That happened once to my husband and he never sent it in. For him, it had no bearing on subsequent visits, nor did it impact his K1 visa.
Enjoy your holidays together!
I nearly missed your post!
Thanks for the information! It makes me feel much more at ease!
...and Thx LizandPat and KimandRuss!
This site is really an amazing community of support.

WOOT Dave and Genna!!! Grats guys
It should not effect you, her passport would be documented as arriving back in NZ (the point of customs is to track where you are in the world) so they would know what date she arrived back. PLus her ticket would have been scanned when she boarded.
I would send off the little green piece of paper ASAP however, with a note of which flight (if you can remember) she flew home on saying that it wasn't removed from her passport by the staff at the airport.
Enjoy your holidays together, your K1 is going to be one of the least painful waits around now
THANKS!
OMG, you guys met online in WoW? So did Genna and I! (Lich King tonite!)
She said she got an official document to send in with the green paper, so we should be okay. I'm gonna mail it ASAP.
And yes... the next 80 days of the wait is going to be a breeze =)
We get to spend my birthday, her Birthday, Thanksgiving, Xmas, and New Years together!
High on life right now! (Her plane has already been delayed for a half out out of LA... but the worst is over, now just a wait)
HAPPY HOLIDAYS TO ALL, and I hope that everyone getting together for the season has as easy of a time as Genna did getting through.

Genna just called and made it through LA! I get to see my girl for the holidays!
She said it was really easy. They did ask her occupation, she told them Live-In Nanny, and she was cleared.
One question I have though... the last time she returned to NZ, they forgot to remove the green Visa Waiver paper from her Passport. This time the guy told her she will need to send that in, as they may think she overstayed on that visit otherwise. Is this going to totally screw up our K1??? I'm a bit horrified right now. Its not our fault at all, and she did not overstay. I do take heart in the fact that they let her back in so easily, so obviously she isnt in the computer system as an illegal.
-
No, you simply have to have met face to face in the last two years.
-
Genna will be entering USA via LA. She does now have a letter of residence, as well as a letter stating that she is currently acting/employed as live-in Nanny for her brothers children and that she will be returning to that job and residence in January. I'm hoping that this is going to be enough to cover the whole employment thing.
She arrives in the USA in 9 hours... I'll let everyone know how it goes...
-
Gratz!
You must feel on top of the world now.
-
Speaking of the ESTA...
Is this only for arriving in USA? Genna will be returning after the 1st of Jan, when it becomes mandatory.
Also, has anyone used it on the voluntary basis yet? How long does it take? We will have to use it once she gets her visa, and I dont want to buy tickets too early if the ESTA ####### takes a long time. (I really hope it doesnt take a long time... enough waiting already in this process.)
Oh, and Kim and Russ, I was also going through a divorce when Genna and I met, or this whole process would be over now and we would be together.
Its good to know that your divorce didnt affect your getting the K1 though... I was a bit worried over this as well.
I think I need to calm down... which will be much easier after Wed. if Genna gets into the USA.

ok ..now reading all this is starting to get me nervous
... we havent received our NOA1 yet and will be going to hawaii to meet up with fiance in less than two weeks for only 10 days so Im just going to say Im meeting up with family and friends for Thanksgiving...hope that works!
I really think you will be fine. The reason I have fears is due to the longer stay time and the job ties to home country.
My girl visited me for 3 months, was gone for 3 months, and is now returning for another 2.5 month stay. Since you are only staying for 10 days, I think it will be easy for you. I'm hoping that the fact that my fiancee was out of country for 3 months, and that its the holiday season she is returning for, will make it easier for her as well.
I was also worried about her not having any occupational ties to her home country, but I think we have resolved this, as she acts as live-in nanny for her brothers children. Her brother's gf will write her an employer/landlord letter to carry to the PoE.
She arrives late Wednesday, so I will let you all know how it goes.
-
It just occured to me... my Fiancee acts as a live in nanny for the children of her brother and his gf. She gets reduced rent and food for this. Do you think this would be okay for her to state as her "occupation" when asked at the PoE?
-
Thanks for advice everyone. I feel a bit better after a nights sleep.
I guess I will advise my fiancee to go the "visiting family and friends" or "Visiting boyfriend and family" route at first.
I'm given hope by the fact that many of you have made it successfully w/o too much hassle, and even the people that got hassled usually still got in.
(Like everyone here, I'm sure) I just cant wait for this stage to be over and it to be "okay" for me to be with the one I love.
I'm kind of hoping that the holiday season itself will act as a good explanation/reason for the trip and the lengthy stay. Surely there are many, many people coming into the country at this time for the exact same reason.
Kim and Russ, how many times did he make it successfully into the country for 90 days before he was denied entry?
-
Congratulations!
...and I dont know what MILO is, but my girl was horrified to find that they dont sell her V (energy drink) here in the USA.
-
Well, my Fiancee comes next week on the 12th, and I'm suddenly having doubts about her gaining entry to the US. After reading as many posts as I could about the PoE experiences etc, I'm pretty sure she will be turned away.
She is going to have a letter from her Landlord stating that her room is being held for her with all her belongings. She is going to have a letter from her mother stating that she expects her back, as well as bank statements, credit card statements, and of course her Return Flight information.
However, she spent the summer with me (80 some days), returning to NZ 3 months ago, and this visit is for 80 days (the entire holiday season.) Also, she has no job. From what I can gather, those two things will cause her to be denied entry.
Is there anyone out there who made two 3-month visits to their loved one in the same year?
I hope I am wrong, but my confidence is broken.
(Also, will it hurt our K1 process if she is denied?)
-
Thanks for the advice.
My fiancee does not currently have a job, as I am supporting her till the visa. However, she will have bank statement and return ticket (or at least E-ticket/Itenerary) in her hand.
I'm just going to tell her to be completely honest, and see how it goes. We have nothing to hide, and I cant imagine NZ is really high on the threat meter.
-
So next Wednesday my Fiancee arrives for the holidays. This will be her first visit during the K1 process. What exactly should she say at the PoE? We want to be honest, but I have read of people being turned away once they mention a visit with a fiance. Should she not mention me at all and simply say she is visiting friends and family?
Also, any tips on evidence she can bring to prove that she has a "connection" to her home country would be very appreciated.
Thanks muchly =)
(and hope EVERYONE here has a great holiday season)

