  1. Some ASC offices do accept walk-ins, some don't. I mean much earlier than your scheduled App. date. Some ASC do take you in on the same day with your App. but might be different time. Everything depends on how busy they are.

    In brief, you can say Time & Day might be flexible depending on the particular ASC.

    Btw, RESCHEDULING ANY APPOINTMENT WITH USCIS OR CHANGING AN ADDRESS DURING AOS PROCEDURE ARE NOT ADVISABLE, THAT MESSES UP THEM BIG TIME !......

    They don't care because you have to suffer the consequences.

  2. You can easily get DL with a valid EAD. Don't freak out, because your husband has been adjusting from K1.

    Even without an EAD, you can easily add your husband to your bank account by showing his passport & your marriage certificate too. I do not understand what the problems are in your state.

    I went to an interview last week, first document she (IO) asked from us, Joint Tax Return. Along with this I have showed Court Marriage Certificate, Church Marriage Certificate, Joint Health Insurance, Joint Bank Account & Miscellaneous Pictures.

    You will be fine, don't worry about it. Interview is not what you think, it is not scary at all. It was like documents exchanging between us. She hasn't studied my file very well, so I was trying to help her out. She has also made a couple of mistakes that I have corrected her. My case hasn't been a straight-forward one or she is gong to RFE me that is why we haven't approved on the spot. I am sure she is going to ask our situation to a supervisor.

  3. You don't have to be nervous, just be yourself, act normal & answer the questions briefly.

    She basically asked following :

    How & When did we meet ? ( To both of us )

    Why did I do separate filing for I-130 & I485 ? ( To me )

    Did you know that he was out of status when you have met your husband ? ( To my wife )

    She asked all of the questions on Page 3 of 485 Application Form. ( To me )

    When did I enter the country ? ( To me )

    Do I have an extract of my birth certificate ? ( To me )

    She asked to see the passport. ( To me )

    She asked to see the document that my spouse is an American Citizen. ( To my wife )

    That is it. She hasn't asked so many questions actually. She has spent most of her time by taking notes.

    GOOD LUCK !.... on your interview. Just take it easy.

  4. We had our interview this afternoon at Mount Laurel, NJ. The officer was so serious & business mind. I can't say She is a friendly one. We haven't approved yet, the officer has asked my "Extract of Family Certificate", which I don't have. All the other documents I have produced, no problem. She even asked me If I had my I-130 Approval Letter with me. She did not have any copy of it !..... I gave the original copy & she photocopied it. She has looked at my wife's US Passport, her NJ License, my Passport, our Marriage Certificate (Both Civil & Church), our Joint Bank Account Statement, Our Health Insurance, the contract of Marriage Reception Salon & Pre-Cana Certificate etc.. I have offered her to see our Tax Return but she said She has seen it already.

    She has taken my two I-90's back. She did not ask about EAD & She has written on my passport "245 INA Pending at MTL" with the red pen with the date stamped on it.

    I think She is going to RFE me that "Extract of Family Certificate" along with the letter,

    I guess I will be approved later on. Let's wait & see.

    Now I can see my case on-line though & it says "PENDING".

Also, I only reported my change of address because I was told by IO, that it is very important to report change of address. I figured I was already approved, already go approval notice and welcome letter. Does it mean that card was sent back to USCIS or is just lost in the system? Can I check with Post Office to see if there is any mail there for me?

    First of all I want you to know that USCIS system is not a PERFECT. Even if you have changed your address, your new address does not appear & is not updated on every single application simultaneously !.......

    Which address have you received your approval & welcome letter ? Old or New address ?

    I know one thing for sure if you are approved on 05-14-09, you should be receiving your GC by now. If your GC was returned to USCIS due to "UNDELIVERABLE", then you are lucky because you do not have to pay $370, just fill out

    I-90 & mail it; you will get your GC in about two months but if it was sent & got lost at old or new address then you have to pay $370 if you want to see your GC.

    Read following carefully especially 2 "in red", exactly taken from USCIS I-90 form application.

    The fee for this application is $290.00.

    The fee for the biometrics is $80.00.

    You may submit one check or money order for both the

    application and biometrics fees, for a total of $370.00.

    Exceptions. There are some exceptions to having to pay the

    $290.00 application filing fee like follows:

    1. If you are filing only because the card issued to you was

    incorrect due to a USCIS administrative error. However,

    if the error was not caused by USCIS, both application and

    biometrics fees are required.

    2. If you are filing only because you never received your

    card. However, if the card was sent to the address

    provided and never returned to USCIS, your application

    will be rejected. You must file another Form I-90

    application and on the first page of the form under

    Application type., Number 2, Reason for application,

    check box a that states: My card was lost, stolen or

    destroyed. Include both application and biometrics fees

    with your form.

    I know it is so stupid logic & way of handling of the business but this is their way !.......

    They charge you $1,010 for AOS application fee, they don't want to pay $4-5 to mail your important document like your GC either with UPS or FEDEX, instead they mail it to you as a regular mail with USPS, it is not even registered, by paying only 38.2 cents !..... and then when it is lost, they say " it is lost & it is your fault, please cough me another $370 if you want to see your GC " this is unbelievable, but what are you going to do about it ? You can take them to the Federal Court, but it takes time ......

    This is the way it works with USCIS. When you change your address during AOS process, they do not update the address properly, hence they must have mailed your GC to the old address. I am very sure about it.

  7. When you apply for I-751 to remove the conditional status after 2 years, they usually don't call for the interview if they haven't called you for the initial interview. So, in your particular case, I don't think you will go for an interview of course if your marriage goes smoothly without any problems. Please be relax, it is over. Do not be paranoid about it. You are done, get over this & concentrate some other important things in your life.

  9. So I finally had my interview this morning and It actually went quite smooth.. The immigration officer told us he was going to approve the I-130 right away and that I will have to wait 30 to 60 days to get the phisical green card in my mail box. now here the question, since in august I am trying to go back to Italy for 3 weeks, and I by the way I already have the plane tickets what are the alternatives in case I dont get the green card in time? can I apply for a green card stamp in my passport? tnks

    You mean I-485 not I-130. IO who does the interview handles 485 only, not I-130. All I-130 applications are approved by Service Centers. If he approved your AOS (I-485), first you will receive a "Welcome Letter" & then physical Green Card; in the mean time, check on-line status & e-mail updates sent by CRIS.

    Since USCIS has increased the speed of printing of Green Cards after the machine upgrade. I am sure you will get your GC sometime in July, the I-551 stamp won't be necessary.
