  1. My NOA 2 never came in the mail. I called USCIS and they told me I need to file form I-824, but that's a 340$ paper. Is there any way that I could get the NOA 2 without paying? Also from what I understand the NOA 2 is only needed at the AOS stage, is this correct?

    Why do u need NOA2 now?

    Your PAcket 3 is already at the embassy which was ffd from the NVC.

    If u werent approved NVC wouldnt have u sent u the packet.

    You Both will received the PAcket 3. What u can to is go to Manilla US embassy and check out what 's included in the PACKET 3 and start gather all the required documents.

    here FROM THE GUIDES

    What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

    2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

    3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).

    4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

    5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.

    6. A copy of the NOA2 that you received in the mail.

    7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

    Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

  3. As you know, I am the most impatient person....

    I have just called NVC and the AVR still has the same message. I check mine and my husbands email every hour waiting for the bloody AOS and IV bills. I never thought I would be so eager to pay a bill..LOL.

    I can't wait anymore!!!!!!!!!!! Can we get some sort of expedite through NVC??????

    CALL NOW!!!!and Talk to the Operator and asked if u can get ur CASE#.

    U'll need a case # to pay for AOS and IV.

  4. This is a pretty specific query. I've searched the various forums but have not found anything on it. We have been out from the USA and when we return it will be about 10 months out. The intent when we left was a 3 month stay in Thailand to visit her family but due to an illness with her mom, while we where here, she had to stay on to take care of her and the situation. If we knew before hand we would of applied for a Re-entry permit,

    So when we return in June she will of been out for about 10 months. With everything I've read it is the sole discretion of the immigration officer, upon arrival, to let one back in with a green card and being gone for more then 6 months but less then a year.

    I am trying to avoid any real problem upon our return and was wondering if anyone had any experience with the BKK US Consulate on form DS-117; Application to determine returning resident status. Any pitfalls, dos or don'ts.

    She has been a permanent resident for 8+years now.

  5. My wife is a conditional resident about to apply for change of status. Problem is we haven't really moved to the US yet. In the last two years we've been looking for a house and jobs, while we tie up loose ends in our previous country of residence. We have only been to the US three times during the last two years, and each visit was under a month, but we’ve never gone over the one year limit. Immigration isn't going to like us coming back again with a return ticket. Most likely they are going to want an explanation. What is a valid reason for being abroad? So far I've thought of a couple things I could say and show evidence for:

    a) My wife is studying abroad

    b ) I've been conducting PhD research out of the country

    c) My wife's mother has been very ill

    Which one do you think is the best, or should I say something else?

    Please help! Our two year old daughter and I are both US citizens and I don't want my wife to be exiled, because I can't live in her country on a visa forever...I just don't see how the US government could separate a mother or father from their young child.

    You should say all three, if they ask.

    But the Bigger Headaches will be when u filing I-751 for ur wife.

  6. the nvc just recently recieved my ds 230 package.how long the review process before it becomes case complete? Is it advisable to email them to ask if my case already complte or any other documents missing?or I just wait for their mail.But mail here in the Philippines is too slow, for almost 1 month to arrive.any tips please

    Why not have ur petitioner called up the NVC,instead of u?

    you could call up the nvc after a week.

  7. Even though you can't go inside for the interview, I think it is a good idea to be there waiting anyways. You can give her your passport to take to the interview.

    I agree. It will mean a lot to her, among other reasons.

    Yeap. It'll Be like Once in a Life time and Very important to her.

    AFter she passed the Interview , It will be the One of the most Happiest time of your life.

    I Plan to go and be with the wife on the interview day, even i know i'll be just wait at the waiting area.

    Should i just give both names to ease any confusion and on QUESTION 7.YES

    on the I-129f should i also put FIRST and LAST to show the other names that was used? ur 1st, middle, and last

    My wife stayed most of her life after 16 in Dubai,UAE. She has a dual passport - BRITISH and PAKISTANI. So when i applied for her GC, i used her British passport etc. Now when we applied for her police cert, the info on it shows her pakistani passport number. What should i do now? When i do eventually go through NVC, will i have problems?

    You dont do anything. you Just wait til the NVC ask for documents.

  10. hey guys! i just got my choice of Agent form DS 3032. but i havent yet recieved my AOS Bill. does anybody know when it is mailed by NVC and recieved by the petitioner. i havent mailed back the DS 3032.

    if u appointed urself a choice of agent, u will be getting it soon.

