The Police Certificates that the embassy requires - I thought I read somewhere a while back, that if a person lived in a country for less than 6 months, a police certificate is not required for that duration of stay. Can anyone confirm/deny this? Been trying to validate this, and have not been able to, yet..

    Wife is Belorussian citizen, has lived in Belarus since age of 16, except for 4 1/2 month period where she lived in St. Petersburg Russia.

  2. Birch, I'm surprised you got anyone at national, their website says that USCIS offices were closed on 25-26.

    I think they're gonna start moving on April in the next week or so.

    They need to update that processing time page.

    I F****in hate this BS. I called USCIS today and got the same bullsh*t. I'm within the time frame. they're working on march. blah blah blah...Christmas day was 8 months......this just f-ing SUX!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    CJ-G, our cases both got approved on 12-23. just like sra advised you, you should work your way through both the routes and see whichever completes first. change your K3 to a CR-1 interview if all goes well. CJ-Vasani is a good example who has secured a february interview date already by doing this. he has completed both the processes and even though he may get a march date for CR-1 interview, he will request his K3 to be converted to a CR-1 interview for which his date is already set.

    BTW - did your case get to NVC yet?

  4. If you go to the guides section of this website, there's a good flowchart that summarizes the K3 process and the forms you submit (I-129F, I-130) for the USCIS approval portion of the process.

    What steps would one need to take in order to take both routes? I am going to send in the i130 with the g325a's first.....should i send the i125 together or later after i get my noa1?? What should I do if I want to do both and see which happens for me sooner.

    at this point i'm playing both games and see if i could get some benefit from the k3 so far i have paid de AOS fee and sent the Choice of agent. and my k3 is already at the embassy and i think this week they are scheduling interviews so hopefully i'll get a good date. play both my friend we have waited a lot and let it be whatever comes first.
  6. Yeah, that makes sense, Sra. I guess they set separate interview dates for both, and we should go ahead & see which one comes first, and have packets prepared for both. Good advice.

    i know you already took your decision but why not continue both path until you get interview date? many people are doing both paths and then if the cr1 gets completed prior k3 interview date they switch their interviews to cr1.

  7. Wy wife and I were approved earlier this week by USCIS on the I-129F and I-130 petitions. We have decided to go the K3 route to bring her here, and then file for the adjustment of status, once she arrives. At this point, with the lengthy wait we have had at VSC, we've decided speed supercedes arriving with immigrant status. We'll file the I-485 once she arrives.

    My research to date indicates that these are the following items we should have ready for the embassy:

    * Two copies of form DS-156, Nonimmigrant Visa Application

    * One DS-156K, Nonimmigrant Fiancé(e) Visa Application form

    * Police certificates from all places lived in since the age of 16

    * Birth certificates

    * Marriage certificate for spouse

    * Death and divorce certificates from any previous spouses

    * Medical examination confirmation document

    * Her current passport

    * Two passport/visa photos for the visa

    * Payment of applicable fees

    I also plan to compile copies of our I-130 and I-129F applications and NOA-2's for my wife to take to the interview, as well as some photos of us together.

    I have a couple of questions that I'm hoping one of the experienced members can shed light on:

    1. Does this list appear complete? (e.g. am I missing anything?)

    2. Seeing how both the the I-129F and I-130 were approved simultaneously, how does the embassy know which visa we are applying for? Does my wife simply tell them we are going for the K3, as opposed to immigrant visa?

    We still are a little uncertain which embassy this is being sent to. My wife is a citizen of Belarus. Originally, we thought she would be out-processed in Minsk (Belarus), but political developments during this last spring created a drawdown in staff at the Minsk embassy, and the State Dept. website reports the Belarussian citizens would be out-processed in Warsaw (Poland). A VJ member recently approved with a Belarussian wife told me that the Minsk Embassy has now started to process again, and that she would likely be sent to Minsk, but the Minsk Embassy and State Dept. website does not reflect this change.

    (Note: For all you ladies who have borne children, please don't yell at me - it's a joke, I know this doesn't compare to childbirth, I was in the room when my ex delivered my son, and all I could think was, "I AM SO F-ING HAPPY I AM A MAN).

