Welcome to this Forum! It could be an approval, someone in this forum posted weeks ago that his/her case was touched 3 days in a row and got an approval notice after that.

you HAVE to wait for a visa number to be available before u can apply for adjustment since you were married to a lpr

Ok i have done alot of research and it seems that it all depends on whether your lpr spouse had filed any petitions for you, if so the you can use that priority date for your adjustment and if he didnt then you will have to wait until a visa is available to you so every yr you have to file for renewal of ead and deferred action status until a visa is available to you...i would contac a lawyer or catholic charities for extra help

Yes my spouse filed I-130 Jan this year and got EAC Reciept number. I also sent that Receipt number along with my I-360 VAWA application.

So Ghana you said I apply for EAD, Advance parole and I-485 together.

But I have to send the EAD application to vermont as my case comes under option © (14) deferred action.

I have to sent the Advance parole & AOS to Chicago Lock box. So, I don't know, what to do.

So how to renew your deferred action status and how long the current one is valid. Is there any fee for this to renew. I knew there is fee for EAD renewal.

It amazed me in a such a great way to know that more cases got approved lately.

I have some comments that I would like to share with you:

gina 12 : If you want to request status of your case, I would recommend you to do it in a written communication and attach copy of your lastest granted prima facie letter. I learned when you call to the National Customer Service (1-800-...) regarding to VAWA cases, they always sent you a letter few weeks later stating that: "They can not deny or confirm existence of your case.....blah blah blah......."

I'm telling for my personal experience. The first time I called them and received that letter I was in shock and worried, later on I found out that Immigration officers do not replay your inquiry over the phone, because confidentially of VAWA cases and also for your safety. They ONLY replay your request if you (or your legal representative) send them an inquiry of your case WITH COPY OF PRIMA FACIE LETTER AND ALSO COPY OF YOUR G-28 FORM (if any. This form is the copy of your signed agreement/ contract between your lawyer and you to be represented by him/her for immigration matters). Don't loose your time calling them, save time and go for an INFOPASS appointment OR send them a simple request letter of status of your case, using a CERTIFICATED MAIL.

Honest : Please get very good advices before you leave. I have heard once you file for AOS you can not leave this country until it gets approved, but if you have an approved I-360 and your current visa and passport are not expired you could request an advance of parole to travel and be able to come back. Otherwise, you can not re-entry into USA even with an approved I-360. Once again, please make sure that you won't have any problem re-entering into this country. I'm very sorry for all the pain you're going through and I admire you for keeping your faith and hope up. Sorry for your lost. I pray God gives you the strenght you need your family as well.

mona_lisa : Thanks for concerning about me. I haven't had luck. I contacted the congressman's office couple weeks ago and they got back to me saying that they don't handled this kind of cases and suggest me to hire a lawyer. Can you believe it?. So now, I'm searching for some catholic charities in my community to see if they can help me out. I will contact them and hopefully I will find out about my case. I will keep you posted and thanks for you suggestions.

So I should have some Non Immigrant visa in order to travel outside other than my approved I-360. Am I understood right?

whenever I apply for EAD, I am thinking of applying my Advance Parole if I have enough money. I check in the USCIS website that I have to pay for both EAD and Advance Parole. what are the docs needed for EAD.

1) letter for economy neccesity

2) Filing fee $340 along with the I -765 completed form

3) I -94 card (front & back)

4) Passport showing our picture, name and date of birth

5) Any foriegn visa stamped on the passport if possible

6) State ID and/or Drivers License

7) 2 identical color photos with name and alien # on the back of the photos

Since I married to a PR, for my country I have to wait for couple of years (may be 6-7 years for the availability of visa number I believe) to get my Green Card and I am thinking of applying AOS after I visit my family back home in India after seeing your message. I am pretty much confused. Waiting for my approval letter.

When did you file for your case, I have always been able to check the status of all my cases it is the first time that I am facing this problem, and because it is a vawa case thus even if you call the uscis they don't give you any info..

Thank you very much Gina. I will share what I did for my paper work and I need some time to work on it. So many other issues going on in my life and I am doing research on the google to get answers. I have to apply for EAD, AOS and also advance parole and want to travel India as I lost 2 member in my life and spend some time with rest of my family. I need to get EAD, some job and save money to travel, etc. I will definitely give the details in couple of days. I going through so much pain and sufferings where my approval really gave me a bit relax and confident that I am going to Independent in USA.

I don't in VAWA we can travel outside USA with advance parole. I have to check with my counselor more. If anyone knows please let me know.

I heared that until we get PR we should travel and I don't know how much its true. still looking is there any rules for VAWA as such.

I read that somewhere which is couple of years old web page but I am not sure.

I also heard that the VAWA processing going to be less as per the organization and it looks like its happening. my case and bethbeth is a good example for this and also as I mentioned in other social service organization they are seeing more approvals with less time. I don't know how much TRUE but I wish you all the best.

