  1. I’m a Naturalized US Citizen. My sister and her family entered on a B1/B2 Visa 3 years ago and over stayed. 
    Are there any provisions for them to gain some temporary rights during their wait for their residency after they apply?
    They entered legally, are here and are waiting for their legal status to be changed. If they could have some benefit during their wait (which will be years) that would be great.

  2. Hi Everyone,

    My wife and I are planning on moving forward with applying for the I-130 here in Ecuador.

    I have been residing in Ecuador now for 1 1/2 years. But we took a trip to the US together in July and went to Peru for 2 days in Sept. In total, I was out of Ecuador for less than 65 days.

    My question: Does this time "break up" my continues 6 months living in Ecuador? I have the paperwork to show that I have been residing here for more than 6 months, but not physically been inside the borders of Ecuador for 6 months.

    Any info???

  3. Hello Everyone,

    My wife and I are ready to begin the process for her to come to the US as a Resident. Im learning, little by little, the difference between a IR-1 and a CR-1. I understand that an IR-1 is good for 10 years and a CR-1 is good for just 2.

    Now here is my question:

    Because my wife is married to me, a US Citizen, she would need to wait for 3 year before she can apply for Citizenship.

    Does the 2 years with a CR-1 count for 2 of these 3 years, or is it 3 years with an IR-1 visa only and ? Is living in the US as a Non Permanent Resident (CR-1) considered part of the time required to later apply for citizenship?

    So my wife and I are ready to begin the steps to apply DCF here in Ecuador. We were married in April 2009. My goal is to begin the process now and have it done by April 2011, being married for 2 years. That way, if I understand this, it is permanent. If not, it would be Non-Permanent, right?

    Our goal is to get her citizenship after 3 years. If we apply now (less than 2 years married) and we have the interview and everything is approved BEFORE our 2 year anniversary but we do not enter the US for the first time until AFTER our 2 year anniversary, will my wife be issued a permanent or non permanent visa?

  5. Every scenerio is different, so its so difficult to find exactly what im looking for. So please have patients on me.

    Im a US Citizen. I was married to an Ecuadorian in Ecuador where we have lived for 1 year.

    My wife has her B1/B2 Tourist Visa, bbut circumstances have changed and we want to begin the process for her Green Card and possibly Citizenship.

    Heres where I need help:

    1) Can we begin the process together in the US. We were planning a trip in June with my wife using her Tourist Visa. Is it better or quicker to begin the process right away or wait until we are both together in the US. That being the case, the tourist visa has a max time limit in the USA of 6 months. Is it typical for someone to obtain their Legal Permanant Residence in under 6 months?

    2) After the Green Card is obtained, its 3 years maintaining their residency in the US if they are married to a US Citizen. After that, they can apply to become a citizen?

  6. Hi. My name is Lee.

    Right now i am a newly wed for 4 months living in ecuador. we have a beautiful house, dont have to work and i really love it here. But the thing is, i want to visit my friends and family for a couple of months.

    I realize that we have an imm dept to keep people from living illigally and giving a visa that costs a coupkle of hundred dollars just for a visit is like a welcome invitation to live illigally there.

    But my question is, as a spouse of an american citizen, is there anything that can be done just for a visit??

    We went to the consulate to apply for a B2 and th interview lasted 2 min, literally. He said that because we were married for less than a year, the answer is no. He didnt bother to look at my Ecuadorian bank account, or the year lease on my appt or the certificate i have from the ecuadorian government that show i am getting my nationality to live here.

    Please help. Any info for just a visit??

    First I want to apologize if this question has already been answered. I looked, but since each situation is different, wasent 100% sure.

    So my wife and I got married April 3rd (sweet!). She is from Ecuador. She has already applied for a visitors visa while we were dating and was denied. So I left the US and we got married in Ecuador.

    Im in the process of applying for my recidency in Ecuador... We plan on living in Ecuador for a while. But since she was never able to meet friends and family in the US, Id like to do so very soon.

    But heres my question: How? What Visa?

    We are not immigrating. Just visiting. But she not visiting just as an Ecuadorian, she visiting as the Wife of an US citizen.

    Please help me with advice or suggestions.

    I will be getting married to an Ecuadorian next month. We will be living in Ecuador at first and plan on making some visits to the US in the near future with the long term plans of her becoming a resident of the US and to live here.

    Without starting the immigration process for her to become a resident of the US and have her just go with me to the US for a visit, what kind of Visa would I need to have the best chances? And any tips to improve my chances?

  9. Hi everyone! My name is Lee and I am totally new to visajourney. And what a crazy journey this has become!

    I went down for a visit to Cuenca, Ecuador in Sept 08. Needless to say, I am getting married to Diana, the most amazing woman Ive ever met, 17 Abril in Cuenca. Things are going GREAT, but it is def more complicated than if she lived around the corner from me here in the US. There are alot of knowledgeable people out there who have a TON of experience and id love some help. I apologize if this information is out there, but every situation is different, so i'd love some personal help. THANKS!

    1) I will be moving to Ecuador on 7 April, which is just about 1 month away. I have been told that I need to obtain a 12-9 to Ecuador and that going just on my passport would not be sufficient. Is that correct? Do I need to do anything special for this other than going to the Consulate in NYC with the correct documents?

    2) Our wedding date is 17 April. As a citizen from the US and marrying a Ecuadorian in Ecuador, do I need to do anything special? Do I need any special documents or forms? If so, can I take care of this here in US or is that something that must be done in Ecuador?

    3) I am going to become a resident of Ecuador after we get married. As the Spouse of an Ecuadorian, is this pretty much a guarantee that I will get my residency as long as I have the needed documents and sufficient money. Any surprises with this?

    4) We then will want to come back and visit the US fairly soon after the wedding. She only had an opportunity to meet my parents and I would like her to meet the rest of the family and know the US for a visit (maybe about 2-3 months?) If I am a resident and I show that this is not a marriage of convenience and that we have a house and I am a resident of Ecuador, do you think this will increase my chances of her getting a Visa to visit? Would this be a Spouse Visa? Any tips with that? Or is her getting residence in the US our only option?

    This site is amazing and I appreciate any info and the experience of others out there in my situation.
