Hello everyone,
I have a question today, one of my friend is planning to file I129 K1-VISA for her fiance who is currently living in a different country as a student. What are the requirements in this situation? Does the beneficiary need to be in his homeland at the time of interview ? I need some clarifications on that please.

Congratulations Fahim! My ROC is coming up too in a few months, my 2 years documents are exactly the same as yours except for the car insurance since I still can't drive (yes, I know, I'm suck, 2 years and I still don't have a driver license, lol). I've been very worried if my papers are gonna be enough for not, but after i saw that your documents are just like mine and you still got approved easily, this has made me feeling much better. Can I ask which USCIS service center did you send your papers to? California or Vermont? Anyway, thanks very much for sharing your wonderful experience with us.
Polar, it was Vermont and I live in Alexandria - Virginia. I don't think Car insurance should make any difference in your case. Also try to send as many documents as possible whatver you got don't leave anything behind just to be on the safe side you know

How can I find out what's the priority date of NVC for Pakistan, if a LPR applying for her Children under 21 or over.
I know USCIS is pretty quick these days I think it's 5 months wait time there but then I wanna find out what's the timeline of NVC

Hello everyone,
Let me share my best moments of life with you today, yesterday on Friday 8th of October when I came from work really tired and exhausted I opened my mailbox I saw a mail sitting there. At one point I thought it's another speeding ticket ehh but I was wrong when I opened the mail the first thing I read was USCIS at that point I thought it's my interview date for removal of condition but again I was wrong. Guess what? it was my GreenCard enclosed in that letter. Yes, they sent me a 10 years Green Card in mail without even calling me for an interview.
I applied for removal of condition in the month of May on 24th I guess 2010, my biometrics were scheduled in September 11th if I am not wrong and the day I received my GreenCard was October 8th, 2010 ( I will never forget this date ofcourse
). Today on 9th I received another letter by USCIS saying that your case has been approved and you should receive your green card within 90 days but I was lucky to receive my green card first then acceptance letter

What did I file? I filled bunch of stuff, ofcourse the I751 the application filled it neat and nice attached my bank statements of 2 years, YES! a bunch of 2 years documents, I also added a letter from the manager saying me and my wife account is a joint account since xx-xx-xxx date. I also added 2 years tax returns I filled jointly with my wife. I also attached my cars insurance which I have my wife added, I attached my life insurance she is included in that. Attached a copy of health insurance plan which has my wife added. What else ? ermm.. I did not send pictures because I think it is not needed. We do not have a baby so didnt send any document related to that, I have my apartments lease with my wife but I forgot to send them. I was prepared to take it with me if I was called for an interview. I think I sent alotta of papers.
I am very happy today and my journey has ended today, the next thing I am looking forward for is my US Citizenship which I am entitled to apply in the month of May 2011, few more months

I must say thanks to all of you who helped me. If anyone need any assistance please send me a message I will do my best to help with whatever knowledge I have ( I am not an attorney or any professional ) I will share my personal experience with you guys if you need.

No my brother is under 21 and unmarried, so I hope when my mother recieves interview call or get visa stampped I hope my brother will get stampped too.. if I am not wrong...

I-130 Important NotesWho May File Form I-130?
1. If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative. You may file a Form I-130 for:
A. Your husband or wife;
B. Your unmarried child under age 21;
C. Your unmarried son or daughter age 21 or older;
D. Your married son or daughter of any age;
E. Your brother(s) or sister(s) (you must be age 21 or older);
F. Your mother or father (you must be age 21 or older).
2. If you are a lawful permanent resident of United States, you may file this form for:
A. Your husband or wife;
B. Your unmarried child under age 21;
C. Your unmarried son or daughter age 21 or older.
NOTE:
1. There is no visa category for married children of permanent residents. If an unmarried son or daughter of a permanent resident marries before the permanent resident becomes a U.S. citizen, any petition filed for that son or daughter will be automatically revoked.
2. If your relative qualifies under paragraph 1 ( C ), 1(D), or 1(E) above, separate petitions are not required for his or her husband or wife or unmarried children under 21 years of age.
3. If your relative qualifies under paragraph 2( B ) or 2 ( C ) above, separate petitions are not required for his or her unmarried children under 21 years of age.
4. The persons described in number 2 and 3 of the above NOTE will be able to apply for an immigrant visa along with your relative
Please explain me this part about a child under 21, I can't understand this, it's confusing to me. If anyone of you please be kind to explain about a child who is under 21 and his mother will be sponsored by one of his son who is a U.S Citizen, will the child under 21 travel with mother?

