  1. Yay! This is a GOOD thing! My case sat at the Vermont service center (last year) for FOUR MONTHS without anything happening. Then, it got sent to California and we breezed through processing in no time! :) Hope y'all experience the same! :)

    Oh thank you for your response. We filed it end of August 2009 and I really hope we will experience the same thing as yours. I am keeping the faith.

  2. Thanks for all your responses. Yes my income is over the required $18,000 for this year as well. I will just fill in zeros on page 5 or put n/a i guess. Like i stated earlier my income is what supposedly makes me qualify. Just to point out page 5 only asks for additional assets if you were under poverty guidelines. i am well over that and sent the proof with the original docs and to answer a earlier question...no i have never filed for this before. Thanks again for all the responses so far. As we all know this process can be a stressful one and it makes it worse when you file forms and follow directions properly just to send it to someone who doesn't seem to be able to comprehend those same instructions. I was not asked to send additional paystubs or supporting evidence. That is why i was confused. Anyway thanks again and any other suggestions or comments are welcome.

  3. Hello there folks. I will try to explain this as best i can. I filled out my I-864 (Aff of support) form and sent 3 past years tax returns as evidence along with a letter from employer stating my type of work, wages and years of service. I just got a RFE notice regarding I-864 saying that i need to complete page 5. My problem here is that page 5 clearly states that if your income(total) for the household size exceeds the federal guidelines you are not required to complete this part. Skip to part 8. We are a household of two so our poverty line should be about $18,000. I have made over $30,000 the past 5 yrs or more. And i included all that info so i did not complete page 5 per the instructions. I tried to call USCIS but as alot of you here already know that was a waste of time. Only answer i got was that i have 84 days to return the info they are requesting. In my opinion it was sent already. So, my question is how do i handle this? I know some of you will simply say just fill the page but it is not that simple. I rent and don't exactly own much in the way of assets. My income is what makes me qualify and like i said, i already provided that info. Help? Suggestions? Kind words? Thanks in advance!

  4. Hi everyone! I changed my address online two days ago and what i put on the question I AM IN THE UNITED STATES AS _____, the options are visitor, student, permanent resident and other. I checked on the OTHER and specify it as K1 fiance/fiancee. Inisip ko kase im here in the states because of my fiance. Or should i checked on the permanent resident? Haay lilito na ako. The thing is i changed our address online using the OTHER option. I have the form which i got from the immigration office, i was thinking to send it too and now i am having second thoughts if what i did on the application online is right.

    Please i need your help....mga kababayan.

    Another question is, does my husband need to file for the I-865 as spouse or sponsor? for the change of address too?

    I messed up with all these infos i am getting.:(

    use your current (the new one you just moved to) address in your AOS application...informing about address change would be if you move again prior to the approval of your AOS.

    your application would show your past US address (the one you indicated when your fiance applied for your k1) anyway

    what should i write in the I AM IN THE UNITED STATES AS

    visitor,student,permanent resident or other?

    I checked on the other and wrote K1

  7. hi there! my husband and i are worried about the status of my paper online when we checked it the other day. It says that they sent us a notification through mail asking for evidence last Sept 4,2009 but we haven't received any yet. We filed our AOS last August 20 and their notice date is August 25,2009. Got our AC Appointment Notice August 27,2009 for the biometrics wherein I was scheduled for my biometrics Sept 12,2009. We moved to our new apartment Sept 12,and changed my address online after two days. I received form AR11 electronic confirmation number and the online change of address electronic confirmation for my form I485.

    Did I do the right thing? I am confused now.Should I call the immigration and ask them if my address has been changed online?

    Can anyone please enlighten me on this matter...This makes us worried...

We called the Immigration couple of times regarding the application of AOS and was told there is no deadline in applying for that after getting married.It was good news for us at least we can save up for the fee,$1010 is really big money. Today as I was checking on my papers, i saw my passport with the K1 visa expiration which is on Sept 2,2009. We called the Immigration again about this and we were surprised about what they said. We needed to file it asap before my visa expires.This is ridiculous!We relied on what they told us before that there is no problem whenever we want to file the aos.And now they are saying if we apply tomorrow for the AOS and if we did not receive the receipt of our application before my visa expires then i will be forced to go back to my country.This is not a good news!!!!!

    Is this true? any experience like this with you guys?or a friend of yours?what did they do?Please enlighten us.

    As others have stated, your K-1 expired the moment you entered the US. However, the I-94 is what will expire and it is best to file your AOS as soon as possible before it expires. You can file afterwards as we filed 3 months after the I-94 expired and all went well. Others have done the same and adjusted status successfully.

    I'm not advising you to wait, but if you can't file until later, you have no choice but to wait.

  9. You do not need to go back to your country. The K-1 visa was used when you entered the country. You got married within the 90 days after you entered - the time that is stated on the I-94. It is the I-94 date that is important - not the K-1 date. While you are supposed to file the AOS application before the I-94 expires, you are not required to leave the country if you don't - in fact, you don't want to leave the country because then you have to start the whole immigration process all over again before you would be allowed back in.

    Let me offer some more reassurance. The 1-800 number that you called is also known as the 'Misinformation line". You can call 5 different times and ask the same question - and get 5 different answers. All 5 of them may even be wrong. The person you speak to on that line is not an immigration officer - they are call center employees reading from a script and they often don't know what they are talking about.

    When the I-94 expires, you are no longer legally in the US and will accumulate 'out of status' days. A few out of status days won't be a problem. If you have more than 180 out of status days or more, though, it is a problem if you leave the US without your green card because you would have a multi-year ban on returning to the US.

