Yes this is for K-1 fiance visa.
Correction: this is for adjustment of status from a K-1 fiance visa. The green card isn't automatic. After the beneficiary enters on the K-1 visa and the two of you get married, you have to file I-485 to adjust status from K-1 nonimmigrant fiance to conditional permanent resident (2-year green card). That's why I asked about the I-485 filing date and NOA1 information—you don't just go straight from K-1 visa to biometrics.

You're missing some items on your timeline. When did you file the I-485, and when did you get NOA1? Did your NOA1 state which USCIS office would be processing the adjustment of status?

You may also want to call the Consulate that issued you the k1 visa. Some ppl have been successful at getting the consulate to re issue the k1 as long as they were not married yet. Also it is only valid for the original length when it was first issued.
Another good suggestion. I've heard of this being done successfully in the past.

According to the IRS "Order a Transcript" page, the correct phone number to call is 1-800-908-9946. If you do manage to get a hold of a person, you should be able to get faxed transcripts within an hour.
Just FYI, the reason they prefer transcripts is because it proves that the return was filed with the IRS.

First, condolences for your loss.
Next, make an InfoPass appointment at your closest USCIS office. You'll need to explain your situation and request advance parole (permission to re-enter the United States) because regardless of whether your I-94 is unexpired, the K-1 visa is good for a single entry into the United States. If you leave without getting advance parole first you stand a significant chance of being denied entry and having to go through the entire K-1 process again (or else having to get married in the Philippines and apply for a CR-1).
I've heard of people in similar situations getting lucky and being readmitted on the strength of the used K-1 visa and the unexpired I-94; don't risk it. Make an InfoPass appointment, explain your situation, request advance parole, and make sure you'll be able to come back after you've said your goodbyes.

Oh no!
Looking at your list, we sent many of the same things as you: deed showing joint ownership of our house, joint bank statements, joint tax return transcripts for 2009 and 2010. (Incidentally, transcripts are always better than copies of the returns you sent because the transcripts prove you filed. You can get them in about a week if you order them through the IRS website.)
Besides those, we also sent our daughter's birth and baptismal certificates, a copy of my 401(k) beneficiary designation form designating Elisha as my beneficiary, a health insurance statement showing Elisha and our daughter as covered dependents on my policy, a copy of our auto insurance policy info showing both our names as covered drivers on the policy, copies of our family plan cellular bill with both our names on it, a copy of our confirmation from our first anniversary vacation, and a bunch of photos showing the two (later three) of us together. They approved Elisha without an interview (card production ordered today) based on that evidence, so I would think if you have any of the above they couldn't hurt.

RFE received today
I sent in what we have - the mortgage for our house, joint; joint bank accounts, tax returns with his name on the return, but he wasn't filing as he had no income (didn't work for a year and a half).
I'm not really sure what else to send them. We don't have much more than that. We have another year of tax returns, another year of bank statements, another year of mortgage payments.....
Any suggestions??
For the list the RFE was dated October 12.

The samples of I-129F say (ONLY complete for Naturalization Certificate). It doesn't make sense to me that I wouldn't add the number of the certificate, date & place it was issued since I was born in the U.S. Is it wrong to include this information as a person born in the U.S.?
As a natural-born US citizen, you don't have a Certificate of Naturalization or Certificate of Citizenship. Therefore, you don't complete that section. You derived your U.S. citizenship by birth in the US. You check that box, provide your proof of citizenship (copy of birth certificate or passport), and you're done.

I put mine together like a timeline story with lots of dates. I was told they would ask alot of questions from it at the interview.
The timeline is very important for the visa application and interview at HCMC, not so much for USCIS.

Both my wife's employer and mine use ADP for their payroll processing. Neither her direct deposit "pay stubs" nor mine contain the employer's logo. This is very common. Won't be a problem.

This is a common misconception. U.S. military bases abroad are NOT U.S. soil. Under Status of Forces Agreements (SOFA) they are exempt from the jurisdiction of the host countries to varying degrees, but they remain the sovereign territory of the host nation. If you don't have a valid foreign passport, USCIS will affix the temporary I-551 stamp to a blank I-94 along with a passport-style photo of the bearer to serve as a temporary green card.

This doesn't quite make sense. "reason given was for Immigration Purpose" - of course, the K-1 is for immigration purpose.
Now, if they denied because they suspect a sham relationship for immigration purpose... then we'd be getting somewhere.

It's been established that the DS-230 is not required for K-1 applicants in Manila. Other consulates differ. Seoul required it for our case, and apparently the consulate where the OP will interview requires it too. Please don't make blanket statements like "No need for ds 230" when you can't possibly know whether that statement is true in 100 percent of K-1 cases at 100 percent of consulates.

He's definitely going to need a waiver, and you definitely don't want to try to handle that on your own. Get a good lawyer. Laurel Scott specializes in waivers, and she's very highly regarded for her work in that area.

When did the DS-230 become part of the K-1 process? Or is that something that is country specific?
I believe AMCON Manila is fairly unique in NOT requiring DS-230. Even though the K-1 is technically a non-immigrant visa, it's processed in almost all respects like an immigrant visa. As such, most embassies/consulates require DS-230 Part I as part of their Packet 3 paperwork.

Hello, I have some questions if anyone can help.
1. If the process is approved and the foreign fiance recieves the visa how long or what is the time period from which they get the visa to when they come to the united states?
The validity of the K-1 visa is six months from issue or the expiration date of the medical, whichever is sooner.
2. Regarding employment vertification of the foriegn spouse how long does it take so he can start working?The foreign fiance can obtain a Social Security Number within a few days of arrival. That does not authorize work, however. K-1s need an Employment Authorization Document (EAD). It's possible (but pointless) to obtain one before the wedding. Realistically, the foreign fiance won't be able to work until you've married and filed for adjustment of status with a concurrent EAD application. The EAD often arrives about a month before the GC, so figure 2-3 months after the AOS filing before he can work.
3. Regarding petitioner income do stocks count as income or must you be employed if there is no co sponser?Stocks are assets, not income. To make up any deficit between your income and the poverty guidelines, you need three times the amount in assets.
4. How long does it take to recieve the green card?From the time you file for adjustment of status (after you marry), 3-4 months is typical.

My fiancee will have interview somewhere in March. She downloaded "Latest" form DS-230 from USCIS (http://travel.state..../info_3194.html) website. However the form has expiration date 02/29/2012 on it. USCIS does not have the form with later expiration date. Any suggestions what to do in that case?
First, the DS-230 is a Department of State form. USCIS has nothing to do with it.
Second, the "expiration date" is of no concern to you. It's a bureaucratic matter between the Office of Management and Budget and the Department of State. As long as you use the most current version of the form provided by the agency, you're in the clear.

Okay, I'm confused. Your signature and your first post say you did biometrics on August 28th—same date as you filed the I-485?
I'm also confused by your statement that "we filled it out at the USCIS local office at St. Paul, MN." I-485 is not normally filed at a local office but by mail at the Chicago lockbox. From there it's transferred to a local office, which sends you NOA1 and a biometrics appointment notice.
Confusion aside, it's helpful that you stated that your local USCIS office is St. Paul, MN. According to the USCIS website, that office's current processing time for I-485 applications is 4 months. If you filed the I-485 on August 28, the same day as your biometrics (I still find this implausible, but I'm going on what you've stated), it hasn't even been two months yet. The National "Customer Service" Center (1-800-375-5283) won't put in a service request unless you're outside of the currently posted processing time. So... sit tight.
