    yesterday was my N400 interview I did file in 11/27/18 under the 90 day rule thru my wife (my wife will be 3 years citizen February 16 2019 ) now I been green card holder for over 3 years ,the officer did the test and I pass but he told me that he need to review my case and search the law and  will  send me the decision in mail I told him about the 90 days rule  he say that apply on the green card only AND MY WIFE SHOULD BE US CITIZEN FOR 3 YEARS WHEN I FILE MY N400 AND I MAIGHT NEED TO FILE AGINE and do it all over with new fee  now  when I file the petition my wife is 76 day shy of 3 years been us citizen   any body have any idea or know what should I do  

    any info will be apricated

    posting this question for friend I told him about this web sit

    he had his AOS interview based on marriage on 5/26 the interview last about 20 Minuit the IO told him he will recommend approval but he need more document 2 day later he receive RFE for marriage certificate and his attorney did send the RFE the 3ed day

    now its been more than 70 days and nothing no letter no decisions 2 weeks ago his attorney was at the immigration office for unrelated business and he sow the immigration officer the one he interview my friend so he ask him about his case and the officer told that he just submit the case to his supervisor and gave him his recommendation that all he heard about his case and he is frustrating and freeking out so is it bad that the case is with supervisor

    is mean he is getting decision soon if so how long tell he get something

    any answer will be highly appreciated

    it been while since I been to this form but I got question about the court process for my co-worker

    he is under removal proceeding but have NO COURT DATE yet (its in Cleveland) he have his i130 approved already thru his us wife his attorney file motion to get Master Calendar Hearing than file for adjustment of status or Individual Hearing

    the question is he file the motion last august and still no court date yet now the last time he ask his attorney he keep saying just wait don't trust his attorney than he say the judge was out of the country

    any body know how long take to get court date after failing the motion

    im preparing my brother i130 for his wife back home he is us citizen he gain Citizenship Through Naturalization my question is in i130 asking to fell out his Certificate Of Citizenship.number and he don't have it i think he lost it but he have his us passport so what should i do leave it blank or what and my 2nd question where should i send the petition since his wife back home and what doucement should i include with petition

    any help will be appreciated

  6. prima facie is when YOU addres all the requirement FOR NOW however some cases get approve with out prima facie detrmination and some cases get denind with prima facie been approved when you send your petition to VSC your cae will be assigned to an oficcer and that when the IO analyses your case and he will detrment wither the case is urgent (abuse wis)or if he need to SEND RFE if your evidenc is sufficient he will order the security clearance about the petitioner and that will take about 3 month but keep in mind that the officer have the right to hold your petition up to 36 month with no decision its not often but it will happend with some people

  7. so your are telling me that being blackmailed is not an abuse ....she holds that i 30 threat over my head to make me do whatever she wants to let me tell you what happened last month my sister came to USA from canada so she came to visit me at my house we are muslims and my sister wear hijab .. my wife did not even let her in the house you know why .. just because she doesn't like the way my sister was dressed up .. is it normal to humiliate somebody over their religion and culture .. this marriage is so over i can not be with this woman any more .. if my vawa approved or not if i get deported or not i am over with this thing.

    sorry to hear that i been thier and i know but with out hard evidenc such as police report OR self-petitioner's affidavit is perhaps one of the most important documents that YOU will submit with YOUR self-petition. The affidavit, written in the petition IN your own words, describes your "story" in detail, including information addressing each of the eligibility requirements. Often, due to the dynamics of the abusive relationship, the VAWA self-petitioner may be unable to obtain all documents necessary to support each of the requirements. In that case, the affidavit serves to fill in for some of the missing documentation, providing an explanation as to efforts made to obtain it, why the efforts were not successful, and why the applicant believes she satisfied the requirements for a particular element. For example, explain in your affidavit. The affidavit is also one of the first documents that adjudicators turn to when evaluating the self-petition in order to get an overview of the case.

    Besides the affidavit, other documents which the VAWA self-petitioner may provide to satisfy each of the eligibility requirements include:

    •Abuser's Status

    o Birth Certificate

    o Passport

    o Green Card

    o Marriage License Application

    o Petitioner may also request that USCIS search its records to confirm the status of the abuser; however, ultimately, the burden of proving the abuser's status remain on the VAWA self-petitioner

    •Good-faith marriage

    o Wedding or honeymoon photographs

    o Birth certificates of children

    o Marriage license

    o Joint tax returns, insurance policies, or bank accounts

    o Cards, letters from abuser

    o Letters or affidavits from friends or relatives with personal knowledge of the relationship

