  1. hi guys, season greetings to u all!!!!!!! i must say i have read alot of ur advices and i have learnt alotttt. I am a new member, and i am really happy to be apart of this forum. my question is, i filed all my forms the same time, I360, I131, I485, and I765. Do you think that was a good idea??? Thank you guys.....

    Welcome to the forum.

    You said you already applied. There is nothing wrong to apply all the Forms together as long as you married to a US citizen.

    If you married to GC holder then you have to apply only I-360 , get it approved then rest of Forms are qualified to apply.

    You will get a EAD to work and it depends upon your situation.

    Don't worry. Wait for your receipt and check online. Take care

  2. Congrats mona_lisa. I'm not sure on your question about if you remarry. I would think you would not be eligible for citizenship if you remarry but I may be wrong. By the way guys today I received my interview notice for 25th January 2010. Wish me luck. And just a very quick question, on the notice it states to bring your spouse's birth certificate or evidence of US citizenship, do I need to take that? Because I don't have it or even a copy of it.

    Very interesting question about remarry, I would like to know the correct answer , I knew that you couldn't get married if your VAWA was still pending and, I remember when I went to my interview the officer told me about the 3 years for the citizenship instead of 5 years

    You shouldn't remarry until you become a PR holder and also when your VAWA is in process as per the I-360 VAWA instruction from the uscis website. for more info see on the below link

    Q. Can A Divorced Spouse Seek Relief By Filing A Form I-360?

    A. Yes. Effective October 28, 2000, you may file a Form I-360 if the marriage was terminated within 2 years prior to the date of filing, if you can demonstrate a connection between the termination of the marriage and the battery or extreme cruelty. A battered spouse who cannot demonstrate such a connection may be eligible for battered spouse cancellation of removal. To qualify for battered spouse cancellation of removal, you must meet the other requirements that would be necessary for approval of a self-petition. In addition, you must have been physically present in the United States for 3 years immediately preceding the filing of the application for cancellation of removal, and you must demonstrate that your removal from the United States would result in extreme hardship to you or your child.

    Your Form I-360 will be denied if you re-marry prior to the approval of the Form I-360. Remarriage after the Form I-360 has been approved will not affect the validity of the petition.

    Regarding becoming citizen, OBOMA passed a new rule which I posted in this forum before that certain applicants are qualified for citizenship in 3 years and VAWA is under that category.

  4. Niagara can you tell us about your experience at the interview?

    I went with my attorney. Officer asked my name, date of birth and two first NO questions. Then they were talking with my son about his band class at school. :star: Officer said he is nice kid and have good potentials. :) Then they stamp my passport and that's it, 5 min.

    On there website already said: Card production ordered. I still can't believe. Thanks GOD!!!! This is the best Christmas present!!!!

    I found a civil surgeon for my medical exam [form I-693], called them this morning, was told that they don't accept health insurance, payment by credit card/personal check, only cash. I have no choice, tomorrow I have an appointment, I have to shell out about $500, the visit-$150, MMR, PPD/TB testing, about $75 each. Blood work for another $150.

    It's a good thing that we are exempted from producing the I-864 or Affidavit of Support.

    I will call the Nat'l Service Center tomorrow, I'm hoping they can help and answer my questions. If I called my lawyer, she will bill me again. My interview is next month, I'm getting nervous. I'm not able to enjoy the holidays even though I'm very thankful to the Lord that he willed my self-petition to be approved.

    Anyway, thank you guys for being here. If anyone has any ideas on how I should proceed, I would truly appreciate it.

    Try calling couple of other Civil Surgeons and ask about the details.

  6. Hello Guys,

    I am a permanent resident as of today. I got a stamp on my passport this morning. Thanks God, my journey is over.

    My interview lasted about 15 minutes and I went by myself, I did not go with my lawyer and honestly you don't need one for this interview. all what they ask me was for my birth certificate and my divorce decree and the NO questions on the I485.

  10. So I had my interview yesterday and it was over pretty fast. All he asked me were the questions on my I485, name, date of birth, parents name, entry date etc. Then the no questions. He then took copies of my travel documents, employment authorization card and my drivers license. He was really nice and friendly, he even made a few jokes. The interview lasted all of 10 mins. But he wouldn't tell me if he was going to approve it or not, he said everything seemed OK and that I should receive a decision in the mail soon.

    On the USCIS case status page, my application is still on 'acceptance' and the last time it was touched was Nov 11. I don't think they are updating it. Anyone else with this problem?

    Gabriela, thank you so much for all your help. You have been so helpful. I guess I still have some more waiting to do because i dont know for sure that it has been approved.

    It takes 5-10 working days. You both will get the Receipt Notice this week hopefully.

    I checked in this forum, some of them mentioned 3 to 4 weeks.

    Hi Honest, I applied for i-131 along with my i-360 the first time and got it in around 30-35 days. HTH.

    USCIS to Hold Certain Cases Pending Changes to Vaccination Requirements

    CDC Removes HPV and Herpes Zoster from List of Required Vaccines for Immigration Purposes

    WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) has, since Nov. 13, 2009, temporarily held certain applications to adjust status to lawful permanent residence until new CDC vaccination criteria become effective on Dec. 14, 2009.

    The Department of Health and Human Services (HHS), Centers for Disease Control and Prevention (CDC) announced on Nov. 13, 2009 new criteria for determining which vaccinations will be required for applicants seeking to become lawful permanent residents. Based on these new criteria, and beginning on Dec. 14, 2009, the vaccines for herpes zoster (zoster) and human papillomavirus (HPV) will no longer be required for immigration purposes.

    As a result, since Nov. 13, 2009, USCIS has held any application that would have been denied solely based on the applicant’s failure to show proof of having received the HPV or zoster vaccine. USCIS will resume adjudicating these applications on Dec. 14, 2009, using the new vaccination criteria, which eliminate the need for the HPV and zoster vaccines.

    So you mean is that all no other proof of uneligibity to pay they ask you?

    I already sent my I-360 so do you I can still sent my application the I-765 and I-485 together the a fee waiver...?? I think you need to have a declaration or something by a your own words.. im confused cause i dont want my application and the fee waiver get denied...

    Its not a problem, the fee waiver is only for I-485 and I-765. so Wait until you get the receipt number and you will also get the primafacie within a week or 10 days.

    In the mean time keep your papers ready for your I-765, I-485 and I-131.

    Thanks for the answer. Right now I am only planning to file for VAWA. Do you know if we have to send some passport size photographs along with VAWA petiton because I was reading instructions of form I 360 and it does not ask to send any passport size photo.

    Further, have you filed your AOS? You can also be eligible to fee waiver I think.

    I didn't send any photos for my VAWA.

    If you are planning to send I-765, I-485, I-131 then you need two photos for each of them so 6 photos for these 3 applications.

    I also want to say that there is no fee for VAWA and no photos
