  1. We're sending Packet 3 back to London tomorrow. I wrote N/A (K1 visa process for permanent residence) for both myself and my cosponsor. I've done a little research and it sounds like it should be fine.

    thanks everyone i sent out all of the paperwork last week, we did as you said and wrote the na k1 visa process for permanent residence for both mine and my moms paperwork, also we put that my dad was partially dependant, not sure but thats what we found would be the best, sometimes these paperwork just are as confusing as a rubix cube, so many different answers and ways to do it, and not everyone is in the same situation, now its just sit and wait for the interview

Hi Guys, well I'm here to re-iterate what I just said about having faith and hope and patience, I have just been notified that my case was looked at and completed 6 days ago, so they're being looked at all the time and your case can be too and good news could be just around the corner :thumbs:

    you dont have a timeline where are you in the processes? my fiance and my packet 3 was recieved on jan 29 and we still dont have an interview date, we have narrowed it down that we wont get it till may, he put a travel date of junish, so they are waiting closer to that time,

    It also says that she should also write N/A ( K1 visa process for

    permanent residence ) as you did on your I-134 for question 11. As for

    the tick box I think she should just tick intend.

    see to me my father is not a dependent (over 18) but with this visa stuff everything seems to be backwards from normal thought process, and no one seems to be going through the same situation,

  4. im not quiet sure what your referring to? yes my mother more then exceeds the 125% above poverty line, the questions we are having issues with have nothing to do with whether she meets that requirement, we were asking whether my father gets put as a dependent (of my mother) even though he works and they file taxes jointly.

  6. This is something I've recently come to actually. With question 11 I was thinking that the co-sponsor would check yes, and write something like "I plan to financially support the beneficiary of this fiance visa should this assistance be required in order to prevent her from becoming a public charge." where as I'd write that I plan to support her indefinitely and marry her within 90 days of her entering the country on the K-1.

    I think the "Dependent" is if there's any one that the co-sponsor claims as a dependent on their taxes. I'm not 100% sure if that's correct though, but does make sense. Hope this helps some.

    Thanks for your help, it helps a little for the question 11, the question 8 has us baffled a bit, since my mom (not my mom and dad) is sponsoring us, my father and her file their taxes jointly, my brothers and I are all over 18 there for not dependents, and my father is not one either, thus we are confused on whether he has to be put as a dependent (cause he lives in the household and is included in the 125% above poverty)

  7. Just as a follow up question as I can't edit, On question 8 for the co-sponsor would they be required to put down that they support anyone in their household, i.e husband. Her parents both work, no kids left at home, just the "dependant" part threw me as I would imagine that would be for younger kids/under 18's etc.

    For various reasons we've had to get my finance's mother to Co-sponsor for us, however for question 11 - I intend/Do not intend to make specific contributions to support the person(s) named in item 3 - we're unsure whether we should get them to tick the intend, or do not intend box. My US finance is ticking the intend box, and writing N/A (K1 visa process for permanent residence) underneath as the guide shows - does the Co-sponsor need to do exactly the same even though they won't be directly financially aiding me (unless of course my soon to be wife loses her job etc).

    Has anyone else who've gone through this route using the embassy in London had a similar situation?

  9. Yes they are and they do it because they can. I've called DOS 3 times and only received help once. The first time the agent (or "visa specialist") I spoke to was really helpful; took my case number right away and answered by query immediately and clearly. The second time I called the agent asked why I was calling and then put me on hold for an unexplained reason for 10 minutes (to take more calls maybe?) and then came back to me and asked again why I was calling... took my info and then told me something (after hesitating and sounding like she didn't know what the hell she was talking about) which the next day was proven to be untrue. I called them last week to find out an update on whether my visa had been issued, was again put on hold for an unexplained reason... was then asked again why I was calling... took my info and then told me I hadn't received the visa cos the embassy had put me in additional processing... which wasn't true. I don't mind being told news that I don't want to hear so long as it's told in a professional and decisive manner; but don't sound clueless because then I just conclude you're BSing me.

    oh dos gives me the run around, they litterally cant tell me anything useful, they cant tell me why my stuff isnt being handled, got told last friday to call the embassy when i said we already did that ( my fiance called and the guy told him they really dont have anything else different then dos) i said well we tried that and they dont have any more info then you guys, she said i doubt that, i wanted to scream. i just dont get how no one can tell us anything, i hate the sitting duck game