    •Battery or extreme cruelty

    o Orders of protection

    o Police reports (note, however, that the self-petitioner need not have called police to be eligible for VAWA relief)

    o Criminal court records, including complaints or arrest records

    o Medical records

    o Photographs of bruises, scars, or other injuries

    o Statements from shelter workers and domestic violence advocates

    o Letters from friends, family, or witnesses to the abuse

    •Joint residence

    o Apartment lease with both names included on it

    o Joint bank account statements

    o Joint tax returns

    o Joint insurance policies

    o Letters addressed to both self-petitioner and abuser

    o Letter or affidavit from landlord

    •Good moral character

    o Police clearance letter

    o If arrests and/or convictions, certified dispositions, as well as detailed explanation by self-petitioner of circumstances surround arrest and/or conviction

  8. i have been married to a US citizen for last 5 months and we had been dating 1 year before we got married in the begining every thing was good but suddenly my wife's behaviour started to change towards me . she was diagnosed with ovary cancer just after we got married but she can not afford a treatment cz she was covered by her father's health insurance and she was excluded from it cz of her marriage to me .she started to blaming me for every thing she has been going through and started treating me badly cursing yelling at me calling me names infront of my family and friends. by that time we had already filled i 130 and 1 485 for me (i came to US on a student visa ). now the situation is that she has quit her job she makes me pay all the bills and rent plus i have to give her money for her perseonal expenses . if i dont she hold threat of withdrawing i 130 and get me deported since illegal immigration law has been passed in alabama (we located in montgomery AL) if she withdraw i 130 and just call the police i would be detained by them for illegal presence in the country. since its a crime to be an illegal immigrant in alabama ... i have been going through a lot of stress and anxiety i am badly stuck in an abusive relationship my friends can not come to my house if i go see them she keeps tabs one me and call all my freinds and inquire about me some times she turn into a an evil person .. i perseonally think she is suffering from a bipolar disorder . now a friend told me about vawa self petition can be my way out of this i contacted a lawyer she told me that i can file for vawa and get out of this abusive situation she told me if my friends can testify about her abusive behavioor towards me i am gonna be able to get a green card on my own ...here are my question... is this true ?..... isn't vawa is hard to get approved for men? .. dont you need medical reports and police reports to proof your case ? i dont have neither one of them since i have never been abused physically... am i gonna be able to make my case only on the basis of freinds testimoney and letter from my therapist? ..... please help me any suggestion any advice would be greast

    im with aztec 100% in order to file for vawa you need hard evidenc that you suffer abuse police reports statment from friend and its sound to me that you going to have to prove good faith marrige since you been married for 5 month if your wife been call you name or keep call you when you go out that what woman dos its not abouse im male and i got my green card throu vawa its not what you thing its hard

  9. I find that we live in a compeltely uneducated world as far as the terms Muslim and Islam are concerned. If people would truly educate themselves I think this world would be very different BUT instead we live in a world where people prefer to be fed information, wrong or misinformed, who cares they said it on the news so it MUST be true.

    They would go into stores and haggle over prices. They would also demand to see a male salesperson, would not deal with women in stores... some Somali students won't talk to female administrators... Somalis have isolated themselves from the rest of the community they know how to cheat the system and if you live in ohio or minnesota you know what im talking about they are very RUD and acting that we owlthem somthing i delt with lot of immigrant and i never seen any body act like th e somalian

It is so unfair that USCIS approve people who applied later, if it was a fair process it should be a first come first served but apparently there is just no standards for the process... it is like being waiting in line at the Bank for 3 hours and somebody comes in and goes directly to the counter!!!

    I am fine on waiting with patience until my time comes but what really makes me crazy is seeing people being approved in less than 30 or 60 days and then people like me having to wait 5+ months, I would really like USCIS to explain us, people who is paying them why the process is so unreliable!!

    Sorry for the rant but I just think that the way they process the applications is just all over the place.

    life its always unfair in genral but when its come to immigration its wors the system dont recognize the good from the bad

    i been in my job over 5 years now and i just find out that they dont need me any more because new management talking over . so i was thinking about filling Unemployment and i have immigration cas pending did that effect my case case in any way ? i never take any money from the goverment befor

  13. The Palestinian Authority proposed an unprecedented land swap to the Israeli government, offering to annex virtually all of the illegal Israeli settlements in East Jerusalem.

    Not only did the Israeli government offer no concessions in return, but – as The Palestine Papers now reveal – it responded with an even more aggressive land swap: Israeli prime minister Ehud Olmert wanted to annex more than 10% of the West Bank (including the major settlements in Ma’ale Adumim, Ariel and elsewhere), in exchange for sparsely-populated farmland along the Gaza Strip and the West Bank.

    The Israeli offer is documented in a Palestinian rendition of what’s colloquially called “the napkin map,” a rendering of which is revealed for the first time in The Palestine Papers.

    Olmert met in mid-2008 with Mahmoud Abbas and showed him a map of the proposed swaps. Abbas was not allowed to keep a copy of the map, and so the 73-year-old Palestinian president had to sketch a copy by hand on a napkin.

    Saeb Erekat, the chief Palestinian negotiator, described the Olmert-Abbas meeting in an interview with Al Jazeera earlier this year.

