  1. hello everyone,please, someone who can explain well.

    My wife and I knows each other from 2003, she was intruduced to me by my auntie who is her co-worker and I am working in Saudi Arabia since January 2001. We spent almost 5 years of our relationship without seeing each other. We had the plan to meet each other by 2007 but we didn't because it's hard for her to get a replacement in the Hospital but we made it on June 2008 when I resigned to my previous job in Saudi and that was the first time we saw each other. Due to the time limit for she has only 31 days to stay in the Philippines, we made everything rushed just to get married and also I got my new job in Saudi once again and anytime soon I will be leaving to Saudi. We got married on July 11,2008. July 27 was her return to the States and the date that I will be leaving to Saudi Arabia.

    We didn't spend much time with each other during our stay in the Philippines, do you think it will be a problem during the application of my petition? :unsure:

    No, you shouldn't, we have almost have similar case. I went to PHIL for 30 days because thats the only days I can get off from the army, we did rushed everything and nicely talked to some people to take their seats for small fee for the required class/seminars. WE made on time, got married, 3 days honeymoons, she stayed in PHILS and I went back to US, filed her paperwork and 10 months later she is here with me.... the 10 months later was kinda s@#! but she is here now for good.

    I know you knowledgeable folks will be able to help me answer this question. My fiance has a c1B visa and a B2 visa; we applied for the K1 visa we wanted to know would he be denied because of the C1b visa also known as a crewmen visa or the B2?

    The only thing I can see that might be an issues is that it will raise RED FLAGS in the immigration. Crewman visa is limited within the port per location, also when crewman have what we call a Leisure pass- to go downtown or visit stores to buy some souvenirs, they have to be back in certain times. As far as being denied thats for the immigration to do their invistagations, ie... did he ever extend his visit if he stopped in other countries or did he make the reporting time? There are more factors to these than just denying it... goodluck!

  3. So I received my Oath Ceremony letter today in the mail.

    "You are hereby notified to appear for a Naturalization Oath Ceremony on: Saturday, July 4 2009"

    Well whoopty-doo. Apparently the USCIS doesn't recognize the 4th (aka America's birthday) as a holiday where people may have plans.... like..... let's say.... go out of town? It's not really a big deal as I will just have them reschedule me but I'm anxious to get this over with. Like really, who schedules anything like this on the 4th?

    Maybe I'm over-reacting......................

    Have a feeling it will be a few months before they re-schedule me. ARgghhhhh how annoying.

    Some people take that as symbolic of taking Naturalization on American Independence Day of being an American naturalize, I can't speak for your personal opinion but I would be glad to take my oath on Independence day. You don't want it, give it to somebody that may have more values to them than you. I am pretty sure someone out there will take your day (seat) to take that oath!

  4. On Monday 13 Apr and Tuesday, 14th, my wife went to St. Lukes Extended Med Clinic and a couple of hours ago she told me that she passed her Medical Exam. They took her passport, pictures, and fee of about PHp 10,500, and today gave her vaccinations paper and everything will be forwarded to the USEM. I will post a follow up on these one after her interview on 21st, April.

    April 21, 2008

    Today my wife got up about 345 in the morning to get ready for her Visa Interview. She got there about 6 am, got in the line, inside, given number, filled up the form, waited to be call and when she was called by her name, it took the CO about 5 minutes to do her interview. She was told that he (CO) thanks the armed forces for doing what they do, told she was APPROVED, given the pink slip and she then paid Php 220 for Air21 and jumping and yelling to get in the taxi. She called me right away after she got home to her friend's house where she decided to stayed instead of the hotel. VISA ARRIVED on 23 April. :dance::dance::dance:

    My wife just left the Mactan Airport enroute to San Antonio,TX. She paid Php 750 Departure fee and Php 1620 airport travel tax. Good thing she have money with her, they will not take credit or debit cards. CASH only!!!

  5. Kabayan, could anyone please tell me how many days did it take to have your visa on hand after your interview? I know my interview date is still way ahead but my husband and I are trying to book a flight a.s.a.p due to the fact that it will be summer there by the time I have my interview and my hubby needs to know when will I be there because he will be assigned to a different state on summer. So with your feedbacks, we could estimate the earliest date I could fly there and he could arrange his work schedule. Thank you for your kindness. Good luck to all!!!

    My wife was still ion Manila when the visa got deliver in Cebu, depends... her is the next day after interview so I guess they have her visa pre printed already!

  6. I am sick of taking ####### from USCIS, and am thinking of suing them with writ or mandamus (WOM). I have approached my incompetent congressman, OMBUDSMAN, local feild office. All are useless and unhelpful.

