    NOA Date = The Receipt Date on your original NOA letter

  2. First of, you fire the tax preparer & don't attend to meet with her on Thursday. She doesn't know anything. When you do "Married Filing Jointly Return", you get the max. benefit. Secondly, you can not be Head of Household, when you are married !.... & at the same time he can not be SINGLE when he is married.

    Not only you will have problems with USCIS but also IRS too. Why ? Because you can not change your marital status annually just because you feel like it. I can assure you that it is going to raise BIG RED FLAG for USCIS when you apply for I-751 (ROC). Look at IRS definition of "Head of Household" !....

    Head of Household Generally, you may claim head of household filing status on your tax return only if you are unmarried and pay more than 50% of the costs of keeping up a home for yourself and your dependent(s) or other qualifying individuals.

  3. Like the other people said above, just wait for your RFE.

    But for your info:

    The following are the most common reasons for a request for evidence:

    * I-864, Affidavit of Support, related:

    * Submission of an I-864 by petitioner/sponsor

    Correct version of the form

    Submission of an I-854 by a joint sponsor

    * I-693, Medical Exam/Supplemental I-693, Vaccinations

    * Marriage/birth certificates and English translations

    * Evidence of Eligibility (I-797, Notice of Pending/Approved I-130/I-129F, Evidence of Nationality, etc.)

    * Legal entry

  4. If I had have come to the U.S. on a B-2 WITH the intentions of marrying my husband then yes I would be worried but I didn't, I came here with every intention of returning to Australia and I have all the paperwork and evidence to prove it.

    This is the way you thought & intended to do. It does not matter what you think or what I think. The most important thing is what IO will think during your interview next month.

    Btw, you don't have to be offensive against me, because I am on your side & trying to help you out here !...

  5. 1. When I am filing the I 485 what do I put in the Current USCIS Status section as well as the Expires on date section? Should I put Pending I- 130 and put N/A on the expires date section?

    Your husband's Current USCIS Status like "Overstayer", "Student", "Tourist" etc.....

    Expires On Date means his I-94 expiration date, whatever it is, if it was expired, give the exact date as written on his I-94.

    2. On Part 2 the applying section which one should i put A or B ?

    Just check "a". Plus You have to write a cover letter explaining your situation, I mean changing your status from LPR to USC and the copy of I-130 NOA.

    3. When submitting the application how do i show I am a citizen, should i include a copy of my naturalazation document along with the packet?

    Yes, You can send a photocopy of Naturalization Certificate and/or US Passport (If any). For your info, if the person has got both of them, When I do their USCIS paper works I usually send both of them.

  6. Your husband's two prior marriages & especially 30 years difference between you & your husband have raised a couple of red flags which concluded a field investigation. It is normal, don't worry about it. You just wait on-line update and/or an official letter from them. I have to warn you, it might take up about 4-6 months to be approved.

    No Field Investigation on my side yet :)

Your permanent resident status is conditional, because you must prove that you did not get married only to to get a green card."

    I think yours is a mistake. Your GC is supposed to be 10-year one. USCIS makes so many mistakes like that. Sometimes reverse situation happens which is another mistake, I mean you are supposed to get 2-year Conditional, but you get the 10-year one. It even happened here to one of VJ members.

    Anyway, the best thing to do for you right now to write your situation to NBC in Lee's Summit, MO. Good Luck !.....

  8. I totally agree with familyguy, everything is TIMING. If there is no time limit, there wouldn't be a Visa type like K-1. All boyfriends/girlfriends, fiancees would come to US on a let's say B1/B2 visa & then they would get married & file for AOS.

    I want to add one more thing, your overstay after you get married to US Citizen will be forgiven by USCIS when you file for AOS.

  9. We had also the interview the same date like yours on August 04, 2009. IO (She) did not say anything whether we were approved or not, the interview itself took about 25 min. I have presented enough documents that we are indeed in Bonafide marriage. Only thing I couldn't give that she has asked is the extract of my BC. Maybe you won't believe me, I am 46 years old, I have never seen nor used that document in my entire life, considering that I have lived in my country Turkey until I was 30 years old, I have completed my compulsory military service & gone to school including the university etc... This is one of the weirdest things happened to me. I did learn that kind of document does exist actually during the AOS interview !....

    Anyway she has business mind & so cold personality that is why I couldn't ask so many questions. Right before we left she just said she is going to send a letter very soon. I do not know what about ( I am asssuming a RFE about that document ).

    She has also taken the followings from me :

    • 2 I-94’s (Original)

    • Copy of Civil Marriage Certificate

    • Copy of Church Marriage Certificate

    • Pre-Cana Certificate (Original)

    • Copy of Joint Health Insurance

    • Copy of Marriage Reception Place Aggrement

    • Copy of Old EAD Approval Letter

    • Copy of I-130 Approval

    • Copy of G-325A of my wife (Due to loss in my case folder)

    I hope this helps you. No matter what we will get GC in the end anyway. I have been living in this country since 1992.

  10. All the posts above are correct. Your application is now pending. When you have applied for I-485, you were not out of status anyway.

    I wouldn't worry about that but I would worry about questions to be asked by IO during the interview. Like you got married to your husband after 5 months upon arrival to US. That is kind of a red flag. Believe me you will have to answer lots of questions. I am not saying it is not possible but will be difficult one.