One more Question!
If she is here, and the NOA2 comes.. does she have to fly right back? Or can she finish out her time here, and deal with the final Visa stuff when she gets back?
Thanks again!
-
Okay, so I'm really considering just going for it. Thats pretty much how our relationship has been so far... we're in love, and if things look rough, we just go for it anyway.
If I can possibly see her for the holidays, I gotta try.
Thanks for all the kind help and replies =)
-
Um... My Fiancee does not have a job at the moment. I am supporting her till she can come to marry in the US and begin life here. What else would qualify as "ties" to NZ?
Also, if she is here, and the Visa progresses to over there... are we in trouble? or will she just be able to continue it when she returns?
Thanks for the help so far.
-
hmmm... sounds sketchy...
I guess I wont be seeing my love for the holidays =(

My fiancee was in the USA (from NZ) with me over the summer on the Visa Waiver Program. She was here for 3 months and left on Aug 9th.
Since that time, we have aplied for the Fiancee Visa.
Now I would really like to bring her back for another 3 months so we can spend the holidays together. I can get a cheap set of tickets (relatively speaking) for Oct 28th.
My questions are:
Will they let her return?
Will it affect the K1, since when I filled out the forms, I marked the box for her NOT currently being in the USA?
Thanks tons for any answers!

She will not need one going through the New Zealand Consulate if that is the only place she has lived. They will take care of it for her at the interview stage.
For others... you need one from any Country you have resided in for 6+ months since the age of 16. The process for getting them is different.
Thanks for the info!
Do I read your timeline correctly? Were you just interviewed and approved?! If so CONGRATULATIONS! I'm soooo happy for you!
Any NZ Interview etc. info you would like to share, I would love to hear!
-
Can someone please explain the police certificate to me? The instructions say my lovely fiance will need a police certificate from all the places she has lived for the past 5 years. I have never heard of a police certificate before in my life.
Is this for the Residence she has lived in... or the countries she has lived in? (Which would only be NZ)
How do you go about obtaining one? How long does it take? Is there a fee involved?
Thanks for any help.

DON'T send the I-134. It is not needed and will be tossed in the trash. Your I-134 should be completed much closer to your interview date, that is when you will need it. Where it says "at" write in the city and state where the notary functions from their office or where they are when they witness it.
Your photos are fine. I took my fiancee's photo and those of her two sons with a digital camera in the portrait mode in front of a blank white wall in her apartment. I went to a local photo shop in Ukraine and printed a bunch of each and cut them to the required 5cm x 5cm size. Our petition was approved in 61 days and our interview was without questions. As long as the photos meet the qualifications (or are at least close) you will have no problem. Make a BUNCH of them. You will need about 10 or so before the process is over. You will need 3 for the medical interview and two for the interview and you will probably need others to get police certificates, etc., and more when you file for AOS after you are married, so stock up!
Gary
Wow, your timeline gives me such hope. Thanks for the photo info! I should invest some money in Walgreens stock, I have spent so much on their photo services lately. Actually though, I highly recommend Walgreens to anyone else going through this process. They can make copies of just about any type of photo, the services are not too pricey, and its all done very quickly.

No need to worry. They are just going to want to know what her background is in and what she plans on doing when she gets to the States.
Russell has his masters in Engineering Geology and hasnt worked in his field in 2 years because he was either here in the US with me or waiting in NZ.
Whew! Genna has a strong background in Electronics Retail, so I'm sure she can get a job at numerous locations here in the US if she needs to. I just prefer to support her in NZ for now so we can be free to spend my free time online together.
Thanks again for all who replied so quickly. I guess I will not send in the I-134 copy.
As for the rest of the package, I think its time to stop worrying and just send it.
This site is a lifesaver.

Here are the guidelines for the photos.
Yes the time should go in that slot but i'm sure it doesn't really matter.
It's probably a waste sending in your I134 now. They dont care about it at uscis. You will need to do it again and have it notorized after you receive packet 3 (information packet) from the Consulate.
Most Consulates follow the financial guidelines for the I-864 (that you file at AOS) since it will have to be done but, New Zealand is very lax when it comes to the I-134. They care more about the NZ citizen being able to support his/herself in the U.S. They even ask to see your CV/Resume at the interview.
There is much talk recently in the NZ thread regarding that.
Okay, now you REALLY have me terrified. I make $36,000 a year, plenty above the 125% poverty... and I have the employer letter, the bank letter, and all that. HOWEVER, I am currently supporting my Fiancee in NZ right now. She had to quit her job, so she came to visit me for 3 months. She has just returned and is living with her brother, and I am paying her living expenses. We just figured that we would rather have her free to work on the visa, and not have to stress about getting some type of temp job that she may have to quit soon. Plus she has no transportation. Anyway, w/o giving our life story... how much is this going to make it hard for the NZ Visa?

Her flight out of LA has been delayed 1.5 hours so far... due to "Storms in Chicago".
I'm in Chicago, and we have had NO STORMS.
This is the second time that US domestic flights have been a severe aggravation.
Next time I am having her fly "Bob's Airline and Catering Service", becuz it cant possibly be any worse than AA and United.
At least she is in the country...
