    Its been a long time since I had to deal with visas for anything other then tourism and there is quite a lot that is unclear to me as a great deal has changed since then. So I have some questions with regards to it all.

     

    I'm a US citizen, currently residing in California. About 14 years ago I did some contract work in China and met a girl with whom we have had an off and on again relationship through the years. I was traveling back and forth and so was she as shes a distributor and had customers here at the time, so things were working out. As our relationship progressed we decided to get married and move together, but then ran into serious personal problems. My aunt and uncle died in an auto accident and I ended up raising my niece and nephew in addition to taking care of elderly parents including dealing with alzheimer's, no joy, while on her end she lost vast majority of her work as the effects of economic crisis that was here spread and also had to take care of her parents, consequently, had to stay there to provide for her family.

     

    So as a result we decided to call it off and not go through with our plans, but have continued off and on through the years. Fast forward, kids on both sides are grown up and on their own, and all other situations resolved and we would like to pick up where we left off.

     

    So as far as I understand, our options are K-1 and  CR-1, I am unclear on both and have some questions.

     

    Last time we went through this we had to file something for DHS if I remember correctly, and the system was still paper based, not digital, between that and the actual visa filing this was a gigantic super long bureaucratic quagmire taking 1 and 1/2 to 2 years, is this still the case ? Or do we now just file for a K-1 directly ?

     

    Both K-1 and CR-1 take a very long time, is there anything else available that is faster and we can just get together and get on with our lives ?

     

    I read that the K-1 and CR-1 are seperate processes from any other visas, my girl has a business visa as she has customers here again, if we open up a K1 or CR-1 process is she prohibited from traveling to the US during that time ? I have read conflicting statements on this and would like some clarification.

     

    Once a visa is granted, would she have to quit doing business here for a while until she receives residency ? How soon can she work or move her business here or open an office ? Unclear on how this works.

     

    We actually never officially cancelled our last process, just let it expire and I did receive the expiration documents. Do we have to contact anyone for anything before we proceed again or can we just go ahead and file for visa without having to worry about getting it accidentally denied ?

     

    What would happen if we just get married here while she is on one of her business trips ? Assuming we want to keep everything legal and do not want to cause any issues, could we just do that and then file for whichever visa or residency permit ? Could she just travel back and forth as normal while that process is on file ?

    this is plainly flat out wrong. i read it, these certificates here are for people that want or need some sort of clearances, not for general use consulate certifictaes as are required now. neither me nor my fiance need any clearance, just a plain certificate for the consulate. this info is not applicable to us and most people here. i think all the info tehre is outdated, from the time when they only required police certificates from some people, not everybody.

    also it still doesnt give me the following clear and precise answers:

    where exactly and precisely do i get the notarial birth certificate and the police certificate, and are they both obtained from the same office. in in my case, is this office located in Tongjiang, Fujin or Harbin ? i do not know how these districts and Municipal Capitals etc. work in China.

    and there is absolutely no mention about Notarial Birth Certificates, just some general Notarial documents and DOS schedule. why would I need a DOS schedule when I am trying to get notarial birth certificate from notarial office in china ?

    only thing that is semi-usefull is the examples they provide, which are BTW same ones found here on visajourney and other sites. so nothing new or even useful there.

    so just to clarify, both the Notarial Birth Certificate and the Police Certificate are obtained at the same office ?

    And if there is no translation there available, she can go get it translated at a bigger city as long as it is a Notarized translation, is this correct ?

    I already asked this on the general K1 forums, but someone pointed out to me that maybe I will receive a better answer in the China regional forums, so reposting here

    My fiance (beneficiary), in Guangzhou, China, received her Packet 3. We went through it back and forth and cant find anything about the doctors appointment. When will this be required and how will we receive the information ? Will it be send to her with the interview appointment letter ? Or did they simply forget to include this in the forms ?

  6. Hi, just a quick question regarding I134, affidavit of support, item #3.

    Where it says:

    "3. This affidavit is executed on behalf of the following person:"

    Do I put my name and info there ? The petitioner, sponsor, or my fiances ? The beneficiary ?

    I looked at the DOS website, I-134 instructions, etc. but I cant find any detailed answer to this question.