I don't know when they touched my case until EWTN mentioned in one of the previous post about touched the file , I don't know about catholic church and also about public benefit too. All I came to know about this VAWA forum and it all very helpful in one way or other and thank all of you who shared the information in this wonderful forum.

I can still not check my status online. How many months after filing could you search for your status online. I am just not able to despite of having the EAC number and the prima facie. Don't worry call them and ask them one more time saying that I am very much worried and wish to know about my status. could you please update my case in the website.

I also suggest you to take a print out, write a letter about your present situation and also explain this problem that you're not able to see the status on the website.

I am not sure but the validation error looks like there might be a space or special character in between. If don't mind please check whether you're tping as follows for example.

EAC0123456789

EAC and then continously 10 digit number and there is no space at the end.

Try it and if still not working please call them and also write the letter about the issue.

Yesterday i received Email from uscis that my vawa petition got approved. after such a long and sad time I am sooooooo happy. My 1-360 took 15 months and 20 days to be approved. Thank God.

I filed my 1-360 06/25/2009 and got the prima facie on 06/30. I have no lawyer. Can not afford. Catholic charities could not help either, heard about them after filing. I too did not know VAWA existed. It feels like you are in one hell.

When I filed, I sent in the filing fees. It was returned a week later, a day before the Prima facie. Why did they return the fee? Any idea?

I needed the money though. After he left, I had a severe accident and have been in PT for 3 years. He disappeared with my travel documents, work permit. For a while I was not sure he took them because they just disappeared from my car. Last year, 2 years later, he returned them thru a friend, after the friend threatened him. Thats when I knew he had taken them.

My biggest problem is that I feel like a complete failure. Like I should have seen it coming. I should have asked more about him. I should have pressed about his job. After the accident I consireded going back.

I can not seem to get over this. I have not dated since then. I really do not mind dying.

I want to say couple of things but take it easy. If dying solve every problem, we can do that.

I lost my youngest brother couple of months ago and I am not able to travel India even for his Funeral and the 31st day after my brother passed away, My grandfather died because he can't bear the pain of young man death in our family & again I am not able to go for his funeral. Above all, I gone through all the NON SENSE with personal problem as everyone gone/going through in this VAWA FORUM. I request USCIS to expedite with their death certificate but no reply. I applied to public benefits, but no luck as I dont have enough documents. I took infopass and asked them whether I can apply for EAD, no luck. I took appointment with Catholic Charities and they said you have to wait until I-360 approved. I been too couple of social service organization including my state coalition against domestic violence got some info here and there but nothing helps me but I never give up, I started writing the declaration letter about my situation and problem every 40 days once with what I tried to USICS and sent it with ceritifed mail.Anyhow finally I got approved and looking for the approval letter to apply for EAD and I-485 AOS.

I taught so many times like you getting hurt by myself but it comes to my mind that GOD created us to live not to dying and he know when to take you breathe out from you. no one have right to take their own life or someone's life.

I appreciate if you forget about dying/hurting yourself and try to fight for your rights, freedom and look for the other possiblilities to lead your life the way you want. There is always different ways to lead our lives. Dying is easy. Live your life with all this obstacles and see the fruit of life. the way I going through is really very very painful and I am still not losing my confident. I really frustrated with so many things but never want to give up. Always try and keep trying. EFFORT NEVER FAILS. I really don't know which USCIS officer made the decision to approve my case but Its really great relief in my life If I get atleast EAD and I don't worry about my Permanent Residence. I checked in the website and its says they are processing may 2004.Anyhow the bottom line is never giveup and keep trying.

Keep writing letter to USCIS with the copy of your prima facie and the blue page about your situation and what you're tried so for and what you're trying by providing the documents. for example I submit the copies of the money I paid for consulting attorney in catholic church and other attorney ($25,$30 because I can't afford and noone help me financially). I sent the copies of the email which I sent to my counselor from Coalition against domestic violence, I also got the letter from my counselor to whom I am having consuling since 2nd jan 2009 which is sealted to USCIS officer about my situation, proof of my blood donation to american red cross & united blood services. the application which I applied for public benefit and the rejection letter of my public benefit and so on. I sent so many documents along with my declaration letter which I sent every 40 to 50 days once to USCIS. I don't care to make the USCIS offier tied to touch my file. I am sharing all this to give confident and also try to send about your situation by writing letter to USCIS and wish all of you to get approval soon.

I gone through so much and I really know the PAIN. I tried a lot and wish you all BEST OF LUCK.

