  1. I'm getting ready to submit my petition next month and have few question:

    1. My non USC spouse was married before, do I need to submit both the divorce decree and the divorce certificate or just one of them?

    2. Can I translate the documents myself or do I need to use a certified translator?

    3. I only need to submit photocopies at this point, no need to submit originals. Is that right?

  2. You should play it safe and wait until the 5 year mark. You won't get an RFE, you will get a denial. 5 years means 5 years, not 4 years and 11 months. Good luck and keep us updated. Always nice to see new members from Jordan!

    Thanks! The instructions says a period of years has elapsed since you became a LPR OR you can establish by clear and convincing evidence that the prior marriage wasn't entered into the purpose of evading any provisions of the immigration laws. So I don't think it will be an automatic denial but probably will delay my case.

  3. I have a question regarding when to submit my I130. I was married to my USC spouse for 5 years before we got divorced. My new wife is in Jordan and we got married two months after my divorce was final. I will be ready to submit my i130 in the next two weeks but if I wait until the end of January it will be more than 5 years since I got my LPR status (USC now). I have tons of evidence that I entered my first marriage in good faith including joint assets, child, multiple vacations together, tons of pics, etc. so that's not a concern.

    Would it make any difference to wait until the 5 years mark or should I just go ahead and file? I just don't want to file now and end up getting RFE. But I might get a RFE regardless I assume?

  4. From what we've experienced, it's mostly A LOT of waiting and TRYING to be patient. Both processes seem to average about 1 year, from start to green card.... but some couples appear to get lucky. We had considered both options for being together. After reading the pros and cons of both, we ended up choosing the K-1 route based upon what we thought was best for our particular situation... btw, we live in the Seattle area and are in the AOS process now... but still waiting. ;)

    Try not to be discouraged. I understand you miss the great NW... but I'm sure the rain and coffee (and perhaps other familiar things) will still be here to greet you when you return :)

    P.S. my wife gets bored when I'm at work, mostly because she has not yet been approved to "legally" work in the US, if you can believe that.. lol ;)

    Agree with the post above. The whole process takes about a year unless you one if the lucky ones who gets approved quicker. Btw... I'm also in Washinghton State specifically in Vancouver ?
