I-134 questions (Merged)
Purple_Paladin replied to Purple_Paladin's topic in K-1 Fiance(e) Visa Process & Procedures
Still filling out this form... So ... On my income tax return I technically do not meet requirements for the poverty level However I do meet them by my income considering the child support that I receive from my ex off-setting my own child dependents that are listed on the form. In other words, my own solo income isn't enough for my fiance, his daughter, and my 3 children. But the cost of my children is shared between myself and my ex through child support. 1. How do I include proof of the child support as income since it isn't claimed on income tax and so not on income tax records? I was thinking I'd include a copy of my child support agreement and the deposits to my bank account. Would that be sufficient? 2. When filling out I-134, do I include my fiance's daughter under Part 2, Item 15 for "Provide the information requested in the table below about all of your dependents and any other individuals you financially support. Do not include yourself and the beneficiary named in Part 3." Or do I include her under Item 13 "How many other Form I-134, Form I-134A, Form I-864, Form I-864EZ, and Form I-864A have you previously submitted on behalf of a person (including yourself, if applicable) and your support obligation has not ended? Do not include the beneficiary named in Part 3." And do I file a separate I-134 for her (his daughter) to take to her embassy interview? 3. Part 3, Item 12 asks for the anticipated length of stay including a start date... What can I put here? I can't know when he will come until the K1 is approved and the idea is his length of stay is forever, as we'll be married... so what do I put? How do I fill this part out? 4. When I input my own info in Part 2, Item 8: It asks for an A number (which I don't have because I'm an American citizen) and/or a USCIS number. Should I have a USCIS number? Would that be the WAC receipt number listed on the Notice of Action form? Or would it be the one starting with PRS listed as a case number on the letter from the Dept. of State? 5. and final (I hope) I saw on another thread someone mentioning the I-134 and their own financial issues and they received a response which mentioned that the beneficiary would not be able to work in the US for up to one year? I hadn't seen anything regarding that. Is that accurate for all K1 fiances? They can't work for a year? I'm not rich. I just make enough to cover the requirement at 100% and I don't think I'll have enough to cover 125% until I graduate from nursing school. Are the fiances not given temporary working papers once they become spouses to cover them until they can adjust status? I hadn't understood this, if it's the case so I'm looking for clarification on this. If he can work, we can definitely meet the requirements together. He has the equivalent of a BA in business. He also has a degree in personal training. It seems odd that they'd handicap us to meeting the requirements they put in place. This thread also mentioned maybe the K1 wasn't the best option... what other options are there? He has his embassy appointment next week, and he's bringing his daughter... so I'm really hoping for this route so that we're all good for both of them to come. Sorry for the TLDR and TIA for any info! -

I'm filling out the I-134 form for my fiance to take with him to his appointment. I was going to include my home as 'collateral' for this under assets but I just saw the portion that explained there needs to be a 'recent' home appraisal for this. I have documentation from the mortgage company to prove that my home is mine, but the most recent appraisal that I have is from 2020 when I refinanced my home. I'm guessing that isn't recent enough. I have documentation from my mortgage company of the estimated equity in my home, but they specified the appraisal so I'm guessing that won't matter. Beyond that, I just have my income. I do have a retirement fund. Should I include that instead? I don't have tons of savings at the moment, I'm currently in nursing school. I do work full time as well and I make enough to cover the poverty guideline. I guess my question is, do I need to list assets? Or is proof of income enough? TIA! -
Thank you so much! 😮💨 He did read everything, but I these forms are exhaustive for English speakers... for ESOL's I think it's even more so. I'm in school and have been checking in with the documentation but left the bulk of assembling the packet to him so that I could study. Now I'm going over everything and didn't think I'd need to send anything. So of course I panicked! Thank you for your timely and helpful response! Much appreciated 🤗

My fiancee has an appointment for Wednesday 2/26 at the French embassy. For this appointment, is he obligated to bring an original certified copy of MY divorce? (i.e.- not a scan of an original certified copy) What about his? Does this appointment take scans? I read something on here recently that made me worry over this. What about the I-797C, Notice of Action Form and the I-797? They were sent to me and I scanned them and sent to him the scans. Does he need the originals? We're under the wire here and now I'm very worried. We've been laboring under the impression that scans were acceptable. Now I'm unsure. Should I have mailed the originals to him? I might be able to overnight stuff to him and get it there by Monday (his flight to Paris is early Tuesday.) Does anyone know exactly which originals, if any, are needed for this appointment? Oh, and what about my letter of intent to marry... I was going to print it, sign it and scan it back to him. Does that need to be an original as well (as in the scan isn't acceptable?) Sorry for alll the questions, I'm freaking out a bit now. 🫠 TIA for any help!