I heared that USCIS working more on VAWA case because my state Coalition Against Domestic Violence counselor, catholic charities and other social service agencie saying that they are seeing more approval for lot of VAWA application than ever before. Well I sent off my RFE last week, so just waiting for my decision now. I'm very nervous but hoping for the best. thank you honst for this post !!!!!!!!!! you semes you did alot of search i usedt do that all the time when i fierst fill vawa but i got tired any way thank you its help i think i agree with number 3 bc/z i heard it befor 3) very few USCIS members are working on VAWA and they work 1 or 2 days in a week not more than that on VAWA cases (Form - I-360) and its only 25 Adjudications Officer handel all vawa case imagin how many case they have recived 45000 vawa pitition last yeare and they say cases are growing up this year maby that

im not sur i could be wrong, but som time i try to convince my self . my pablem is my ex wife keep use my immigration stutes (im under prceeding but i dont have court dat yet) for the custody of my son and she give hard time with vistition i cant relly wiatt any more when i see poeople her have been wiat 16 .19 month i get dispointed but i did do alots of search as well and the average is around 11.13 mounth

I am not able to get good sleep for couple of years with all this problems and I use to sleep 2 days once or 3 days once but now its better it takes 22 -28 hours once I get sleep for 4 to 5 hrs , I always think about my problems and feel too much pressure on me.

At some point I use to think, its my fate to go through all the NON SENSE happened/happening in my LIFE.

Anyhow I don't want to go indepth, as everyone of us go through the same NON SENSE with different people in different situation only the people,location and scene will be different but the pain & suffering will be the same with various levels.

I didn't know about VAWA otherwise I could applied it atleast 2 and half years ago. what to do I am feeling better that atleast now I applied.

Recently I came to know about many organization who help people like us and being there for help but no luck.

AS EWTN said only things is WAITING with your legs and fingers crossed until you get approval.

Nothing is Permanent in the world, EVERYTHING has to change and it will keep changing constantly all the time.

weather change, people behaviour changes, GOVT change, rules changes and soon our waiting time will change to short period pretty soon hopefully.

I wish I could help all the people who suffers for various reason in the world and be like a GOD (who is everwhere according to all the religious in the world.) you know.

i don't understand it seems to me that they dont have a sequence after all...

I checked with my coalition against domestic violence in my state, catholic charities and also other helping agencies. I don't know how much all the below statements are TRUE but they are saying

1) It depends whether the case is genuine or not and how much serious the person affected both mentally, physically and financially, etc

2) Whether you paid the file fee for VAWA, if you paid process will be quick. (It clearly says if its against Violence, no need for filing fee but i don't know)

3) very few USCIS members are working on VAWA and they work 1 or 2 days in a week not more than that on VAWA cases (Form - I-360)

4) They want to see whether the affected person still wants to stay in USA or going to leave the country because of the violence, pain & sufferings, etc.

5) USCIS also want to check whether we entered into marriage life with good faith/intention and not for immigration purpose.

6) USCIS doesn't want to encourge the Domestic Violence so that more people will file and misuse the VAWA system.

7) As Govt changes every 4 years, the rules and regulations for VAWA also changes and the fund will vary for the victims. They want to discontinue the VAWA system as many of the US citizens are victim of the situation and also many organization against the VAWA system and few organization supports the VAWA

I really don't know how much all the above statements are TRUE but that's how I heared from all the agencies and I am not able to believe any of this. Who knows anything may happen. Anyhow what ever its is, I badly need a WORK PERMIT (EAD) as I married to a PR person but I am not able to get one until this I -360 get approved.

I am not able to get any public benefit unless I leave the family and stay in shelter house. If I come out of the house No one knows about my kids life and how can I stay in the shelter house without job and I don't know how could I bring the kids away from my family. shelter house provide the shelter only for 90 to 120 days and after that who will help me and with a job. I don't know and right now they don't have any vacancies for the shelter house too. what to do. no money to run away from this country too.

I think its my mistake to enter into this country and asking help from them.

Nobody cares about anybody. For everything in this country we need MONEY MONEY MONEY. No values or respect to human life and their emotions.

I knew that we need MONEY but its not everything you know.

No one knows about our suffering whoever formed the rules & regulations because they aren't one of us (suffering/suffered person). they might never go/gone through this kind of hard time because they lead a comfortable life through out their career and never know the real pain.

Today my lawyer received my second prima facie letter in the last 19 months when I filed my case at Vermont Center. It's just unbelivable that I haven't been requested for RFE by immigration or have a decision already. It's very frustrated.

My case was touched 9.3.09. But I heard nothing from them, I guess they receive my request for my 5th prima facie extension .. I haven't receive RFE or what so ever I pray for approval of all our case because we all deserve it..

bethbethb got a approval today and I am really very Happy about it.

I have no idea about the processing of I-360 for VAWA from USCIS.

For some cases they take less time and for some cases they took more time and for some they are still waiting over 19 months. Its completely make us frustrated with this processing on top of other personal frustration.