    He went with the President Peres and me and… actually sat outside discussing all issues. And then the president came out of that meeting 20 or 30 minutes, and we sat with the two presidents. And the offer wasn’t made at one meeting. This was three or four meetings actually, one showed him a map, Abu Mazen had given him a map, he showed him a map and Abu Mazen had to draw with his own hands.

    The Palestine Papers include two renditions of the napkin map, one showing Israel’s proposed swaps in the Jerusalem area, another showing all of Israel, the West Bank and Gaza. Israel would keep all of its major West Bank settlements – Ma’ale Adumim, Ariel, Kedumim and others – none of which were included in the Palestinian offers.

    Olmert also proposed a “safe passage” – a territorial link between the West Bank and Gaza – that would be under Palestinian control yet remain under Israeli sovereignty. A special road would connect Bethlehem with Ramallah, bypassing East Jerusalem.

    Olmert also proposed delaying any decision on the Haram al-Sharif: the issue would be negotiated between Israel and Palestine, and those talks would be overseen by a committee of the United States, Saudi Arabia, Jordan and Egypt.

    The two leaders met again on September 16, 2008. A set of talking points prepared by the NSU included a great deal of confusion about Olmert's offer; the memo urged Abbas to ask for a copy of the map, and raised a number of questions about the territory swaps.

    How do you see it addressing our interests, especially as Ariel, Maale Adumim, Givat Zeev, Har Homa and Efrat clearly prejudice contiguity, water aquifers, and the viability of Palestine?

    How do you see the specific areas that you suggested to swap from Israel to Palestine addressing our interest of swapping territory equal in size and value?

    The NSU memo did not explicitly endorse or reject the Olmert offer; it did warn that continued settlement growth (particularly in East Jerusalem) would make any agreement "much more difficult."

    I dont know much about it, but for what I have read in older posts they usually don't approve EAD without the I 360 being approved. Good for you that they approved yours so fast

    you have to file i-765 concurrently with I-485 to get EAD approved IF YOU dont file i-485 than you have to wiat for vawa to be approve in order to get EAD approve

    ... Now, the I360 takes around 5 months (hoping for less!! :))) Hope the other members can help you out!! good luck!!

    yes VSC will process vawa cases in 5 month but desont mean that they get decision in 5 month every case has it unique sutiton

    well question i filed my Vawa petition concurrently with I-765 and I-485 on October 16 2010 .. I received prima facie and my employment card. But I have not receive any notice of my I-360. should i be worried ? i do not have an asttorney so any help is appreciated. Thanx :)

    the prima facie is notice of your I-360 and its look like every thing is in order and you address all requirement for vawa case for now. other wise they will send RFE befor issuing the prima facie and since your I-765 is already approved that fast your case should go smoooth

  16. Hey guys, my case was denied yesterday. I'm sooo depressed. I waited for a full year and this is the result. Is there anyone here who got denied and appealed and got through???? I'm waiting for my lawyer to get the letter. I think it was denied because me and my husband didn't have a lot of assets together. All I had was the cable bill. Any advice????? Thank you.

    oh god sorry to hear that im relly scard now we send RFE AT THE SAME WEEK and no decsision by law the have to send you NOID (Notices of Intent to Deny )AND gave you one mor chance to sumbit mor evidence so what the reson for the denied

  17. After almost 3 years got my approval.. yes , thanks God!

    -Got an RFE for good faith & good moral

    -I wrote a letter to our congressman

    -called the USCIS number to check my case status, it was way beyond the time frame.

    -wrote the Vermont Service center to expedite my case.. w/ my letter of request of prima facie extension.

    I had 7 Prima Facie since then

    I responded My RFE by myself and requested prima facie extension by myself i hired a lawyer to represent me at the court because im currently on proceedings.

    My lawyer used to charge me $500 to extend my prima facie thats why i try to did it myself

    He was also charging me &2500 to prepare my RFE I dont have cash so i did it myself..

    God helps prayers help :)

    what should i expect next i have an appointment with my lawyer iam afraid he's going to charge me arm and a leg again..

  18. I have a question guys, in your experience how many months before they gonna request for further evidence? currently i just receive noa and prima facie

    in general USCIS will issue RFE in the first 10 month but me and other tow member her got RFE after 17 month .USCIS adjudication officer uses RFEs to request additional information on the pending application under any of the following circumstances: (1) Something is not clear in a case that you have filed; (2) If there is a document missing; (3) the officer needs updated information on your case; (4) the RFE notice was issued by mistake or in error; (5) the RFE letter was issued for any other reasons the adjudication officer likes.

  19. I sent an email to VSC to inquire about my I360 Petition. They responded saying that my I360 was approved on April 2004 and should schedule an appointment with infopass to get more information on how to file the I485. I 2004 i was in removal proceedings and the judge granted me withholding of removal. I have never received an approval from VSC.Is normal and should I make the appointment to talk to an immigration officer.
