  1. I recommend going to USCIS.gov website and downloading the form from there. But I believe the form available there will expire at the end of October, so you may need to wait until early November to download the new/update one. Nearly all the forms in VJ's Download Section are directly linked to USCIS so what is here, is the current version(s).

    Also, the currently posted I-751 will not expire in October - its current version is "Form I-751 (Rev. 08/25/08)" which is the latest propagated version - the USCIS site will indicate if/when a new form is propagated and if previous versions are accepted.

    Just to kind of clarify...

    I didn't know they were linked. But I still think it is safer to always go directly to USCIS. But that's in my opinion.

    Regarding the form, the edition is 8/25/08, but I just clicked on the form and on the top right hand corner it says "OMB No. 1615-0038; Expires 10/31/09".

  2. Hello to all the members here i have a question hope you can help me.

    my question is Do i need to file the FORM USCIS I-751? for lifting condition. Cause im trying to print the this form but i cant. or i just file only the cover letter I-751 and the rest of the form post here in the example forms.

    my other question is my green card expired feb. 05 2010. so Nov. 05 suppost to be file for my Lifting condition 90 days from the expiration date of my green card . what if i file my Lifting condition at the end of November or December 05 is that too late to file my form for lifting condition? the reason why i wait for that Cause my due date for gitting birth is Nov. 19 so im planning to fille my form after i give birth

    VisaJourney is a great source of information and reference, a place you can share your experience and check how others are doing with their application. But you should always use USCIS as the main website to download forms and updated instructions regarding fees, dates, documents necessary, forms, etc. I advise printing the instructions for the I-751 guide and reading it carefully. Then if you have doubts, you can search for answers here.

    Also, you have 90 days before 02/05/2010 to file your application. It doesn't matter when within the 90 days you apply, as long as it is BEFORE 02/05/2010.

    You can apply in December, after you give birth.

    I think you replied to an older timeline/time list. If you send me your bio appt letter date I can update you.

    I think you will be fine before Christmas. In the worst case scenario (if your NOA doesn't come) you make an info pass and get the stamp on your passport. Read the posts from David-and-Mae, she never got ther NOA but she did ended up getting her bio appt letter.

  4. Instead of a blank sheet separating the tabbed sections, I listed the documents contained within that tabbed section on the page with the tab.

    Actually, I did list the documents in each section. I guess I put "blank" but in fact it wasn't really blank. My mistake. I first had them blank, and right before I mailed I decided to print the list on each Exhibit tab.

  5. My bio appt letter arrived today, the schedule date is 10/24 in Santa Rosa, CA (about 1hr15min from here). However, I will be in Chicago between 10/22 to 10/26. I will try going for an earlier bio starting late next week, and I will bring a copy of my itinerary/ticket so they can understand and hopefully approve my request.

  6. NycBra - when did you get your NOA? I mean, how long did it take?

    (also, I'd be happy to start a new October thread...I'll give it a shot, altho I'm not sure how to format the timeline thing appropriately....)

    Hi ichi. I submitted my I-751 on 9/16 and my NOA arrived on 9/26. But it varies by each person. I think 10 days is the average time.

    I updated your October time list, but feel free to modify the format. Maybe someone else will join your list and help update future October filers. Good luck.

    You are not applying to your interview location. Actually, I only found my interview location AFTER I submitted my application when they sent me the appointment letter for interview. Especially given that NY is fairly big (I used to live in NY), I think people are sent to different locations depending on which part of the city you live in.

    I inserted Chicago, IL on mine, not Garden City (which ended up being my interview location). I guess the best advice here is to call USCIS and ask a customer representative. REmember to get their reference number/name and create a memo for your records. Every time I called USCIS I saved a memo file for my records. Ex.: On date, time, I called x number and spoke to Y customer agent who said bla bla bla bla.

  9. It is technically illegal for an employer to ask the immigration status during interview. And unfortunately some employers don't even call certain applicants for interviews because they just assume they are foreigners (given that the name is not "american"). To avoid having to ask for their immigration status, they just don't select those applicants for interviews.

