  1. I would mention it on my application. You need to be 100% truthful. Good luck on your journey.

    Hey guys it me again,

So as i was getting all my paperwork together i noticed that i have to include all documents of previous arrests and court cases. The thing with that though is that I had two court cases, both were thrown out but i only have paperwork on one of the cases. Also the case that i have no paperwork for there is also no public record of it, im not sure why because i am absolutely sure that i didnt get it expunged.

I am wondering if i should include an explanation of what happened or should i just not mention that case and just wait for them to ask me about it, because im pretty sure theyre going to find some record of it somewhere somehow. Will these cases affect my AOS application in any way even though they were both dismissed??

  2. Ours took about 5 months. CSC is a lot faster. As long as you have no RFEs and you prepare your package for intreview as soon as possible, I think you would be fine, Of course, every situation is different. Good luck on your journey.

    Hi everybody!

My name is Molly and I am from Grand Rapids, MI. My fiance, Steve, is from Windsor,ON. We became engaged in Aug,2010. We set a wedding date of Oct.1, 2011, but Im now wondering if we may have jumped the gun on this one. We mailed out I-129 a couple weeks ago and I received notification this week that they have received our application and it has been sent to California to be processed. Ive heard a lot of different answers on the processing time, from 5 months to 12 months. Im not sure what to expect.

Im just wondering what everyone's opinion is. Do you think that a wedding 9 months from now is pushing it?

  3. According to my Filipino friends, Asiana Airlines is not bad. Try Philippine and EVA airlines as well. I enjoyed EVA . I stopped over in Taipe for 2 hours. In my professional opinion, EVA has excellent customer service.

    Howdy!

What you think of Asiana Airlines?

Trying to book my ticket now from LAX to MNL.

    Lemme know.

    Thanks!

  4. You can apply for any job you are qualified to do once you get your EAD. There are no restrictions whatsoever.

    Hi all,

Just a quick question regarding work and looking for a job after moving to the U.S

Do you have to work in a similar job when you move to the U.S, or can you do anything?

Just asking as I work for BMW as a semi-skilled technician, but I don't really want to carry on doing this when I move, thats if my application is granted that is. I can put my hands and mind to most things, but I would love to open a English style cafe after a short time if possible.

    Thanks

    Dave

  5. I hear you. Unfortunately, there is no special considerations for MOB to attend the US wedding.

My fiancée's mother does not have a visitor's visa. I'm thinking it will be next to impossible for her to get one, as she would not have sufficient money in the bank and other requirements for a visitor's visa (from my understanding). Does anybody know anything that I don't (is there any special considerations for the mother of the bride to attend the US wedding)??

    Thank you,

    J.W.

  6. Your mother-in-law can attend the wwediing if she has a visitor's visa. If not, she cannot.

    Hi Everybody,

I assumed that my fiancée's mother would not be able to attend our wedding here in the USA (which means she would just visit here during the wedding and then return to the Philippines), and we were planning to have a second wedding in the Philippines later. Now, some of my fiancée's friends are telling her differently.

Does anybody here know the details on this question?

    Thank you!!

    J.W.

  8. You file it 90 days before her conditional green card expires. Good luck on your journey.

    Hello all

Before I continue a big thanks to all the amazing members on this board who helped me with my answers to questions and of course everyone's support.

So I have been away a while the reason for that is b\c my wife finally got her late in 2010. So I am trying to figure something out and I need a little help from the VJ community again. My wife and I were married in November of 2009, so we have been married for less then two years. Her green card is set to expire in 2012.

I know we have to file her I-751 but I am not clear on something. My question is do I file it 90 days before the green card expires in 2012 OR do I file it before our 2 year wedding anniversary which is in Nov 2011?

Also on a related note IF we are supposed to file the I-751 in 2012 (before her green card expires) can my wife travel back to her home country for a few months?

    Thanks in advance to all

  10. It is not the business of USCIS; as long as you are living together and you have adequate evidence of an ongoing relationship. Good luck.

    Thank you guys!

We have the lease, joint car leasing document, joint car insurance, health insurance cards, life insurance document, tax document, pictures, joint bank account, joint credit cards, joint internet bills, same address of our driver licenses, same address of mails. Hope that they are enough. Thank you, then we know that we don't need to move to a bigger apartment just for this. I would be a little tough. Thank you and good luck!

  11. Do not panic. You would certainly get RFE ( Request for Evidence) notice in the mail very soon. You should start gathering the evidence right now: so that you can mail it back immediately. This may set you back a week or 2 .

You will get a reply requesting addional information (RFE). Do not just mail evidence w/o the RFE notice as they will not be able to relate it to your original filing. No harm other than delaying the process.

  12. Please do not give up. Before you know it, you are on the plane to the United States of America. You can do it. Good luck on your journey to America.

i got my NOA1 Thur California center on sep 1 st its already been 5 month at the end of this month but hope we get the NOA2 soon......Iam started being un patient Now!!!!!!!!!!!! Any where here around that time

  13. She must go home. The law is very clear. Anyone that comes here on a K-1 visa must get married within 90 days of arrival .

What it means when it says she can stay on an I-130; that is for a couple who, for whatever reason could not marry in the 90 days (death in the family, illness, ect.) but still wants to marry. They just couldn't do it in the 90 days becuase of extreme circumstances. She cannot stay here legally unless she marrys the petitioner in 90 days, or petitioner has a good reason they couldn't marry in 90 days, and applys for the I-130.

  14. We filed in 2008 and paid $1070 for both i-765 and 1-485. We just filed for removal of conditions. That law took effect in 2007. Good luck.

I have seen on some posts that if one files an I-765 together with the I-485, the $1010 fee for the 485 will cover the 765 as well. In other words, no need to pay the separate $380 filing fee for the 765. Looking at the instructions for the 765 however, I am not so sure. Here's what the i-765 instructions say on page 8:

"NOTE: If you filed Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, no fee is required to also file a request for employment authorization on Form-I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of Form I-485 as of July 30, 2007."

I read this to say if you filed the 485 by July 30, 2007, you don't have to pay a separate fee for the I-765. But it doesn't say anything about people filing after that date, meaning the separate fee should be paid for filings (I-485) after 7/30/07. Did I miss something in the form or instructions?

  15. I am sorry to hear this. You should have received something. 3 weeks is a long time to hear nothing.I hope they did not misplace it. If I were you, I would call on Monday sice you have the proof that it was signed for.

I sent out I751 papers on DEC 17 to Vermont. But i haven't received any info yet, also the checked hasn't been cashed. I check the delivery status, the package was signed by a person. What should I do now? How to follow up?

    Pls give me some idea.

    Thank you
