hi everyone. i hope i can get answers in posting my situation here...i Have a son...i am the mother and a natural born
american citizen...i was born in the united states...i did not grow up in the US...i grew in the philippines. my mom was
working in new york when she had me but decided to live in the philippines when i was still an infant.
i never gave up my american citizenship and i never got filipino citizenship. so basically i was an american growing up
in the philippines. i only spent vacations, holidays and summers in america while i was growing up.
i am married to a pakistani...we met in the philippines ( he is on a student visa). i gave birth to our son last 2007 in the
philippines. i tried to get CRBA and a US passport for him because i am am american citizen and I am his biological
mother. but the consular in the us embassy in manila, philippines said my son can not claim his us citizenship because i
have not been present in the united states for 5 years prior to his birth...she adviced that i should petition my son if he
wanted to come to the united states with me, meaning he should get a filipino/pakistani passport for his immigrant visa.
well, my family and i decided for me to come to america first and establish domicile here. so i left my husband and son
back in the philippines. i got a job and i have been away and living here for 7 months now. and i want to petition my
husband and son.
i know that i have to file separate I 130's for each, one for my son and one for my husband...the thing that worried me
the most is that my son's will probably take only a couple of months and his visa will be ready much earlier than his
fathers...after all my son is only a child...and i researched that it would not even take more than 5 months for my son
to get his immigrant visa. and when he does get his immigrant visa, and enters the US it will not be very hard to get his
citizenship because he will be in my custody (USC parent custody). of course i want my family here but i am working...i
work at hospitals and if my son's visa comes earlier than his fathers...how can i take care of him (a 1 year old) alone
and go to work. i wanted my husband to come first and maybe after 3 months my son...so i will see if my husband can
get a job here too and so we can manage out finances before my son comes...of course we want a place well establish
for my son when he enters the U.s.
I am assembling our package and i have most documents with me already. but i am torn about whether i should
already do my son's with my husbands I 130...im sure my husbands will be a longer journey because he might run into
some A.P. (administrative processing) and i dont want him to be left behind. i tried asking some immigration lawyers
but they did not give me an good answer...most of them just commercializing for me to hire their law firm...
i asked that if my send both I 130s at the same time...would my son's affect his fathers by maybe speeding up the
process? or what if i send my husbands now and my son's 2 -3 months later so their visa will be issued together?
please help and advice....i know its a little personal but i want to hear your opinions...
also have a couple of questions regarding filing out the I 130...if i decide to do my husbands and son's I 130 and send together..one for each...in the last question...
1. If separate petitions are also being submitted for other relatives, give names of each and relationship.
(for example this is my husbands I 130)... Name of son...(my son/child)?????
2. Have you ever before filed a petition for this or any other alien? YES (obviously my son)
If "Yes," give name, place and date of filing and result........
Son's name, (place)--don't know yet because im still sending the initial I 130's for each, both of their I 130's going together...(date...the date when i signed their I 130;s??)
please help! greatly appreciated

i dont know if they will give her a visa...like a tourist visa? but just file the I 130 already soon...

3. copy of my birth certificate (from the REGISTRAR’S OFFICE of my town in New York)
4. marriage certificate - in this case the NSO copy because we got married in the philippines
5. my G325a
6. husbands g325a
7. photo of me
8. photo of my husband
9. our evidences of a bona fide marriage: our son's birth certificate (NSO copy)
Life insurance I got from them
a copy of me sending money through western union
4 - 5 pictures (still choosing which ones)
for my son:
1. his I 130
2. check for 355$
3. NSO copy of his birth certificate since he was born in the philippines
4. a copy of my birth certificate
I think I shall include a cover letter too indicating which papers are for which I 130 and i think I need to paper clip my husbands papers together and paper clip my son's as well... did i leave anything out?
i am concerned about my birth certificate, my mom gave my a copy of the one she had ever since i was born but it ripped so i ordered from the town that i was born in in new york, through the REGISTRAR’S OFFICE...i hope that is okay.
and also if anyone knows about the NSO copies from the philippines, I will send the original marriage certificate and birth certificate for my son but will just send a copy of our proof of bona fide marriage og my son's birth certificate...