    So, get your AOS in asap. Once it is accepted your status changes to 'AOS applicant' - a legal status that allows you to remain in the US legally. You will receive an NOA receipt that is your proof that you have filed. As long as you don't do anything to bring yourself to the attention of authorities (ie a border patrol, police, etc.) until you receive the receipt, you are going to be fine. They are not going to be looking for you - and you should definitely NOT leave the US. Good luck.

  10. Are you married yet? If not, that would be first thing I'd do. If you are married then your K1 is expired already. Either way, you'll have to start the process soon. Find the money, any way you can - no point in screwing your life up...its just money.

    yes we got married last June. We will be applying for the AOS tomorrow. The question is what if we didnt receive the receipt of aos before my visa expires? it says in the passport my K1 visa expires Sept 2,2009.

  12. Hi everyone!Please if you can enlighten us with this problem, we will gladly appreciate it. If you have experience same thing or have heard same case, what did they do?

    Here's our case. I came here on K1 visa. We've called the immigration office before asking if there is a deadline to apply for the AOS and they told us there is no specific time since we were trying to save up for the application first. Now we called them again after checking my passport to find out the expiration of my K1 visa which is next month,so my husband called the Immigration to inquire about it,if we can apply for an extension or something, and we were surprised about what they said. If we pay the AOS tomorrow and if we haven't receive the receipt of the AOS, i will be forced to go back to my country. We were not expecting this. We relied on what the immigration told us that there is no problem if we dont apply for the aos right away. Now we are both in a hurry to apply tomorrow.

    Is there anyone of you who have experienced the same thing? Is that true, if we dont receive the receipt of the AOS after filing it, i will be forced to go back to my country? This is really very disappointing.

  13. Kelangan ba na pagkatapos ng kasal,iapply agad ang AOS? Di ba sa K1 visa,kelangan ikasal bago mag 90 days,pano malalaman ng embassy na kasal ka na?i mean, is it really needed to do it before 90 days? Pano ba ang dapat gawin? We're lost here.

    hi madz! Honestly consuls do not care at all on how interviewees look like,how they dress and all those stuff. They are just after your documents and on how confident are you in answering their questions. I would suggest you to wear a conservative top meaning not sleeveless or plunging necklines, then jeans and flats. Bring a jacket with you or if you have a cropped jacket/blazer in case you feel cold. Good luck girl. Do not worry, you will be fine...

    hey! PA is near NJ,I have been to Philadelphia once, i think that was three weeks ago. One month na ako dito nung 10. So far so good,though i must admit i am missing my family after talking to them on phone. Wala ka ba relatives sa states? I got my relatives in LA but that's too far from NJ. I am the only one in NJ,im just thankful the family of my fiance are very nice to me and making me feel i am already part of their family. The more i am missing my family in Philippines. Anyway, you will be fine. The adjustment won't be easy, but as long as you guys love one another, there is nothing to worry. Good luck and God bless.

  16. i know the feeling....i have 16 dogs and it is truly painful when one has to leave,and your dog's death is very tragic. I am so sorry. It must be very painful on the part of your husband and his family since they are really the ones who lives with the dog. At least you had a chance to know her and be part of her life before she bids goodbye to the world.

    here's the story..Me and my husband got married this afternoon, we we're very happy on that time.. we went to have our ceremony with my husbands grandparents..we went home after that and we decided to have a dinner at Sushi Sake restaurant here in Texas.. We are so happy on that time..After we had our dinner,we went home.. and my husband and I decided to go out to buy some DS Games and Xbox games,we went to starbucks.. and, while we are heading to go home,, on our street we saw a white pet laying in the middle of the street..my husband driving a car and when we saw the white pet in the middle of the street ,we get out of the car and we knew that it was our dog Babe..she was hit at the head and I saw a blood on the floor..it was really really painful..it so terrible that it happened today..we are so upset and very very sad...

    Our wedding reception is on Sunday and it will be held at the house of my grandparents..very sad that their almost 8 years dog died..until now we are crying and can't forget our dog..she was really really a nice dog..our guard dog and barking when there's a mail man..and in the morning,knocking my door in my room to get inside and sleep with us in our bed..she will be very missed..my grandparents in-law got the dog since 2001..she was a very healthy,and a nice dog..she loves to play and loves to talk with us..its really really hard that our dog had to leave...

    here's the pictures of our dog BABE.. :crying: it's really hard,I can't stop crying..R.I.P our dog Babe..you'll be missed.

    would be going to have her medical. Are there any Filipina here that can answer if it's

    okay to have the medical done if it's time for your monthly cycle ?

    Before I had my medical, i was reading here at VJ about their experiences and from their posts it says that if you have your period then you have to wait until it is gone. So i went at the hospital before i get my period and then i was surprised when i met someone who's having her medical too and the red flag is up. She had her medical finished even with menstruation.

    I would suggest your fiancee to have her medical before the red flag is up. I guess it depends on the doctor, whether it will be fine for them to check you with your period on. It will be embarassing because you will be asked to undress completely, know what i mean.

    It depends of the weather. that time it was summer here in US, so I wore jeans and blouse; also I brought jacket with me just in case very cold in Airport or inside the Airplane.

    what about your shoes?

    I wore 4 inches heels I was comfortable I used to it wearing high heels sandals even though I was doing a lot of hiking looking the gate number etc etc. :star:

    wow,you got a great job at that time. me too i want to wear high heels during my poe.

    high heels is no good if you are goin to travel that long....you are just giving yourself a hard time, believe me.:) but hey it's not how you look which matters on your port of entry....it's your complete documents. Take care!
