Well, it turns out I was right. My congressman's aide phoned me about 10 minutes ago, NVC DID send the package to the wrong embassy (Warsaw), so the NVC supervisor told my rep's aide they would be sending a wire to the Warsaw embassy to forward the packet to Minsk immediately. She said if Minsk did not receive by mid-week, to phone the congressional office back.
Thumbs up to Congressman Bilirakis' office (especially Sonja Stefanadis, you rock), and a thumb to the nose of you arrogant and rude NVC reps who treated me like an idiot and would not help me when I explained to you last week that this is what I thought had happened.
Hopefully there will be no more screw-ups prior to the interview. We've had enough to last a lifetime.

For any of you NVC vets who may have experienced something like this....My wife's I-129F and I-130 was approved just before Xmas.
She is Belarussian, which means she has 2 potential embassies to deal with for the exit interview. Minsk for the K3 (non-immigrant), Warsaw for the IR-1 (immigrant).
We're going K3. We have our reasons for going this route, which I won't spell out here, but a lot of it has to do with her logistics.
USCIS got the info to NVC on January 5. Checked with NVC later that week, they said the 129-F packet was sent to Minsk on Jan 6. Then, I get two identical letters from NVC over the next week, one dated 1/7, and one dated 1/13, saying the info would be sent to Minsk within a week. I called NVC to ask about these, but again, they said it had been sent on 1/6.
Been calling the Minsk embassy since 1/6, up to and including today (1/23), they say they have nothing. Every time I tell NVC that, they say the same thing. They sent on 1/6.
From a tip provided by another VJ'er, I checked DHL's website for the packages sent from NVC since 1/6, up to today. Over 700 packages, sent to all embassies around the world, including some close to Belarus (Warsaw, Moscow, Kiev), but not a single one to Minsk. I decided to call DHL and speak to a rep, he confirmed this. Nothing to Minsk sent from NVC.
So, I call NVC back today, tell them Minsk still has nothing, and DHL says nothing has been sent. My suspicion is they may have mistakenly sent this to Warsaw. I tell the agent that. She was terse, and told me, no, it was sent to Minsk, on January 6, you just have to be patient. I ask her, wouldn't it be unusual for a DHL package to take 17 days to get to Minsk, especially when DHL shows no record of a transmittal, not even one that is in transit. She said there is no way I could get that info from DHL. I told her that I most certainly did get the info, from two sources - their website, and a DHL agent. She said to continue to be patient, and if it didn't get there by the end of the month, to call back.
I think this is BS, and it has me concerned, because there is obviously a time-ticker on the I-129F and I-130 approvals. I'm thinking about calling my congressman's office to see if I can get them to look into this.
Any thoughts? I would really appreciate the perspective of those who have experienced something similar.

Well, if it's any consolation, the next phase is not absent of drama. Take a look at my thread in the NVC forum, and you'll get a nice slice of what can happen once you get over to the "other side". I think the biggest lesson I've learned from this whole journey is what we (those who chose foreign spouses) are willing to go through to be with our SO's. I'm now thinking that ALL couples (including american/american) should have to go through this prior to being issued a marriage license. The divorce rate would be cut in half.

Hi Chris! Glad to have you back. I don't know of any other April filer in VJ that's left. I think it's just me and some May/June people. I give up. No point in even getting happy with an NOA2 as I see now that USCIS can just bring about more misery with NVC! When will it be over? Who knows? As I said in another post...I feel like a "game over"...like when you lose your video game, it says, "Game over" and then the music winds down and game shuts off.
If drinking weren't a sin in my religion, I would be so freakin plastered right now!

Yeah, at this point, we're more concerned with speed in getting her here, more so than the additional hurdles that would be faced with an adjustment of status action after she got here. Also, it gets a little more complicated for her if we go CR-1, because she has to travel to Warsaw Poland for that embassy interview, and although Warsaw is actually closer to her home than Minsk (she lives in a town called Brest, on the Belarus/Poland border), she needs a visa to go to Poland, while she does not need a visa to go to Minsk, it's the capital of her country. She knows Minsk very well, so she has told me she would rather go to Minsk than Warsaw, even if it means a few more headaches for her once she gets over here.
However, with this new drama I'm facing with I-129F packet being sent (or, NOT sent) to Minsk by NVC, I'm thinking I may get the CR-1 process started if they don't get the K3 matter resolved by the end of next week. Just to have all of my bases covered.
I'll be so glad when this mess is over.

