  1. Okay here goes I called DOS on Friday the 9th and spoke to Chris he told me your case is pending AP I tried to pick him and he would just say the case is in AP. I called on Wednesday the 14th and spoke to Katie she said on they are just waiting on an interview date its summer and they are busy with other visas I can tell she is looking at the first screen and I said You know its been 2 years and Im getting a little confused as to why its taking so long. She said mmmmmm wait a minute she apologizes and tells me she was on the wrong screen she says its in AP they are working on it and I said how long will this go on she said oh! oh! they sent a letter dated Thursday the 8th requesting a new medical, police report, DS230 and new photos Im in shock and I tell her thank you and hang up. So I tell m husband to schedule a medical we have the police report and to call the call center and see if they give him an interview date( Ukraine has a call center you buy time to talk to them $12 for 8 minutes) They ask for his case number and tell him his interview is August 18 So now I have still not heard from the Embassy and neither has my husband so Im not sure what he is suppose to do. Im just hoping that the call center would not give him a date unless it was cleared by the Embassy to do so. I called DOS today and spoke to Brian he told me the same thing I told him my husband didnt get a letter and he said they also sent me one so Im waiting for mail from Ukraine LOl in the past they have always sent emails why not now. At any rate it seems to be moving forward.

  2. if you only knew... between the 3 kids, parents, grandparents, dogs, chickens and work I am torn in 1000 different directions.. then I try to keep my husband happy so I spend several hours a day on the phone with him.. I dont know how I have time to get all bent out of shape thinking about this process... but I do...

    omg ...and you still have time to get pissed off....

  3. LOL... I work 2 jobs..I have several hobbies one being I am learning Hindi.. I have some days that are better than others.. but all in all I think I am doing very well..I have thought about opening another buisness but right now I am lacking the motivation.. I know this too shall pass... I just wish it would pass sooner than later

  4. Thank you for your reply, SO, I guess he will just take his chances and I will report pack for others that might go through AP at the New Delhi Embassy.

    This process has confirmed my sneaking suspension that I am a control freak... via the withdrawal symptoms that I have been experiencing.. <sudden out burst, crazy emails at 1am to the President of the US, posting weird pics that only I laugh at,angry replies on VJ to innocent ppl>

    All the statistics that I have looked at were so sporadic that I figured my case could of been finished from 1 week into Ap to over a year... not to mention in WhatzNexts AP Tracker ppl from India had the highest number of denials :(

    Thank you for your encouragement... to think that it would only be 1 to 2 more months is exciting... :thumbs:

    I am also a serious control freak so this whole process has been hard for me because there is no way you can control this.I have gone form anger to crazy to sadness to depression then finally now i am at acceptance. Ok so u might think this is funny but i use to work at a drug rehap. And its kinda like aa and na. Step 1You have to admit you are powerless to control our journey,the dos and the embassey. Thats the hardest step. for me and you for sure. Step 2.Believe that a power greater than ourselves can resort us to sanity. and so on.....Its called the 12 steps to recovery. I seem to be better after seven months of Ap. I have had to find a creative outlet for my crazed energy from nerves because i was having problems with a bleeding ulser from worry. So i opened Shutup&drive. It is keeping me so busy i dont have much time for going insane waiting. i miss Alen so much . The other half of me is missing but i must go on and do this so im ok and it will give us a great income. He want even have to look for work when he adjusts his status because i will have a job at our business for him. It takes alot to open a state approved driving school but it is very lucritive. So if you are so crazy from worry and not being able to control this. Do you work? Have hobbys? try and find something you can do to take you mind off the wait. It really has helped me alot. And i have ocd and am a control freak....

    Put your focus on the business and I am sure you will succeed. I know its hard but I am trying to think the system will work it might take a little time Im not really sure when my husbands Ukraine visa will expire or if he will be able to renew it but I asked DOS and I am not sure it the lady knew what she was talking about but she said when my husband got to Iraq he should go to the Embassy and have his case transferred from Ukraine to Iraq did your honey try this. She told me I couldnt do it the Iraqi Embassy would have to request it from Ukraine. But I am hoping it dosent come to this.

