  1. When sending the email in the form of letter, make sure you send it tomorrow morning around 8 am. Sending the email tonight may put your email on the bottom of their email list due to the several emails they receive daily - you want to make sure your email is at the top when they open their email box.

Edit and address the letter to fit your situation.

Be sure to copy the following:

Donald Neufeld (Associate Director of Service Centers Operation): donald.w.neufeld@uscis.dhs.gov

    SCOPSSCATA@dhs.gov

    OLUInquiries@dhs.gov

I hope some good news comes soon!

  2. LoveMyTico, personally I think the congressional liaison is BS. If I were you, I would send the letter in an email to the TSC email address to Mr Roark, Ms Barrows and the TSC chief of staff.

My file was touched the next day after I sent my letter and approved four days later.

I hate the stupid statement of "Although assigned, we cannot predict the date on which the adjudications process may be completed."

  3. That's what I intend to do. I intend to contact NVC and tell them I prefer the I129F and ready to incur the additional cost. I am sure they will agree to it. Look at it this way, going the I129 route, you will end up spending about $1000 extra and you know how our government likes money ;)

  4. Thanks everyone - this USCIS process has been a spirit killer for me. Thank God, I am off their hook.

Since both my I130 and I129F were approved, I will send an email to NVC opting to go the I129F route, therefore avoiding the delay there. I hope they honor my request; at this point I don't care spending $1000 for adjustment of status.

LoveMyTico, consider sending that letter to accelerate your process.

I firmly believe some officer at USCIS sat on my file, until they got contacted by the director to look at the file after the director read my mail.

  5. LoveMyTico, you and I are stuck in the same water (USCIS) but different boats (TSC & NSC). I sure hope your I-129F gets approved before your I-130. That will shorten your journey.

In my case I got a stupid letter from NSC today for a 02/06 service request - stating my case has been assigned to someone; but they can't tell when it will be reviewed. Are you kidding me? What kind of process is this? When a case is assigned to an officer, you would think that it should come with a deadline for that officer to review and if issues are found during the review, then the review should escalate to the next level.

In 7 days my petition would have been with USCIS 11 months. NSC tells me processing time is between 60 - 90 days from date of receipt. This Thursday would mark 90 days since they received my file from NBC.

Whether NSC likes it or not, in the end I shall prevail as they have no choice than to approve my petition.

  6. I was transferred Nov 15 to NSC. According to NSC, they received my transferred file on Nov 27. I am still waiting, unfortunately. The messages below show a series of conversation that I initiated with respect to my case status.

My online status has shown alien registration number changed twice: on Nov 27, 2013 and now Jan 16, 2014. Still no approval.

I am beginning to think that someone at USCIS is deliberately holding my file hostage for no just reason. If indeed this is true, then I only feel sorry for that person. There is absolutely no reason why I should be waiting while July are already getting approved.

From NSC email below, it takes 60 - 90 days for processing from the receipt date. What I don't understand is NSC is telling me to contact them if I have not heard anything within 60 days. Why another 60 days when my petition would have been with them 90 days in 14 days.

    Good morning,

USCIS records indicate we received your I-130, Petition for Alien Relative, at the Nebraska Service Center (
    NSC
) on November 27, 2013. Current processing times for I-130 petitions at the
    NSC
are 60-90 days from the date we receive them.

At this time the case is assigned to an officer. Although assigned, we cannot predict the date the case may actually receive review.

If the you have not received a decision or other notice of action on this case within 60 days, please contact us for updates.

I-130 Petition (US Citizen filing for spouse): MSC***********5 Transferred November 15, 2013 (80 days ago)

    Dear
    NSC
    ,

Yesterday marked exactly 10 months since USCIS received my I-130 petition with receipt number
    MSC***********5
. The petition was transferred from
    NBC
    to
    NSC
on 11/15/2013 and the transfer notice stated to allow 60 days to hear from
    NSC
. It's now 80 days and nothing still.

In December 2013, a Tier-2 Officer put in a service request and I have not received any response to the request.

On 01/10/2014, I was informed by my Senator's office that my petition was assigned to an officer and should be adjudicated within two weeks. More than two weeks have passed since 01/10 and nothing.

Please, kindly provide me the status of my petition. How long more, before I should get a decision?

    Petition filing date:

  7. Info pass was useless. Local IO tells me he can't do.anything. He could have done Something if the file was with them locally. Senator told me Jan 10 that file was assigned to an officer. Today at infopass I was told file was assigned Feb 07. Dam*, no truthful info whatsoever. I hv been dealing with Senator's office. I will engage congresswoman's office tomorrow. This is unacceptable. Local IO told me every case is different when I brought up the fact that July are getting approved - BS. USCIS will delay my case, but in the end they are condemned to approve it whether they like or not.

  8. I have an infopass appointment in an hour abt my case. I am sick of the false info given by USCIS employees. My case according to the senator's office was assigned to an officer the first week of January. Why am I still waiting when May, June, July are already getting approved. How different could my case be with regards to the May, June, July filers? If it's background check holding my case - I wonder why it would take them this long when I have a secret security clearance.

From the NY Times article: "After Speaker John A. Boehner of Ohio said on Thursday that the House was not likely to act on an immigration overhaul this year, immigrant advocates are turning up their pressure on Mr. Obama to expand the deferral program to include many more of the 11.7 million immigrants in the country illegally."

I seriously hope Obama does not give into this immigrant advocates push to expand the program. Illegals should have to go back home and get in here like every other person who is doing it legally. This nonsense has affected me and my spouse and I am not in support of it.

  9. LoveMyTico, I feel your pain and I have been feeling it 9 days more than you (My PD 04/03). Please stay positive and don't let this process drive you insane.

I called my senator's office this week since they last told me 01/10 that my case had been assigned to an officer and that I should hear something within 2 weeks. Two weeks past and nothing.

    04/03: PD

    11/15:Transfer to NSC

    Still waiting....................

I try to remain strong and having good conversation with my spouse via Viber.

  10. Got this from Senator's office:

USCIS records show your constituent’s I-130 petition has been assigned to an adjudicating officer. The officer will be reviewing the petition within the next two weeks. They should receive a decision or notice of other action once their petition is adjudicated.

If they have not heard anything within one month, please inquire again and we will search to see why their I-130 petition has not been completed.

    Thank You,

    Congressional Liasion

  11. For all those going for their interviews, petitioners be sure to send a copy of the affidavit of support (AOS) to your spouse to carry along to the interview. I have seen a lot of people where the consulate requested AOS even though it had been submitted at the NVC. Be sure to take all necessary measures to avoid any further delay on your case.

Why would NVC keep collecting the $88.00 AOS fee if the consulate abroad turns around and ask for it again. AOS are supposed to be processed at the NVC stage and forwarded abroad.
