  1. Ive done a search but can't seem to find the answer.

    We've just got our NOA2 so naturally we're now going through the next stage - just a quick question though if anyone could answer it would be great!

    We've checked up on the national poverty line and we are slightly confused - should we be looking up the line for 2 people in the household (me and her, we're not currently living together obviously as im in a diffrent country :P) or just for one person? The form on the uscis website http://www.uscis.gov/files/form/I-864P.pdf only lists for 2 people so which one should we use? If it is for one person household does anyone know where we could get these figures from for the 125%?

  2. I apologize in advance if this question has been asked a lot before. I honestly searched the forum.

    We filed in May 21st of this year and have only seen the case touched once on 8/27/2009. The 6 month CA processing times would bring us up to November 21st. There have been no requests for evidence - or any communication whatsoever.

    First question - Is this normal?

    Second question - Assuming we get an interview date between now and Nov. 21st, (and everything goes without a hitch) what is the "average" time between that date and getting the Visa approved?

    At the beginning of this process i was foolish enough to believe that the 6 month CA processing time would be the amount of time it would take to get my fiancée here. DOH!

    Ron, i dont know what to tell you my fiance and i were with the Cali center and we sent our petition on the 18th of august and was approved the 23rd of oct.. call and find out whats going on with it.. my fiance says that it will take 2 to 3 months after your NOA2 approval..

  3. Thought I would drop in and say hello, our NOA 1 is August 25th. We still havent heard anything yet, its nice to see some August people getting approved.

    Speaking of which ours just got approved today, wahooooo! They touched it on friday, then literally 10 mins ago I got an email saying they had approved it, so I guess they just waited till after the weekend! One step closer, lol my fiancee was almost crying down the phone

    We are currently assembling our i-129f package but we're slightly confused as to the photo 'originals' they want when it comes to the interview. As all our photo's are digital when they say originals do they want the actual memory card or what?

    They don't accept electronic media of any kind. Their computers probably couldn't even read them. :blush:

    Generally, when they say "originals" they mean they don't want photocopies. Just get your digital photos printed on photo paper and you'll be fine. Also, don't bother to put them in a photo album. Most consulates won't accept anything in a binder because they can't be passed through the curved slot under the window.

    Great thanks! We were thinking along the lines of getting them done on photo paper but we wern't certain. We were just a bit baffled as the guide said they wanted 'originals' of everything, so by that we assumed the photo's as well, and being on a memory card we had no idea what they ment!

  5. These days, a good photo shop offering passport photos will have a digital camera. It may be set to take the Euro/UK std. size, but if you take the US specifications with you, they should be able to comply.

    That'll teach me before posting, just looked up the snappysnaps store online and the local one does the us style passport photo's in house...

    Ive searched and searched but can't seem to find an answer.

    We're currently putting together our I-129F package and I need a US size (2x2 inches i think) size photo. With them being a diffrent size in Europe does anyone know where I could possibly go to get this done? Ive thought about taking my own photo then taking it into snappysnaps or somewhere for them to possibly resize it and print me a load off, would they accept that? Does anyone have any better idea's?

    If my fiancee requires a co-sponsor for the I-134 yet their financial situation changes between then and having to apply for AOS and the I-864 do we have to still use the co-sponsor or can she just sponsor me herself?

    On a side issue - IF we do need the co-sponsor for the I-864 do they have to see the full 10 year requirement through to the end even if we get ourselves into a position of being able to support ourselves (which we will be).

    What we have decided to do is mail the I-129F petition on lucky Friday March 13th and when I enter a week later on March 20th just state I am going down for vacation and leave out any mention of "fiancee" at this point. Thoughts and advice is highly appreciated.

    Sounds good. Think of it this way (plagiarized). It is no less honest to fail to mention visiting a fiance than it is to fail to mention that you will visit a pubic library. A general but truthful answer to "Purpose of visit?" is fine. Having evidence of ties with you just in case is a really good idea though.

    Ive also wondered this when we come to submit our K1. Would they have any knowledge of my K1 application at the POE, if so Im guessing that saying im visiting my girlfriend, rather than my fiancee woulden't go down too well? I last visited her 2 weeks ago and just told them I was visiting my girlfriend, he asked about where I met her etc, but was all very friendly and was on my way within a minute.

  9. Think 125% for both.

    The 134 is "short term" for the time leading to the adjustment of status. As noted by limejello the 864 is a binding agreement that lasts for approx. 10 years. If you can't show a solid case with the K-1 petition you won't get a visa and not make it to the AOS. Check the UK regional forum for more input specific to your fiance's journey.

    Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

    Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

    Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

    No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

    So, basically we will need 125% of the poverty line regardless really in the end? It still sounds compleatly weird to me, if a person has just over 100% then where will they find the extra 25% from in the space of the time it takes from the K1 to the AOS.

    Is it just me or is the whole process compleatly designed to confuse you? It's like, we think we've almost understood everything then another spanner gets thrown in the works.

  11. The income requirements are non-negotiable. So if the USC's income is below the 125% of poverty amount you will need a co-sponsor for the I-134.

    If your income situation changes by AOS time then perhaps you will not need a co-sponsor for the I-864. The I-134 is just for the K1 process. The I-864 is the biggie where the co-sponsor does commit themselves for a 10 year (40 quarters of employment) period of time. Read through the I-864 instructions to familiarize yourselves with the requirements.

    So, from I understand - as we are both now slightly confused, For the I-134 for the initial K1 visa the USC needs 100% or above poverty line from what we've researched. However when it comes to the AOS and the I-864 form after we marry the USC needs 125% or more. Now, this to me sounds slightly crazy, why the diffrence in 25%? Why not 125% for both the I-134 and the I-864?

  12. Also, your "boyfriend" needs to be your "fiance" They do not give K-1 visas to boyfriends.

    I think it's kind of silly to beat people up because they call their SO their boyfriend rather than their 'fiance'.

    The original poster was hardly "beat up" over it. It was good advise. Refer to your SO as your "boyfriend" at the embassy interview and you might just get denied.

    I hardly think so.

    And I only mention it because it's not the first time I've seen members get after a poster because they typed 'boyfriend' on the forums.

    Seems like nit-picking to me.

    OKAY first off.. we aren't engaged yet.. if you re read my original post is says we are going through the guides and familiarizing with everything.. we understand that the k1 isn't for boyfriends..

    thanks to everyone else who was helpful.. we wont worry about my other income..just go based on the part time job..

My Boyfriend (Windsor, UK) and I (Washington State) are new to this.. we have just started going through the info and familiarizing are selves with all the steps...the one i am most worried about is the affidavit of support..see i work a part time job that reports taxes..but i also have other income that taxes are not taken out of.. if you go based on the taxed income i don't meet the requirements.. if you add the other form of income i do.. i guess what im asking is.. should i report all income.. and if i do will i get in trouble for not reporting the other jobs?