    My application is pending 19 months. I filed during the "rush" fiasco of summer 2007. My application has never left the Vermont center. I received a LUD in january, and then this week on a SUNDAY!!! This makes me to believe that it was just a system update, and no actual breathing USCIS worker really pulled out my application for any solid action. It was either a system backup, or random touch on applications that seems to collecting dust. The USCIS bot touches them so that they can sleep on it for another 3 months.

    At first USCIS wouldnt even tell me the reason for delay, untill a couple of months ago. They finally got off their coolaid and donuts and told me that my application is pending name check. It wont move ahead untill a security clearance is provided. For a person who doesnt even have a speeding ticket, its unreasonable to prolong security check.

    SO, after taking their ####### for more than year and half, I am suing them. I think i might be able to ask the court to reimburse for lawyer and fed court fee (about $2500).

    I have yet to see my lawyer, but want to ask if any one here has filed a law suit against uscis and has gotten anywhere.

  7. Hi. Im just waiting for my interview....and im just wondering what to bring regarding proof of relationship. Do I need to ask my husband to send all the letters that i sent him? Or they only need my husband letter that he sent to me? thanks!

    *** My wife interveiwed lasted about 15 mins included the pre screen windows. Thye didnt asked anythiong excpet for the wedding albums and nothing more. Maybe being in the military got some breaks after all.

    My wife lives in Bislig, Philippines and her mother lost her vaccine records over the years; there are no doctors in Bislig that we have found that can do blood panel/screen to verify vaccines she already has.

    Should my wife try to get her vaccunes before the medical exam for visa or at the medical exam?

    If before does she have to get every single vaccine on the list or which ones would she need to satisfy the requirement?

    Or will they definately provide the necessary vaccines during the visa medical exam. I just don't want her to go to med exam and have them tell her they can not give them for some reason , at that time, and delay the process.

    What should we do?

    Since ur paying the 10,500 Php, have it done in Med Exam and you will have the official med records of the vaccine was completed.

    I am not bragging so please don't slam us for this! I want to post this to help other people. And also to demonstrate how CIS doesn't work in order of date received. Granted we probably sent to much (even Kiva and YouTube!) but we were determined to send everything possible to prevent RFEs. A note on the photographs, we didn't send individually printed photos on photo paper (why waste the money?). Instead I ganged up 9 photos on an 8 1/2 x 11 and printed them with a color ink jet.

    I must also say I am highly disappointed that President Obama is not in the president line-up on the back of the green card.

  11. Just got my Approval letter in the mail, approved 4-24-09 Transfer on 2-25-09. Thanks to everyone on VJ for their kind words and encouragement. For all of you still waiting Please just hang in there your day will come soon.. As a foot note as i see many arguments on these forums about filing taxes together or married filing single,I did not suppy any taxes at all for removal and still got approved. so please dont make comments about what Immigration does or not do unless you not something to be a fact and not what you believe.

    *** First of all CONGRATS....

    *** Second, everyone have been different answer to that base on their experienced. There are baseline that everyone need to follow and we go with that. If you approved without the neccessary documents needed, then its good for you. Each CASE is treated differently as where you received your AOS from, so you can't judge either, thanks! Each office have tonts of tons of cases, if they are so behind on cases then they make shortcut somehow and somewhere. So don't critizise everyone's answer, it's a guidance for people to follow. If there 100 cases to be file, most likely there 100 ways to treat them, every case is not the same.

    On noa1 was no instructions or anything just that my check cleared..now here is my question..

    Based on this notice can i send in my i-129 now or do i need to wait until i get a another notice...

    Once you have the NOA1 noticed, yes you can send the I-129F, but to be honest with you the I-129F and I-130 is only 2 weeks different and majprity of the time it will get approved the same day. Most of us here in vjs once both cases are approved, we chosen to go with the CR1/IR1 route. Goodluck and I hope you have patience!

  13. I have a question!?!?!? Everyone talks about seeing "touches" on their cases and I am wondering if I am looking in the right place.

    I login at the USCIS web site where you have to put in "Customer" from a drop down menu, and then our login name and password.

    Is this right? I mean is this where you all see touches on your cases. We only show that they received the case on March 4 2009, they do not show that we received a biometrics appt notice, and they do not show the RFE we received. I have called several times as well and that doesn't make touches show either :blink:

    I just would like to know if I am actually looking in the right spot. I know everyone states that they don't keep the system up to date very well, so I was hoping that maybe I could look some where else. . .

    Any help you can offer would be appreciated.

    When you see "TOUCHES" means that someone have the time to be place the updates info in your case. Some people will get APPROVAL with no "TOUCHES" n\and some get " TOUCHES" after the APPROVAL. It's not reliable information but if you get "touches" means hey you got case reviewed. Goodluck.... NO other message will be place in "touches" except the date that someobne works in your case and they wiull not be on a specific details. All "TOUCHES" means someone look at your case, what they did, who look at it, what do you need will not be place under the "TOUCHES" updates, just the DATES only. I hope this help!

