  2. The marriage has been rocky too. I'm very stressed, to be exact, miserable. I have had many health problems since I moved here because of the stressful living condition. Yet, my husband only let me see the gynecologist because I complained about the pain during and after sexual intercourse. He didn't care about my feelings or health; yet, he doesn't want to be accused of raping. Discussions with him about anything are just impossible.

    It's just depressing. Sorry for venting. But I really panic! I wish I could go back in time.

    People here have given you good medical advice. Getting tested for HIV and STIs right away should definitely be your first priority. But there's another issue at work that is downright scary, and it's your husband's treatment of you. I couldn't let this go without commenting: He let you see the gynecologist? You have a right to your health, and no one - not even your husband - should stop you from receiving medical care, whether you appear to be in perfect condition or not.

    Please do as others have suggested: if you have family or friends in the area, reach out to them for support and protection. If need to see the gynecologist again, you could check into seeing a Planned Parenthood physician, if you have one in your area. They will be able to do confidential exams and testing, so even your husband doesn't need to know, and in many cases they can provide reduced-cost or free services.

    You have enough on your plate as it is now, but when you are secure in your health again and things are calm, I urge you to consider you marriage: are you truly equal partners, or has he overstepped his bounds as a husband?

  3. hi all, we've got our packet all put together and will send it off tomorrow! here's our list of evidence, in case it's helpful. I'm not sure if it's too much or not enough. I'm hoping it's more than enough. We get very nervous about these processes, probably stems from having to go through a really tough consulate for the original K-1, and of course the fact that our life together is on the line!

    Well, USCIS took our money yesterday, so that's an encouraging sign. But good bye money :(

  4. Hello everybody. I have been reading VJ for years and now is the good time to ask questions.

    Our window opens on Oct. 29, so will be shipping our documents on the 27th. Unfortunately, Vermont is our office...

    So, do you think this list would cover our case (my wife and her son entered the US on a working visa P-1/P-4 and we got their GCs in Jan.2011)???

    In my opinion, your evidence is great :thumbs: Most likely approval-worthy!

    Thanks Leenie for starting this thread. I am a USC and my wife is a conditional resident. Our window to file ROC also opened on Oct 13th. We had a baby last year. We have the following documents

    Joint tax return transcript

    Birth certificate of our son

    Joint bank accounts

    Life insurance with my wife listed as the beneficiary

    I am not sure will this be enough. Some people here on VJ mentioned that USCIS no longer requires to send pictures. Will these following additional documents be helpful. Medical record of our son with both of our names, and medical record of my wife during her pregnancy with my name in it.

    Yes, I think the additional documents you mentioned will be helpful. I would include them if I were you. Truthfully, I think you need a little more evidence to make your case without an RFE. Do you have any of the following items or could you obtain them? These are just some possibilities...

    - Apartment lease or mortgage documents

    - Joint loan documents of any kind, such as for a car

    - Car title showing both names if you own your car

    - Joint health or dental insurance records

    - Joint auto/home/renters' insurance

    - Joint credit cards (you can actually photocopy the cards themselves) or card statements

    - Joint utility bills

    - Joint cell phone plan/bill/other information

    - Copies of emails you sent to each other

    - Cards or letters addressed to you (such as from wedding/Christmas/etc)

    - Signed affidavits from friends and family (at least 2)

    And yes, do send in pictures! We sent about 20. People on the forums have been approved after sending only one or two pics, but I am a believer that pics are still pretty important. They are the best way you have to depict the humanity of your relationship.

    So, the big day is almost upon us. The excitement has kicked in and on the 22nd we'll be sending in my ROC application. I'll be a busy bee copying, printing, tagging this upcoming week. :)

    It feels so good to have it sent off! I bet you can't wait! But now I don't really know what else to do with my time. haha tongue_ss.gif

Thanks Leenie:)...Good luck to you too!!! but my husband and I live with my parents still but we have lived in the same house since we filed for AOS...Most of the documents we're sending has our address printed on them. I hope that's sufficient and won't have any problems. I am finishing everything today so I can send it out by tomorrow so I can start the waiting game....hehe... as for bank statement I added a few...thanks again!!! :)

    I think in this kind of case, a lot of people have had their parents write up and sign a short letter explaining the situation. If you don't go that route or don't have time to, it seems like the rest of your evidence is really good, so here's hoping for no issues!

  9. For the lease agreement do we have to send in all the pages of the lease? I have at least 30 pages for my lease agreement. Not sure if the first few pages would be enough to send in

    Yikes! Our lease is only three pages, so we are sending the entirety of our current lease and two of our past leases. For your case, I think it's fine to just send the first few pages and also the signature pages showing all the appropriate parties have signed off on it.

