If you are filing jointly but live separately they may not approve your ROC until a final decision is made. I would try to decide for one or the other. If you can't make it work, then you need to divorce and file by yourself. They will certainly ask why you live separately and it's ok to say that you do but like I said they may wait with their decision until you two make one.

Yes I meant passport style pics. I know about the evidence pictures.

When I submitted I thought I remember all sorts of instructions - tabs on the bottom, no this or that.

So here I am again trying to find info on the I-751 packet.

I currently have regular tabs for the different sections of evidence with colored cover sheets.

Can I staple pages together or use paperclips?

Or leave them all loose and use one big binderclip?

Also - no pictures required this time, correct? I didnt see anything in the instructions.

Should I staple the check to the cover letter?

Also, should I send this regular mail?

Hi all,

I am completing my I-751 and noticed that it expires tomorrow. My packet is ready and I am planning to send it out tomorrow or Friday. Now I wonder - should I wait an extra day since the form seems to expire tomorrow. They may reject my application because I did not use the correct version of the form.

What do you think?

I think the house is key. During my interview, the officer harped heavily on the house. He wanted to see that we are both on it. We are but I did not have the actual deed with me, something I did not realize until he questioned the paper I thought was the deed.

I would add her to the house. It should be a simple transaction at the county office.

I am celebrating 4 weeks of useless waiting.

Its so hard though when you read all these success stories of people being approved right there at the interview, with stamp and letter and everything within a week.

So yes, I am looking at my work permit that I am holding in my hand, and I am applying for jobs, green card or no green card.

Life goes on. And if I never get it, I'll move to Mexico ...

Yup! I think I was harder because I had not come across a similar situation recently and all I could do was fill my head with a lot of questions. Now that I know it is not that uncommon, although not pleasant at all, I am just going to try to keep busy with other things. I start a new job nest week and have exams at school, with that and family life, that should help keep my mind off this whole thing for a little bit and hopefully I will get a nice surprise

So question - did you have any trouble getting a job with the EAD card? I mean, its not the real GC and its only valid one year?

Its because I already started interviewing as well and have one opportunity coming closer to me than I thought. I just assumed that I would have my GC by now so that is why I started the job search. The risk will be for me to leave my job I have had for 8 years and take a new one without the GC. I am not sure anymore if its safe to assume I will have my GC within a year, and then - will employers accept the EAD card?

In your case, you should at least give it another 2 weeks. I think 3 weeks is a general average time to wait. By then your card or at least the approval letter should be made and in the mail.

I never showed my passport either. The first thing he asked was for my I-94 card. He took it and wrote with RED pen on it. I am upset that I did not question him on that. He should have explained his actions. He did not say anything. At least your IO explained some things in detail.

I wouldn't worry too much. If they wanted the deed of the house they would've sent you a letter requesting that piece of evidence or even the IO would've mentioned something about it. It's very frustrating to wait not knowing the outcome but that doesn't mean you are denied. Trust me, I went through this kind of stress for 7 months after the interview and finally everything worked out. I had to involve a local senator though because I was out of normal processing times.

I see - your journey was almost a year. What a bummer. Do you have a threat somewhere describing the interview/post-interview situation?

We have had a very similar experience, although ours has been for a lot longer than yours.

We had our interview in August last year, the IO said pretty much the same but he kept telling us that we should be recieving the GC in 5-6 weeks "if all is OK", he was also running behind that day and was feeling under the weather.

6 weeks to the day we got an RFE for proof of continuing relationship, we sent more joint bills, affidavits from friends and family.

Still no response so we called uscis in Jan and spoke to a 2nd tier person, they submitted a service request which he said meant that we would either recieve a decision within 2 weeks or an explanation about when we would recieve a decision. 3 weeks later we got a letter stating that our case required further processing and that if we didn't hear anything within 6 months then we are to phone again....

Oh, and no updates at all on uscis internet site since Sept, not even to say we had or that they recieved the RFE.

My goodness, this is horrible. I feel very sorry for you. How can they let you wait for so long without a notification or anything. You need to engage a lawyer or call a congressman. I may be in a similar boat soon, but waiting for that long is not OK. You filed a valid application and have sufficient evidence, they should not treat you that way. What is this waiting suppossed to do for them? You have to remove conditions anyway after 2 years, so why doubt the relationship now? Please keep me posted, I just don't think that is right how your case is being handled.

This is interesting. When I posted my experience, not many responded. Now I see that so many others go through similar waiting times.