We decided on the K3. I told my husband, since we are already in AP now, maybe we will be safe later...we can look at the CR1. He was WAY against it.
All of the guys there that have been in AP for like, EVER..are CR1.

go to the "track" button, hit "track by reference"
where it says Reference*, put in a code like this: EXP 12 JAN 2009A
That previous code would be for a package shipped on January 12.
So, if you wanted to do January 13, type EXP 13 JAN 2009A
if you want to check a date before January 10, like Jan 9, you have to put a zero in: EXP 09 JAN 2009A
Select a pickup date range from your shipment date, to today's date
For origin postal code, put in 03801 (NVC's zip code)
Hit "track"
The only detail you will get is the tracking number, status, ship date. origin, and destination. In your case, with an Amman embassy, yours maybe easy to spot. Like mine, Minsk. Not many Belarus visas, I guess. For cities like Moscow and warsaw (and others), there's a ton, so you can't really spot yours individually.

Yeah, I'm giving that some serious consideration. It creates issues for her, but I think it's better than sitting around while nothing happens. If I cannot get some movement by early next week, I think I'm gonna start filling out the forms.

The only advice I would like to give you is I know you want to pursue k3 route for personal reason, but since that route is not getting you anywhere why dont you try CR1 route and complete all the paper at NVC.

Although I know there are others on this website who can probably shed more light on this than me, I do have some experience with both sides of the equation. My wife is a (soon to be) K3 receipient, she was approved by USCIS, and we are awaiting final embassy interview. For us, this process has taken the better part of a year.
A few years ago, I also hired an employee from Ghana I brought over on an H1-B work visa. One thing your husband needs to keep in mind: Although I understand and appreciate his sense of pride and responsibility in not wanting to come over to the US until he finds work, getting a work visa is not the "slam dunk" that it once was for foreign employees. First, there is an annual cap on the number of work visas the US issues, and the "demand" for these visas very much outweighs the annual supply. Second, it is going to be a challenge for him to find a company that will hire him if he is not here to personally interview and familiarize himself with the firm. Because US firms take on greater legal and financial resposibilities by hiring an H-1B foreign employee than they would with an American employee, that employee must typically have special skills they cannot find in a similar American employee. Long story short, his wait to find that opportunity to come over on a work visa may be long - much longer than he thinks - if he waits to do that.
If he absolutely refuses to go the K1 route, I would suggest that you at least consider the K3 route. It's going to take 6 months to a year to complete that process (depending on the service center that processes your application), so maybe he will get authorized for an H1-B in the meantime. If you wait for the H1-B without the K3 option, your wait could be much longer.

Hello!! I am so happy that I found this site.I am planning to marry my German boyfriend in April. We are thinking that we don't need to apply for a fiance visa since he plans to return to Germany until he gets permission to work here. He doesn't want to come here unless he has a job.
I believe we need to apply for the K3 after we get married.
My big question is how long will it take before he gets permission to work if we get married and he returns to Germany? Will he be able to visit during the time we are waiting for working permit?
I can't believe how complicated this process is! We just want to be together but we couldn't survive if he came without a job.
I would really really appreciate any help!

Lisa, I have had a similar experience. I got letters from NVC dated 1/7 and 1/13 that said the same thing yours did, that the case would be sent to the embassy (Minsk) within a week, and the embassy says they have nothing. NVC tells me when I call them, that the info was actually sent out via electronic transmittal and DHL on 1/6, but I have been calling the embassy every two days since 1/12 and they say they have nothing up to today. When I tell NVC that and ask them what is the deal with the duplicate letters with different dates, they have no answer for it. Finally, today they told me that if the embassy reports they do not have the packet by next week, to call NVC back, and they would look into it.
Don't know what to think of this, I suppose I won't get too stressed about it just yet, but I think it just goes to show the government ineffeciency doesn't end when the USCIS circus is over.