    We tried to do a walk-in biometrics at the Naperville, IL ASC for our AOS, and they did NOT let us do it. So, if you would have to go to Naperville, I suggest don't waste your time and just wait for your appointment. I don't know if doing an early bio really speeds up the process that much, if at all.

    - copies of state ids and driver's licenses showing same addresses

    - copies of income tax returns filing jointly 2010 and 2011

    - copies of credit cards showing same card numbers

    - copies of costco and sams club membership cards

    - copies of car registration showing both of us as registered owners

    - copy of car title for our old car showing both as owners

    - copies of joint checking acct statements (this one i am planning to send just the statement when we first opened acct and the most recent one... Or is it better to send copies of each statement since 2010?)

    - copies of joint savings acct at fcu (this one i am planning to send just the same as checking)

    - copy of purchase of car from dealer

    - copy of contract signed for 1st car loan

    - copy of contract signed for refinance of car loan

    - copies of car insurance cards

    - copies of pictures with my husband's kids visit in 2011

    - copies of benefits election for 2012 and 2012 from my work showing my husband as primary beneficiary

    - copies of envelopes of invitations and cards addressed to us

    - copies of few letters addressed to both of us

    Do u think these would be enough evidence? we dont have utility bills under both our names :( Is there anything else u can suggest i send?

    Hi! We're sending our papers tomorrow, too. It will be so nice to get it out of my hands (but it will still be on my mind, of course :wacko:)

    s only a few small things I would suggest:

    1. A lease signed by both of you or a mortgage document would really round out your package as far as shared residence is concerned. Do you have anything like that to include?

    2. For your bank statements, you might want to include a few that are dated between the account opening and the present. You don't have to send one for every single month you have been married, though.

    Heading to the post office this morning to send our application up to Vermont. We had issues with the K1 visa application being misplaced by staff in the past, which caused a delay, so this one better go through without a hitch! :angry:

    I called our landlord and he said he can "add me to the lease". My husband said to wait (due to our other strong evidence) and see whether USCIS will RFE-ed us. :unsure:

    If you can get the letter from your landlord, that should be perfect and you can probably get approved without an RFE. I agree with your husband - adding you to the lease would mean you would be responsible for the rent if your husband doesn't pay up. So, it's probably best to leave things how they are if the system is working for you guys.

    Me and my husband live alone and rent. All apartment-related documentation is in my husband's name.

    What should we do at this point? Any ideas?

    P.s. We have a few envelopes, letters, postcards addressed to us both. I'm assuming those aren't enough?!

    I think the thing that is most compelling about both people being listed on a lease or a mortgage deed is the shared risk. That is serious business that two people would likely not enter into together unless the marriage was legit. Even if technically/legally you are not separately responsible for the rent, if I were in your situation, I would probably include a copy of the lease along with a short letter from the landlord explaining that they know that you live together and have done so since XX/XX/20XX date. I don't think mail addressed to the both of you could hurt, it's just not as compelling. But hey, lots of the documents you are already sending (such as tax returns) probably show you live together, so hopefully that IS compelling!

    - and of course the $590 check/money order :blink:

    Are we good to go?

    One thing that sticks out to me is that you seem to be lacking evidence of the fact that you live together, besides the IDs/DLs. Do you have rental or mortgage documents you can send as well? I think adding that, if available, would make your evidence very strong. If you live with parents, you could ask them to draw up and sign a letter attesting to the situation.

  15. I am going to send in my wifes ROC to CSC tomorrow, unfortunately, i couldnt find a physical address with which i could have sent it via fedex, thus the delay to monday.

    Anyway, my package looks sorta something like this, we waited until our son was born so we could send it 2 birth certificates.

    - Coversheet

    -I-751

    -Copy of wifes green card

    -Copy of our drivers licenses

    - 2011 +2012 state and federal tax returns

    - Copy of housing contract from the university housing listing her as the spouse

    - Copy of our Bank of America statements for last 3 months

    - Copy of our other bank account last 3 months + the first statement

    - Copy of our daughters and sons (born 9/26/12) birth certificates from the county

    - Copy of our cable bill since june

    - Check

    I am hoping thats more than enough.

    If I can give a little advice, one thing I might recommend is to make sure you send documents spanning the entire length of your marriage. For example, don't just send bank statements for the last three months; send statements from different points throughout your marriage. You don't have to send one for every single month, though. Ditto for the housing. Does the contract show you have been living together for your whole marriage? I've been trolling the forums like a mad woman, and people do get RFEs for this kind of stuff sometimes. Oh yeah, also, are you sending some pictures? Good luck! :)

  17. Of these, today I found out that my wife forgot to assign me as her life insurance beneficiary, so she is updating that today. Should I try to include that information once she does? or is it odd that she is doing that now? Should I just leave it out entirely? She did the 401(k) a while ago, and I have documentation for that.