  7. A similar issue happened to us. My wife called them and provided the EMS tracking number. They were able to sort it out. Contact information for EMS can be found on their site http://www.ems.com.cn

    the only thing that site lists is a phone number, 11185, and it says to call the Beijing Brach for International, which is 10, so 0 11 86 10 11185 is the phone numebr they provide. When I call it it is just auto recording in Mandarin which gives phone numbers to local branches, in Mandarin, then disconnects.

    My fiance went down to the EMS service, twice now, supposedly they have somebody "looking into it", the 2nd time she went she spoke with a manager or supervisor, and still got same reply. She also asked for her money back since they guaranteed to deliver in 4 business days and the thing is still stuck at exact same point. needless to say she was unable to get anything back and just asked so maybe someone a bit higher would get this thing going. So she is doing all she can and I would also like to call, ask and get on them about this in addition to her.

    So I am looking for an actual working phone number, to the Guangzhou EMS service, or even perhaps to the Beijing one since thats supposed to be the international one, other then what they list on their website as that is simply useless.

    If anyone knows and could let me know I would greatly appreciate it.

    I just went through a nightmare scenario dealing with USCIS and Consulate in Guangzhou, I finally flew out to GZ since my fiance lives there and straightened out most of the mess they made of our K1 proceeding.

    Anyways, she finally got her package, and shipped all the copies to me by EMS. Now it seems stuck in Guangzhou. We have used China EMS many times before http://www.ems.com.cn/ and our documents, packages always got to me very quick, 4-6 business days and without any problems.

    This time, she sent the copy of her package to me on Nov. 21. When I use the tracking number provided I get the following:

    2009-11-22 20:51:00 GUANGZHOU Posting

    2009-11-22 21:10:00 GUANGZHOU Despatch from Sorting Center

    2009-11-22 22:13:00 GUANGZHOU Arrival at Sorting Center

    2009-11-23 01:01:00 GUANGZHOU Despatch from Sorting Center

    and thats it. I was thinking that maybe its stuck in customs, but in our previous times she sent anything to me, it specifically stated "in customs" on the tracking, which it does not do this time. So our documents have been stuck pass this "Sorting Center" for about 10 days now.

    I called the phone number listed on their website, 11185, tried 10 (Beijing), 20 (Guangzhou) and (21) Shanghai. It says that Beijing "10" is their international help line, but when I called it, its only an automated message in Mandarin and then it just ends and disconnects. The other 2 just disconnect, without even giving any messages.

    So if anyone could please help I would greatly appreciated it, what I am looking for is a customer service phone number, specifically to EMS customer service in Guangzhou, and a number or extension / option, to get help in English because my Mandarin is just not adequate for this sort of thing.

    So if someone could please let me know of a phone number or provide me with a direct link where I could find it I would greatly appreciate it. I really need a number, directly to Guangzhou EMS customer service, it would help greatly if there was someone there that speaks English, just looking for a place where I could get help with this.

    Also wondering if anyone else has had anything like this happen to them and what did they do and how it turned out.

  9. Hi, I have the answer you are looking for, but you and other people here will not like it.

    I just returned from Guangzhou , went there to find out what happened with my K1. They screwed everything up, royally. Heres the scoop:

    I filed K1 I129f on paper complete all documents, letters, cover letter, supplements, photos, even some video clips on CD. Received NOA2 from USCIS on Oct6th, then nothing from GZ.

    I called about 6-7 times, each time just got referred to their website e-mail and fax.

    Tried website e-mail, replies I got were completely irrelevant, nonsensical and just flat out stupid.

    Faxed about 5 times, confirmed with my lawyer about what I was faxing, format etc. all checked out fine. Received a confirmation from my fax machine that the fax was received and printed, but nothing from Guangzhou Consulate, ever.

    Finally, since I wanted to spend time with my girl anyways, I decided to go down there and see whats going on and straighten up anything that needs to be straightened out. Heres what happened:

    1. Made initial appointment via their website https://evisaforms.state.gov/acs/default.as...Z&appcode=1

    Went to this appointment, only to find out the people at these appointments do not care, do not know anything and are in general unable or incapable of any help whatsoever regarding immigration issues.