Its been 3 nerve-wrecking weeks since my intereview. My officer did not say anything. He did not even ask any personal questions. I called last week and was told the same thing - to wait 30 days. But then someone recommended to do the Infopass, which I did last Friday. There I was told that a decision has not yet been made about my case. I don't know what this means. My officer also leaved through the papers when we interviewed as if it was the first time that he saw my application. He did not say so, but there were long moments of silence where he would just read and jump through different sections and ask random things that he just read about. At the infopass I asked when I can inquire again, and was told 90 days as well, but I don't think its a rule. The infopass is a service they offer and I don't think that there are limitations to using that service. There is simply a guy that looks in the computer and tells you the status. Its not a big deal. I think I could go back there every week if I wanted to. The thing is that the infopass does not do anything. They don't take any action by you showing up there. At least I don't think so.Its simply to receive a status update.I don't know whats next. I decided to wait a little longer and then I don't know what. Involve an attorney?

Well, there was one thing: He wanted to see the deed of the house with both of our names on it. I had submitted that already in my application and only brought an exact copy of it, so when he asked me to see it again, I noticed that it was not really a deed. I am not sure what the paper was because it had our appartment address on it. So basically I had nothing really to show that the house is in our name. But I did have copies of mortgage applications where we both signed and were approved + other things such as bills in our name, health and car insurance cards etc. The appartment lease was also there were we lived previously.

He had all that in the application but asked for it anyway again. So I gave it to him. The only thing was the house deal that I did not have anything. But he also did not ask any questions, like how we met, or anything. If he had had any doubt about the validity of our marriage, then why did he not ask more questions? I even gave him a certified copy of the marriage license since it stated in the paperwork to bring one. He looked at me rather strangely when I gave it to him and then he handed it back to me. Like I said earlier, the guy was strange, the entire interview was strange. I guess i am feeling the consequences now. Maybe he did have doubts, but then why not initiate a conversation and give as us a chance to talk? We sat there quiet for most of the time as he leaved through the application.

The officer said 90 days until I can inquire again. I think I have to just wait now. Whats else can I do? Maybe they are backed up from the snow and have too many things to process. I just assumed that the application would be reviewed prior to the interview and that the interview only serves as a last checkpoint for clarification on any open issues. What else would the officer still have to check now? Could they ask for a second interview?

Just got back from Infopass appointment. I was told that my case is still with the officer and that a decision has not been made.

What an answer. I am back to waiting. I asked what that means, and he would not tell me. I mean - could I be denied still? I really don't understand why my case is being so complicated. I have been in this country fo so long, always in status, have a solid relationship thats goes back many years and now marriage. I don't see any holes in my application process. The officer did not ask for any further information either. So what is the problem?

The only other explanantion I can think of is that Texas is backed up because of the snow days in February. Everything was closed for almost an entire week and maybe that put them behind with everything.

Do an infopass appointment as soon as possible. Also, don't listen to those USCIS representatives, sometimes they don't know what they are talking about. I didn't have my passport stamped and I didn't have my I-94 taken and I did get approved. Don't worry about it, but follow up by scheduling that infopass.

Interesting, we are in the same situation then.

I really don't like this. Just as we as applicants have to follow certain procedures, such as filling out the proper forms, paying our fees, etc, they too should follow standard procedures. The process should not be different from applicant to applicant. It leaves people in limbo. We paid for a service and we followed the rules, so we should expect the same treatment in return. Each interview, once it went well, should be conculded the same way whether you are in Texas or in San Francisco. There should be a form you sign that shows that you successfully completed the interview and will receive the card within a certain amoutn of time. I walked out of there with nothing in my hand. It was so awkward. My online status is not updated. Thats a another thing that bugs me. Why have a system in place if its not being properly utilized? Why are officers not held to certain standards and are required to compelete their functions as they should? At elast after my phone call yesterday, they should get in touch with the Texas service center to at least ensure my online status is updated. Thats a service they offer to us as customers. Its like when you go to FedEx to track a package online. How would customers feel if only certain people recieve correct tracking info and the others receive no info at all?

All this comes down to poor customer service.

I called them today and need to wait until 30 days are over ... another 2 weeks, until they take any action. Hopefully my card arrives in the meantime. PLEASEEEEEEEEEEE!

I already have job interviews lined up. You guys can't imagine ... I don't want to whine but I have worked for the same company for 8 years now. Only one promotion, hardly any increases, completely underpaid. I started looking for jobs after my interview and have already 2 compamies interested to pay me 30% more of what I make. Its the greatest feeling in the world not to be tied to one company anymore but to be able to go out there and search Monster like any normal person. Thats why I am so impatient and so worried that now, that I am so close to my card, things get complicated.

Oh, and the lady on the phone asked me something strange ... whether or not my passport got stamped during the interview. I said no, but that the officer kept my I-94 card. I asked if he should have stamped it. And she said yes, that if I was approved, he should have stamped the passport. Isn't that strange? That did not happen.