    To avoid it, I have on my resume under my "profile" section (a short bio about my qualifications, specialties, etc) which says "Fully authorized to work in U.S. (green-card holder)".

    I've seen other people listing at the bottom of the resume something on the same line. I totally recommend writing something on the resume. Very few employers actually read the cover letter. Your husband should write it on the cover letter as well, but it is good to keep in his resume.

  10. Its not only in VJ there is alot of Philipines. At my work 70% are Philipines. And they are talking their own language so I sometimes feel that I am not in USA. But anyways California is the closest place for them to immigrate and no wonder that CSC has alot of them

    Hey all, I didn't mean to create any discussion. Sorry if I did... I have NOTHING against Philippines and, in fact, I've been there, worked there and like the people in general. My only comment was regarding the approvals. That I think there is more Filipinos at VJ (and I don't have anything against it. As I said, I wish there were more Brazilians here) and therefore we see more approvals for them.

    As far as I know, there are only 2 centers to submit I-751, either Vermont or California, and California deals with cases not only from California, but from many other states.

  11. Noticed that all the 10 yr GC approvals coming through CSC for month of August are all filers from the Philippines and one Australian. Would appear that the FBI/Interpol background check must move at a very fast pace through those two countries compared to all the others, thus resulting in such fast approvals. :thumbs:

    I guess you have a point but on the other hand, we have to remember that VJ is a real small sample (I don't even think it is considered a statistical sample) of all the applications they receive. And I notice Philippines has a large representative population here at VJ. I recently joined VJ (few months ago) and I wonder how many other Brazilians out there are submitting their applications (many I believe, but they haven't found VJ yet...)

    I don't really know if FBI/Interpol background check are faster for Philippines, maybe we are seeing more approvals because there are more Filipinos posting their timelines here.

    I am not saying you are wrong, I am in no position to say who is right or wrong, we never know what really goes on with USCIS. But I have to confess you make an interesting point... I will try to see any pattern for applicants from other months.

  12. Maybe you should start a topic with the subject as October I-751 filers and insert your timeline. You can copy one "timeline" from our September thread topic, or from other months.

    Also, since you sent only one month after us, you should have a look at the September thread anyway to see how long others have been receiving their NOAs, sometimes not receiving it at all (but receiving the Bio appt letter).

    Now that you have already sent the package, you have to sit down and (try) to relax. I know it is hard, I can't relax myself. I already got my NOA and waiting for my bio appt letter.

  13. No updates here today. :unsure: I am hoping to receive my bio appt letter starting this Friday. I just have a feeling it will fall in one of my many upcoming work and family trips. I think I will try to go for an early bio anyway, but I need that letter first.

    Anyone else had news? I feel our September thread has been a little quiet lately, maybe everyone is anxious like me checking mailboxes or waiting for the appointment dates.

  14. So I went to my Infopass appointment in Kansas City... Got my extension stamped on my passport and was allowed to an early Biometrics. Thank goodness, we don't have to go to St. Louis for that. All in all, the trip was very successful! :thumbs: The tech that took my fingerprints was very optimistic. She said "Just wait for your card in the mail". :whistle:

  15. thanks for the help kids - do you think the "bad faith" tourist thing does in alot of people?

    I would avoid entering as a tourist. Since you will be married and she is coming TO STAY here with you, then it would be a bad-faith entry in the country. It could hurt the application for AOS (in my opinion).

    Just to give you an example. When I applied for my F1 in Brazil, I was engaged to my now husband. But I was going to return to US to pursue school, not to get married in 3 months. During my interview for the student visa, they gave me a hard time because I was applying for a student visa since I was engaged. I explained my focus would be the master's program, not to get married. Yes, we had plans to get married (reason we were engaged) but not for another 1 year or so. As far as I understood, entering the country with a fiance visa I would have to get married in a short period of time and we didn't have plans to get married that fast. We wanted to enjoy our engagement, have time to plan for the wedding which would take place in Brazil in a later time. It took me a solid 40 minutes interview to explain the reason I was applying for the F1.