    About the 401(k) issue, if you are in a hurry to get your application in the mail, it's probably not necessary to include it because the rest of your evidence is pretty solid. If it's not going to be a long wait, though, I think it's worth it to toss it in. It's not odd that it's only recently done. If all of your evidence were to represent recent items, then that would appear contrived.

    Based on what I've read around VJ, your list is probably enough to get you approved. How much evidence to send seems to be a matter of opinion: some advocate sending as much as possible, no matter how significant something is (or insignificant); others feel that too much evidence can be overkill and tiring for the person reviewing your case.

    Here's my suggestions, FWIW: Do you have joint any joint health/dental/vision insurance, or are both of you separate? If it's joint, you could send in your insurance cards and any EOBs you might have. The items listed in green are probably not going to add much to your application, nor would a BJ's membership, really. Affadavits are debated on the forums here, but it generally seems they aren't given as much stock as other types of evidence. If you haven't already gone through the trouble of acquiring them, it might not be necessary at all. We're not going to submit any affadavits.

    Today I did that, and had the transcripts faxed over, now my wife has to do the same thing too. <_< We have filed as Married Filing Separately so they wouldn't let me request transcripts for her records. Hoping that she will be able to get them faxed over without us having to go to the office to pick them up.

  18. I'm trying to put together all the documents i need. I'll be an october filler as well since my green card expires on january 5th. What do you guys are sending as of proof of relationship? What other documents do i need to include with the application?

  19. For those curious, the $700 does not include the application fee, or biometrics, or shipping -- so it would work out to a pretty significant total.

    Thank you, Leenie. Your words are very encouraging and have made me more certain of our decision. You have affirmed the conclusion we have come to as well. I have been reading up on the forums, have triple read the instructions, and now I just have to keep gathering more forms. I'd rather keep those in our saving account (saving for expenses of having a first child). :innocent: As a bonus, I still have the copy of the submission we did before (and that were many more forms), so I hope to implement some of the ideas used there.

    One thing I wish I had done, was requested the tax return statements earlier... requested them today. They say 5-10 days to arrive, can't remember how long they took before... too bad they don't send a digital copy.

    Good luck with everything! You'll be fine, but you can always come here to to ask questions on any sticking points. As to the tax transcripts, I've read on VJ that they can be faxed to you right away or that you can go to your local IRS office and have them printed on the spot, although I have no first-hand experience with either of those methods.

  20. We are also hoping to file, and can do so after Oct 6th. Right now, what has me thinking is whether I should do it through the lawyers I have always used or just try to file myself.

    Now, I understand that each person has to decide for themselves, but I am wondering if anyone has any information that could help my decision. The lawyers are offering a flat rate fee of $700, but if I could get the same success rate by filing myself, it would be nice to save this money (especially since I am the one still gathering all the information).

    What do you guys think? Overall, we have a good amount of evidence in our relationship, the only thing that would help us is if we had kids already, but we are planning to have them next year.

    Hi Felix! Here's what I think: ditch the lawyer! Is he/she charging $700 on top of the regular filing fee or is that figure inclusive of the filing fee? Either way, it's money you don't have to spend. Most everyone on VJ is here doing it themselves from start to finish with the help of this site's guides and forums. If your case was particularly unusual, then a lawyer may be able to help you navigate some of the difficult issues, but if your case is more cut and dry (it sounds like it is), then the ROC is definitely something you could handle on your own; it's not very complicated. Why don't you take some time to read the guides and browse this forum to get a full picture of what will be required of you? I think it will quickly become clear to you that you can handle it.

    My window opens October 24th. Cant wait to get this restrictions off my plate. I am all ready to file it in. It is very sad that VSC is really slow at this point. I cannot believe people are waiting 7-9months before removing restrictions on the green card. I quick question though. Would the waiting time affect the time to apply for naturalization ?

    Yes, it's scary sad. I'm so sorry for all our VSC filers.

    Regarding naturalization, one is still considered a LPR while ROC is being processed, so the time still counts towards the three years. In fact, I've read some cases here on VJ where people became citizens before the ROC was even completed! :wacko:

    Being that it's almost October, I thought I would get the ball rolling on this topic. I am the USC, my husband is a UK citizen, and our window to file for ROC opens on October 13th. We're gathering docs now, and we plan to send everything off the day the filing window opens.

    So, who else is planning to file in October? How is it going putting together your stuff?

    Should anyone like to use it, here is a calculator I found floating around in other threads: http://www.uscis.gov/dateCalculator.html

    Just enter the date your green card expires, and it will tell you the day your filing window opens.