    Alens had a temp residented card he was denied asylum in sweden. And since he was trying to Immigrate to the Us. They officer in sweden that was in chage of his case told us he would give Alen time to immigrate and not ship him home so he did have a valid id temp resident card at the time of his interview. The embassey check with his officer who says yes he is legal then they tell the officer it may be 6 to 9 months before he gets a visa. So they ask him to return to the embassey after interview . He goes and they call the swedish immigration police when he gets there. And even though his id is valid they take him to deportation center and hold him there. They give him the option to return or they will deport him. So he stays there in deportation jail thru Christmas then decides to return on his own. They release him and he goes home to pack and say his goodbyes then goes to deportation center 2 weeks later they fly him home. So if you guy cant get another visa he is taking a chance. Some embasseys let the person go ahead and immigrate but from all the trouble ya have had i might think about transfering it if they dont call him for an interview soon. Ours happen after the interview so they want transfer our case til our ap is finished in sweden. Then they might transfer it or just sit on it awhile. They were very nasty to us so i can see this happening. I am seriously thinking if we dont hear something soon filing a writ myself. You dont have to have a lawyer to file it. You can do it yourself.im going to wait it out til arround the end of aug. then decide one way or the other. You do have to contact the Iraq embassey first in order to transfer it they have to send for it. I emailed them and they were very nice. And responded ithin a few minutes of my email to my questions. There was a case in dec. i think where they approve a fiance visa in like 3 days for a male. That was the only one i have seen that was done at the baghdad embassey. Most Iraqis have fled so they file from other countrys. The dos info says they give you an interview date within one day of getting your file in there system and issue visas within one day but that time doesnt include ap. So if you are thinking about transfering your case. Email them first ask questions. Good luck i feel for you and i am still praying for you.

  6. I am sorry you are in Ap. Ar is when they are reviewing the information you gave then at the interview and checking all the documents you submitted to them at that time. Ap is when you info is faxed or mailed to washington for background checks.Not you whole file that the embassey has but they send info to diffent agencys in washington whom do background checks. I hope your ar or ap isnt long. Good luck to you.

    IMO, you could have gotten your citizenship 3 years later after arriving in USA, then filed for your father (immediate priority date, no waiting)

    But - you didn't do that. Perhaps you filed petition (with you as the Petitioner) when you were a Permanent Resident? Instead of USC ?

    AP is AP -is not any published timeline - they need to complete namechecks on your father.

    Is strange, really, as USC cannot petition for father in law. USC can petition for father, sure, but? Ya, I get it - your husband was some co-sponser on the I-864, but that doesn't matter for why your father is in AP.

A writ of mandamus to my understanding would NOT be for us right now... it is for someone that has spent an excessive amount of time waiting... i am sure we have heard all the operators tell us... well it could be 2 weeks it could be 6 months or even a year.... What I havent heard them say is that it will take 2 -5 years ... ya know... so I would think after the one year mark that we could think about filing one... it is basically you sueing the government.. it sounds glorious and most of what I have read has been the lawyer sending the embassy a letter of action with 30 days to respond.. and most of the time <except in this 1 indian case I was reading> they get the visa sent out pretty quickly.

    Awww im sorry. It is hard at first then after a while you just become use to the fact that you are at thier mercy. It has been 7 months of ap so far with us. We filed july 28th of 2009. The waiting stinks. I was lucky i got to live with Alen til dec. But he had to return to Iraq and i cant go there. I miss him so much. But have been trying to spend my time getting a new business up and running. That in its self will make you crazy. So i just added to my stress level. What was i thinking. Lol.... I know we cant really go together and file suit against DOS but it stinks that we have no rights or they dont have to let us know what is going on. I think they should have some sort of deadline to finish AP. And if it cant be completed in that time they should have to let you know why or give you some sort of idea when it ill be finished. It is wrong to make people wait years to be with there loved ones.

  8. I wanna know why we cant as a group file a writ and sue all of the DOS. I wish there was a way to change this process. My trying to relax today at home but i really need to be out putting flyers on cars for my ne business. I am hoping it does well. I have put alot of money in it . I didnt take out a business loan ,so it has really been hitting my savings hard. Thank god i have my first class on the 19 and will get some return on all i have invested. Hope you all have a good weekend and someone gets some good news next week.

  9. I have written letters to fox and cnn and got no response. Im not sure if or how to go about trying to make a change in the system. Mabe research senators or congressmen whom want immigration reform and try and go to or get a congressional hearing.There needs to be change. But i have no idea how to make it happen. Most people dont want to help immigrants they dont want more immigrants so why help us. It sucks . We are all suffering but seem to have not to many options for help. we are coming up on 7 months of ap.

    received at the Embassy May 12

    received at the Embassy May 14

    undergoing security checks

    waiting for an interview date to be scheduled(does that mean it takes 6 weeks to schedule a date)

    the famous its still pending

    or its under Administrative processing

    all your papers will have to be updated the Embassy will let you know what they need (When?)

    when it is reaffirmed they have to update the seurity checks

    My question to them today after all these different response was What is the last entry date you show her response was May 14 when the Embassy received it so what the heck? :wacko: she said

  11. hello everyone, i am on nvc stage and my case completed on 06/14/2010 and my residence was london before but i moved to india permanantly as i have no visa anymore to stay in uk .i called nvc and they told me that they will schedule my interview for london(as i requested for change of address from uk to india not embassy) and i ask them to change my embassy from london to new delhi. operator asked me for the proof of my residence in india which i sended my e mail tolday now my queastion is how long it take them to update it and to schedule my interview in new delhi

    They say it can take 2 months to tranfer a case from one embassey to another . But since your never went to the first embassey you are in good shape. It shouldnt affect you i wouldnt think. Your case should go straight to delhi. Good luck.