Well, NVC sent me 4 letters, with all different dats saying that the case would be forwarded within a week. As of yesterday, the consulate still has not received it and they told me to try again next week. Im sure they just love hearing from me now lol
I have Y's package with everything ready to go out in the mail. His whole packet 3 contents, all of our proof, the i-134 with salary letters,paycheck stubs and tax transcripts..i hope they dont want to see 08 tax returns before issuing the visa(trend lately with jan interviews)
So, for now..we are just waiting for nvc to get the packet to Amman. I got the AOS fee bill from NVC for the CR1 this weekend, and am ignoring it since we are going through with the k3.

and yes, i was thinking... since i got approved, i can have some experience for you guys when you are getting ready for packet 3's and interviews and such

Remember that I am a K3 person, so I am married, and I filed an I-130 and an I-129F for my spouse. Push affimred what I believed. If you are a K-1, and filing for your fiance', I do not think the same thing applies for that question, comapred to me.

Sample forms have "no" for question 36. I read this as prior to this visa application. My fiance has all forms filled out and I am not sure if I should call him and tell him to change his answer to question 36...Thanks push. Just checking..CJ-G

On question 36 of the DS 156 (Has anyone ever filed an immigrant visa petition on your behalf), I assume the correct answer is "yes", with the response, "spouse filed I-130 petition". Hi all,I'm a member here, but I don't want to post under my regular name because I'm too embarrassed about what's been going on...
I've been messed up for the last couple of weeks here... My husband, who I worked long and hard to get to the US awhile back, I found out recently was having an online affair with 2 girls in his home country. It looks like this was going on before he came here too... He has his conditional green card now.
He's told me that he kissed one of them one time when he was out dancing (yeah right) and that that was it. But he was for sure writing her. Before we got married, after we got married, the whole bit. Telling her that he loved her...
The other one he swears was just online writing, something that he did to pass the time.
Keep in mind that this man and I have been together for 2 years now. We did long distance to Peru from the US for a year and a half before he got here.
This all got started because I found a picture of him in our pictures section (I was going to look at our wedding pictures) and there were all these little pictures of kissing, hugging stuff, stuff to put on someone's page on a social networking site. I was like, "What??" Also there was a picture of him that someone had downloaded and then wrote "I love you" on it...
I checked the social networking site and found out that he had a second profile! One that said he was looking for open relationships and he was friends with all of these other women. He'd also been emailing them through a second email acct that he created to communicate with them. Such bs... I couldn't even believe it.
He's deleted the second profile and the second account since I found out about them, and he swears that he'll no longer communicate with them. That it was just some stupid silly game that he played to pass the time since he wasn't able to work yet. Supposedly everything is ok between us but I'm just not convinced. He's probably just going to call them on the phone now.
That I'm the one that he loves... now of course I'm wondering if the whole thing was just a scam to get here... how else could I feel differently? He was telling the other two girls that he loved them. What a crock...
I feel now like my whole marriage is a lie. I don't really know if he loves me or not. I told him that if there was any doubt in his heart that he should let me go and get on with my life. I've lived for him for 2 years. I feel so stupid.
Any thoughts? I really need some help.

Hey everyone. I'm in the NVC-Embassy phase, and I am wondering. Although the embassy website info states an I-134 is what is necessary for the affidavit of support, the I-864 seems to achieve the same purpose, and I am a little uncertain as to which document should be provided to the Embassy. By the way, this is for a K3, Warsaw. Also, will a simple US notarization of this document suffice?Thanks.

I am wondering what they look for (Waraw, Poland). I sent an I-864 with my I-129Ffor the K3 package, but that was 9 months ago, I have new tax info. Should I file both forms?

The Police Certificates that the embassy requires - I thought I read somewhere a while back, that if a person lived in a country for less than 6 months, a police certificate is not required for that duration of stay. Can anyone confirm/deny this? Been trying to validate this, and have not been able to, yet..Wife is Belorussian citizen, has lived in Belarus since age of 16, except for 4 1/2 month period where she lived in St. Petersburg Russia.