    2. Went to see immigration officer on following Monday, November 16th 2009. You can do this if you are US Citizen or legal resident, the petitioner. Spoke with immigration officer and here is what I found out:

    a. They converted my case into electronic format, but excluded ALL my documents. They scanned the main application only and sent it from USCIS to GZ by electronic mail. They did this without my knowledge whatsoever or any sort of notification.

    b. The immigration officer was arguing with me that it can not be and that I filed electronically .... seriously. I had a freagin 20 pages of documents submitted including my fiances divorce documents from previous marriage ! about 20 photos, and like I said, even CDs with AVIs from family events.

    c. As it turns out, when they did this conversion, they misfiled our petition into a completely different category.

    d. they have different people working on these different categories that do not communicate with each other so once misfiled, the proper person(s) never get notified that the petition is there and waiting !

    e. my fiances address never was updated (she moved), either by any of the faxes or their e-mails, so they sent the package to the wrong place !!!! They finally sent it to right place after I appeared in person and updated it at the consulate myself, and thankfully she finally got it just 2 days ago.

    3. In general, the GZ consulate is rigtht down horrible.

    I fear you guys are in the same boat as I am, and I have to tell you all, the only way for you to get all this going again is for the petitioner to appear there in person, because they do not allow people that are not US citizens or legal residents to go see the immigration officers.

    Also, their e-mail and fax is an utter waste of time, they don't seem to look at it at all, and I think they just trash and recycle the fax papers without even glancing at them.

    Also, I even the immigration officer with whom I spoke was unable to provide me with concrete information about their own requirements !!!! She either didn't know how to obtain a notarial birth certificate, or what it is, that's why I asked people on this site. This is sad really. Their level or either unwillingness to help or incompetence regarding their own requirements, procedures, etc. is amazing.

    So my advice is, stop faxing and e-mailing and waiting for a miracle, just get on the plane and go do what you need to do. Please also, document all your fax attempts, print out any e-mail they replied to you, etc. If you don't the immigration officer wont even want to speak with you. They will just dismiss you and tell you to go e-mail.

    Its sad, its scary, its wrong, but there it is folks. Its the US Government at work, doing everything in their power in order not to help us or make things right when they make mistakes. BTW, I just returned from Guangzhou Nov 21st 2009, and my girl finally received a package just yesterday. We will see whats next.

    I just came back from Guangzhou on Saturday, Nov. 21st

    The quarantine situation is definetly relaxed, but if they see you with anything as much as a common cold or a little bit of diahrea which is common to get on long flights, they will lock you down for 5 days observation just in case and to see if it doesnt develop into something far more serious.

    My best advice is don't get sick. Before you go do the following if you arent already:

    1. Do some exercise, especially cardio-vascular so your body will get stronger.

    2. Start taking vitamins about 1-2 weeks before you go, especially vitamin C. Also, take at least 1 just as you are getting on the plane and 1 more with you take it like 2 hours before you get off.

    3. 3-4 days before flight, start taking 1 pepto bismol a day. This will help with any stomach problems that might pop up.

    4. take a weak 24 hour lasting anti-allergy, decongestant pill just before you get onboard. This one helps a lot, as even if you get some allergies they will think you are sick and stick you in.

    5. Go to your physician / insurance HMO, and do all travel vaccines, especially flu shots. I have Keiser and ended up taking 5 vaccines altogether before my trip. Vaccines are great because they will continue working even after I am done with my trip.

    Obviously eat a little better and get extra sleep / rest a few days before flight too. Basically, do not display any signs of sickness when boarding, on board or arriving in China. Once there don't worry too much.

    And make sure you do not make a mistake and check a box that you are sick on that form they give you.

    Yesterday I (the petitioner) have visited the US Consulate in Guangzhou, China, regarding our proceedings. One of the issues me and my fiance are having, is that she can not obtain an original birth certificate. It is simply impossible because of the time and place she was born at.

    We have been told by immigration officer to obtain a "Notarial Birth Certificate" instead. I have never heard of such a thing before and unfortunately trying to get the immigration officer to explain to us what it is or how to get it was like banging my head against a brick wall.

    So could someone please explain to me in detail, what exactly and precisely is a "Notarial Birth Certificate" in China and how do we get one ?