I134 may or may not be requested at embassy interview but it needs to be completed. It wasn't asked for at my wife's interview in Manila Interesting. Had either of you already sent proof of finances or something to that effect? I was under the impression that financial proof was really the most important thing in all of this process. And when you say that it needs to be completed, yoou mean filled out and taken in paper form to the interview with my fiance? Because I noticed on the K1 information page for travel.state.gov immigration that the online form is not currently being accepted. Thanks again for the info! -

Follow up ? : Adjustment of Status filing is done when he's here and after we are married, is that correct? -
The subject has it all. I can't figure out if I'm supposed to file the I-134 Declaration of Financial Support for my Fiance and his daughters K1 and K2 applications or the I-864. Do I submit my W2 from last year as proof? Part of my income is child support from my ex (until my kids are no longer my dependents.) Do I just show the court agreement showing that? Thank you in advance for any help. There's SO much to all this!

K2 interview with K1 or separate?
Purple_Paladin replied to Purple_Paladin's topic in K-1 Fiance(e) Visa Process & Procedures
Update: He made a separate account for his daughter and scheduled her appointment the same day/time as his. However, the Embassy website in France seems to be having difficulty today and when he went to print the confirmation, the site crashed and he lost the page to print the confirmation. He did manage to print the confirmation for his daughter though. He currently has a ticket in for that and to ask if all is well for his and his daughters simultaneous interviews. If anyone has any info or tipe, it's greatly appreciated! -
Is there a way for my Fiance to shedule the K2 interview for his daughter on the same day as his K1 interview? Are these scheduled separately or should he just bring his daughter with him to the K1 interview along with the DS160 completed? I know now that the K1 is a non-immigrant visa. Is the K2 considered an immigrant visa? He's trying to schedule these now and running into some difficulty. He's 6 hours from Paris so he'd like to get it all done in the same day if possible. TIA for any help here!

I'm sorry in advance if this is the wrong tab to post this under... I wasn't sure. So as of October 25, USCIS has sent our file to the Dept. of State. (I suppose this is the same as NVC?) I was looking at the timeline and noticed that there are more fees for processing: Immigrant Visa Application Processing Fee Affidavit of Support Fee. (above from the NVC website) FYI_ We did not receive the Welcome Letter yet from NVC... just the USCIS case update that they sent on the file. I'm just trying to get everything in order for when we do receive the Welcome Letter. I know that we don't pay these fees until we receive the letter from NVC. Oh, and question on that note: who will receive this Welcome Letter? My Fiance or me? Does anyone know if we must pay these processing fees twice? (As in: Once for my fiance and once for his daughter?) I don't see it clearly explained how dependent children intending to come with the K1 Visa beneficiary are supposed to be handled in the paperwork process. Any info is greatly appreciated. TIA!

9/4 to 1/3 is not 6 months? It's 4 months and we're now down to less than 3. That is a very short amount of time to coordinate two all day trips for my fiance to go to Paris and first get his and his daughters medical appointments done and then the interview process. So perhaps I misunderstood how much time we have by that document to do what... or perhaps you misunderstood what I meant by not having much time. In any case, good luck to you!

I received our I129F approval letter with a notice date: 09/04/2024 The Approval notice states that it is valid until 01/03/2025 When I check the status of our case on USCIS it says only that we were approved. It says nothing about the approval being sent to NVC. We don't have a lot of time before the I129F expires and there's still a lot to do. How long do I wait to contact someone to check if we have a NVC case number? Would I contact USCIS for that? I tried calling today but it was only an automated system that sent me in circles with no new information. I read all of the information that I could find here and it seems that around now is when we should have notification that USCIS sent our file to NVC. What happens if the I129F expires before they give us a NVC case number or before my fiance gets an embassy appointment? I'm sorry if this question gets asked a lot. I did look around and found similar questions but all with different circumstances. Thank you in advance for any helpful information! Tracy