  10. I love this girl. Everyone still waiting for their approval, you must know that I would have not remained in one piece, if not for she (Narnia), and Lisa. They care beyond their own circumstances, and give love when they're not asked for it.

    I'm telling ya. I'd trade in my approval today to see these two ladies get theirs. Please, everyone on this thread, show them some love. They saved me through almost 9 months of hell..

    Mamalou, honey, we're here for you! Don't despair!

    EVERY SINGLE ONE OF US has had this situation with our husbands/wives. We all been through this. A few weeks ago when my house got robbed, I was the one crying and telling my husband I'm leaving everything and moving to him, because I don't wanna be alone anymore. I was acting totally crazy and screaming, crying, and just losing it. This is normal! Because you love each other...so of course you're gonna feel pain, being apart!

    I don't know what others had to wait, after sending an RFE. I always thought it it took 2 months for the approval after an RFE was answered. If it's faster, even better.

    Look at it this way...you have already passed 8 or 9 months waiting...another 2 months is still okay. Because it's not much longer. So in your case, maybe it's only another 2 weeks. Don't throw all the time you already spent, alone and struggling...don't throw it away now!

    We're here for you. We are always complaining and crying to each other here. That's what we do in our NO touches NO approvals thread and our weekend pity party thread. Join us! We're here and we NEVER get tired of hearing anyone's problems.

    I wish you the best of luck and I DO THINK you're gonna get your approval this month.

    PS- Lisa mentioned that it's almost the same like the people whose husband is in jail and they are waiting... Well my grandmother has Alzheimers, so she can't remember things anymore. She actually thinks my husband is in jail. Everytime I talk to her, she asks me, "Did they say when he's going to be let out of jail? God damn those people! Why aren't they releasing him??? He's innocent!!! He didn't do anything wrong!!!" LOOOOOOOOL

  11. Mama we love ya baby. Keep the faith. If you do not get aproved within the next 60 days, you need to do this. Get your or your spouse to find an immigration lawyer, and ask them if you are at an appropriate time frame to have them file for you a motion that is called a "writ of mandamus" . It is a judgment, issued by a court, that compels an administrative agengy of government (like USCIS) to take action on a pending request. I have read on a couple of immigration sites this past week where immigration lawyers have successfully used this to get USCIS to move on a case that has been stuck for a long time.

    Yesterday was almost a a tragic day for us, My husband is terribly depressed about the whole thing, We were expecting last week & this week of our NOA2 after we responded the RFE , but it was so frustrating, still no email from CRIS-Vermont until now, looking at the thread of some members here they got approval after 10 to 15 days, thats why my husband was expecting the same. We both feel the same way now we are sooooo pathetic waiting and waiting ,don't know now how much longer we gonna wait for more, we don't know what will happen to us now. Yesterday morning, my husband was crying out loud when i talked to him in the internet, At this point in time he's very deeply affected of the situation, he was sitting there, saw him hysterical, his mom, trying to comfort him, he shouted all his anger & frustrations. He keep on crying suddenly told me better to ''kill himself'' and speaking words he ''don't want to live anymore '' my life is useless without you sweetheart'' why it so hard to live with my wife'' why don't they approve us yet, why those people (Vermont) screwing us they don't care our feeling,,they want us to separate'', I was crying & screaming trying to stop him, i comforted him & I did my best to calm down, I talk to him with Love & affection ,just to cool his anger,.. Oh, i really pity him, i know what he feels now, I keep telling him that no one can help us except to have more patience & might as well ignore the petition in the meantime, & he answered, I been so patient for the last 300+ days & its over.

    Things are so complicated, Our relation being husband & wife is so much important to him more than anything else in this world, he want us to be together, last Aug/Sept when were not yet approve he wanted to come & live with me here but i just stop his plan & told him to just wait until we get approve. Now he want to pursue it by early Jan. 2009 he will come, don't know yet if he will return to the States or not, but sure he will lost his job, & losing his job might be an issue in the Consulate interview, am afraid it may jeopardize granting me a visa. Don't know now what to do. We are in the verge or uncertainties.

