  1. It is true. They do check. My wife filed after 3 years in January and they checked everything. The application was well packaged. We did everything on our own. Thank you VISAJOURNEY community. She is going for her Oath Ceremony on July 5 with passport application on hand. The immigration journey is over. Thank you Lord.

    An act of congress in 1927 ruled an immigrant married to a US citizen would be a far superior US citizen, so adopted the three year marriage privilege. And its just that, a privilege, not a requirement.

    Years later, the INS was changed to the USCIS demanding tons of proof you are married, were free to marry, living together, paying taxes and bills together, buying joint property together, but only legal stuff, haven't figured out a way that both of you jointly purchased a new ten buck toaster, and indeed that US citizen is a US citizen.

    So this documentation can be burdensome and is the key reason for RFE's with further delays.

    Residency requirements is an entirely a different issue. Not only how long you were gone, but the reason why, be prepared to answer this. One good reason is getting work, have a son and a niece with these issues. Have college loans to pay off, and the odds of getting a job with over 2,000 applicants is minimal. And you sure can't pay off these loans working for Walmart. So they had to leave. Maybe that was your situation.

There are scammers everywhere as well. Nigeria is a beautiful country to visit .I am glad to hear that you are going to register your trip with the US State Department.

  3. Congratulations. My wife will be at that same ceremony as well. Steve D is correct. From the Convention center to LAX is about 45 minutes(on the average) in the afternoon. I am assuming that the ceremony will not be over till about 4:00 p.m PLUS THE HEAVY AFTERNOON traffic in Los Angeles. It took me 1 hr from the convention center to LAX few weeks ago and I eft at 3:30. It all depends on traffic and it is unpredictable. I think you should cahnge your flight to after 6:00 p.m. or reschedule your oath date. Good luck

    Well the 110 onramp is right next to the convention center so it won't take you that long to get on the freeway.

    PROBLEM is, if you are in the afternoon, the 110 is going to be your worst enemy. I'd say in the WORST case it'll take you a minimum of 45 minutes to get to LAX via 110-105.

    If it's tight, I'd reschedule one of them. Which one is more important? You be the judge.

  4. As a tax professional,I think it may. He should consider filing amended returns to correct the mistake as soon as possible. For Federal,he needs to file form 1040x.

  5. You may be able to get Medicare for them. I think they have to be 62 years old to qualify. Check with your county social services in your state . Good luck.

    ry calling your local welfare office and ask what they will be eligible for I think medicade and medicare for the 62 year old and the 58 I think will have to work untill 62 before they become eligible for any social programs also I beleive some of these

    programs fall outside of your 864 some fall inside of it which will make you responsible so give welfare a call its what they are there for don't be shy and ask if nothing else they can point you in the right direction Ok then have a good day

  6. We had our interview in less than 5 months. Biometrics was done at The Van Nuys Office. Interview was at the Chatsworth office on June 6 and oath is on July 5. We filed the N-400 on January 28. Good luck

    Per the USCIS website, the LA office is now processing N400 applications filed Nov 2011. Every field office is different, it could take 8 months or it could be faster to process your particular application.

    I had my Bio May 17 and I'm still waiting to be placed in line for interview...

  7. There may be some tax consultants in South Africa; but I think you will be better off selecting a tax consultant here in your wife's hometstate. The filed tax return can be emailed as a pdf to you and the embassy. Good luck on your journey.

  8. Everyone is 100% correct. Even if the sister-in-law wants to come as a visitor, she must proof that she has ties to the Philippines. She has to proof that she will not decide to stay here in nthe US and become Tago and Tago. I learned that word by watching CITIZEN PINOY..an immigration program one of the Philippine TV station.

    Please do not do anything that is ILLEGAL. It could land you in trouble and your sister in law could be banned for life. It is better to do everything in a legal way. We are all following the law.

    Yes, you need to get a visa and a letter of invitation.The company I've used before is Travel Document Systems. Also, if you've never had a yellow fever shot you'll need to get one of those. It's also advisable to get anti-malaria medication. You need to start taking it a certain number of days before you go over so plan accordingly!

If you move prior to the scheduled ceremony, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    Naturalization Applicants: you will receive your certificate at your oath ceremony. You can expect to be scheduled for an oath ceremony within 45 days of receiving your recommended approval. Many offices schedule approved applicants for the oath ceremony on the same day as the day of the interview. Please check the local office profile page on our website to determine if the office where you will be interviewed schedules same day oath ceremonies.

  13. I am not from Philippines;but I have been there 3 times. Based on my experience, it is about 3 weeks on the average from Medical at St.Lukes and receiving the visa. Every case is different. We just brought my mother and father inlaws to the USA to live with us. In their case,it took 2 weeks. Good luck.

  14. I am sorry to hear of your situation. Like everyone is saying,I do not believe there is anyway you can get around meeting in person within the last 2 years before filing. I understand that you are sad. Please make sure that attorney is not a crook . Ask for references before hiring this attorney. Like others have said,your best bet at this is to have your spouse to come back to the Philippines and

    1.keep his ticket and boarding pass to show as proof

    2.take lots of pictures with you and your relatives

    3.write a good Letter of intent to marry you within 90 days of arriving here in the USA. --signed by you and him and possibly a witness

    4.Uscis is very strict with that 90days. I know a person that got married on the 91st day. Technically,she was out of status on the 91st day and that created some problems.

    someone told me to ask my fiance to call uscis and direct to tier2 (person inside the uscis not the csr)

    and tell everything or ask and inquire what should we do if continue or to withdraw.

    another question is: if we let this denied and plan to re-file again, the re-file petition will not meet problems bcoz of past k1 filing denied?

    and I also read some attorney offer help for waivers does this will help?

  15. Can anyone please help update the status of my wife. I did it;but it did no work.

    On May 1,she was placed in the que for interview.

    On May 14, she received her interview letter

    On June6,she had her interview and it was approved

    On June 20,she got a text stating she is now in the que for oath ceremony

    Infopass for me will be quite an inconvenience as the office is 3hr one way from my location. I just put in a e-request from USCIS webpage but dont know the effectiveness of that. It is now over 45 days since the interview and approval. I may call the USCIS line tomorrow and try to 'spank' some ;)
