  1. Her case isn't that simple. Her fiance is originally from Iraq. He was in Sweden and had his first interview at the embassy there. The US embassy in Sweden wanted to have a second interview, but his time was up there and he couldn't get it extended. He wasn't able to go to his second interview at the embassy. The embassy knew his situation. Being that he couldn't go to the second interview (no fault of his own), they sent his case back to the US. They have been through a lot!

    I think I have this correct....if I dont' Bridget, please correct me.

    Not sure what they did with our case. I have never recieved notice it was sent back. I resently hired a lawyer to find out what happened to it so that we might refile once we are married.

  2. Well i just thought id check in with you ap people .It has been a long journey for us and still no end in sight. Our visa was suppose to be returned in may of 2010 to the us. still nothing...Finally i decided to hire a new attorney to try and get some answers. So that when we marry in a few weeks will will know what to put on our paperwork as far as why we never got our first visa. I have seen alot of people on here come and go. I have myself been so impatient with the visa process. But all this time has taught me i must do this in gods time,not mine. So now in a few more weeks i will fly to Lebanon once more and marry. Please keep us in your prays as i do all of you. We will need them for the next leg of the road ahead. bridget

  3. We had a visa interview in dec.2009. We were denied but requested the consulate look over our case again. They ask for my fiancee to come in for another interview but he had to return to his home country of Iraq so this was not possible.From what we understood they were returning our case to the usa since he couldnt reinterview there. It will has been one year and 2 months since they told us they were returning our case to the us. We have heard nothing nor have i recieved anything from uscis or dept of state or our local service center.our status still states aproved on the website. Could they have kept our case in sweden and just let it die there since it was expired ? I would assume someone would have to send me a denial letter. All we have is the letter that was mailed to his old address in sweden from the consulate. We will marry soon in Lebanon and try to refile but i was wondering if i need to find our fiancee visa first. and also if there is some way to get our original documents returned to us.

  4. Hello guys, just wanted to let you all know that still in AP and still waiting. It's officially been one year and four months. Any news for you all? Bridget, did you file from Beirut yet? Please keep me posted guys...I feel like I'm going crazy!!

    I havent gone yet. i hope to go in march or april depending on when i cna leave my business. Trying to get dates together now. I hope all goes well and we are on our way to bringing him home soon. He had an interview with the un on Jan. 6th and has another in may.

  5. i will get all paperwork together.i do hear it is beautiful. we will file from the us . as i have to come home .i own a business and cant be gone more than a month.

    Yes, Just like Zeek said you can marry however way you like. Also i know that if you leave here with your husband for more than 6 months you are able to file at the U.S Embassy in Lebanon and get the correct paperwork that's needed and i heard this process goes by pretty good. I've been living with my husband since April but i filed from the U.S. Just make sure you have every proof you can get about ur marriage and also make sure u have all the paper work... Good Luck!

Hi im not in ap any longer.we were denied at embasseyy in sweden. my fiancee had to return to iraqin dec 2009.and fled to lebanon in nov. 2010. i will go there in march for us to marry and refile. good luck on your ap there. im hoping we have alittle good luck in lebanon. we havent had much luck so far. have either of you travel there? my fiancee is in beruit. i will fly over for a month in march. I have never been and am excited. do either of you know about marrying there?

  7. just wanted to check in with all of you on ap and those of you who finally got your loved one home ...congratulations...since appying in aug. 2009 our case was denied at the embassey and returned (129f).I guess in march i will fly to lebanon to be married and try to refile. This has been a long learning process and we still have many months to go. Our jouney has been a long one but in this journey we have learned to lean on each other and take things day at a time. we will be together in time. each day passes ,is one more i lose with the one i love . but i have come to believe that god has set us on this path and we must travel it and endure to be together. each step is not one day lost but one day closer to the day we will be home together at last. this has not torn us apart but brought us closer as a couple and made our love stronger. If i live my whole life running between to countrys to be with this man i love so much ,i will count each day a blessing i had with him. good luck to you all. i pray each of you find your happiness....

