole thing, I would be more than happy to print and send a big chunk package to them. But as for now, I will leave like this and have my fingers crossed.

I would ask a friend you know that has check and has enough money in the account to cover the fees.
You can give your friend the money you have now and say you will pay the remaining as soon as you receive your paycheck. Can you ask this to your boss? Since you are working and he/she will have to pay you anyway...

It seems you will have to buy a money order. As someone already said, safer if you can borrow the money from friends/family and send it on time.
If you end up sending it late, you should write a very good cover letter explaining the reasons for the delay.

Even more important is to call USCIS since her green card (10 years one) may have been delivered. Usually you need to report ASAP is you lose or your card is stolen. In your case, you never got it and you don't know for sure if it was returned to USCIS or not. So, call them tomorrow.
I think she first need her permanent green card on hand and you both should think of alternatives.
As per the stamp, can't you go to the US consulate in the country where you are now? The stamp on her expired passport, if the stamp is valid you MIGHT (not sure on this) be able to use it with the new passport, like when you have a valid visa in an expired passport you need to carry both passports (the one with valid visa and the new passport).

I think it's plenty, you hit the most important ones: Tax returns with both your names, some joint accounts, lease, child birth's certificate, insurance.
I wouldn't send 4 affidavits, sounds desperate in my opinion. But if you think they will help with your case, it's your decision.
I think you have enough good evidence. I am sending mine on Tuesday.

RDSEY: Just so I can better understand the situation, here are some questions:
- Your husband is from Nigeria and you are a US resident/citizen?
- Were you the I-864 (financial supporter) when your husband applied for the green card?
- Do you have children with him?
- I am confused as to whether you did file for divorce or not, and if it was granted or not.
As other people have already mentioned, your husband can file to remove the conditions without your name. Given the situation, he is probably filing it separately but I think he needs some sort of paperwork to show he is divorced or getting the divorce, etc. If he has children with you, this may work in his favor. If he is using your name in the application (as if he is filing it jointly) then he is committing a serious fraud.
Unfortunately, there is no way you can ensure that. But if you think he engaged in a marriage with you only to acquire a Green Card, I believe you can report him to the immigration. But be prepared to prove (as I think you are doing) that the marriage was on good faith from your part. Being in good-faith doesn't only mean you didn't cheat on him, but it mostly means you truly wanted to get married to be together as a couple, it means you didn't get married just to keep someone in the country.
Also, if you were the one who signed the I-864, unfortunately you are responsible as his financial supporter until he becomes a US citizen, dies, or other options (I don't really recall all the alternatives). So, if you truly think and you can prove he got married not in good-faith, I think you should report him.
Forget all this discussion going on about countries, scams, etc. Scams happen everywhere unfortunately. And if you were caught in one (without knowing it), then you should take actions to protect yourself.

I recently came across the I-865. While I did file my AR-11 I didn't know my husband had to file the I-865.
I second Lailaa and also think you should submit both asap. The AR-11 you can fill online (and you can print a copy for your records after you file it).
As per the I-865, your husband needs to fill out and mail. My husband just sent his with Priority Mail + certified + delivery confirmation (the green return receipt).
I will be submitting my I-751 next week, and the lawyer advised us to have all other pending situations (change of address, etc) already taken care of before I send my package.

Once you get the letter back with the apostille/authentication, and next time you go to the consulate again, make sure to bring a copy of the email where they responded "yes".... just to be safe ;-)

Thanks alot. Did you mean #1 that if she's still attending the school? She went the summber one, and now she's not attending. She just stays home while preparing these paper work. But on her passporst, she's given for 5 years re-entry till 2014. What I mean is if she can stay in the US w/o attending the school and while applying for the status change.
I am not an attorney so this is what I THINK it happens. If you are in the country as a F1, you have to keep status (take 12 credit course load). At least that's what happened to me when I was a F1 student. During summer I didn't have to study because it was not part of my program, but in the Fall I returned to my masters program and had to enroll in at least 12 credits. She should read the requirements and obligations of a F1 visa, and how to keep status, etc.
So, if she does not want to attend school anymore she/you should file the AOS asap. AS the other person mentioned, read the FAQs and all the instructions. If she wants to work while she awaits, she needs to file a work authorization permit. But she can only work AFTER she receives that.
But usually if you are on F1 and on status, you are permitted to work after you complete your first year at the program for up to 1 year (I forgot the name of the document, but the school which issued her I-20 should be able to help out with that, IF she is studying and keeping status.

Hi kitikichat, it is not about my case fitting into yours. As I said, there are options because there are different cases. You are the only one to decide which option fits in your case. Not if mine is applicable to yours.
I am married to an USC and I was a F1 when I got married. I didn't get into US with a K1/K2 etc.
Read the section of the instructions that says "Evidence of eligibility". If you don't know what exactly is your case, you can call USCIS and talk to an officer who can help you better understand your options.

or h? since I am currently in my F1 status and I just got married last month to a US citizen. And I am following the step by step guide on how to file an i-130 for spouse inside the US. Thank you!
In MY case it was " a ", but it varies by person. You should read all options and make sure you pick the one that corresponds to your case.

If you are on F1, as I was, usually you don't have an expiration date per si. It is " D/S " which means "duration of status". Usually that's what they write on I-94 "D/S". I put that on my I-30 when I submitted it.

My husband just mailed his I-865. I talked to a lawyer and he said it would be good to have everything in order before they receive my I-751.
He said a lot of people don't mail the I-865 and while it is required, there were very few cases that it became an issue (something related to received public fund benefits, etc).
Anyway, it was our fault we didn't see he also needed to file the I-865. But it is in the mail now... uff..

The I-865, as I have learned today, is the form for change of address from your sponsor. So if it is your sister in law and she hasn't moved, you don't need to file it.

Wow after doing some research I think I am required to file AR-11. I don't know what to do now.I'm getting ready to file I-751. Am I in trouble ??
You have to file AR-11 and I-865 and I just found that out.

Hey all, I just became aware of the I-865 (didn't know my husband was supposed to mail address change as well!!). I submitted my AR-11 (2 in the past 2 years) on time, etc.
In 2 weeks we will be submitting my I-751 to remove the conditionals but I am now worried about the fact that we didn't file his I-864. Should I just ignore? Would it feel bad to submit his now since we moved back in April??

Never mind my last post. I just realized my confirmation number appears on the bottom of my saved AR-11 (I always keep a copy for my records).

When you file the I-751, you can include the confirmation you received from your AR-11 and the NOA for I-865.
I never received a confirmation from my 2 AR-11. Do you mean the post office delivery receipt??
Funny that the first AR-11 I sent was on July 2008. I typed my name instead of hand signing and they returned my request. I signed it and send it back (but this time I didn't pay for the return receipt/proof of delivery).
Then, on april 2009 I sent a new AR-11 (since we moved again) and never got any confirmation back that my address was updated.

Hi Chris-n-Veronica, do not use that number. I read in a number of other threads that that number is NOT the case number. Your case number will come with the biometrics letter I think.
Hi payxbika, I don't think I will have time to stop at a post office on Thursday or Friday. And I don't really want to carry the envelope with me. My husband is traveling as well so I may ask a good friend to drop it for me... still deciding since I would prefer to do it myself.