    Is it a letter written by a witness which has been signed and notarized ? or some sort of a police or other record from her home town ? or is there an actual document named as such in China ? and how do we get it ? Where do we have to go to obtain one ? her home town ? which agency or institution ?

  13. Make sure you provide both your DOB and full name along with the case number and your beneficiary's DOB and full name in any correspondence. Put this in a fax with your signature or for good measure have what you fax notarized first.

    of course i have.

    provided GUZ#, USCIS #, both hers and mine A#s, phone numbers, addresses, e-mail addresses, dates and places of birth.

    there doesnt seem anything left for me to provide, its getting frustrating and rediculous.

  14. On Oct.6th 2009 I received NOA2, USCIS #WAC********, petition approved and sent to Guangzhou, China Consulate.

    My fiance moved and changed address at the beginning of the month, October 3rd to be precise.

    I am having great difficulty to get her address updated.

    Things I have tried so far:

    Called NVC, they informed me our petition has been forwarded to the consulate, and provided us with GUZ #.

    Called Guangzhou Consulate. I was told to use the webform e-mail to do it. I used the webform e-mail, provided all information as requested. The 1st time was on October 20th, and I received the following reply:

    Dear Mr. Z*****

    Thank you for your inquiry.

    Since we are unable to distinguish whether you are the petitioner based on the email account you are using, in order to protect the petitioner and the beneficary,

    we suggest you mailing or faxing us your inquiry with your signature, mailing address, the zip code and the beneficiary’s contact phone number.

    We will either reply to your inquiry by mail or get back to the beneficiary by phone call after making sure you are the petitioner.

    I have then repeated the e-mail and also made a fax document which I have faxed to the number provided. I also repeated the e-mail and fax at 7 business days interval since the

    If these records are not updated properly and in a reasonable time, any mail send from the consulate to her address will either fall to the wrong hands or be returned to the consulate and she will be unable to get it, causing our case further delays and problems.

    So please help us update these records.

    That is the fax I have sent to them. I am unable get any sort of response whether our address has been updated or not, either by e-mail, phone, or normal mail.

    Also, to this day I have not received any confirmation that our petition package has actually been delivered to Guangzhou, also no e-mail, letter or phone. And yes, I have signed up for e-mail notifications at the USCIS. And this

    worries me because I talk to other people going through this and hear about their petitions getting lost, not delivered, etc. So how long does it usually take for what people refer to as the NOA2.5 ?

    Also, I do not understand their reply, as the e-mail account I have provided is listed on our I129F petition, as well as all other records pertaining to this,

    So that part of it is just plainly wrong and incorrect. Also, how can they be unable to verify who is who when I provided them all our correct records, all they have to do is pick up the phone and call USCIS, or her or myself. I don't get it.

    My biggest worry is that the consulate will send her something by regular mail, and that mail will fall into wrong hands, or be returned to consulate, causing us further unnecessary

    delays and many problems, so it is imperative we get this updated before that happens.

    So as I have stated, I tried by phone, tried by their provided e-mail, tried by fax, I am just unable to get through to these people. What do I do now ?

    How do I update her address information since those options did not work ?

    Also, I am going to China, to be with my fiance, in Guangzhou, starting November 7th and I will be returning on November 23rd. If this can be done "in person" at the consulate,

    then we will be glad to do it, but can it ? Or is it just going to be the same kind of treatment I received over the phone where I just get told to go to their webform e-mail ?

    Any help with this would be really appreciated. I don't want to become one of these nightmare cases where they end up losing our case and we have to get senators, congressman, lawyers etc. involved in all this.

Add to that she changed her address at the start of this month while our package has been forwarded from USCIS to its next step. Also we are trying to get prepared ahead of time and are having some difficulties understanding and gathering rest of the records required.

    ok, so here goes:

    1. Where is my package heading now ? is it DOS or NVC ? and who should I call with her address change ? Also I do not know if I have correct phone numbers, I was unable to come up with a specific during my searches. I have NVC at 603-334-0700 and Department of State at 202-663-1225. Are these the correct numbers or is there some specific place / bureau I am supposed to call ?