  8. My case is in Admin process in Islamabad for k1 visa from last 12 months, 2 weeks ago i called Islamabad embassy lady astonished me by saying that we know through our resources that you did marry but not engagement, and we are sending your case back to U.S, file marriage visa again.

    I did aruge with her and then i hang up the phone.

    Next day my fiancée called department of states and they repeat the same thing that we have issue you letter and it will arrive in next week.

    Its being 2 week 2nd week almost getting finish and no letter me and my fiancee did conference calling to state departed and asked about the case status they replied our case is still in Admin process, they making us crazy some times they say denying your case some times they say still in admin process.

    I am soo saaad :(

    I am sorry that this has happened to you.I think sometimes they play games with our minds. Hang in there friend.I will keep you in my prayers.

  9. This is so weard. As of now we are still in ap as far as the consulate and the dos says. Even though they sent my fiancee a denial letter ,our case has never been sent back. They have decided to take another look at our case at the consulate or so it seems. Hopefully we will get good news this time. They want to reinterview Alen but he is in Iraq so hopefully they will sent our case there .PLease keep us in your prayers as we continue to pray for each of you on your journey.

  10. Looks like CSC may be changing...Here's the exact info from CSC that my Senator's office received:

    "9/9/2010

    I just received the above file and forwarded it to our adjudications unit for review. I will send you an update when the review is complete. Thank you...."

    Then I received an email that my case was updated with USCIS:

    We reopened this I129F PETITION FOR FIANCE(E) on September 13, 2010, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    Has anyone else received anything like this? For more info on our csae see below. Hope everyone is having a smooth journey. I believe it is also important to note my Senator's office involvement has been very strong in our case. Its seems like not so many are. I think that may make a huge difference also.

    MONICA,I LIKE YOU FIND THIS CONFUSING. We my fiance was sent a letter from the consulate sayin we were denied and our case would be sent back. we emailed a request that a senoir officer review our case before it was sent back . As of june our case was denied and has never been sent back . uscis still says it isunder ap. And the consulate doesnt respond to our emails. I have no idea how long the consulate can sit on it before they send it back.we got our notice of denial in may saying we had one year to respond. I have no idea what to do. Should we refile or what our case has been . I have no idea if they will send it back or what.

  11. Years months days anyway you say it or write it we had a very long timely journey but I am happy to report that on August 30 my husbands visa was issued and he received it today. Im still in shock. So to all that are experiencing problems hang in there it might take time but hopefully the wait will not be in vain. Thanks to all for your support

Hey Bridget and yes you are still on AP until you submit your evidence and / or file your appeal and the case is processed or closed I know you wont give up and you will get through this its just a big hurdle that takes time to jump over it but you will. I got an email from someone else today and their case was reaffirmed so hang it there.

    And no new news for us as usual the Ukraine Embassy was closed tuesday another holiday and they will be closed friday so I see nothing changing for us in the near future LOL and then they will be closed for labor day

    Well seems rhe embassey really email me back. I was so surprised. They said would it be possible for Alen to come to another interview with the consulate. I told them he could reinterview in Baghdad or they could speak with him over the phone. That he wasnt in Sweden but had to return to Iraq. No anser as of yet but seems they are relooking at our case. Fingers are crossed...

  13. Just came in to check on everyone. I see not many off AP yet. I am praying for each of you still. Our case has not been returned as of yet. I have requested a senoir officer or the consulate review it and allow us to send whatever evidence we might have to the contrary. The dos still says we are on ap. hahaha ,after almost two most since we get a letter stating we are denied. Hopefully the consulate will review our case.