    My wife and I will be going the B2 route. She has all the qualifications to go abroad as a tourist on a tourist visa. My question is, how much does she need to have in her bank account to proove to the officer at the embassy during the interview that she is financially able to go to the US for a period of time?

    Did she received any paper from from CO/embassy?

    This is the 1time hearing by Fiancees getting railroaded at the embassy by COs.

  13. Our interview is scheduled for April 20, but mu hubby has only visited once. He stayed from Jun 18 2008 to July 27 2008 and we were married during that time. Since then he hasn't visited, but we have kept records of our Yahoo Messenger conversations and we've spent time together online every day. We've also exchanged cards and gifts through mail.

    Do we have reason to fear being denied since he hasn't visited, even though we have kept in regular contact with each other?

    if u must , u should bring bring the TRAVELLER"S CHEQUE to philippine in person.

    That way u it could get there once and u know the plan, and could talk to the ppl who will build the house.

  15. This is Nathaya’s minute by minute recap of her US Embassy K1 Visa interview in Bangkok, Thailand on 3/19/2009. Her interview was approximately 5 minutes in length. She waited approximately 1 hour before her name was called. Three other Thai women were interviewed before her, each one leaving with their passports (not a good sign). After her name was called, she approached window number 5 and the following illustrates her interview:

    The Embassy Interviewer (E.I.) gave instructions to Nathaya to scan each of her hands/fingers on the electronic scanner for identity authentication.

    The E.I. then gave Nathaya a compliment about her hands after she finished with her digital fingerprints. (She had just freshly manicured and painted her finger nails)!

    What is your name?
    ” the E.I. asked.

    “Nathaya,
    ” she replied.“

    "
    Is your Fiancé’s name, Christopher?
    ” the E.I. asked.

    Yes
    ”, she answered.

    "
    What do you call him?
    "

    I call him, honey
    ”.

    Ok, I’ll call him Chris,
    ” the E.I. stated as they both chuckle.

    When was his first trip to Thailand?
    ” he asked.

    His first trip was in May of last year
    ”, she responded.

    The E.I. then opens up a small photo album that Nathaya prepared. It contained pictures of recent trips and photo moments of places we visited together.

    ” the E.I. asked.

    Yes, to visit my friend,
    ” she replied. (Nathaya did in fact visit her friend for a short time on a tourist visa last November before visiting me).

    His response as he smiled was: “
    Why don’t you just say that you visited your fiancé too?!

    Her response then was, “
    I visited my friend before I spent the Thanksgiving holiday with my fiancé’s family.

    When will you get married in the states?
    ” the E.I. then asked.

    Soon after I arrive, probably in the first two weeks.

    Well, congratulations!
    ” he said!”

    Who is [ex-husband name]?
    ” he asked as he looked over her application.

    My ex-husband,
    ” she answered.

    Where does he live now?

    Up country in Lopburi province.

    Have you ever stayed with your ex-husband where he lives now?
    ” the E.I. asked.

    Never,
    ” she expressed. Nathaya then offered up (on her own) that her husband was unfaithful, the reason for the divorce and the reason she never left Bangkok.

    The E.I. then directs her to come back to the Embassy on Monday to pick up her Passport (with visa) at 3pm.

    He finally says to her, “
    You can pick up your paper work over at the other counter on your way out. Have a good day; Sawadee Krup!
    ” (goodbye in Thai)

    Nathaya replies with “
    Sawadee Ka!
    ”, picks up her packet of evidence and paper work and proceeds out the embassy doors.

    It was that easy. Just as easy (if not easier) then getting her US Tourist Visa. I hope everyone has the same luck and patience we’ve have. Three pieces of advice I can give to this entire process is: 1. Make sure you dot all the “I’s” and cross all the “T’s”. 2. Collect your evidence of relationship wisely. And 3. use this website and forum as a resource and tool to help you through the process. It will lower your stress levels and prepare you for your next milestone. Good luck everyone. We now need to get started on our AOS (I-485) packet. ;)

  16. We recently recieved a letter saying that my wifes green card was "ordered production" and she is scheduled to fly home for a visit on April 1 which we know is cutting it short.

    The question is has anyone else have any experence with how long it really takes and we are thinking that worse case the card will arrive b4 she is scheduled to return and I can just mail it to her before the return trip. Does anyone see anything wrong with this plan? Is there something I'm missing?

    We will appreciste any input.