also...im not even 100% sure that I will send my son's with my husbands...i was thinking my husband first then after 1 -2 months my son? this is the situation...i am worried that if i send my son's and husbands together my son's would be approved months and months before my husbands and it would mean my son would come first before my husband. of course i would love my son to be here (yes i am his biological mother and i am an american citizen by birth but he could not claim citizenship through me because i did not physical live in the united states for 5 years prior to his birth so i have to petition him) but how can i work and support my family when it will just be me and my son. i wish that if i do them together then it would speed up the process of my husbands but i doubt it...im sure my son's will be done in about 3 -4 months because he is only a child 1 year old. but how i can i take care of a 1 year old all alone and i have to work? but i need my husband here with me too...
i feel like im betraying my son if i file for my husbands first...i am so confused and lost....i just miss them so much and im planning to visit the philippines after i file my I 130...imagine a mother being away from her son? what should i do?

what do you mean less than two months old? i got these copies before i came to the United States...whihc was in july 2007 pa? the NSO certificates have expiration dates on them?

i was just reading some timelines and i noticed CSC give away NOA2 after 3 -4 months while VSC gives it after 7 -8 months...whats wrong with Vermont? but i dont think we can choose which service center...
depends where you live i think, but sometimes people get transferred to CSC from VSC...can we write a request letter for this?

i currently signed up for life insurance with my son and husband as the beneficiary...only 9$ a month and the insurance is 150,000$...not much but its just for now, another evidence for a bona fide marriage. also i just sent 100$ to him...not that i do that and he needs money from me but just to show we have co mingling of finances since i can not add him into my accounts here in america (ING and checking accounts) because he has no SSN, i'm including that and maybe 4 -5 pictures or him, me and my son before and left and pictures with me meeting up with his uncle in the United States and him with my parents.

We are going the K3 route and proceeding with the I129F at the embassy. Should we ignore letters from the NVC we receive for the immigrant visa petition?
We got a letter from the NVC about a 'choice of agent' and a request to pay the AOS fee. Should we just ignore these?
Also what happens if a person were to go through this whole NVC process with the I130, and still take the K3 interview and come to the US on a K3 visa. All the fees and progress with the NVC with the I130 would then be wasted?
No, your money would not be wasted.
I just called NVC today. They explained that a person can either adjust status once in the US on a K3 visa OR continue with the I130 immigrant visa process. If you choose the latter, you will have to travel back to the country of origin for the immigrant visa interview at the US embassy.
...i have a question about this, so its obivous for the K3 to be filed in the country of marriage meaning the interview for K3 would be at the US embassy of where the marriage took place? what about for the CR-1 or the IR-1? does the interview have to be in the spouse's country of origin or where our marriage took place (you see our country of marriage is in the philippines and my husbands country of origin is pakistan). in my I 130...to that question...i put US Embassy, manila philippines as our consulate...we prefer that he does the interview in the Philippines rather than going back home to pakistan...anyone have any idea?

yeah ill just send the original NSO's...good thing I got 2 copies...and my husband and my mom have a copy for them too! MISS THE PHILIPPINES SO MUCH...SO FREAKIN COLD HERE

YUP I HEARD ABOUT THAT...just open another savings account and send the atm to the philippines....my husband doesnt actually need money...im just doing this for evidence of a bonafide marriage...co mingling of financeS?

i know but there are certain requirements you have to meet in order for your son to acquire citizenship if you are a USC...i missed out on one so i have to do it the long way for my son...

lucky you! and lucky your son too! i couldn't do the CRBA for my son although his mother is a USC, i was born in the US but i grew up in the Philippines and went to school there. I didn't meet one requirement...which was to have lived in the United States for 5 years before my son was born. I even talked to the consulate in the US embassy in Manila before I left for the United States but she said I would have to file for a petition for my son.
So now my son has to get a filipino passport and I have to petition him...the IR-2 route...but its all good, i mean he would eventually get his US ctizenship once he enters the US and lives in my custody...I also wanted to file thru DCF at the US embassy Manila when I was still in the Philippines but i didnt have a job, no financial support and no one wanted to be my co sponsor...anyway not bitter about that...at least i fought through for my family, graduated, got my a$$ back to the US and found a job...SUPERMOM and WIFE huh?

hello people of the philippines...what did your USC spouses send for the I 130? a copy of the NSO marriage certificate or the one from the local civil registry? if i photocopy the original NSO copy...it wont be very clear? or should i just send the original NSO marriage certificate...its easy to get another copy anyway from NSO in the philippines right?

i know that my son's birth certificate would probably be enough but i dont want them to give us a reason for an RFE...better safe than sorry right? also, for the marriage certificate...just a copy right? and not the original? for the I 130? did anyone from the philippines send a copy of the NSO marriage certificate or from the local civil registry?