    This is killing me though, we are still waiting for ours! Almost 2 months since we sent off packet 3 as well =/

    thomas we are in the same boat as you, i call dos almost daily and they give me no help and no helpful info, they are rude and inconsiderate, my fiance and i are curious on what you put for your wedding date? we put august and we wonder if that has something to do with the delay, keep up posted

  11. Hi - We are currently waiting for our interview date via DCF in London. I sent in our checklist first week of Feb, so I'm hoping to hear in the next week or two. Does this seem right? :) How long have people been waiting to hear back?

    my fiance and i have been waiting since the end of january, but there are people on here that sent theirs in after ours and have already had the interview and are approved, its a sitting duck game

  12. You can't combine incomes between sponsor and co-sponsor, in other words each sponsor has to demonstrate their current financial situation and their own dependents.

    Your co-sponsor has to demonstrate that their income is 125% of the poverty line for them, you, and however many other dependents they have. This is usually anyone they claim on their tax returns, plus all children under 18 even if they don't live with the co-sponsor. If they have already sponsored someone, they need to include them too. This is more often the case where people have obtained relative visas for their parents, and are now doing the same for siblings. If they don't claim your fiancee on their tax returns as a dependent, then you wouldn't count them in the household size (irrespective of whether they live in the same house or not).

    In our case, my fiance will do an I-134 but falls short of the poverty line for 3 people (him, me and my daughter) so his mom is co-sponsoring. She is married and files taxes jointly with her husband. She therefore needs to meet the 125% for 4 people (her, her husband, me and my daughter).

    Sweet thanks, thats what we thought just the other way around (me her and her mom) but instead its me her mom and her dad so its still 3 which would be fine.

I haven't looked into the co-sponsor side of things at all, so just to clarify for a numpty like myself, i need two I-134's from both my finance and co-sponsor and supporting evidence from both of them. Theres no other forms other than the ones ive already sent in for the interview?

    Also do I go by the 3 people now for the poverty guidelines when calculating the 125% line? Would they take in both sponsors income for that or just the co-sponsors?

    What was something that was about to blow my head off with stress you've both made us feel alot better, thanks again.

  14. Candidly - it is entirely possible that the Embassy would review the affidavit of support (and all the stuff with it) and never make any comments about it. So it could 'fly' just the way it is - BUT - that might not be the advisable approach (all they'd have to do is ask "has anything changed?' and you're on the hook).

    If it were me - I'd revise my affidavit (do a new one, with all new supporting evidence - which would be mostly copies of what you already have and based on what is CURRENT) AND secure a co-sponsor.

    I'd have these new affidavits with me for the interview.

    Gotcha, we have no problem getting a co-sponser - would they then accept both affidavits, her own plus the co-sponsers at the same time? Would that require sumbitting two I-134's?

    (Obviously less money but does it impact her overall qualifications to meet the minimum requirements?)

    Not enough to meet the poverty line, but that isn't taking into account unemployment insurance (not sure if they would include that or not?) but we don't know how much that will be yet as its literally hours ago she got laid off.

    I'd love to say just give it a few weeks to see if she can get another job, but if we need to use our co-sponser we obviously need to move fast to get all the documents together so she can send me them before we get an interview date through.

  16. Hi guys and gals,

    Unfortunatly my better half got laid off today. She has two jobs which she works during the week so she's currently looking for another to make up the rest of her income. The problem is as we're patiently waiting for an interview date I already have all the I-134 stuff filled out with letters of employment detailing her salary from both employers. As the embassy already has packet 3 is it still ok to just go ahead as is with what we have already? We do have a co-sponser if needs be but we would rather not have to use them if possible.

    As is this could get any more stressful.. lol

  17. Have you called for an update? It's the middle of the month and so it could be that your packet 4 is in the post as we speak. They seem to assign interviews in the middle of the month, for some reason.

    Yep, my fiance is pretty much calling them everyday, but getting diffrent answers depending on who you talk to - some say they have our packet but not being processed, others say we're not eligible and some just say " er what does logged mean?". Im trying to stay optimistic but seeing people who've sent theirs in after us getting interview dates really does make your mind wonder what the heck is going on.
