  1. You are applying for N 400 under 319 (a). Since your I-751 is been pending, the officer that will look at your N-400 will call in your I-751 to review it if it has not been processed by the time he is almost complete with your N-400 application.

    These case are treated separately. Don't get scared. Your I-751 cannot be denied if you submitted the right materials. If the USCIS office that works on you I-751 has any doughts on your I-751, that office will refer you to your local office for an interview. Otherwise they will approve your I-751. So if you get an interview letter for your I-751, that would mean, they have doughts.

    I recently filed my N-400 on 08/06/08 at TSC and it was received 08/11. My I-751 is still pending. Filling an N-400 will force USCIS to look at your I-751. Make a copy of your conditional card (front and back) and send all the required documents for your N-400.

    Within 30 days I will be eligible to file for N-400 based on 3 years marriage,

    ..The problem is -unfortunately- my I-751 is still pending

    In the I-751 forum I remember

    Someone said filing for citizenship forces uscis to adjudicate of the I-751 is that coRrect?

    and without receiving the fisical card how can properly file front+ back of the card? Can I make a copy of the conditional card ?

    Does anyone filed under the same situation?

    I had the same situation. I sent N-400 with I-751 still pending and one month later my I-751 was approved. I sent copies of my old green card and also extension letter and I also wrote on my cover letter that my I-751 still pending. Good Luck!

    Form N-400 Filed Under INA 319(a) or 319(B) . In almost all cases, a Form N-400 that is filed while a Form I-751 is pending will have been filed under either section 319 (a) or 319(B) of the Immigration and Nationality Act (Act). Each of these sections of law requires a higher level of evidence of marital union and joint residence than is required for the approval of Form I-751 filed jointly. If a Form I- 751 is pending at the time of the conditional resident’s examination on the Form N-400, the USCIS officer adjudicating the Form N-400 shall conduct the N-400 examination. If the applicant demonstrates 319(a) or 319(B) eligibility and the Form I-751 is in the file, the U SCIS officer shall approve the Form I-751 and update MFAS.

  3. I sent my N-400 to TSC on 08/06/08 and it's being held at the post office now, because it was a certified mail. I called the post office in Mesquite this morning and they said USCIS will pick up the package on Monday or Tuesday

    Anyone else out there that has submitted or will submit their N400 to TSC?
  4. Do not be worried too much. Your application was not denied. It was rejected because of insufficient amount in your account. Resubmit your documents again and make sure you send the same thing you previously sent and add any additional document you think might help you in the case. Try to avoid contradictions in your documents.

    And this time, if you owe USCIS for your first I-751 submission, make sure you send two checks. One for the previous amount owed and another for your current submission. You case will be fine.

    My I-751 has been pending for over 16 months now and I am fine with it. I just sent my N-400 two days ago.

    Ok here I go again. Our case is denied. My husband didnt tell me that there was a problem with the check that I sent to the USCIS together with the application. I just found out that they sent us a letter about the fee and that we should send in the correct fee on August 6, 2008. My husband didnt say anything about this. I just figured it out when I received the letter of rejection for our case.

    So, we still owe the USCIS with the correct fee eventhough they rejected our application. The letter says that we can refile again with the correct fee.

    Here is my questions:

    --I'm just wondering if the extension letter from our case that is denied is still valid?

    --Or do I have to refile before my greencard expires on Sept. 12?

    --Are they going to send back the papers I sent them?