Unfortunately, no. He will have to file an I-130 for each of them separately, including his 16 years-old brother. The process for your parents will be rather quick, while the process for your brother can take up to 10 years or more.
Another option would be to have one of your parents become a US citizen and then he/she can apply for your brother. That should be less than 10 years for sure.

I arrived United States on 21st August 08, I recieved my GreenCard alongwith all the Welcome letters on September 19th.. I applied for SS at the local office, then I applied for State ID and Drivers license myself. So you have to wait for the GreenCard to arrive.. take a chill pill
as for the SSN is concerned go by yourself and apply for one they will issue you..

actually my elder brother is soon going to get his US Citizenship, what I want to know is when he files I-130 for Dad and Mom is it possible that he should file for one of our brother who is right now 16 years old?.. I have heard that child under 21 will travel with his mother?.. So will he be included in I-130 of our mom or what?.. a detailed answer will be highly appreciated..

No, not yet. Received my 3 welcome notices on 9/15 which said my green card should be coming within the next 30 days

by the way it's nice that you and I have almost the same dates at POE.. so we might both be filling I-751 (removing condition) almost same dates so we'll update each other..

LOL @ 3 welcome letters - guess they really want to welcome you into the country! Glad your green card finally came though.
I'm kind of hoping my Green card doesnt show up for another week or two since I have an Infopass appointment at the end of the month to confirm that they issue it in my correct name (they've been putting my name in incorrect order on everything and I'm worried it's going to be wrong on my green card too)
But have'nt you recieved your Green Card already?..

It is not a judgement here. I wrote becuase such polite and romantic guy suddenly turned into agressive and "we-take-no-prisoners" attitude person once somebody expressed (Gigi??) her not so favorable opinion.
Fahim is a smart, capable and smooth guy. He will adjust to a new situation very very fast and act apprprietly. I see reasons the wife was in love for so many years ...being in other part of the world. He asked here about his GC but I am sure he knows about legalities more than average VJ poster. Just think...he has been here just for a couple of weeks but did so much already. He is a smart guy.
I know I should not write because their relationtion is not my business. Just felt sorry for the girl-sound like she is in love in this. For him it is more like business. But nevertheless, they might be happy. And I am not vicious-hope both will be happy in marriage.
Thetreble, nobody stated here that they know about OP, his intentions, etc. Even his wife does not know. And nobody really answered his question about SS/GC because the way he asked was more like dumping his frustration here than really asking a down-to-point question. He needed feedback. He got it. And being a smart calculating person, he absorbed it and (in my opinion) will make sure that in future nobody will "incriminate" all these to him (he will prepare to answer, get story strait, etc). He is an ultimate survivor. My thumbs to him too! So, maybe our posts will help in some weird way too
Who are you to judge and why do people keep giving the same arguments over and over again? You don't know his family or the people he is dealing with in the situation. I really LOVE the judgment here. Some people need to get off their AOS high horse thinking they know everything and everyone.I have nothing to say about you but I can only laugh on you hehe.. you have too much of time to post rubbish and garbage.. I know what I am going through and things are fine for me.. soo cheers.. I have nothing to worry and nothing to say.. I mean, I being the owner of this thread do not even pay attention to this thread anymore because it means nothing to me anymore.. yes when I came things were quiet difficult for me but not anymore.. life is smooth and charm and happily living with my wife..

Hello,
On the port of entry I changed my mailing address and I moved to a different address than the one mentioned in my I-130 it was because of job. Now I plan to move to NY tomorrow.. so do I have to inform USCIS or anyone? please help me in this regard. I am on Conditional Green Card.

Yes you need to complete form AR-11 everytime you change address, you must do this within 10 days of moving, also if your sponsor is moving with you then they need to file form I-865 to update their change of address and they must do this within 30 days of moving.

