We just ended our journey for my son, who came to US on a IR2 visa.

We first submitted the initial paper work, forms, evidence of relationship etc, as I guess you've already done.

One thing I must say is that, most of our communication with NVC was through email, which worked fine and the website is also pretty straight forward with the instruction for the next steps.

You should pay the applicable fees for your case. Then, they will contact you and ask to submit the Affidavit of Support and later the Biographic data forms and other documents.

These can be filled out and prepared in advance by you, and it is a good idea to take a look and see if you need more time to collect all the information you need to fill out the forms.

In our experience the I-130 for a minor child was very easy and smooth, not so much paper work, pretty straight forward.

After 3 weeks of his arrival in US he received his 10 years green card in the mail!

Just want to add on to the other's replies. I came to US 4 years ago, married my USC husband, my son stayed behind with his dad in Brazil. Time came when we decided that he should move to US. My USC husband petitioned for him ( I-130) and the process went VERY smoothly. It took almost a year, but it could have been shorter than that, as it took a while for me to get aquainted with this type of process. All in all it was indeed super-fast and easy.

He is 16 now, and just moved in with us, going to school, making new friends and everything is going great.

Wish the best for your friend - and I would suggest she joins VJ as this is the best source of info, help and support needed in this journey.

Oi,your son won't have any problem entering via Nashville even if will be leaving in Houston...!unless is stated by the Embassy in Rio that he need enter the US via Houston and this situation is more common for Mexican nationals were sometimes POE are nominated by the Embassy in Ciudad Juarez.

I was wondering if someone could help me with this question:

My 16 year-old son has his IR2 interview last week at the Rio de Janeiro's consulate - Brazil, and everything went well. He was approved and we're now in process of making the travel arrangements.

My husband and I live in Houston and there is a chance that my son's father will travel with him to the US as he has some business to attend in Nashville.

I was wondering if there is a problem if my son enters the country through a different POE other than where he is actually is going to reside - which is Houston, TX.

Anyone?

I got my really GREEN card in the mail today.

I guess this the end of this part of the journey.

I was just thinking that it feels so good to be over and done with this process.

I'm not the type that worries too much, or panic, but it has been a long and winding journey. Tons of time and energy trying to put our lives together in a "orderly process" so it could be analyzed and approved by someone that would decide whether or not we can stay here and be together with our loved one.

I'm not complaining, I'm just saying that it seems all very ironic and er.. legal.

I really feel relieved!

I'm not sure when I will have the energy to go for the citizenship (c'mon, they ask you to submit the divorce decrees, again! Humf!).

I don't really know the 'legal' implications. Particularly I don't think you need to register your marriage in Brazil at all. I did get my registered at the consulate and they told me that, next time I go to BR I should bring the marriage certificate and register at a Brazilian cartorio, which I reckon would help to get my brazilian documents changed. My new BR passport is updated, as I renewed it at the consulate. So is my voting card. I would have to change my ID card, I suppose and CPF. I don't know. As you mentioned is time, money and energy consuming and if you're not planing to live there, and you already applied for US citizenship, I certainly don't see the point. :whistle:

Ann, it might be a good idea to check if you need any authorization and/or affidavit from the children's other parent (assuming you have custody of both kids), to take them out of the country. Whenever my son is traveling from Brazil to US to visit me, I need to send his dad in Brazil an affidavit saying that it is OK with me for him to travel as an unaccompanied minor. The Brazilian authorities don't allow minors to travel without the paper work in order, the consent in writing by the parents. I don't know about England, but maybe you should check about that.

Help me please i filed i751 in nov i got my NOA1 date 12/07/10....but as off today i still have not got Biometrics. i called VCS they send me latter saying due to limited capacity at your (ASC). i will get appointment as times available. im very worried about this. is any body on VJ who in dallas tx haveing this same problem.

Don't fret. I had the same long wait for Biometrics. I filed on Dec, NOA1 in the beginning of January. Bio was only scheduled for Feb 22. I've also called them up, got the same email, but the letter finally came on the mail.

Just relax. It will come.

