  2. Processing time for I-485 is based on local field office.. My local filed office is currently processing cases filed May, 2009

    That's correct, once the I-485 is moved from Vermont Service Center to Local office, its really matters depends upon the volume of cases pending in the local office and number of employee in that particular office.

    You can write a letter if you want to move from one office to another but in general its not a good idea as the transfer case from one office to another makes more delay

  3. My I-485 was touched today, I called USCIS to find out how long it takes to get biometrics appointment. She told me my file is currently at my local office, it was transferred on Monday and I should receive the biometrics appointment within the coming weeks. I also asked her if it was standard for I-485 to be transferred from NBC to local office, she said it is, I for some reason thought NBC usually sends out the bio appointment and interview notice. Processing time for I-485 at my local office is May, 2009, I filed I-485 July, 2009

    Wow that was fast. Mine is still at NBC and I was approved before you. What are they doing with my file????

    You filed your I-485 along with I-360 but lostinNJ filed in July 2009. There might be a few days or couple of weeks difference to move the case from Vermont to NBC as you filed on March 2008 and lostinNJ file in July 2009. Just a guess. no one knows, how exactly the USCIS processing goes because each case is unique in its own way.

    The processing time as of August 31st 2009 for the VERMONT SERVICE CENTER for VAWA : processing 29th july 2008.

    If you file your VAWA through an attorney as him/her to request letter to adjucate your case. If you filed by yourself write a letter to USCIS to adjucate you case and mentioned that your case is behind the processing time and also mention that you didn't receive any response so for.

    The processing time is almost 14 months as of now. that's the reason it takes more months. In other words we can say they (USCIS) have enough evidence that we are going through a hard time with our spouse and they will first establish the PRIMA FACIE and they(USCIS) process according to the filing date which is almost 14 months as of today. In some cases they do consider the expedite and they will adjucate the case sooner.

  7. Hey guys, what are some evidence to establish Economic Necessity?

    Dear lostinNJ,

    some evidence to establish Economic Necessity means you have to show them(USCIS) that you need money to pay your rent , food, phone, laundry, clothing, bus/train fares, etc.

    I hope this is for EAD.(Form I-765)

    So u were married to an LPR? I'm married to a US citizen, all my I-797C notice of action doesn't have priority dates, I just read the I-797 Approval and it says I have a priority date of Feb 04, 2008. I'm lost as to why I have a priority date if I was married to a US citizen.

    If you're married to a US citizen, you will get the GC soon. You can call the USCIS Customer Service and check with them regarding the Priority date.

    Since you married to a US citizen. you can apply for your EAD (Form I-765), GC (Form I-485) along with your VAWA application.

    USCIS will approve your EAD pretty soon and you can able to work independently.

    USCIS processing time for EAD is maximum 3 months and for the VAWA 13.3 months. Once your VAWA approved you will get your interview and GC within 3 months (Maximum).

    You guys married to an US citizen and you don't have to worry about anything, you will get the GC pretty soon. I mean within 3 months from your VAWA approval

  11. I am waiting for interview. It's supposed to be before the end of the year, that's what my attorney told me.

    I was reading LostinNJ link, maybe they will send me green card without interview because i already had my I-485 interview in 2006 with my ex.

    I wish you ALL THE BEST to get the Green Card without an interview. I think Obama Govt. speed up the Immigration cases.

    As of 31st August the average processing time for the VAWA is 13.3 months. I hope things moves faster for all of us.

    I dont filed my VaWa yet, because I m still gathering evidences.and Today I just got my restraining Order.. I will file it soon .. for now I am waiting for my insurance copy..

    I cant afford lawyer thats why I am asking if I can file it by my self

    I took almost 5 months to just gather all the information. But Don't waste that long. First check in the USCIS website in the I-360 instruction and also in the website. http://www.asistaonline.org/vawa.asp they provide a bunch of sample documents like table of content for I-360 application, cover letter, checklist before sending your application, etc. If I get some time, I will go through the above mention website and send you the list of documentation requires for filing your VAWA.

    If you have questions, please let us know. We all will help you. you can also check with Catholic Charities.

    anybody can help me I need opinion , I am working on my self -petitioning trough Vawa .

    My question is can you file by your own and send it to vermont direct them or you just need legal service to assist you to file ??

    Did you already filed VAWA? What does Vermont direct them means? Of course there is no replacement to take legal service help through Catholic charities or if you can able to afford an attorney.

    I filed my VAWA by myself and got approved.

But I'm so happy for all the great news we have had lately and specially when one of you have been approved :yes: I'm getting scared and nervious about my case :unsure: Today is one of those days that I think my case is not going to be approved :( I'm worried :blush:

    Thank you very much for your wishes. Don't get scare and nervous, there is nothing you can do other than waiting. As lostinNJ said its much better waiting for the approval rather than it goes negative. I am really don't know why it takes so long. I am sure they are going to approve your case in couple of weeks. Please relax yourself and be happy you're pretty close to the approval. I knew saying is easy but following the advice is more difficult.

    You thing about after the approval, everything will be fast to get your GC. Noone can stop you. hang in there. :thumbs::thumbs::thumbs:

    i thing my pitition collect dust in vermont ...they never send me 2nd prima facie is that normal

    As of 31st August 2009, USCIS is processing 29th July 2008. So we are close to Nov 2009 and USCIS will be processing sep 2008 or nov 2008 VAWA Application. So Diama and you are very close to the approval.

    I don't know about EWTN case, why is getting delayed may be another case is with USCIS.

    Don't worry, count your days your approval is pretty close to you.