    To all the good people on VJ Im very sad to say I dont have good news. I feel like Im sinking down into a dark pool of water but just to let you know Im not exactly drowning yet. My husband went to the Embassy with all the requested papers and photos. He was interviewed again like it was the first time the interviewer didnt realize this was a reaffirmed case. At any rate she asked for a signed I-864 in blue ink by me. Now I have to send him this piece of paper by FEDex at the cost of $157.00 and he has to ride a train for 10 hours to put this paper in a drop box at the Embassy. The sad thing is we all know they have the signed I-864. So now I am wondering as always Whatznext. However after I got this piece of info I called DOS to see what they said. She said he had his interview so what exactly do you want to know. I explained the I-864 she sad she understood my point that they have to have it but that is the info the Embassy is requesting at this time. It disgusting to think we have such incompetent people working at the Embassy. Anyway bottom line is no visa yet

    awwwwww im so sorry . the good news is maybe they will issue his visa as soon as they get this info.i know it is upsetting but dont give up hope. im tryin my best not to but im at a loss for what to do .good luck....

  15. Well I'm not whatznext but my fiance got this email when he got home, from his senator:

    "Dear Mr. XXXXXX,

    Thank you for contacting my office with your matter. I have contacted the United States Embassy in Montreal on your behalf, to which I received the response, "I'm following up with great news that the admin processing has been completed on this case and Ms. XXXXXX is being issued her K-1 visa." I hope this information will be of help to you.

    If I can be of further assistance to you, please do not hesitate to contact my office again."

    Soooo stoked.. after 14 weeks.. I can't wait til I have the visa in hand.. so sure something else is gonna go wrong or there was some mistake by the senator :wacko: would be great to have it on Friday though since we are already heading towards my fiance's on sunday for a family thing (in canada though).

    Seems like a good week, hope it is one for whatznext too!

  16. I hope some of you have good news. I have been really busy with my business and soooo sad. I have no clue what to do or where to turn. Our lawyer said this is beyond his scope of practice,blablabla...I dont know if we even have any options. This seems to be a rare instance i cant find any other cases that are simular. If anyone knows of someone who might cna help or hears of a simular case please let me know. Good luck to you all and i hope your pain is over soon and you are reunited with the one you love.

  17. I never had any luck with Chris but can you imagine having to listen to people like us all day..... desperate and hanging on to every little word of hope they say LOL they have the power to make or ruin or day/week

    Yeah im sure it sucks to listen to us whine.My lawyers sent me an email asking me to send him a email as to why they might think he has suspected of terriorist activities. wth i guess they remember nothing of my panicked calls after they questioned us at our interview about someone calling and threatening the embassey.why the heck would Alen threaten the embassey of the country he is tryin to immigrate to.im just sick to my stomach.

I have cussed and fussed and LOL here I sit at least now you know you will have some action. I hope this ends your AP quickly. I think I told you a long time ago not in this exact word but you are spunky I like your energy. Like Melody you will make it happen.

  19. Bridget did you get a copy of the letter? Did you call the Embassy to see what they have to say The Embassy didn't even have to give the reason and if they will not discuss it with you there is nothing to do except wait and see what USCIS says. I know how upset you are. But just try and calm down until you know what you are up against. I went 10 months with out even a small idea of why our case was sent back. You should have read some of the post and reason that were given to me from our very own VJ members and I must say they were not very supportive but we are here to be with you and hope to help you through this.

    I know it just so sucks. I really use to believe in my government ha...What happened to not guilty til proven. guess that only counts if ur not trying to immigrate. Im just so sad. I miss him so much but we are not giving up. Please pray for Alen and i we are just both so heart broken.

I called the Delhi Embassy this morning to check on my Hubby's visa... and the Nice AMazing Sweet Helpful Awesome Man told me that his visa was issued July 29th :D I am sooooooooo happy I am not even thinking straight right now... Just wanted to let everyone know that might have been following my outrageous postings.. I couldnt have done it without each and everyone of you... I really appreciate being able to have friends that are going through the same thing... I love you guys!!! I am praying that each and everyone of you get out of this AP hell ASAP... noone will know the kind of hell it is until they experience it first hand.

    ps dont worry I am not going to go anywhere I will still try to keep my peeps intertained :dance::dance::dance:

    (I) has engaged in a terrorist activity,

    (II) a consular officer or the Attorney General knows, or has reasonable ground to believe, is engaged in or is likely to engage after entry in any terrorist activity (as defined in clause (iii)),

    (III) has, under circumstances indicating an intention to cause death or serious bodily harm, incited terrorist activity,

    (IV) is a representative (as defined in clause (iv)) of a foreign terrorist organization, as designated by the Secretary under section 219,

    (V) is a member of a foreign terrorist organization, as designated by the Secretary under section 219, which the alien knows or should have known is a terrorist organization,

    is inadmissible. An alien who is an officer, official, representative, or spokesman of the Palestine Liberation Organization is considered, for purposes of this Act, to be engaged in a terrorist activity.

    (ii) Terrorist activity defined.-As used in this Act, the term "terrorist activity" means any activity which is unlawful under the laws of the place where it is committed (or which, if committed in the United States, would be unlawful under the laws of the United States or any State) and which involves any of the following:

    (I) The highjacking or sabotage of any conveyance (including an aircraft, vessel, or vehicle).

    (II) The seizing or detaining, and threatening to kill, injure, or continue to detain, another individual in order to compel a third person (including a governmental organization) to do or abstain from doing any act as an explicit or implicit condition for the release of the individual seized or detained.

    (III) A violent attack upon an internationally protected person (as defined in section 1116(b)(4) of title 18, United States Code) or upon the liberty of such a person.

    (IV) An assassination.

    (V) The use of any-

    (a) biological agent, chemical agent, or nuclear weapon or device, or

    (b) explosive or firearm (other than for mere personal monetary gain), with intent to endanger, directly or indirectly, the safety of one or more individuals or to cause substantial damage to property.

    (VI) A threat, attempt, or conspiracy to do any of the foregoing.

    (iii) Engage in terrorist activity defined.-As used in this Act, the term "engage in terrorist activity" means to commit, in an individual capacity or as a member of an organization, an act of terrorist activity or an act which the actor knows, or reasonably should know, affords material support to any individual, organization, or government in conducting a terrorist activity at any time, including any of the following acts:

    (I) The preparation or planning of a terrorist activity.

    (II) The gathering of information on potential targets for terrorist activity.

    (III) The providing of any type of material support, including a safe house, transportation, communications, funds, false documentation or
    identification, weapons, explosives, or training, to any individual the actor knows or has reason to believe has committed or plans to commit a terrorist activity.

    (IV) The soliciting of funds or other things of value for terrorist activity or for any terrorist organization.

    (V) The solicitation of any individual for membership in a terrorist organization, terrorist government, or to engage in a terrorist activity.

    (iv) Representative defined.-As used in this paragraph, the term 'representative' includes an officer, official, or spokesman of an organization, and any person who directs, counsels, commands, or induces an organization or its members to engage in terrorist activity.

    When they did thier namechecks or background checks he came up in a big way IMO... whether they are right or wrong in thier decision of terrorist ties it will take a great deal of evidence/legal skills to get through this hurdle.. it will have to be addressed to ever get him a visa... when they send the case back to USCIS this must be addressed.... I am so sorry to see that this is what they came up with.. best of luck... and I am hoping you made a typo in your post and it was not 212 a3b

    No i didnt post wrong. It is that. But no he has never even had a speeding ticket. He is christain and has never been in trouble ever. But if you read our interview info 3 weeks before our interview the embassey had a call from someone threating them. Alen was the only Iraqi applying at the time. He was questioned by the police as was everyone else whom they could find whom had called the embassey that day. he let them take his cell and examine hes numbers and calls on it. He was never arrested they told he was free to go and they knew it wasnt him it didnt make since for him to threaten the embassey he was tryin to imigrate thru. They also gave him his phone back. omg it makes me so sad that people can just make up there mind someone is bad because of his origin or the color of his skin.im so sad

  22. Yes they say AP depending on who you talk to some people will say the case was returned for additional processing call USCIS but we know that is useless. Until you receive the letter from USCIS it is still under going AP. AP is a term they use loosely
