  1. I'm looking for some help on getting "Evidence of a Bonifide Marriage" for my I-130 (AoS from B2 visa).

    1. Documentation showing joint ownership or property; or None

    2. A lease showing joint tenancy of a common residence; or Because I don't have a SSN they wouldn't put me on our lease until I have one.

    3. Documentation showing co-mingling of financial resources; or We sent a form to his bank to add me to his bank account but they are taking a LONG time to do it.

    4. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or None

    5. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or We are co-renting with my husbands best friend and wife so they are obviously aware of our marriage. We can go to the lawyer on the military base and get something like this but I'm not sure what we should write in the affidavit.

    6. Any other relevant documentation to establish that there is an ongoing marital union. What else can we use? I just came here in January and got married in February. We really don't have much together because I don't have a SSN and they won't add me to anything. He did put onto his medical insurance (tri-care) at work. Would that also be proof?

    Back history - No, I did not intend on getting married when coming here. I came here Jan 16, 2009 and we got married Feb 10, 2009.

    So your saying that in 25 days you met and fell in love with the partner of your dreams?

    If so, then you may be having problems demonstrating that it is a bonifide marriage because perhaps its not????

    This is going to have a huge weight on your application.

    If you married under 30 days, in most cases they are going to assume you had intent.

    If you married 30-60 days it is usually upto you to prove you had no intent on staying n the states (showing your ties back home, mortgage/lease/job).

    In most cases if you marry after 60 days they are a bit less strict regarding the intent issue.

    Ive heard this from several people on this forum, AND 3 different lawyers I have spoken to. Ive had one tell me to just come down and marry after 90 days and all will be fine. But I told him I want to do it the right way where I have no chance of being barred from the US to visit my husband and apply for the CR1/K3. Ive had another tell me the same thing, but marry after 60 days. I was shocked to hear that they all said to just cross over and do it, I dont want to risk being with my husband for years. Short term pain for long term gain. But the thing that they all had in common (the lawyers) was they all said do not marry before 60 days or in most cases its a lot harder to prove intent

    Since your marriage was so fast after coming into the US, I hope you have a good immigration attorney

  2. Im 26.. and I dont have my records from when I was less than 14. My old doctor moved out of country and havent heard anything about that since.

    What do I have to do to prove I had my vaccines as an infant, etc?

    All I have is a photocopy I got in the 10th grade from the schools health district showing what vaccinations I had upto then, and that I was needing a booster.

    Is that enough to show the dates I had my vaccines before highschool?

    Or is there something I can have my Family Doctor do now to make sure I have everything I need upto date?

  3. I got a quesiton about this Child Support Stuff. Im the non USC (Canadian). My exhusband owes quite a bit a month in child support to me (since its Canadian its non taxed income to me).

    Can my USC husband claim that amount that we get for my children here in Canada (we havent filed for CR1 yet as we havent got married just yet) when we do get married can he use that Child Support I receive as moneys received?

    The last time I crossed at the POE (Halifax), I almost didnt go through. I had a return ticket, but I didnt have a copy of it, just a confirmation # from the email I got from Air Canada.

    I was going just for 11 days and they hounded me. And my proof was that I have a mortgage here in Nova Scotia, and I have my two children who I have custody and primary care and control of, to come home. But just because I couldnt show them my return ticket, I just about got sent back home... until they had me call Air Canada and confirm with them at the POE that I indeed had paid for a ticket to come home on the date I indicated. And that was with my ties.... and with me only being gone for less than two weeks.

  5. LOL! I love hearing about other couples meeting on MMORPGs! Thats how Dave and I met too.. we talked in /tells for about two years and on ventrillo with linkshell events. And then it miagrated to MSN then skype and then we started dating in the summer :) Orlando was our 'love at first site' too at the airport when he picked me up lol!

  6. I called today and kept getting different answers.

    One said I have to file the RC65 right away when I get married and include proof of his US income so they can re-calculate my benefits.

    One said I have to file the RC65 right away but his US income wouldnt be calculated

    But both said that the RC65 has to be sent in right away after a marital status, or else if your recalucation means you are getting less.. then you are going to owe back pay to CCTB from the month following you got married.

    Once DF and I get married, since he is a USC and hasnt lived/worked in Canada, what do I do when it comes to my RC65 (change of marital status)? Is it going to change my amount from CCTB with his US income (hes not bio dad)? Or does his US income not count? Not sure how all this is going to pan out, with the government, when they ask for my spouse's SIN # and he doesnt have one, and how benefits are going to work

  10. Was your preferred POE one of the ferry crossings between Ontario and Michigan along the Detroit River? When I activated my K-1 I went the week before to the Algonac ferry crossing to ask them in person if they did K-1s. The border official reassured me that they did indeed do them and it wouldn't be a problem. So, we showed up the following week and a different border guard was on duty. She refused to do the K-1 and we ended up having to travel north to Sarnia/Port Huron. When we finally got the visa activated there they told us that Algonac could indeed do the K-1 and were surprised that they wouldn't. So, I think it is up to the individual border guards whether or not they want to be bothered. I had done everything I could to verify that we would be processed at Algonac but luck of the draw was we got the lazy border official. If I had had any idea that would happen we would have headed for Detroit and saved ourselves nearly 5 additional hours of travel as well as the aggravation.

    Yeah, it must be upto the individual. Ive heard of two different people crossing through no-where NewBrunswick, one person got through activating their K1 , but the POE officer had no idea how to do it, but he did it... and I remember them saying it took a while.

    Then another person went through and was told they didnt do them

  11. This thread was interesting to read, lol. Im Portuguese, and therefore my European DNA sure didnt bless me with the 'light hair' gene..

    Im too chicken to do a brazilian, I hate pain. But I do wax (just not brazillian). And also gotta wax my upper lip... its light, but the ends of it have a few darker hairs that drive me nuts.

    Another month and im down in FL with my sweetheart for 2 weeks!

    Thats when Im hoping he will officially propose to me :P Even though we knew we wanted to get married a long time ago. If not, I have a big feeling its gonna be the 4th of July weekend that Im down in FL visiting... but I can always wish :P