    The National Visa Center (NVC) is part of the Department of State (DoS). Your best bet would be to call the NVC (you have the correct number) with your USCIS receipt number (the one from your NOA1) and they'll be able to give you the NVC number (begins with the letters "GUZ"). They'll be able to tell you if your petition has already been sent to Guangzhou. If so, contact the Embassy using the online email form to inform them of her new address:

    2. She was born over 30 years ago in a very small village far in rural China. It is a very simple and beautiful place and people there still live in clay huts even now. Unfortunately for us, they just dont have the kind of records we are used to, and we are unable to obtain a birth certificate. Although she has a residence book, ID, passport, etc. What can be done here ? Can someone please share some info, or please point me to some examples ? Also I do not know Chinese documentation and I do not understand this "residence book" thing. Would this suffice in lieu of birth certificate ? I am in the dark here.

    The "residence book" is a simple register that contains a record of the people living in a household. It is traditional in many East Asian countries. The "residence book" will probably not be accepted in lieu of a birth certificate, but it can often be used (along with supporting evidence) to get a notarial birth certificate at a notarial office in China.

    3. Police records. Will we have to go through all the cities and obtain letters from the police ? If so, can someone possibly post or point me to an example of one ? I doubt the local police stations have such "forms" on hand.

    Police certificates can also be obtained at the local notarial office in China. Only 1 police certificate per country is required.

    Ok, thank you, that clears up quite a bit. I am still a bit unclear about the police certificate. So if there is one certificate, she can just obtain it at any police station anywhere ? So this way if we just go to the police in Guangzhou we can get a general type of certificate there ? And is there a specific form for this ? Or is it basically just a signed and / or notarized letter ?

  17. after NVC sends the package to China, your package is probably stored somewhere in a warehouse, because Guangzhou Consulate is not ready for you, after NVC sends it, expect another 2-3 months wait, if your lucky sooner, but usually 2-3 months, check out my timeline.

    ok, i understand the waiting period, i am referring more specifically to some sort of confirmation that they have actually received it though. my USCIS period was over 5 months but I got my confirmations right on time and pretty much immediately.

    ok, this is what you do

    Call the National Visa Center to make sure that it actually left the US for China

    then after you get that confirmation, call the department of state (DOS) to check the status, DOS gets the status from Guangzhou Consulate, so it's current information.

    me and my fiance filed our I129F with USCIS, on Monday, October 6th I received NOA2 that the package has been forwarded to the appropriate consulate. Since she, beneficiary, lives in Guangzhou China, then it is pretty safe to assume thats where it would be going. I have been told that it usually takes about 5 days for the package to reach the consulate, today is the 15th, and I still have not heard anything either by regular mail, or e-mail.

    So my questions are the following:

    1. when should I become concerned about this and start calling ?

    my fiance and me are in middle of K1 proceedings, just received NOA2 today, and she just changed her address, she is the beneficiary, living in Guangzhou, China.

    I will have to change address when our package gets to NVC i think, my question is, are there any specific forms for that or do I just call them ? if so do I call consulate in GZ or local department of state ? or how does that work ? I am sort of in the dark on this subject.

    sorry, i didnt post complete info

    I am the petitioner, she is the beneficiary, she currently lives in Guangzhou, China, and will be moving very soon to another city, either Shanghai or Beijing, wherever her work assigns her, this will be most likely by the end of this month, as you can see from my timeline, our estimated NOA 2 date is Oct 1 - Oct 11, so its coming very close.

    thank you for the advice so far, and yes the mail system there sometimes sucks :( most things get through most of the time, but sometimes we have problems.

    we get around it by using EMS so we have precise tracking numbers, and if they mess something up at least we know when to call post office and she can go pick it up directly if need. her job also complicates things because like i said, she often has to travel and if she doesnt know something is waiting for her they will send it back. when we use track numbers she simply tells the post office to hold the delivery for her and not return it to sender.

    so i got a little bit of a problem here with this package 3.

  22. hi, i am unclear about the process for K1 visa around my NOA 2 and / or right after it. specifically, what is it and at what stage that will be mailed to my fiance ?

    also, we have about 2-3 weeks left until the estimated NOA2 date, and she has to move, how do I go about her change of address with the I129 still at USCIS ? or should we just wait until it gets to the next stage ?

    I am worried because she has to do some traveling due to work and family, and the change of address, if she is not there to pick up whatever they sent then it will be returned to sender and we will have more and further delays.

    please help if anyone has any info