    This is just a brief explanation that how you enter the country really matters to them. In their mind, they thought the F1 was "bad-faith" of my part, which was not. I pursued my masters and got my degree. And we planned our wedding with the time we needed/wanted.

  16. The letter isn't needed. Your G-325 gives your history so the CO is aware of the student status.

    From what you state you are able to demonstrate current, continuing income (for the both of you) that meets the income requirements. That is what the CO's are evaluating.

    Past income not as important, but I would still include the letter. By giving the information early on (your low income last 3 years) you avoid USCIS asking you to further explain your financial situation.

    Your income+your husband's will be plenty. You are in the right track.

    I agree. Include the 2007 tax return and include a note explaining the difference. It would be good to attach with the note a copy of the social security card showing that the date issued was after tax was submitted.

    as for joint bank statements, I think better to give them complete statements instead of only first page of each..so they will have a chance to see detailed transections in the account. Also if you have, you can add several copies of checks from same account, signed by either of you at different times ..I guess you might get the copies of checks online.

    I disagree. Send only 1 complete statements, and a couple per year with the front page only showing both your names and address. USCIS will prefer to see a cover page of the account throughout the year (example: 1 for January, 1 for June 1 for November) and maybe 1 full statement.

    I think the photos is a personal thing, but in my opinion 34 pictures is too much.

    You already included bank acct, credit card, vehicle, lease, tax returns. So I think you are covering the most important items. Just attach the 2007 as well.

  18. When I submitted my AOS application, I just put a big binding clip (the thick bulky ones that mozplay posted the pictures).

    For my I-751, I brought my pack to Staples and they have a machine that punch for you. You can choose the standard 3 holes on the side OR the standard 2 punch on top. So I did the 2 top one. Then I bought the BASE of the ACCO fastener to keep all the paper together. I bent each "leg" of the base to keep the package/papers tight. I will try to attach the picture to this message.

    This way I think it will be easier for them to disassemble my application if they want, and they already have the 2 holes punched.

    Edit: one more thing, I attached the check to the I-751 form using a paper clip. I think as long as you don't have the documents stapled, you will be fine.

    And I did tabs using "labels", the printing/address labels. I separated my documents into Exhibits, and each Exhibit had a letter. Ex.: Exhibit A (Financial joint accounts); Exhibit B (Joint Tax Returns); Exhibit C (Proof of joint residence), etc. So I inserted tabs with each letter on the bottom of my application.

  20. Hello everyone!

    My wife (F-1 Visa) and I (US Citizen) are just beginning the process of her AOS. She graduates in May so we are trying to get the documents into the Chicago box as quickly as possible. A few headscratchers are on these forms:

    1) I-485, Part 2:

    Of the ten options available, 'h' seems the best, because we can just write in "I am married to a U.S. citizen." None of the other fields seem to apply, except for 'a', which is almost unreadable to me. What to choose?

    If you file all documents for AOS at once (i-130, I-485, I-864), then you choose A (if you don't fall in any of the other categories). Because the I-130 will give her automatically an immigrant visa number and you are submitting it together, then you choose A. Don't choose H only because you can say "I am married to a US citizen". If you don't fall within the options b-g, then choose A.

    2) I-131, Part 2:

    The USCIS customer service told my wife to fill this form out. We think she may need an advance parole document in case she needs to return home in case of an emergency. She is not a conditional resident yet by sheer virtue of the marriage, correct?

    3) I-131, Part 3.1:

    My wife has no travel plans to leave the country yet. Why would she need to fill out a "Date of Intended Departure?"

    She can apply for I-131 even though she doesn't have specific travel dates. Just write "to be determined".

    4) Affidavit of Support:

    I am going to graduate school and no longer have the income to meet the 125% federal poverty level requirement. My wife's brother who is in the U.S. on a green card wants to be a co-sponsor. Should I put myself down as the primary sponsor and her brother as the 2nd sponsor?

    Can't really answer this one. I think it would be better to put her brother then as the main sponsor, and you can explain in a cover letter why you are not sponsoring her.