  14. I can't really help myself :dance: - I'm so excited that after 400+ days of waiting, Arun's CR1 interview in Delhi is only a few days away. And then, God-willing, he'll fly to me next week! Woohoo! :dance: I just love saying that - "he'll be here next week, he'll be here next week!" (L)

    I was blessed to be able to spend much of our marriage with him in India, but I've been back in the USA for almost two months now, and I am just soooo ready for him to join me! (And of course, he's never met ANY of my family or friends, so they are excited, too!)

    By the time of his interview, it'll be 425 days from the day we filed the I-130. Whew, what a long journey! But it's well worth it! :)

  15. After almost three weeks of USCIS approval of our NOA2, NVC finally received it today April 27,2009. I know that my next step is to send the DS-3032..Should i go ahead and mail this ASAP? Any info will be great..Thanks!

    Give them a chance to put your case in the system, once your case is GENERATED then you need to get everything ready as it will go fast from here on. If you have anyhting need to be signed, sign them and do not dated it till its ready to be send. Get DS 230 ready, PCC, MC....etc whatever applies to your case. Your getting to the end of the tunnel, goodluck na lang sa inyo!

  16. My cousin recently stood in for immigrant visa in Mumbai Consulate in India and they DENIED him the visa......Here is the timeline of what and how it happened. Can anyone from VJ community help me understand why this happened and most importantly....HOW TO FIX THIS.....

    1. My uncle was a green card holder and he applied for his son to come here on Immigrant visa. At that time his son was over 21 but NOT married. So his visa category was "Adult Unmarried Sons/Daughters of Permanent Resident".

    2. My uncle became citizen in 2004. So, he "upgraded" petition for his son so he can come here faster because of him being US citizen now.

    3. My cousin (my uncle's son) got married.

    4. My uncle submitted his son's marriage cert. and later (upon birth of his grand child), grand child's birth certificate to add them (wife and son) on his son's petition as dependents.

    5. In 2008, NVC approved the case. DSL forms were sent to my cousin in India. My cousin paid necessary fees (choice of agent, IV fees, etc.) and filled out DSL forms and sent them to NVC.

    6. Mumbai consulate scheduled a visa for him (my cousin) few days ago.

    7. My cousin went to get visa with his wife and son.

    8. Consulate denied him the visa because they said: He got married before my uncle became citizen, so he can't come under this category now.

    After all these waiting for 6-7 years, they (NVC, USCIS and Consulate) NEVER found any issue with this application and now they are finding problems when he stood in for his visa interview....THIS IS SO INSANE....PLEASE HELP....

    The big mistake I see on this CASE is that your cousin got married and now belongs to another column of visa request. I think he is now priority 5 because he got married and now an adult. That will take from 6-10 years. Your cousin PRIORITY is the least on his case... son/daughter under the age of 18, wife/husband, is sample of the priorities... to bad!

    For the I-864 submission, do we need to submit the tax return for 2008 with original signature, or can it be a photocopy of what I submitted?

    Can I also mix and match, I plan to send tax transcripts for 2006, and 2007 and my tax returns for 2008 (since it's too early to get a transcript.)

    Yes you can send 2 transcript for the 2 previous year and the tax return for this year as long that you have supporting documents for your financial income. Photocopy is fine , thats what I sent them and have no issue. goodluck!

  18. I filed an I-130 for my wife, I thought that i didn't need to file one for my step-daughter ( yes I mis-read and understood the instructions, I though she would have deriviative status on the i-130 but that is only on the i-129)..

    Now do not know if i should file an i-130 for my step-daughter now, 90 days after filing the I-130 or file an I-129F assuming it will be faster than waiting for my Step-Daughters i-130 to be approved.

    So what do you think.. should I go ahead and file the i-130 for my step-daughter and just wait ..

    or file the i-129f hoping it will be approved faster than the Step-daughters i-130

    If I file the i-129f what documents do I need. The instructions are a little confusing... """You must submit the documents required in Items 1, 2 and 4 of the instructions, but may omit the documents required in Item 3.""""" but I am not quite sure what those items are.. I called the help uscis help line and they didn't know either..LOL

    Hope all that makes sense and hope someone can offer advice...

    You must as well file her paperworks or wait till you get your NOA1 and use that case number. For every person you want to come to the US, you have to file seperate for them. Goodluck!

  19. Congrats, I think I remember you. You got approved in Jan right? Well me too, and my husband just passed his interview, we're waiting to get his visa stamped passport delivered in a couple days:) Woohoo, it's sooo relieving, and we couldn't stop smiling cheesily at each other and laughing so much.