OK, I would like to hear specifically from people who were granted conditional green cards and had to file for removal of conditional status.
We arrived here last month, August. 2. We will be married 2 years next April 4.
1. When we were interviewed at the London Embassy, we were confused about when to file for removal of conditional status, so we specifically asked for clarification on when we had to file. The interviewing officer said, "it must be filed within 90 days of your 2nd wedding anniversary."
Of course, this conflicts with all the written paperwork we have received, and we told her that, but she was insistent.
2. When we arrived at the POE in Seattle, we mentioned to the officer that we had been given conflicting information, and again asked for clarification. He also said that we had to file for removal within the 90 days preceding our 2nd wedding anniversary, and he pointed out that it would be coming up soon, in about 4 months, so he urged me to keep the date on the calendar and not forget to file. I mean, he was absolutely certain, and repeated it over and over, that it was related to our wedding anniversary.
OK, so when I read the guidelines on here, and read the paperwork we have, it sounds pretty clear that we don't have to worry about filing for removal for at least 1.5 years. That the actual time to file is within the 90 days preceding the expiration date on the green card.
Is it common to get this kind of conflicting information, especially when it's being given from the immigration officers themselves, TWICE, from two different officers?
I'm terrified that they are actually right, and if I miss the filing deadline we will be in big trouble.
Who has done this, and when exactly did you file? And who should I call to get the most definite, clear guidelines so that I can sleep at night?

My wife's K3 case has been assigned an interview date of Sept 19 at the Chennai Consulate in India. NVC received her CR-1 documents on Sept 4th and is pending completion. I am trying to figure out the best course of action now and was hoping for some advice:
1. Send email to consulate and have them request NVC to approve CR-1 documents and send them to consulate sooner so Sept 19th can be converted to CR-1 interview....is this even possible?
2. Try to postpone K3 date by about 2 weeks and request consulate to convert to CR-1 interview as soon as they receive documents from NVC (assuming no RFE, based on estimates, case should be complete in a week, and consulate should have received documented in 7-10 days from then, i.e. Sept 18th - Sept 21st).
3. Ignore K3 interview date entirely and wait for CR-1 interview date.
Side question: Can medical reports & vaccinations obtained based on K3 interview appointment letter be used for a CR-1 interview?
Any guidance from you guys based on experience / other knowledge is highly appreciated. Thanks!
I went through the same situation your wife did, I recieved K3 VISA Packet in January 2008, at that time I thought to go for it but then my lawyer suggested me to wait for CR1. So I ignored those documents and waited till August 2008 and I recieved my CR1 on my passport. So let K3 be ignored it wont be converted as easy as you think, just ignore those documents and let her wait for CR1 Interview. My suggestion only you're the best judge.

My POE was 24 August 2008 (Sunday) and as the immigration officer was reviewing my documents he noticed that I had ticked the box to have a SSN automatically assigned to me. He explained that it could take up to 4-6 weeks and if I wanted one sooner I could just go down to the social security office and apply for one there.
On my third day in the country (Tuesday) I went down to the local social security office and explained my situation to the lady there. She said that I had to be in the country for at least 10 days before I submitted an application just so that my information could make it into the system.
I waited a week then went back to the office yesterday (Tuesday). I passed my application and passport through to a different lady to one I spoke to the first time. She looked at the stamp on my passport and said they usually have to wait 2 weeks before they can process a new application in order to avoid assigning multiple numbers. But she looked up my name on the system anyway and said good news, my information has already made it into the system and I was assigned a number the previous Friday (29 August 2008). She gave me a print out of my number and explained that I should give it another week for my card to arrive.
So all in all it took them 5 days to assign my number which is pretty quick I think. No sign yet of my Welcome letter but I'm sure that's on it's way too
hey, I arrived on 21st August 2008 just 3 days before you.. Anyway I did the same thing, I went to Social office and applied for a card they issued a card to me and asked me to wait for 2 weeks to recieve my card so it took 8 days for my social to arrive. I have not yet recieved Welcome notice or anything like that either.. So I thought it was only me who is having this issue but you're there too hehe.. anyway dont worry it takes usually 3 business weeks for Green Card to arrive so let's wait and hope for the best.. as soon as I get my card I will post here same goes for you if you recieve anything just let us know please.

Its difficult when a parents aren't behind you and I am sure shes having a hard time with everything as well.
