My husband and I had the same problem. We simply included a notarized affidavit from my mom stating that we live together in her home since he entered the US on [date] and pay her [X amount] of rent per month. Then for more solid evidence I attached printouts from my online bank account of the deposited checks from our joint checking account...some signed by me, some signed by him.
You probably don't have to get affidavits notarized, but my boss is a notary so it was just easy to get it done.
We didn't want to go through getting a more formal rental type agreement and backdating it because our situation is not at all formal...the affidavit should definitely be enough.
Thats awesome. That's exactly what I will do. Our situation is also far from "formal."

Nope.
That just said, why don't you invest $1 in a standard rental contract, sign it, have your mom sign it, back-date it, and enclose it?
Boy . . . my mom was right: I'm smart!
Would that work? I have no idea how Leases are actually done, and was thinking there was probably some legal filing needed.

We are about to apply for my wife to remove conditions. We have a lot of joint financial and address evidence, including insurance, life insurance, dental bills, 2 years tax returns, bank statements, and joint credit card. However, we rent from my Mother and so have no official lease or rental agreement. Is this going to be a big problem for us in the evidence department?
-
Has anyone gone through the Removing Conditions process?
We are married and have nothing to hide, so I am not too worried about it. Should I be?
It looks straightforward and easy. We don't have a ton of evidence, but we have Tax Returns, Wedding Photos, Insurance, Credit Cards, Bank Account, Dental bills with Address, and Life Insurance. Will these be enough?
Any advice or help is appreciated.

Thanks all, you have really eased my mind. Now I can relax and enjoy the trip!
-
No it shouldn't if her passport and green card match no problems!
Her passport and Green Card are in different names. Green Card is Married name (current name), passport is in Maiden name.
No, all she needs is the marriage certificate. The tickets must be in her passport name.
The tickets were made in her passport name. So we just need to have the Marriage Certificate with us on the trip?

My wife and I have been married for nearly 2 years. We never got around to changing her name on her passport, and she is still on her conditional 2 year green card. We are returning to NZ in April for her brothers wedding. Will the maiden name on her Passport cause problems with her getting back in the country?
-
Hey, been a long time since I popped in here. Hope everyone is well! Sorry to hear about the Father in Law CDNEH.
Been married nearly 2 years now, heading up to the slightly nerve wracking Removal of Conditions filing this year. (Is Genna not having a US job going to effect this in any way?)
I have another question I am hoping someone can answer. Genna's brother is getting married this April, so we are heading back to NZ for a 2 week visit. We never got around to updating Genna's Passport with her married name however. Is this going to cause any problems with her getting back into the USA?

Went to the Biometrics yesterday and it was all smooth.
Got a notice in the mail today that our case was transferred to California and we will be contacted with their decision.
Still REALLY hot here in Illinois.
-
Just got the mail and there it is a brand spankin' new EAD card
Congrats!
Genna is hating the heat here... but then so am I!
She had a taste of it last summer though, so she knew what was coming. She also loves the fireflies.
-
We called the USCIS about Genna's Biometrics letter, which we felt was a bit late in coming, and they were generally vaguely helpful I suppose... saying "It could take some time."
Anyhoo, we finally received the letter today 6/20, and her appt is on Thur 6/25.
More progress, Yay!
The story about the Passport and the English language made us both laugh.
-
We received our NOA on the 6th of June, but still havent received our Biometrics appt letter. USCIS website shows a "touch" on the 9th. At what point do you helpful folks think I should call them? Seems like we should have received our letter by now. If its lost in the mail or something, I would hate to miss the appointment!
-
Just dropping in to say we got our NOA for AoS in the mail today.

Thanks for the help!

We recently applied for my wife's AoS (via K-1) w/o including the EAD application. (I wanted to get the AoS going, and didnt have the extra bits for EAD collected.)
My question is, after the AoS interview and the acceptance, can she then work w/o an EAD?
Is the EAD only necessary for the waiting period?
Thx for any help!

Kewl! Thanks guys, that's kinda what we were figuring as well. I'm just not going to bother with it at this point then.
The sheer number of passport photos and fingerprints is truly ridiculous! And as you said Kiwiana, Genna has looked a bit different in every photo.
-
Does anyone think it would be viewed unfavorably to apply for AoS w/o applying for the work thing (EAD or whatever)???
I have just read that that application requires yet another freaking set of passport photos, and frankly, unless necessary, we just cant be bothered to get what would probably be our 10th set of passport photos done. (We just got the ones for AoS)
-
Hey all.
Good to see most of us here are happy together with our SO's now.
Genna and I have gotten married, received her new SS card, added her to my insurance, and are now working on the AoS package. I basically had to raise riot at the SS office to get it put into her married name, but I succeeded!
What exactly are we supposed to send in for the medical part??? She got a medical in NZ for the K-1... and now we have her X-Ray and this one page Vaccination worksheet. Is that what we are supposed to send in? This is the only unclear area for me.
Also, If we dont get the package sent in by the time the K-1 expires... what can happen? Is it real risky, as in she can be sent back?
-
We drove out yesterday to get Genna's SS#. We were just going to wait till after the wedding, but decided to get it done. It was about an hour drive to get to the place, and then about an hour and a half wait for them to call our number. The actual process was really quick. Anyway, another thing done.
Now we are just putting immigration on hold while we work on the wedding (April 25th).
Speaking of NZ foodz and drinks... Has anyone found "V" or a similar tasting drink here in the States?
Hope everyone is getting on good!

Thanks for the info! Thats exactly the kind of information I was looking for.

Looking at all the guides and such, I am having alot of trouble deciding the importance of the Social Security Number with the K-1 Visa.
My fiancee is already here in the States on her K-1, and we are getting married on the 25th. She does not plan on working for a while, and we already have the marriage license. So, my question is, how important is the SSN to AoS? We plan on filing AoS as soon as we can after we are married. As far as the SSN is concerned, I would almost rather wait at this point till after we are married, so we can just get it in her married name. However, all the guides seem to suggest getting the SSN before the wedding.
What exactly is the SSN's effect on the entire AoS process?
-
Well, we have our marriage license, so there was no need for a SSN for that. I filled out the form last night for the SSN and we plan on running up to the office (which is really quite far away) on Tuesday or Wednesday next week. We get married on the 25th, but if the SSN doesnt arrive by then, I guess I have no worries, since some others here have not applied for them till after the wedding.
Kiwiana - ugh... we have like an hour drive to the SSN office, and then if we have to wait another 1.5 hours only to be turned away, I am going to be boiling over.
-
Thx Ruby!
One more question... how does the Social Security # fit in with this whole process? Is it required for the AoS? We are getting married on the 25th... have we already screwed up by not getting the SS# yet? Genna didnt pick up one of those Work Authorization forms at PoE, becuz we dont really have any desire for her to work just yet.
They say it's best to get the SSN first, and then do a name change later. That's what I did, and I had the card in 1 week.
We are off tomorrow to Arkansas for the wedding, which is April 8th.
I guess my actual question is... do we NEED to get the SS# for the wedding and the AoS? or is it just something that is nice to have for work, etc purposes?

Thats great news.
One last thing, where do I get the forms or whatever for the Affidavits needed for RoC?
Oh, and also, we are going back to NZ this month for a visit, but the tickets are in her Maiden name because her passport is still in her maiden name. Should we use the trip as evidence, or skip it since its in her Maiden name?