Had BIO taken today. Easy, in 15m I was out of there. ASC people very helpful and friendly. Now, I guess I just have to wait a little bit more. Humf.

When you go for your medical exam at Rio de Janeiro... do you live the Doctor's office with everythng you need? is everything done on the same day?

Thank for the information! :-) am trying to get my wife to relax a little bit about it...she has her CR-1 interview on March 1st :-)

From my experience, the doctor will do a routine exam - breathing, pulse, blood pressure etc. He will then ask your wife a few questions regarding her health, previous conditions, vaccines etc. He will take notes and will request some further lab work if needed. At the time, immigration requested HIV test, TB and some other, I can't remember. He will also advise to maybe get the Hepatitis vaccine. If your wife has some sort of vaccination records, it would be helpful to show it to the doctor so he can take a look at what boosts she might need. I remember that I had to have a boost for tetanus and some other. This can easily be done at any public ambulatory, they do have the vaccines available and is free and painless.

She will have to see the doctor and show him the lab results and the vaccination records with the boosts, if applicable. He will then fill out the immigration forms and will give her a sealed envelope with the results. She will have to bring this envelope with her on the interview. The envelope should not be opened. This is basically it.

I had to get one from UK and, although the certificate does not bare an expiration date, they do consider de 12 month window. You will be fine, don't worry.

It's been forty days for us since noa1 and still no Bio appt. getting worried so I called today, they just took info and say wait another 30 days. Anyone else with problems with California service center ?

Same sea, different boat. Our case is on VSC (Vermont) but no Bio letter. I called last week, as it had been over 30 days. They put a service request and sent me an email saying that they are sorry, but my bio is pending due to limited capacity at the ASC (Application Supporting Center). I'm just waiting. But really? I was there last time 2 years ago, and there was another couple waiting, that's all. The place is big, I just don't understand this "limited capacity" #######. But well, I'm waiting, patiently.

My husband filed a K1 visa for ex-wife 13 years ago. At the time it was still INS

Anyway, there was no problem with the second petition for me. You just have to make sure that:

+ Your fiance knows about it, including when the marriage was terminated (important info for the K1 interview)

+ You have the papers proving that divorce is final and you are free to marry

+ You inform USCIS, checking the proper boxes in the biographic forms.

So be ready, be honest and he only thing you are going to get is an approval saying that they've noticed that this is the second K1 petition.

All, I have a question about jurisdiction for the consulates and wonder if anyone can answer it for me.

My wife and I got married in North Dakota, but I live in New Jersey.

Since I live in New Jersey I called the New York Brazilian Consulate because I had some questions. The first thing he asked me what what state I got married in

and as soon as I said North Dakota he said that Chicago is the jurisdiction. I've tried calling the consulate in Chicago with no luck atm.

But does that mean we have to fly to Chicago just to register the marriage?

This makes no sense to me....

I guess if you visit the Brazilian Consulate web page, http://www.brazilconsulatechicago.org/en-2-3-0.html, they have instructions about what to do if you want to register your marriage and get a Brazilian Marriage Certificate. For what I understand, you can mail the documents needed for them to start the process, but eventually you will have to go in person to sign the papers.

Once you've done that, there is a last thing to do, when visiting Brazil next time:

=> SUBSEQUENT MEASURES TO BE TAKEN IN BRAZIL

In order to officially register the marriage in Brazil, one must bring the Certificate of Marriage Registration (“Certidão de Registro de Casamento”) issued by the Brazilian Consulate to the Registry Office of the First Office of the Civil Registry (“Cartório do Primeiro Ofício do Registro Civil”) of either the individual’s hometown OR of the Federal District, which has jurisdiction over the entire national territory.

So I called USCIS regarding the Bio letter, which as to this date I have not received it.

They just sent me an email saying that "your biometrics appointment is pending due to limited capacity at your local Application Support Center (ASC)."

They will schedule and appt and send the letter at a later date.

Good enough. I was starting to think that I'd missed it.

Why do we get so paranoid, I don't know. Oh well. Hope everything will go smooth for you guys!
