    US immigration policy allows only US citizens and/or lawful permanent residents to petition their sons and daughters. The nieces and nephews are not permitted to be beneficiaries of a petition for immigrant visa unless they are considered adopted children.

    You may want to look into the possibility of judicially adopting your niece and then file for her immigrant petition as your adopted child and do this ASAP before she turn 16.

    Honestly, you were wishing for an impossible thing as there were bunch of requirements for it if you check the adoption policies of the US and Philippines.

  2. What if you don't want to change your last name to your husband's last name? Do you still need to report???

    My USC husband petitioned my daughter(his stepchild) recently, and my daughter's Birth Cetificate only shows my name, without her bio-father's name on it. Her bio-father abandoned us when he knew I was pregnant, so we were not married at all.

    Do you think I need a CENOMAR or Report of Marriage for my daughter's interview???

    Reporting of marriage is not mandatory. You are only required to submit ROM when you want to use your husband's last name but it's a good thing to do I believe so the marriage will be recorded in Philippines.

    CENOMAR is for K1 applicants and you're already married so there's no point of applying for it. Since you have full custody of your daughter it should be easy for her to follow you here in US and when you apply for Citizenship in the future, she will benefit from it and acquire citizenship as well (before child turns 18)

  3. I've been reading this site since last Dec 2009 and joined last Feb 2010, as I filed my petition las Feb. I got an approval last Apr 5, had medical last Apr 19 (and done today) and planning to have interveiw in 4th week of May. I have to call USEM to arrange the appt interview.

    Okay, you have already approved NOA2 from USCIS, call NVC, several times, until you have MNL# case no. Email your fiancee the copy of NOA2 and the MNL# case no. She can go to St. Lukes and do the medical. The guard wouldnt let her in since she doesnt have any appt letter from the embassy. Show to the guard the email, with NOA2 copy and MNL#. Convince the guard that you travel far just to have the medical, and most likely the guard will let you in.

    Call NVC again and again, until you would know on when they ship to Manila. In this way, you can track on where and when the package is. And did you know that, it is the date when NVC electronically sent your case to USEM? So which mean you can call the embassy so schedule for interview. You can verify my sending an email to USEM, inquiring to schedule for appt interview (be sure to email 2-3 days after your pkg ship from NVC to MNL), and put all the information on your email - MNL#, petitioner/beneficiary - DOB and email address. And a day or so, USEM will email back that you can arrange an interview.

    Well, in this way, with above information, you can plan ahead of time I hope these help everyon and future VJers.

  4. I think February applicants progress is extremely slow.

    I am waiting since 3/9/10. No updates on USCIS site, its stuck on initial review.

    Contact the USCIS and ask about the status of your application. My online status has no touches either after NOA1 still on 'initial review' but USCIS sent an email that I don't need to take biometrics anymore. I made phone call before they sent the e-mail so I guess you really have to follow-up sometimes instead of just keep on waiting.

  5. I remember our experience in Quezon City hall. We came from the US embassy to get theCertificate of Legal Capacity to Contract Marriage , then straight to the City Hall to apply for the Marriage license and then attended the seminar after lunch . We didn't hire a fixer to get things faster, I just talked to the people conducting the seminar,I told them that I needed to finish the seminar that day cause we already have a wedding date, they saw that me and my partner are really eager and sincere to have that seminar so they just put extra seats in the seminar room, kicking.gif .The people in the City Hall are educated and very helpful, you just need to present yourself as decent/educated and not like cheap bar girl marrying a foreign national. We finished everything in just one day! We just came back to get the license after some working days and get married the next day.

    It is not nice to judge any person dear just because of their social status… :bonk:

  6. Congratulations on your pregnancy! It's going to be difficult for couple of weeks after you give birth but after that I'm sure you'll be fine. In Philippines, life is easy if you have the money, you can hire a nanny to take care of the baby or maid to do the house chores while recuperating from giving birth but here in US nope, family is away, unless in-laws are near they can offer some help if not, basically you are on your own with the baby after hubby goes back to work.

  7. A drivers license would be a good thing too. It would open up new opportunities for her.

    I agree. Everything is spread out here and not all places has good public transportation too so most people really have to drive.

    I skipped the biometrics! :dancing: I received e-mail from CRIS this morning and thank God, I won't have to wonder anymore if I have to do bio or not. :P

    E-mail says:

    "Recently you called to inform us that you have not received a biometrics appointment letter. After checking our systems the biometrics taken on 03/28/2009 are still valid and you will not be scheduled again. We are sorry for any misunderstanding and thank you for informing us of this matter.

    The current status of your case is that you are in the queue for an Interview Appointment. You should be receiving this appointment notification within the next 60 days. If you need to expedite your case further, you may contact your local District Office."

    Also a Texan married to a filipina. We bought 500sq.M and built a beautiful 4br/ 3CR

    Western house to my specs with a 3meter high wall around the whole property. The construction was all first class. We built in San Pascual

    Batangas in the province not in town. Maybe we spent 4m PhP for everything, land, house, furniture, landscaping, wall and steel gates. We already turned down 6M Php. Its all in where you want to live and how far you will travel to town!

    We LOVE our house and the neighbors ore like FAMILY! Thank God!! Good Luck but be careful, for 18m you can build on the best golf courses.Totoo..

  10. You were put in an administrative processing? Embassy has to do background check on you probably. What did the Consul asked you about the NBI record?

    It may cause a little delay just be patient and pray. Hopefully you will have your visa soon.

  11. I'm confused about the requirements of ROM. The LA Consulate website has consular forms section. However, the checklist are not the same as what's written on their Procedures and Requirements for ROM...Which do you follow? And btw, their form is too old, says last revision is Oct 2004? Ah well..

    I followed the requirements/procedure portion but you also have to check the provided list of requirements so you won't miss anything and also send copy of your Green Card or Proof of your immigration status here in US. Agree that the forms needs some upgrade. It won't happen anytime soon I guess. Good luck.

  12. May I reiterate? You're saying for report of marriage, you don't need to personally appear to the consulate office? Just have the documents needed ready then you can mail them yeah?

    Yes, Report of Marriage you can do it by mail but for passport application, they require personal appearance.

  13. Hi, I hope someone could help. I'm a Philippine green passport holder which is good until April 2012. Is it necessary to renew it with the machine-readable even if it doesn't expire yet until in 2 years?

    I'm planning to go home this year, would you recommend having the passport renewal ( married name change too ) done in the Philippines? Thanks!

    PH Green passport is valid until the expiry date so don't worry…be happy…lol

    If you renew your passport in Philippines under married name, make sure to submit REPORT OF MARRIAGE ABROAD to the Consulate in L.A. You will be asked for it when you renew your passport.

  15. My fiance specified in the form that the preferred consulate is Manila, Philippines. NVC said they sent it to Hong Kong because I'm in Macau. Next week I'll be back in the Philippines for good. He called both embassies and they said to send an email and so he did, but I'm just afraid it will cause such a long delay on the process. I will keep you posted on the developments. Thank you so much.

    I wonder what is the solution to that…That is a mess. Did you notified NVC that you will be in Philippines for good and filed Change of address also?
