  1. It is a pity that all of us here (on both sides of the various borders) have to endure such long timelines to be able to get the chance to be together on a daily basis. I think that for many of us, especially those of us who have been through marrriage and divorce and DEFINITELY those men (and a few women) who lost their a$$es in divorce settlements, the 90 day period between arrival and the "deadline" is really the final test. Sure, we are all committed to getting engaged and married, but the 90 days is a final test. Having been involved in many long distance relationships, you can never be certain how your relationship is going to be on a day in, day out basis. If you and your fiance had actually spent much time in a "normal" dating situation, you might have found out you were not right for each other much sooner and certainly wouldn't have had to endure the USCIS torture test. Be glad that your fiance' had the fortitude to be able to make the tough decision to stop what he felt was not the right thing for him. In the long run it will be less painful for you. But do not lose hope that the right person is out there for you.

    Good luck healing and then finding the right one for you.

    Just a correction to your statement above: I was the one that made the "tough decision" to return home, to make things easier for him. We are both still very much in love with each other and want to be together, bearing in mind we've known each other for over 10 years and have spent "normal" dating time together, but due to medical reasons, like panic and anxiety attacks when he realized the 90 days were counting down, it made life very difficult for both of us, so it was either me coming home or the risk of being deported.

    I went to the US on a K1 visa to marry my fiance. Well to cut a really long story short, things went a bit pear shaped and he got cold feet and panic attacks about getting married as it got closer to the time.

    I have now returned to my home country...can someone confirm if I have to notify USCIS or can I just let it be.

    Advise would be appreciated :)

    You do not have to notify anyone. I presume you turned in your I-94 at exit? Job done.

    Thanks to everyone for advise along my 9 month journey to getting my K1, you were all super fantastic, just heartbreaking that it had to turn out this way, but I guess everything happens for a reason.

  4. I'm now seriously confused after reading the guides, so a bit of guidance from folks that have been through the process would be appreciated.

    I received my K1 visa on 29 June '09. On the day I found out that my son that was on the I-129F petition as a follow to join has to travel within one year of my K1 being issued if he wants to travel on a K2, which means he will have to leave SA by the end of June 2010. He will be finishing his final year at school in SA before he joins us, which will be in December 2010.

    I was told that my fiance now has to re-petition for him to join us. Is this the I-130? And what kind of visa will he then travel on? I'm seriously confused. :help: My son will still be under 18 when I get married and adjust status.

  6. You only send the signed DS-230 part one back either per fax or email. Then the OF-169 to get your interview date.

    If your interview date has been booked, then you just take all your paperwork with you to the interview with your medical docs.

    I just followed the order that was on the packet #3 list and all the supporting evidence behind that. I literally just gave them a wad of papers and the CO made her way through everything.

    I received my visa yesterday...it was the greatest birthday gift I could ever have received.

    The consular officer thought he was real funny when he called me to the window and said "Im sorry, it still hasnt arrived yet" (bearing in mind I was told it would have been ready for collection last Thursday already) I didnt know if I should laugh or cry at that moment. He then slowly brought my passport out from under the counter, opened to the page where my visa was, started giggling and said "It's all yours, what date are you leaving"

    My K1 visa was issued on August 15, 2008, and that means I have less than 2 months. I should have checked on this matter earlier :(

    Btw, I am planning to visit home end of August and likely to extend my stay.

    Your daughter is eligible for a K-2 for up to ONE YEAR after your visa was issued. This means hers needs to be issued before August 15. Call the consulate and make an appointment for an interview, use you case number as you did for your visa. Your daughter needs a medical exam. When you go to the interview (you or the petitioner will have to attend, your daughter is optional under age 14) You will submit visa applications, just like you did, an affidavit of support, birth certificate (no police certificate required under age 16). The petitioner needs to write an "acceptance letter" accepting the child into the US. You will pay the visa fee as you did. It is basically a carbon copy of your visa application minus a few items due to age. You can schedule the appointment any time the consulate has available, so I suggest you get after it now. Waiting until your planned visit is too late, you or your husband will need to be present. You will also have to submit a copy of your marriage certificate, copy of the NOA2 approval of your K-1, and copy of your AOS filing receipt OR Green card and "Welcome Letter".

    I just did one of these last week for our oldest son. No problems, but the 1 year time limit is carved in stone.

    I was put under the misconception that the K2 had to be issued within a year of the K1 being issued and that it would be valid for 6 months (like the K1) in which to travel.

    The K2 is good for issue and travel within the year.

    I had a rude awakening last week when my visa was approved, and I was told we would have to go the I130 route for my son if he only intends joining us at the beginning of December 2010

    Update.... Well I'm excited too. After plenty tries of calling the freetown embassy, and being transfered to answering services, none working numbers and people that just take a message and say i'll be contacted. By the grace of God i was finally able to talk to the right people and it literally took only 10 minutes for him to look up the schedule on the computer, take my case number and boom i was assigned and interview date Monday 6/29. Well i'm not even gonna ask question of what have been taking them this long. We are so ready !! :dance:

  10. What a loooong day it's been for me, but worth every moment... Visa approved! :dance:

    Must admit I was a bit confused because I wasnt told I was approved, I was just handed a little green slip and told to go back on Thursday at 2pm...untill I read futher where it said, 'to collect immigrant visa.

    Yup, Monday is the BIG day :star:

    I guess I am freaking a bit and my mind is in 101 places right now thinking of everything that needs to be done after the interview in limited time.

    Went to the mall today... I take this route EVERY weekend. Goodness knows how I got where I did, but I sure wasn't at the mall. I got hopelessly lost within 10 miles from home. :bonk: Im seriously losing it, but all will be fine after Monday and I can get back on track.

    NatPatBen that touch sounds promising. Crossing fingers that your big moment will be in the coming week.