    My VJ friends Please we need your support...we are emotionally down this time.

    I would hate to think that VSC would want to go into the New Year with applications backed up to April/May '08! Doesnt look good - so we hope all those who have petitions from that time hear great news ASAP!

    Guys and Gals,

    Let me start. I got approved last Thursday for both I-129F and I-130. I am waiting for NVC to assign the case numbers for both, forward the I-129F/K-3 package to the Consulate and for them to generate the DS-3032 and Affidavit of Support Review Bill.

    So tommorrow, I am hoping to find out 1) Case numbers for both I-130/CR-1 package and I-129F/K-3 package 2) Receive news that K-3 package is sent to Consulate.

    I will post all development for both processes here. There is also a forum for Nov/Dec I-130 approvals to which I will/we should post to.

  18. I decided to not post this as a separate thread, I thought I would just sneak it in.

    I got the e-mail about a half hour ago (12:30 eastern time)

    They finally freaking did it. The I-130 and I-129F's are approved.

    Tremendous amount of love to all of you who have shown support. For all of my girls and guys still waiting, stay strong.

    Not leaving ya. I want to watch all of my peeps get their approvals - Plus, I can now give ya'll first hand accounts of the next steps of the journey, as I stumble through those.

Well, after almost 9 months since the NOA-1's, and 8 months since the first touches, I just checked USCIS' website again about 10 minutes ago (for the like the 4th time today), and it showed a touch with today's date on both the I-129F anf I-130. No approval, just a touch - but that alone nearly sent me into heart failure.

    I guess it would be wrong to have a drink over simply this event :blink:

  20. It ia, at this point, highly questionable whether or not the I-129F really is doing much to speed up the approvals, so if you submitted it late, don't be ashamed to put it on your timeline. The K3's that are being approved are being driven more from the NOA-1 date of the I-130 than the I-129F.

    You may want to call USCIS customer service and ask whether or not (the I-129F) is in the system.

    The thing I keep coming back to is this: Even if we just focus on your I-130 NOA 1, you're barely at 6 months. These applications are not being processed at VSC within six months. If they were, there would literally be dozens of people on this forum who would have their approvals already. I challenge you to find any VJ member who has/had a K-3 petition at Vermont who has been approved in sis months or less, since July of this year. You're not going to find them.

    It stinks, but the reality is, you just have to be patient, and your congressman is not going to respond to your letter, because you are within posted USCIS processing times, which for the I-130 is February 26, and the I 129F/K3 is March 7. You simply need to prepare yourself for a wait of 2 or 3 more months before any action is taken on your case. That is what the rest of us have had to do. Your congressman will be of no help to you right now. My congressman couldn't really do anything, except ask VSC questions, ever after I fell outside of processing times.

    I know of no set form, you basically first write or call them, and then they will send u a form giving then authority to speak on your behalf for your case. You will need to explain to them your case details, like a introduction, tell them the problems, and ask what help they can be. Mostly they can only speak up showing their concern for your case they can not make decisions already made to change but hopefully can influence some kind of changes etc

    in looking back at your timeline what are you expecting, faster? your in vermont so i would guess a good 6 months before your 2 at the least, it does seem to be moving..your rep wont be able to hurry this

    For your information regarding my specific case, I filed the I-130 petition in June of 2007. Vermont received it on June 09, 2007 I got the first Notice of Action (NOA1) on June 16, 2007. Since I received that first Notice of Action I have received several RFEs which we had took actions accordingly.

    Interestingly, whenever I want to check my case status online, it shows my application was received in June 16, 2008 and whenever I call USCIS helpline, I am always told that I am within the timeline considering the USCIS website. I have also filed a I-129f receipt number EAC 08-237-50204 in order to expedite my process, yet a very unfortunate of myself that while checking the case status online, it gives an validation error with a message that states “Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283”

    I did not posted the date that I have in real in I-797C form, as I thought it could be a little humiliation of oursalves... We are probabely the only one couple who has this situation. We are no where in this race actually....
